Are Bloggers Expected to Pay Tax (Part 2)

SHOULD BLOGGERS BE TAXED?

The answer is YES and NO. We could look at this from the angle of the LAW and from the angle of the determination on the basis of what ‘mode’ of blogging is in perspective. The first question to ask is are certain bloggers hobby bloggers or professional bloggers.

Empirically speaking, bloggers and freelancers and webmasters and other people who offer specialized online services in different genres may be considered owners of their own businesses, and or people who get paid for using their talent and or acquired skill.

Bloggers and webmasters usually earn income from advertising and from selling their services. Other online professionals, such as virtual assistants, social media strategists, SEO specialists, content writers and website designers usually earn income from selling their services. In this case Bloggers may be considered as self-employed individuals.

It is true that in Nigeria, the Federal Inland Revenue Service is still battling with making e-commerce generally and blogging a taxable means of earning income – there are a lots of issues trying to establish whether blogging is seen as a hobby or as a professional means of doing business. But it is also important to note that bloggers do native advertising of company’s products.

For example on Linda Ikeji’s blog, a lot of advertising is done for a lot of companies ranging from small businesses to multinational corporations who leverage on the traffic on her page to promote their business concerns. On that count, it will not be fair not to consider that a taxable income, since we have companies whose revenue are stemmed from advertisement itself.

Further, freelance writers and online professionals may argue that their services are immaterial and therefore cannot be taxed. A blog can be seen as a publishing company of some sort, just like a media house which owns print and electronic publishing platforms. In that case, the argument for it being taxable carries the day. Besides, there are offline strategic partnerships that ensue from just promoting a business, from where a blogger earns big.

There is also the direct advertisement angle of blogging. This is a complete taxable income and incurs some tax liability too.

So yes, bloggers are required to pay tax. But that isn’t all there is to it. there are few pertinent questions and clearances that are critical to the understanding of this discourse.

Let’s get to the difference between a professional and a Hobby blogger:

The truth remains that blogging is a painstaking, sometimes difficult venture that requires consistency, persistence, and hard research as well as passion. A lot of people consider blogging to be somewhat of a pastime, but there are levels when it crosses the line and becomes a full time and rewarding business. However, this takes time and nurturing.

In the Companies income tax act, Section 9:

PART II

Imposition of tax and profits chargeable

Charge of tax
(1) Subject to the provisions of this Act, the tax shall, for each year of assessment, be payable at the rate specified in subsection (1) of section 40 of this Act upon the profits of any company accruing in, derived from, brought into, or received in, Nigeria in respect of‐

(a) any trade or business for whatever period of time such trade or business may have been carried on;

(b) rent or any premium arising from a right granted to any other person for the use or occupation of any property; and where any payment on account of such a rent as is mentioned in this paragraph is made before the expiration of the period to which it relates and is included for the purposes of this paragraph in the profits of a company, then, so much of the payment as relates to any period beginning with the date on which the payment is made shall be treated for these purposes as accruing to the company proportionately from day to day over the last‐mentioned period or over the five years beginning with that date, whichever is the shorter;

(c) dividends, interests, royalties, discounts, charges or annuities;

(d) any source of annual profits or gains not falling within the preceding categories;

(e) any amount deemed to be income or profit under a provision of this Act or, with respect to any benefit arising from a pension or provident fund, of the Personal Income Tax Act;

(f) fees, dues and allowances (wherever paid) for services rendered;

While this may be seem confusing to a lot of bloggers out there, simply put this explanation this way, income tax will be levied on any form of trade or business for as long as the business has been carried on over years.


Therefore it is important to ascertain whether business transactions are being consummated, services are being provided, direct advertisement are being done from an blogging platform. This can be used to address the issue on whether a blogger is an hobby blogger or a professional blogger cum business owner.

The following characterization helps to draw the line, however fine, between blogging for fun and making money out of it:

Hobby bloggers do it mainly for fun and leisure, not necessarily for the money, although money can also come in through Google Adsense and traffic, but it will be limited. On the other hand, business bloggers want to make money through it.

Hobby bloggers may or may not have specific area of specialization when it comes to topics, but professionals usually focus on niches where they feel more comfortable to blog about, like lifestyle, sport, health, entertainment, politics, etc.

Seun, a young unemployed Nigerian graduate owns a lifestyle blog in Nigeria. This Lifestyle blog generates as much as two million monthly page views and a lot of engagement. Recently Seun was approached by EtiMuMu Limited in Nigeria and TravelHub in United Kingdom over advert slots on his blog.

Due to the impressive traction on Seun’s blog, every advertiser is looking for an opportunity to obtain an advert slot on his blog. Anyways, Seun decided to avail the advertisers advert slot on his blog.

After inserting the advert banners of the advertisers on the blog, it was time to request for payment and the advertising company requested that Seun prepare his cash invoice indicating his tax identification number so that necessary tax deductions can be made.

The foreign blog also stated that Seun should make the invoice tax inclusive so that they can remit VAT on the invoice after making payments into Seun’s account.

Now Seun is confused.


He is not a full-time professional blogger, writer or media company. He is just a young school leaver who feels who could make some online cash writing on an online, free platform.

I am very sure that Seun is not the only Nigerian blogger going through this phase and having this issue with numerous native and foreign advertisers, there are other bloggers having the same tax problems.


Now this brings us to the question, are Nigerian bloggers expected to pay tax?

Blogging has come to stay in Nigeria, you would agree with me right? Whether as a source of passive income to people who love writing or as that incremental revenue for passionate Nigerian bloggers, Blogging is now seen as a medium of self-sustenance on the long term for Nigerians.

A lot of questions that should come to the mind of Nigerian bloggers are the relationship the blogs have made them create with other registered businesses in terms of expenses.

From Domain cost, to hosting payments, Digital marketing expenses to mention a few. Have you ever thought of how these companies manage their expenditures and leverage these expenses to pay taxes to various authorities
?

It does not concern you, right?

A lot of bloggers may even argue based on materiality on whether their blogs can be deemed to be a business or not since e-commerce is an area of taxation where the FIRS Inland Revenue Service are still battling with and also the fact that the income made from the blog online cannot pass as being taxable.

However it is important to note that while income from Adsense or other form of online advertising can be argued on the basis of immateriality, what about direct native advertising?

What about your blog being seen as a media company based on the volume of traffic coming onto the blog and the various offline strategic partnership the online platform is getting into.

What about offline alliances and relationships with brands that may lead to benefits in kind, and other fringe benefits of maximizing the potentials of one’s passion. Are these not taxable?

Okay, so if we still are bent on arguing the non-tax deductibility of all these incomes generating spectrums. How about direct advertisements?

Just in case the tax inexperience of numerous bloggers have come to fore, it is important to note that for accounting and tax purposes advertisement can be seen to be advertisement cost on the part of a business and income for other business.

Infact there are media agencies like media buyers whose bottom-line are tied to advertisement income. If your blog generates tremendous income from advertisement, especially direct advertisement, then there is the potential for exposure to tax and taxation.

To take a deep peek at this, we ought to ask ourselves certain rhetorical questions. Are there people who have their sources of living off blogging? Have you set up your blog as a media company in form of business enterprise? Are you a professional blogger and content writer?

Do you make blogging income from direct advertisement?

It is no longer news that the duo of K-brule and Khloe has been disqualified from the Big Brother Naija, Double Wahala 2018 edition after earning 3 strikes – A set of warning that after it reaches 3 warnings, the contestant involved would be automatically disqualified from the house.

I am very sure that a lot of us would not have been too surprised about this disqualification as you would agree with me that the pairing of K-Brule and Khloe popularly known as K-Square was just a ticking time bomb waiting to happen.

Anyway, here are the relationships and life lessons learned and I hope you share similar thoughts as well:

1. Run away from toxic relationships before it destroys you:

No matter how sane you intend to stay in that relationship, a toxic relationship will never keep you sane. Instead of looking for how to create an avenue for peaceful co-existence between yourself and your partner, just get the hell out!

It has been said so many times, and now it is obvious from what we all saw in the Big brother house, a toxic relationship will DESTROY YOU! Get out Now!

2. Emotional Abuse is a killer


So now you know what emotional abuse can do to you. Right?

Of course you know who the emotional abuser was and what it led to eventually! All the lessons are just there for everyone to see. I’m sure when the realization of disqualification hits both parties, they alone will be left to ‘rue their chances’.

The really stood a chance of getting to the finals, didn’t they?

3. Attitude is everything

Being emotionally unstable is not a thing of the ladies only. A lot of guys are even worse. K-brule seemingly was the emotionally unstable guy and Khloe was the uncouth, and terrible lover. You can as well see the combination as being crazy and dangerous.

The moment you realize that your partner needs help emotionally and you cannot help, then refer him to professional counselors or psychologists who can. Why rub it in when you know your partner is in a situation and needs to be helped? You are not just helping the relationship but destroying it.

4. Relationships have rules, stick by them

Support your partner, help him/ her, love him/ her as much as you love yourself. These are basic relationship rules that should be adhered to and unfortunately, K-Squared failed in this regard, now see where it has gotten them.

Need I more say more on relationship rules?

5. Being selfish is harmful

If you are selfish, then you are not worthy to be called a lover, a partner or to be in a relationship. Relationships are for people who are not perfect but have come together as one to build perfection. You cannot be selfish as a single and get into a relationship and still be selfish. The results are sad and damaging because instead of supporting the relationship with your selflessness, you are taking advantage of the other to destroy than build.

6. Be Supportive

This cannot just be overemphasized. Being a support system to your partner goes a long way. Look at the team #Mina- Nina and Miracle, as relegated as them seem in the eye of the housemates, Nigerians think otherwise and that was the reason for the highest votes in the house.

Doing right by your partner is such a big deal because it not only shows that you stay true and dedicated to your relationship, but is paints you in a good light and gives your love life the avenue for growth. It was obvious that K-Brule and Khloe never really cared for each other and never had the goal in mind, if they had they would have worked on their differences and supported each other to the end.

What did they say about relationship that builds foundation on support. Anyone?

7. Never ever disrespect your family!

Never ever bring your parents into your relationship fights. What for? Why? Do you need to do that? Relationships are about two mature people, if you cannot deal then why enter into the partnership in the first place? You both needs to recognize that the relationships are all about you and not your immediate or extended family, so you need to create a gap and respect each other extended family space.

You should NEVER DARE to disrespect your partner’s family. It shows lack of depth and mutual respect not just for the extended family but for each other.

8. That brings me to mutual RESPECT

In as much as loving relationships are about bringing all our love, silliness and pettiness to the table, there should also be avenue to have mutual respect for each other and one another. What is a the essence of a fruitful relationship when both partners do not have respect for one another and always going for each other’s throat?

It is the way you treat your partner with respect that will make others value your relationship!

9. If you cannot deal with Alcohol, don’t go close

The attitude of K-Brule with Alcohol just seemed like a well scripted movie that will play out its part. It was obvious from day 1 that a lot of the housemates cannot deal with the repercussions of being drunk to stay sane. Why drink too much when you cannot get a hang of yourself? Why destroy a potential opportunity for you to become a celebrity and have a great future because of alcohol.

This is a lesson to all Nigerians who finds solace in alcohol, learn to stop when it is time to. Self-control is KEY!

10. And finally Self-Control

This is better saved for the last, don’t you think?

Do you better if either of both parties had kept shut and dealt with the partnership issues one on one, things wouldn’t have escalated to the point of getting qualified? Two fighting and giddy heads will never breakthrough. if you are stuck in a partnership cum relationship like that of Khloe and K-brule for strategic reasons, then learn to have self-control over mundane issues.

Look at the bigger picture, the possibility of being the WINNER at the end of the DAY!

The ability to deal with a partner’s inadequacies solves a whole lot for budding relationships and this is very well evidenced in the K-Square partnership.

In any government of any country, continent or nation, the citizens are expected to be responsible for its smooth running. While the electorates oftentimes look up to the government for the provision of every essential amenities through the magical wand of the political power it holds, the people also have a role to play while the magical show is in progress.

One of the roles is the payment of tax. Government collect taxes on various facilities, transactions and services offered by the state, and the revenue generated through these taxes are in turn used to provide more infrastructure and improving on the existing ones.

Unfortunately, people have devised cunning means of dodging this responsibility and causing problems in the society. Tax evasion and tax avoidance are the two major tactics adopted by dubious taxpayers to avoid paying their tax liabilities.

Although tax evasion and avoidance are almost similarly in nature and both aim at taking advantage of the law, they are technically different.

Constitutionally, the two may be deemed to be unacceptable. The major difference between these two means are reduction of tax or complete escape from tax payment, although tax avoidance is legal. Let us examine the various definitions of tax avoidance and tax evasion by economic scholars and reliable sources.

Tax evasion involves doctoring business transactions in such a manner that the involved taxpayers will escape paying taxes to the government or even if they pay, there will be fake accounts of tax remission, says Auru, an economic expert.

In other words, evading tax completely means not honoring their civic duty of paying taxes. In a legal sense, tax evasion is fraudulent.

Taxpayers evade taxes by giving bribes to tax collectors in order to be falsely cleared from debt, presenting fake managerial accounts to the government, flouting stipulated laws on tax payment, holding back authentic statement of account that depicts the correct financial profits, etc.

[center]On tax avoidance, Businesses usually compromise the legal system of tax in such a way that they minimise tax obligations for both the present time and the future. A lot of businesses take advantage of loopholes established in the tax laws to minimize existing tax liabilities.[/center]


Tax avoidance refers to a legally acceptable means of taking advantage of anomalies in the existing tax laws of a state in order to reduce the total tax liabilities the business would have to remit to the government, by requesting for legitimate debentures and discounts.

Whereas, tax evasion involves the unlawful owing of tax payment and part payment of taxes, deliberately done by the individual, tax evasion is deceitful. It gives a taxpayer an avenue to intentionally escape paying tax or presenting fake documents which may indicate amount higher than the true paid tax. Tax evaders cancel the statements of their financial profits, demanding for false entitlements to wages and expenses, and other unscrupulous acts.

Payment of tax is mandatory for everyone, as long as they have started making income. Tax evasion is seen as a deliberate and unlawful move to escape the check and balances or the remission of taxes stipulated under the Nigerian tax laws.

Such action is punishable by either jail terms or payment of fines.

Throughout the world, tax evasion is a global menace frowned at by all judicial systems. People take joy in soiling their hands by dipping into this crime.

I saw this coming and many more online startups are struggling to stay afloat. Please to the young entrepreneurs out there, I have an advice for you: Profits sustains business, not hype or noise. Profit in business is success, but unfortunately, the media tends to deceive a lot of people.

- Being the biggest, is not profit.
- Receive an award, is not profit.
- Being everywhere and spending millions in ads is not profit
- Raising $1million is not profit
- Signing up 1 million users in an hour is not profit
- Having 10million followers on FB or Twitter is not profit

Some weeks ago I happened to meet an old man drinking palm wine in an obscure corner in Ibadan.

He was alone except for the stately bottle of palmy before him.
Tapping the space beside him on the bench he asked me to settle down.
Would I like some palmy? No, I mind.

Speaking Yoruba, he asked me if I was married. I said I wasn’t.
He wanted to know why. I wanted to know why he wanted to know why. He smiled. But it was the type of smile that went everywhere except the eyes. I wanted to leave, but he told me to listen.
He told me, he said, “my boy, there is ‘iyawo’ and there is ‘aya’.”

Iyawo and aya are both words the Yoruba speakers use to describe a married woman. But I have never thought of the words in a deeper way than its copious usage.

So I asked, “what is the difference, Sir?”

He picked his cup of palmy, took a swig, gargled it and carefully sets the seat of the cup back on the spot where it left a wet round mark on the table.

I watched him as he dipped his wrinkled hands inside his buba, rummaged around the folds of his ofi and produced a round tin container. It was old and rusty with age and wear; black with so much handling and when he opened it there was a brown, powdery stuff inside it.

He took some of it between his thumb and fore finger and deposited it on his spotted tongue.

He continued, ” ‘Iyawo’ is the woman who is only out prospecting. She is selfish. “She has come into your life to see if it is comfortable.”

I thought for a bit and asked, “Is that not a good thing; no one wants to suffer, not even I?”

He shook his head slowly, savouring the stuff melting his mouth. I wanted to ask how it tasted.

“You hear me, but you didn’t listen.” He said, “I said she has come to see if it IS comfortable. Not if it WILL be comfortable. And it is about her comfort, not both of you.”
“She has done ‘Iya,’ that is, ‘branch’, then ‘WO,’ that is, ‘check’ or ‘look.’ You get me?”

“She has no intention of staying if it isn’t already a garden of roses. She doesn’t want to build with you. And if she finds nothing already made, she leaves. But if its already made, she stays. But, the day you lose what you have, you lose her love and she likely leaves you.”

I was engrossed.

How about ‘Aya’? I asked.
“That is the complete woman.” The old man replied.

“That is the woman who is not affected by what you have. The front seat of your car is just like any other seat in the car. What matters to her is what you are inside of you. Not your riches, not your handsome or your broke.

What she is looking for is an easy to love, strong, hardworking man who she can work with. A friend and ally. Her soldier, you know.”
“That woman is not easy to define…or find.”

I sucked in a large gulp and let out a deep sigh. Then I asked him if I can do the palm wine now, please. He filled the cup and passed it to me.
I drank it.

I grimaced as the tangy syrup made its way down inside. “Sour?”

“So do you have a girl you like?” He asked.
I told him I do have a friend I think about in a certain way.
“What do you think of her, is she nice to your neighbors?”
The question threw me. “My neighbours? Why my neighbours?”
The old man laughed for sometime before saying, “your generation is too naive, even dangerously so.”

Then my phone rang. Pat was on her way.
