The Speaker of the House of Representatives, Mr Yakubu Dogara, on Thursday said that the National Assembly has powers to alter national budget according to the desire of the citizens. He stated this during plenary after Rep. Abubakar Lawal (APC- Adamawa) drew the attention of the lower chamber to Acting President Yemi Osinbajo’s remarks. Osinbajo’s was reported in the media to have said that the power of appropriation was vested with the executive. According to Dogara, it is left to the judiciary to interpret which arm of the government has the powers to alter the budget according to the Constitution. “This issue is left to the judiciary to interpret to us as to what arm of government has power to do what. For me, this is not an issue we should dwell so much on. “I don’t want to believe that the Acting President made that statement because when it comes to the budget, the power of the purse rests with the parliament. “The executive is just one man; every other person in the executive arm is answerable to the president alone. The relationship is that of master and servant, but for the parliament, it is that of equals. “Even, when the president hasn’t said anything, everyone is trying to read what the body language is; the basis of democracy is collaboration. “In the case of the budget, if the parliament disagrees with the executive, the worst that would happen is that they will refuse to sign the budget. “In that case, we can override the veto of the President and pass it into law. “The worse the Executive can say is that they will not implement. The question then will be, is that the law of the land? Anyone with honour, who is in the seat, should know the right thing to be done. “In case of the executive, everyone knows the consequence and I don’t want to mention it by its name. “This house is not going to be a rubber stamp to the executive arm. “In the United States where we borrowed our Constitution from, once the president walks into the chamber with the budget proposal, it becomes dead on arrival. “It is therefore what the parliament decides that brings it back to life. “The priority of the people may not be that of the executive. This kind of talk is not helpful, so we shouldn’t even take a debate on the issue,” Dogara said. Earlier, mover of the motion, Lawal, stated that the acting president’s speech had undermined the powers of the national assembly. “I read in the media where the acting president was quoted as saying that the national assembly does not have the powers to alter the country’s budget. “This will undermine the powers that sections 4, 5 and 9 of the Constitution have given the National Assembly, the power to make laws. “Order 12(19) spells out the procedure, so for someone to come out and say that we have no power, it’s a breach of our privilege,’’ he said. Osibanjo had while signing the 2017 Appropriation Bill on Monday stated that the alteration of the budget by the national assembly had distorted the plans of the executive in implementing the 2017 budget. Lawmakers have passed a bill that will now allow a pregnant woman who suffers a miscarriage to obtain a birth certificate for the foetus. The certificates would be available to women whose pregnancies end after nine weeks (two months and one week) and before 20 weeks (five months). The first of its kind, the bill is named ‘The Grieving Families Act.’ The bill, which has also been signed into law by the governor, will allow the state to start issuing “certificates of nonviable birth” if parents request them. Lawmakers in the State of Florida in the United States had argued that the certificates would be available to women whose pregnancies end after nine weeks and before 20 weeks. In Florida, after 20 weeks, pregnancies that end in miscarriage are considered stillbirths and a death certificate is issued. It’s also the case in many other American states. With this new law, however, Florida parents of stillborn children can also now request a birth certificate if they want. Associated Press reports that the bill received support from Democrats and Republicans, as it passed unanimously in the state Senate and only had one “No” vote in the House of Representatives. Ade Adesomoju, Abuja A Federal High Court in Abuja on Thursday gave an order permitting the prosecution witnesses in the trial of a former National Security Adviser, Col. Sambo Dasuki (retd.), to testify behind screen. Dasuki is being prosecuted before the court on seven counts of theft of Federal Government’s sophisticated weapons, illegal possession of firearms and money laundering. Justice Ahmed Mohammed, in a ruling on the prosecution’s application for witness protection, ordered that the witnesses would be allowed to testify behind a screen to be provided by the court. The judge ordered that the screen would be used in such a way that it would not shield the witnesses from being seen by him (the judge), the defendant, and members of the prosecution and the defence teams. Other members of the public in the court are not to be allowed to see the witnesses. In dismissing the objection of the defence to the application on Thursday, Justice Mohammed ruled that the application was in order since Section 232 (4) of the Administration of Criminal Justice Act 2015 allows the use of such screen by prosecution witnesses in cases involving economic and financial crimes. The judge ruled, “Section 232 (4) of the Administration of Criminal Justice Act permits the use of screen in a charge of economic and financial crimes; and money laundering is part of the charges instituted against the defendant. “Therefore, the request is in order, especially when it has not been shown that it will prejudice against the defendant.” The judge dismissed the the ground of objection by Dasuki’s lead counsel, Mr. Ahmed Raji (SAN), who argued that the application constituted an abuse of court process because a similar one filed by the prosecution in the same case had been dismissed by the former trial judge, Justice Adeniyi Ademola. http://punchng.com/dasuki-court-grants-protection-for-fgs-witnesses/

Gbenga Odogun, Lokoja The Igala Socio-Cultural Group has described the inclusion of Igala land as part of Biafra as an insult to the sensibility of the people. Igala land is in the eastern part of Kogi State, sharing a border with Anambra State. The group, at a press briefing in Lokoja on Wednesday, said that including Igala land as being part of Biafra was not only insulting but also provocative to the Igala race. Barry Idakwo, who addressed the conference by the Igala, said that the declaration of Igala land as a clan by the Biafran agitators was a product of ignorance of history and mischief. “It is, therefore, unthinkable to annex the Igala kingdom without consulting us. Probably, this may be due to the erroneous belief that Igala kingdom is a clan and thus it is not important to consult the people of the great Igala before being annexed as part of the agitation. “It is against the spirit of fairness, sovereignty, equity, peaceful cohabitation and democracy to forcefully and falsely claim that a great kingdom as the Igala kingdom, which was never defeated in any war is part of Biafra,” Idakwo explained. http://punchng.com/igala-not-part-of-biafra/ |
The Niger Government on Wednesday declared ‘state of emergency’ on federal roads following the collapsed of two bridges, linking the Western and Northern Nigeria. Mr. Jonathan Vatsa, the state Commissioner for Information, made the declaration shortly after inspecting the bridges in Tatabu and Bokani villages both in Mokwa Local Government Area. “There is no guarantee of life on these roads, therefore, on behalf of the acting Gov. Alhaji Ahmed Ketso, Niger state as a government hereby declared a state of emergency on federal roads in the state,” Vatsa said. The two bridges collapsed on June 4 and June 11 respectively after downpour; a railway that links Western and Northern parts of the country also collapsed as a result of flood in the same area. “Road users should, henceforth, be very careful and take precautionary measures while travelling on the roads. The federal roads in the state are no longer safe,” the commissioner declared. “I advise drivers of trucks and articulated vehicles to be conscious, especially when approaching a bridge,” he said. Vatsa, however, appealed to the Federal Government to intervene in rehabilitating the roads, saying the Northern and Western parts of the country are currently cut-off as a result of the collapsed bridges and railway tracks. “The two bridges must be fixed at the same time because they are links to each other in one way or the other. “Vehicles conveying goods and people to other parts of the country will now have to use Tegina-Minna-Suleja-Abuja and Lokoja route which is longer,” he added. Vatsa called on the Federal Government to do something urgently to reduce the hardship on the people. Malam Suleiman Mohammed, a resident of Bokani community, said that the collapsed bridges had left motorists and passengers stranded without alternative route.
