The Federal Government has amended the ‎charges of preferred against a former Minister of Niger Delta Affairs, Mr. Godsday Orubebe, before the Code of Conduct Tribunal.

The amendment which saw the number of the original counts filed against Orubebe reduced from four to one, has eliminated the charges bordering the acceptance of N70m bribe by the ex-minister.

Only one out of the two counts bordering on false assets declaration ‎in the former charges was retained in the new one.

Lead prosecuting counsel, Mr. Mohammed Diri, told the Danladi Umar-led CCT on Tuesday that the amended charge was dated March 7, 2016 but filed on March 8 (Tuesday).

He said the amended charge was filed in line with provisions of section 214 of the Administration of Criminal Justice Act, 2015.

Diri said it was served on the defence some moments before the proceedings began on Tuesday.

The lead defence counsel, Mr. Selekowei Larry (SAN), did not oppose the amendment.

The tribunal subsequently accepted the new charge and struck out the former ones.

The tribunal chairman also directed the fresh charge be read to the defendant.

‎Orubebe pleaded not guilty to the charge on Tuesday.

The prosecution alleged that Orubebe failed to declare his asset at 2057, Asokoro District, Abuja when he assumed office as Minister of Niger Delta Affairs on 29 June, 2011.

The offence was said to have flouted the provisions of section 15 of Code of Conduct Bureau and Tribunal Act.

Orubebe was initially arraigned on November 8, 2015 before the ‎fresh amendment to the earlier four counts.

Diri told the tribunal on Tuesday that he had three proposed prosecution witness‎ and intended to call them in one day.

He sought an adjournment to open the prosecution’s case.

The case was adjourned till April 7.

A five-storey building collapsed in the early hours of Tuesday at Lekki Phase 1, Lagos State, resulting in the deaths of at least four people.

As of 9am, four people have been recovered dead and six others rescued.

The spokespersons for the National Emergency Management Agency, South West zone, Ibrahim Faronloye, and the Director of the Lagos State Fire Service, Rasak Fadipe, said search and rescue operation is ongoing.

As a few of his predictions seem to have come to pass, President of Omega Fire Ministries, Apostle Johnson Suleiman, has urged Nigerians to pray ceaselessly.

He made the call as President Muhammadu Buhari-led administration recorded the death of Minister of State for Labour, Barrister James Ocholi, demise of some Nollywood stars in the last few weeks, killings in Benue as well as Saudi Arabia and Iran cold war.

In his new year predictions released in December 2015, Apostle Suleman stated that Nigeria would witness serious political developments.

He said some ministers would be absent from cabinet meetings in 2016 due to health related issues while some won’t return alive.

Expressing sadness on the death of Ocholi on Sunday, Suleman, reiterated his charge on Nigerians to pray ceaselessly for themselves and office holders.

Speaking to DAILY POST through his media manager, Folorunsho Hamsat, Suleman specifically called for divine intervention “so that a sitting state Governor would not die before the year runs out.”

“The apostle recieved the news with sadness and again stated that a governor may die next.

“He will speak to the public soon but for now, his condolence on Mr. James Ocholi’s death goes to the federal government, the people of Kogi, his friends, family, staff and others touched by the unfortunate incident,” Hamsat said.

EFCC and Buhari have made a lot of Nigerians believe he has done a horrible thing, and at such he should rot in jail!
But as the law states, he must be tried for his misdeeds in all fairness!
If government have sufficient evidence to prosecute dasuki, no need for all this harassment!

Sentiment is different from law. There are bail-able offences and non bail-able offences.

Unfortunately for Buhari what they accused Dasuki of is bail-able. If he is not confortable with the law he should send a bill to the NA to change it.
Disobeying the constitution he has sworn to defend is not the solution.

Another judge of a Federal Capital Territory High Court in Maitama, Abuja, Justice Peter Affen, on Friday ruled that the continued detention of the immediate past National Security Adviser, Col. Sambo Dasuki (retd.), did not violate his order granting the ex-NSA bail on December 21, 2015.

The judge dismissed the application by Dasuki seeking to stop his trial for alleged diversion of N19bn arms funds on the grounds that his re-arrest on December 29, 2015 violated the order of the court granting him bail.

Justice Affen ruled that the application lacked merit and ordered that the trial of the ex-NSA, who was charged along with others, must continue.

The judge fixed April 20 and 22, April for trial.
Earlier, Justice Baba Yusuf of the same court had also on February 8 made similar declaration that the detention of the former NSA was in not in breach of his order granting bail to him on December 18, 2015.

The judge had fixed March 23 for commencement of trial.

Dasuki had also filed separate applications before the two judges asking for orders prohibiting the Economic and Financial Crimes Commission from further prosecuting him on the two separate sets of charges pending before the judges.

Among his other prayers anchored on alleged violation of the orders of the court by the EFCC, Dasuki prayed the court for an order discharging him of the alleged crime or alternatively staying proceedings.

Meanwhile Justice Adeniyi Ademola of the Federal High Court in Abuja had on Thursday fixed April 4 for ruling on similar application filed by Dasuki to stop his trial on four counts of money laundering and illegal possession of firearms.

Dasuki was re-arrested by operatives of the Department of State Service on December 29, 2015 shortly after he was released from Kuje prison upon fulfilling the bail conditions imposed on him by the two judges of the FCT High Court in Maitama.

Justice Affen ruled on Friday, that since it was clear that the ex-NSA was not re-arrested by the EFCC but by the Department of State Service, the EFCC could not be said to have violated the said order granting him bail.

The judge ruled that though the EFCC and the DSS were both federal agencies, the wrongdoing of one could not be blamed on th order.

He also ruled that the order granting bail to the defendant did not preclude him from being re-arrested by other agencies of the Federal Government in respect of other alleged crime.

In his ruling delivered on December 21, 2015, Justice Affen had directed that if Dasuki or any his co-accused was needed by the prosecution for further investigation, they could only be held between 9am and 6pm and be allowed to return home on each day.

The judge ruled that if the prosecution needed the accused beyond the stipulated period, it must first obtain the leave of court.
“The order of court made on December 21, 2015 did not in any way contemplated any government agencies other than the EFCC to whom the order was directed,” Justice Affen ruled.

While ruling that the EFCC had not violated its order, the judge added even if it did, Dasuki’s lawyer did not show how that could constituted grounds for discharging him or stay the criminal proceedings.

He also ruled that the ex-NSA should have pursued the enforcement of his fundamental rights to liberty in an independent civil suit.
Dasuki and others are being prosecuted on 22 counts of diversion of N19bn arms fund.

His co-accuse include a former Director of Finance and Administration in the Office of the NSA, Shuaibu Salisu, and a former Minister of State for Finance, Bashir Yuguda.

Others charged along with them, are a former Governor of Sokoto State, Attahiru Bafarawa, the ex-governor’s son, Sagir Attahiru, and a firm, Dalhatu Investment.

The EFCC is also prosecuting the ex-NSA and others on separate set of 19 counts of alleged diversion of N32bn arms fund before Justice Baba Yusuf.

His co-accused in the case are Salisu, a former General Manager, Nigerian National Petroleum Corporation (NNPC), Aminu Babakusa and two companies – Acacia Holdings Limited and Reliance Referral Hospital Limited.

Uche Secondus, the Deputy National Chairman of the People’s Democratic Party, PDP, says former Rivers state Governor, Rotimi Amaechi is behind his ongoing corruption ordeal.
The PDP chieftain made this known on Thursday in Abuja while addressing newsmen.

He alleged that Amaechi had manipulated the media to misrepresent the case against him.

“Against this background, it is most disheartening that the facts of the matter under investigation have been grossly misrepresented in the media, apparently under inducement by some political opponents in the APC particularly, a Minister from Rivers State.

He admitted that he received vehicles from Jide Omokore but claimed he had no knowledge of Omokore’s dealings with NNPC.

He said, “I want to state categorically that what I received from my friend, Jide Omokore were cars and buses supplied by a well-known car company, Skymit Motors apparently from a credit facility Mr. Omokore has with the company.

“I don’t have any knowledge of the so-called transaction the investigators are alleging he had with NNPC.

Secondus further stated that the ruling All Progressives Congress, APC was out to humiliate leaders of the PDP.

He said, “This is in line with the strategy of the ruling party to hide under the anti-corruption fight to humiliate the leadership of our Party.

“My immediate concern is the denial of the fundamental human rights, excessive physical incarceration and the orchestrated negative media campaign completely skewed against those being investigated.

“I have been granted bail under very stringent conditions after eight days in detention.

“Since the EFCC did not establish any case against me, I find my needless detention a clear case of witch-hunt and pure political persecution that has become a stock in trade of the APC government.

“I will, however, restate my confidence in the rule of law and the relevant institutions for the resolution of this matter on its merit in the interest of justice.”
