Speaking from a lawyer's point of view, a public holiday properly declared by the appropriate authority is binding on everybody within the jurisdiction. By implication, a public holiday declared by the fed govt is expected to be binding on everybody within the federation with the exception of those providing essential services eg. law enforcement , hospitals etc. In practical terms however, a private establishment could require its staff to come to work on a public holiday. The problem arises where the staff is penalized for failing to show up on a public holiday. In such a case an action for wrongful termination may succeed only and only if the staff can prove that the termination was as a result of observing a public hols. Coming to the question of whether a private uni can compel its students or staff to show up on a public holiday. Well, if a school conducts an examination on a public holiday, a court of law can compel it to cancel such examination. But if it is for just lectures...u choose to attend or not. But if any especial advantage is extended to those present or if theose absent are made to suffer a serious disadvantage, then the affected party can successfully challenge such action in a court. |
aventura: This thread is dedicated to those that have gotten one or two inspirations from controlled drugs. Weed is generally associated with misfits, never-do-well et al, but I can categorically tell you that is not true. We have government officials, CEOs and role models who in one way or the other make use of these drugs. Today I am standing tall in my profession and career whilst using thses drugs. I've come across people who don't beleive that I smoke pot but I keep telling them that there is more to it that the eye 'sees' in this inspirational drugs. To cut the story short, I opened this thread for people acroos the globe to come in and identify with your family.Dude, I take it you are too stoned to even understand the gravity of the damage you are doing to yourself. But that would have been just fine by me( u got the right to kill yourself) but to come here and be advocating drug abuse is taking your right to self destruction too far. You can kill yourself or ruin ur life...but dont come seeking ppl to accompany u on your doom walk. Talking about being succesful due to ur drug induced 'delusion' humour us a bit by posting one of ur works here, or at least a link to enable nairalanders judge ur inspired delusion. This is one of the most disappointing days of my life. How can the Nigerian Law School be associated with this kind of rubbish? While at the NLS Bwari campus, i discovered that the law school was the only place in the whole Nigeria where sanity rained. It was, and i believe, still is the greatest institution in Nigeria. Admitted that a disgracefull thing has happened but i know that the Law School will still maintain its standards. It pains me that morons who cheated their way through life would come here to scream 'murder' but i know that no one who's been through that school would ever talk down on that great institution cos not withstanding the disaster of leakage, i am confident that the council of legal education/ body of benchers will go for the heads of all who have a hand in the this mess. |

@Poster,I think u r doing a gr8 job but i have to point out that you were wrong to say that a person under 18 yrs can be a director in a company provided at least 2 other adults are also directors. You seem to confuse directors with subscribers to the memo & articles of association. Setion 257 of CAMA is explicit as to those who cannot become directors. I think you are misinterpreting the provisions of Section 20 of CAMA. Section 20 has nothing to do with directors.It deals with the subscribers to the Memo & Articles.Hence,while ur answer would be correct with respect to subscribers to d MEMART, it wld be wrong to extend it to directors. D4 a person under 18 cannot be a director in a company, period.Thanks. |

Now i'm glad smbdy has noticed this very troubling trend. I strongly believe that anybody who walks the streets of Lagos would definitely notice hundreds if not thousands of these women peddling a head load of various concoctions. These so called local remedies come in all the colours of the rainbow. While i must admit that our indigenous/ trad medicine have been proved to be potent and quite helpful, proof also abound in support of the view that these concoctions are responsible for a very high percentage of kidney related ailments. My biggest concern is that the so called practitioners/ vendors of these traditional mixtures are totally ignorant of the chemical component and long term effect of these mixtures. Often times, their focus is on the immediate effect of the mixture with absolutely no regard as to the long term effect thereafter. For instance, a man who suffers from headache, typhoid, toothache or any such ailments, goes to traditional practitioner who administers a mixture of herbs, and behold, the headache etc is cured. However, little do they know or care to know that a mixture which cures headache could also have a dangerous effect on the kidneys or other organs. And usually nobody associates the subsequent condition with the earlier medication for headache. Similarly, a single substance taken separately could be potent and harmless, however when mixed with another substance may becomes a completely new chemical compound which may be dangerous and unfit for consumption. That's why i always baffle at the rate at which our people love mixing these things. I've once come across a man who insists on being given a sample from the vendors entire collection i.e a sample from about 12 different bottles. Well, guess we are all entitled to our choices, but isn't it rather stupid if one gets killed on account of the choices he chose to make? |

You may wish to read the supreme court decision in the case of AG FEDERATION Vs A.G OGUN STATE The Law is that such state law shall be void to the extent of its inconsistency. This we Lawyers call the doctrin of COVERING THE FIELD. So, since you are in the UK, take time to talk to a Lawyer and u would find out, that u are not that intellectually qualified to argue with a 1st yr law student, let alone THE MBA. @Mistakey u are going about this argument the wrong way, an emotional charged argument for an equally emotional charged respondents who are baised from the on-set. We must understand the position of the law rather than overwhelming ourselves with the emotionality of what happened. Nigeria Bar Association did not do their home work well b4 issueing that statement, their statement is full of hoalers which a secondary school kid doing social sciences will not make. 1) Yerima's constiunency is a 99% muslim constituency and they sent him to the Senate with the Understanding that he would protect their God giving Islamic rights. According to the muslim holy book it is ok and acceptable to marry a 13 year old as a bride, even Mohammed had a 9 year old. Thank God that is not the issue here. The issue is the Federalism Nigeria practices, the Senate cannot overule laws passed by State's House of Assembly the whole essence of Fedralism is for prompt, concise delegation and divulging of the power structures to the federating units without the centre appearing to be un-necessary over-bearing OR lording it over the States. 2) As a Senator Yerima is accused of sitting in the hallowed chambers making laws for the nation, how can he be making laws when he is clearly dis-obeying a federal law which recognises the age of consent to be 18years. The Federal law can be overided by the State Law, since the issue in question has a strong regional undertone. It would be wrong and inconcevable for a reps from Akwa Ibom and Ebonyi State to make and overule what a particular section of the country has being accustomed to in the name of one Nigeria, that is not democracy but dictatorship. The local people of Zamfara State are happy if it comes to matters regarding secular religious matters their reps if in any dis-agreement can exercise his right to abstain. I see Senators and House men In the UK and USA on items they do not agree on Abstaining why is this Universal right a problem in Nigeria. Our constitution does not say explicitly that a senator cannot abstain so why the hullabaloo and commotion. 3) For any Bill to become law 2/3 OR Sometimes a simply majority is required. Assuming if out of 106 senators in the Hallowed Chambers want to pass a highly sensitive bill, and 10 islamist Senators choose or exercise their right to abstain have they done something contrary to the Constitution, I think I beg to differ on this and Nigeria Bar Associtaion should be cautious b4 giving out comminiques that cannot stand simple validity test. Man, even as we all feel your pains,I will wish to point out that your philosophy of life will definitly guarantee you lots of pain.So I really hope u have a highly effective 'pain absorber'. @ ufobabe, pls from all u've said one can safely say that your friend has an advanced case of syphilis. I can't be too sure but i think she should test for the presence of the syphilis bacteria cos if these symptoms have persisted for ten yrs as u claim and if it turns out to be syphilis,then ur friend may be facing seriouse health danger including insanity,cervical cancer and multiple organ failure.
