[s] adonainana: Young man your answer is Yes,GEJ was right to sack and remove SLS as CBN governor. In this instant case, Section 292 provides for the due process of removing a judicial officer, which is a recommendation of the NJC and a 2/3 vote by the senate. Those who drafted the constitution knew one day someone like Buhari will come to power and try to usurp the right of either the legislature or the judiciary hence the rigid process of first recommendation by the NJC, then the whole SENATE must vote to remove him.
Anything else apart from this is null, void, arbitrary, a sign of a deliberate an obvious disregard for the provisions of the constitution. The constitution is there for a reason, just like the immunity if gives Governors and Deputy Governors via section 308 from criminal and civil prosecution.
The constitution is supreme and is what we live and die for. You cant ignore or disregard it [/s] https://pbs.twimg.com/media/Dx0iF3PW0AACTKp.jpg |

I welcome your opinion, but it's just an opinion that doesn't alter the fact that the CCT is a product of the Nigerian constitution and every order issued by that court is backed and blessed with the Nigerian constitution and the president lawfully obeyed a lawful, valid and constitutional order by the CCT.

Wilstino: My friend, let us be objective regardless of our political inclination and for the sake of the future democracy. This is a dangerous precedent. No one is arguing whether he did it or not, the point is that there is a constitutional process for removing CJN which the government has failed to follow, perhaps due to its ulterior motives. It is not about PDP but our democracy. CCT is a product and creation of the Nigerian constitution with constitutional trappings. The CCT issued a valid court order that the president obeyed.
So, what constitution are you talking about? The CCT issuing valid court order or the president obeying court order are not part of the Nigerian constitution?
I really don't get the meaningless and ignorant argument you people are making for real. |

Muscomide: You miss the point completely. It isn't about Onoghen's alleged failure to fully declare monies held in accounts. Rather, the issue is about an arm of government (executive) and its attempts to erode on the constitutionally vested independence of another arm of government. (judiciary). If this is allowed to stand, it portends for us a gradual slide into dictatorship. .....but without corrupt judges and the very violation of the law by the CJ and his refusal to resign or recuse himself, we won't be at this junction.
I mean, after self-confessing to the crime, why not just be a man and step aside? Why run around from court to court with a million SANs just to evade and stall? The man is a crook, he's immoral and shouldn't be anywhere near our judicial system.
The crooked and corrupt CJ is the issue, not the aftermath, |

modath: Atiku should ask for a refund from the people that sold Dubai strategy to him, these people hate PDP deep down cos all they've succeeded in doing is make their affinity and obsession with corruption & grand larceny so obvious at each and every turn.
PDP won't stop making sane & fair minded people laugh, CJN admitted to "forgetting" to declare over $3m (and counting) and "they've turned that into a CONSTITUTIONAL MATTER" rather than distancing themselves from the drama, they have decided to carry it on dem head like expired gala for inside go slow... This is where and how credible politicians take advantage of such matters to shine and look good by distancing themselves from corruption, corrupt people and self-confessed public officials like the CJ, but the PDP can not stay away from corruption, they can not stand against corruption simply because everything about them is corruption, they are so used to it that they don't even see the immoral side of corruption and defending corruption.
Dele Momodu earlier today said on Twitter that the fight against corruption is a fight against the opposition, admitting that the CJ is a member of the PDP.
What about just asking the man to step down because he broke the law or at least recuse himself?
...but of course, these corrupt judges are their go-to corrupt judges for favorable judgments, these judges are the reason why court trials are stretched for years and decades via ridiculous adjournments, frivolous appeals and even perpetual injunctions in favor of criminal |

Wike also publicly announced and thank Mary Odili for her role in ensuring he won his case at the supreme court. That is on record. The wife of the former governor of Rivers State must have a hand in all of the mess at the supreme court and should be suspended next.
If we do not kill corruption, corruption will kill us. Onoghen can now go and join the PDP formally. The different layers of the Dubai strategy are being torn apart, only a free and fair election on the 16 of February will determines who rules Nigeria not some underhand tactless by Saraki.

nymphomaniac: Upon reading the shocking news that president Muhammadu Buhari has suspended the CJN Walter Samuel nkanu onnoghen on the advice of the NJC, I realized that this administration has no regard for the 3rd arm of government.
It is true that we lawyers have our share to blame by not speaking out early enough when he declared national security to be superior to the rule of law as well having kept quiet during this one-sided and loopsided anti-corruption campaign of this administration, but the impunity of Mr president has reached his peak.
It is clearly stated in the constitution the procedure for the removal of the CJN and failure to abide by due process makes such action a nullity.
I urge all lawyers to speak up against this autocratic order and in succession, do the needful by voting in someone who will uphold the sanctity of the rule of law and due process.

adanny01: Way to go Buhari.
I never thought you had it in you to do the needful. Our laws have been turned upside down and loopholes have been found and created everywhere around the constitution.
The president who enjoys very detailed immunity from the constitution is not protected against criminal prosecution but Judges want to prevent themselves from all prosecution whether criminal or otherwise. Its wrong, the section of the constitution the judges are using to shield the CJN doesnot intend to give such kind of immunity to any Nigerian.
How can the CJN admit to a crime but is defended by Nigerians. Have we sold our conscience for tribalism and political affiliation?
For me, I would never support corruption or a corrupt individual. Unfortunately, this is where we are today. |
