There is nothing illegal in giving posthumous national honours, a senior official in the office of the attorney-general of the federation has told TheCable.
The official, who declined to be named because he was not speaking under authorisation, said it is “more of a convention to give to only living persons”.
He said Alfa Belgore, former chief justice of the federation, who descried the posthumous awards announced by President Muhammadu Buhari on Wednesday as illegal, was confusing two categories.
The official told TheCable: “The honorable justice is confusing the Honours Warrant with the The Star for Fallen Soldiers which is only given posthumously to members of the armed forces.
“The is nothing in the National Honours Act that precludes giving national honours posthumously. If the law expressly forbids it, President Buhari will not have granted it. The president has broken with tradition without breaking any law.”
Belgore was the chairman of the national honours committee in 2016.
Meanwhile, the official gazette for the award of Grand Commander of the Federal Republic (GCFR) to MKO Abiola will be presented to Buhari for his signature any moment from now, TheCable understands.
This will provide a legal seal on the award.
Buhari had on Wednesday announced the award of GCFR to Abiola, the presumed winner of the June 12 1993 presidential election who died in government custody in 1998.
He also gave the Grand Commander of the Order of the Niger (GCON) to Babagana Kingibe, Abiola’s running mate in the election, as well as Gani Fawehinmi, the late human rights activist and constitutional lawyer.
Buhari further declared June 12 as Nigeria’s Democracy Day to replace May 29, which constitutionally remains the day the president and governors elected during a general election are sworn in.
The Cable understands that Buhari had directed the attorney-general, Abubakar Malami, to prepare the gazette for presidential signature before making the official announcement of the honours.
“By the provisions of the National Honours Act of 1963, national honours must be gazetted,” the source said.
Section 3 (1) of the act says: “The President shall by notice in the Federal Gazette signify his intention of appointing a person to a particular rank of an Order.”

Buhari was the Head of State when Gani Fawehinmi ignored the rule made by NBA that no lawyer should take legal briefs regarding the military tribunals established to try corrupt politicians! Gani publicly told the world that he will take the legal briefs (and he did) because Buhari was a very honest man who was fighting corruption. NBA sanctioned Gani but he never cared. He stood by Buhari both as military Head of State and as a civilian candidate. That was the reason Keyamo willingly accepted Buhari’s campaign spokesman offer.
In all of Buhari’s previous attempts at the presidency, in Gani’s lifetime, he campaigned for Buhari.
So, next time, when you respond to issues, educate yourself. Stop displaying your stinking ignorance on social media! Very appropriate response. 1) Peugeot Automobile Nigeria (PAN). This was a joint venture between the Federal Government, Kaduna State Government and Peugeot.
2) Volkswagen Of Nigeria (VON). This was a joint venture between the Federal Government, Lagos State Government and Volkswagen.
3) Mercedes Benz-ANAMMCO. This was a joint venture between the Federal Government, Anambra State Government and Daimler Benz.
4) Leyland Motor Company. This was a joint venture between the Federal Government, Oyo State Government and British Leyland.
5)Nigerian Truck Manufacturing Company. This was a joint venture between the Federal Government, Kano State Government and Fiat.
6) Steyr Nigeria. This was a joint venture between the Federal Government, Bauchi State Government and Steyr.
The Federal Government sold its shares in these companies as part of Obasanjo's privatisation programme.
The company that bought PAN were unable to run it profitably and AMCON took over the company. The Kaduna State Government has been looking for a private investor to take over AMCON's shares in the company. Governor El-Rufai made a pitch to Aliko Dangote and it appears that Dangote was convinced.
Stallion Motors bought the VON plant in Lagos and the Leyland plant in Ibadan. The Leyland plant is used as a training center and Nissan vehicles are assembled in the VON plant in Lagos.
Volkswagen of Germany sued Stallion Motors because they did not give them permission to restart production at the Lagos plant, but they reached an out of court settlement. The VON plant now also assembles Volkswagen vehicles.
The Lagos State Government is a shareholder in VON, therefore Lagos State BRT buses are assembled at VON. A good update. |

The FedEx affair....
1. I bought items worth 180,044 Naira, I was told Nigerian Customs wanted N60,634.84 as custom charges (Email of January 29th) within 5 days. I paid on 31st January, 2018, i got the item on February 6th and demanded for a Customs Receipt (Email of February 7th),
· The fictitious duty was paid only AFTER I had received my package and AFTER I raised alarm.
· Receipt showed disparity in the amount paid into the Customs (N55,392 vs 60,634.84)
· “Airport taxes” were claimed and covered by a FedEx receipt when the only body responsible for issuing such receipts is the Federal Airports Authority of Nigeria (FAAN)
I raised up the issue with a Team Lead who felt ignoring me would make me forget the issue.
2. I wrote to FedEx Nigeria Senior Management, providing ample evidence of the fraud and extortion by their staff, hoping for a simple solution – refunding the fraudulent charge in full and ending it there.
3. I started receiving an avalanche of harassing phone calls at odd hours (is this a FedEx policy?) culminating with a coercive threat call by a Director at 19.08 hrs on 6th March, 2018 (NOTE – The telecommunications provider can be subpoenaed for more details when we go to court) He was sorely mistaken, it just made me angrier.
4. I made covert investigations with legal counsel and I wanted to present evidence in America. I was strongly advised that the international offices would just cover up the case that I should reply to Homeland Security and FBI instead. I couldn’t unfortunately because I have some important issues to attend to in Nigeria.
I then escalated to 17 FedEx International Staff; mostly country managers about the fraud and extortion ring being perpetrated by FedEx Nigeria. I sent the mails at 5.30am and by 9.00am i got 17 "MAILER DAEMON" messages like all the messages weren't delivered (cover-up even at international level).
I had promised that i would escalate the case to the Presidency and the Head of Nigerian Customs. I received more threats and a letter from their lawyers.
They felt i was cowed, but they don't know i fully intend my money to be refunded.
HOW CAN ONE SEND A PETITION THAT IS SURE TO LAND AT THE DESK OF IBRAHIM MAGU (EFCC) AND HAMMED ALI (CUSTOMS)?
