EXPOSED: Malami Sponsors Bill To Take Over, Stall Criminal And Corruption Cases To ‘Protect Crooks’

SaharaReporters gathered that the move by Malami is to stall the prosecution of high-profile corruption and criminal cases in order to protect his allies from facing justice.
Nigeria's Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami, is currently sponsoring a bill before the National Assembly to take over prosecuting and investigative powers of all the law enforcement agencies in the country.



SaharaReporters gathered that the move by Malami is to stall the prosecution of high-profile corruption and criminal cases in order to protect his allies from facing justice.

The bill tagged “The Prosecution Of Offences in Nigeria Act, 2017” if passed into law by the National Assembly will allow the office of the AGF to take over the conduct or discontinue criminal proceedings.

“Responsibilities to institute or take over the conduct of proceedings. Procedural requirements for taking over of criminal proceedings,” Part V of the bill seen by SaharaReporters read.



“Procedural requirements for discontinuance of proceedings. Discontinuance of proceedings after accused has been sent for trial.

“Assuming Conduct of prosecution by the Attorney-General. Review of prosecution powers of law enforcement agencies etc. Review of investigations conducted by law enforcement agencies.



“Power to conduct investigation. Power under the Extradition Act. Conduct of criminal proceedings by persons other than a Prosecuting Officer.”

Part V Section 20(1)(a)(b) further stated in part, “Subject to the exercise of the powers of the Attorney–General for public prosecutions under the Constitution and the provisions of other applicable laws, rules or regulations and notwithstanding the provisions of Part II of the Administration of Criminal Justice Act, 2015 on the control of criminal proceedings, the Prosecution Authority, under the directions of the Director shall, with effect from the date of commencement of this Act, be responsible for – conducting criminal proceeding against any accused person before any court in Nigeria in respect of any offence created by or under any Act of the National Assembly; taking over the conduct of criminal proceedings, instituted by any law enforcement agency, including the Police.”

Part V Section 24 is titled ‘Assuming conduct of prosecution by the Attorney-General’.

The section says, “Notwithstanding the provision of this Act, or any other power conferred on the Director under this Act or any other Act, the Attorney-General may after notifying the Director, intervene in the first instance or on appeal where, in the opinion of the Attorney-General, the proceedings raise questions of public interest.

“The Attorney-General may only assume conduct of a prosecution after consulting the Director on the matter and giving notice to the Director of his intention to assume conduct of the prosecution.

“On the receipt of the notice referred to in subsection (2) of this section, the Director shall turn the prosecution file over to the Attorney-General and provide any information that the Attorney-General may require on the matter within the time specified.”

SaharaReporters gathered that the bill is expected to be presented to heads of law enforcement agencies tomorrow (Tuesday, August 31, 2021) at a meeting convened by the Administration of Criminal Justice Act (ACJA) Monitoring Committee Secretary, Sulayman Dawudu.

They are to be blackmailed, intimidated and forced to endorse the ‘satanic’ bill secretly sponsored by the AGF, a source told SaharaReporters.

“Malami to re-enact the surreptitious takeover of the prosecution of corruption cases in the country and return it to ground zero,” the source added.

“The publicly criticised bill on creation of public prosecution authority, prepared in 2017 has resurfaced within the government by the Ministry of Justice through its ACJA monitoring Committee, Secretary, Sulayman Dawudu.

“This bill purporting to take over all prosecuting and investigative powers of all the law enforcement agencies in the country is to be presented to the law enforcement agencies tomorrow Tuesday, August 31, 2021 at a meeting convened by the ACJA monitoring committee to blackmail and intimidate leaderships of the law enforcement into endorsement.

“The bill is in all intent, purposes and activities in contravention of international standards in the fight against corruption; it leaves the fight against corruption in the control and manipulation of a political appointee in the person of Attorney General; it creates another agencies with investigation and prosecution over and above trained law enforcement agencies; it conflicts with the laws establishing all the law enforcement agencies; and will frustrate and demoralise the law enforcement agencies.

“The Attorney General who had bared his fangs recently with the withdrawal of his political associates like Danjuma Goge and others will have the express power to kill cases where he has interests.”


Implications Of Having The ‘Satanic’ Bill Passed

Identifying some of the implications of having the bill passed into law, an expert in legal matters noted that the “bill essentially kills the independence of the ACAs (Anti-Corruption Agencies), whereby they will be subservient to other authorities in the course of their investigation and or prosecution”.

The expert further noted, “The track records on investigation and prosecution of the office of the HAGF (Honourable Attorney General of the Federation) are nothing to write home about in comparison to the stellar prosecutorial outcomes of the Anti-Corruption Agencies (ACAs), especially the EFCC.

“Consequent to the above, the incompetent cannot school or attempt to school the competent.

“This is creating another bureaucracy in the face of crushing debt profile of Federal Government of Nigeria and rather insensitive at this time.

“The progenitor, who is attempting to resurrect this bill, ought to face his primary responsibility of monitoring the Administration of Criminal Justice Act rather than creating unnecessary administrative chasms just as he tried to do with the botched EFCC repeal and establishment bill that the HAGF had to publicly dissociate himself from.

“The Office of the DPP (Directorate of Public Prosecutions) is already there as well as that of the Solicitor General of the Federal Government of Nigeria and this bill will be superfluous in the face of these and also, the Legal Departments and Investigators within the ACAs will be certainly thrown into confusion if this bill sees the light of day.

“The political backlash of this will be a major distraction for Mr. President, as this will clearly be seen as immoral when you attempt to give such sweeping powers to a card-carrying politician and political appointee.

“If the office and person of the Attorney General was separated from the office and person of the Minister of Justice, then certain aspects of the proposal may be considered, but when one person is holding the two offices, this bill cannot but be used as a political tool to tie the hands of the ACAs, embark on political vendettas or even frustrate many high profile cases of perceived party faithful.

“If this process or workshop or meeting tomorrow is being sponsored by any development partner such as ROLAC, etc, they should be alerted that they are indirectly meddling with the fight against corruption and the process of instituting good governance and accountability in the country.”

Brief History Of Malami’s Fraudulent Interference With Law Processes

In 2020, Malami grabbed the headlines after taking over the case involving Bala Hamisu Wadume, a notorious kidnapper.

Some soldiers had killed three policemen in Taraba State while Wadume was being taken to the police headquarters in Jalingo, the state capital.

Wadume was later re-arrested in Kano and is facing prosecution alongside Tijjani Balarabe, an army captain; and 18 others on a 16 counts bordering on terrorism by the Inspector-General of Police, Mohammed Adamu.

However, the matter took a new turn when a lawyer from the Ministry of Justice, Shuaibu Labaran, informed the court that Malami would be taking over the case.

The action attracted reactions with many saying the AGF was plotting to kill the case, going by his past record.

Also in 2020, the AGF took over the money laundering trial of Akinola Ogunlewe being handled by the Economic and Financial Crimes Commission (EFCC).

At the continuation of the trial on March 10, 2020, Labaran told the court that Malami had shown interest to take over the matter.

In view of the interest shown by the AGF, counsel for the first, second, third, fourth and fifth defendants, Ebun-Olu Adegboruwa (SAN), and the prosecution counsel, Bala Sanga, agreed to return before the court on April 7, 2020 to report on an out-of-court settlement.

That was the last heard of the matter as Ogunlewe walked away a free person.

Another case taken over by Malami was the N25 billion fraud trial of Danjuma Goje, former governor of Gombe State.

The case was stalled when in an emergency hearing before Justice Babatunde Quadiri, EFCC counsel, Wahab Shittu told the court that the agency was withdrawing from the case and handing it over to the office of the Attorney-General for continuation.

The AGF, however, stated that having thoroughly reviewed the matter, he found no prima facie case while adding that it was weak.

He, therefore, withdrew the charges against Goje from the court in exercise of his constitutional power.

The withdrawal of the cases by the AGF made Goje a free man.

Another of such corruption and controversial case taken over by the office of the AGF was the alleged debts of N242 billion and $1.3bn owed by MTN for its business malpractices in the country.

MTN announced that it received through its counsel, Wole Olanipekun (SAN), a letter from the AGF formally withdrawing his demand for N242,244,452,215.97 and USD$1,283,610,357.86 alleged revenue indebtedness.

According to MTN, while the AGF had dropped his demand, he, however, referred the matter to the Federal Inland Revenue Service and the Nigeria Customs Service to resolve the controversy.

The matter has since fizzled into oblivion.

Also, in 2017, Malami ensured the withdrawal of an ongoing corruption case involving three former officials – Nasiru Ingawa (former Special Adviser on SURE-P (Subsidy Reinvestment and Empowerment Programme) to former Governor Ibrahim Shema), Abdulazeez Shinkafi (former Director of Finance and Account at the Katsina State SURE-P department) and Bello Bindawa (former Chief Store Officer in the Katsina State civil service) who were prosecuted for allegedly mismanaging N5.7 billion SURE-P funds.

However, on October 25, 2017, the Katsina State Attorney-General, Ahmed El-Marzuqat, notified the court that the state government was taking over the prosecution of the accused persons from the ICPC (Independent Corrupt Practices and Other Related Offences Commission) following a fiat from the office of the AGF to take over the prosecution of the case.

After a slow prosecution by the state government, the Katsina State High Court terminated the corruption trial of the three persons.

The AGF was also accused of stopping the prosecution of former Senate President, Dr Bukola Saraki, for allegedly forging the Senate rules to conduct the election of principal officers of the upper legislative chamber.

In 2019, the Concerned Football Patriots accused Malami of making frantic efforts to shield the President of Nigeria Football Federation (NFF), Amaju Pinnick, and other accused officials from being prosecuted for the alleged mismanagement of $9.5 million FIFA grant.

While the case was going on, Malami reportedly sent Abubakar Musa, a lawyer in his office, to pray the court for an adjournment to allow the AGF harmonise all the cases in the various courts.

After a month, the Nigerian government withdrew the case against Pinnick, NFF Secretary-General, Sanusi Mohammed; 1st Vice President, Seyi Akinwumi; 2nd Vice President, Shehu Dikko and an executive member, Yusuff Fresh.

A Kano State-based Muslim cleric, Sheikh Abdulmalik Ibn Muhammad, has condemned those who frown at child marriage, saying they are ignorant and do not know what the Quran says about such things.

Sheikh Muhammad who said this during a marriage sermon in Dala local government area of the state, insisted that there was nothing wrong in a man getting married to a girl-child as long as her parents agree to give their blessings and he is capable of taking care of the bride.

The cleric who was speaking at the wedding Fatiha of a 65-year-old man who got married to a 12-year-old girl, said that Prophet Muhammed and the Holy Quran did not condemn child marriage and does not see why anyone should condemn what the Prophet did not kick against.

“I often wonder why people condemn those who get married to child-brides, as they now call it,” Sheikh Muhammad began.

“They are ignorant and ill-informed because Prophet Muhammed, Peace be upon Him, did not condemn child marriage.

For those who do not know, the Prophet himself got married to a child and there was nothing wrong with it as it was backed by the teachings of the Hadith.

One of the Prophet’s wives, Aisha Bint Bakr, was betrothed to him when she was just six years old and he got married to her when she was nine. However, he did not consummate the marriage until she was 12-years-old.

And the Holy Prophet was about 53 or 54 then.

Lady ‘Aisha was the noble daughter of the honorable companion of the Prophet, Abu Bakr who was loved the most by Prophet Muhammad among all of his companions. Abu Bakr gave his consent for the Prophet to marry his daughter.

The Prophet was grateful to Abu Bakr and used to say in this regard ‘the only one who I am indebted to and couldn’t fulfil his debt is Abu Bakr”. The Prophet did not only mean the financial support by Abu Bakr but more importantly he meant his devotion to God and the sincerity of his heart.

Apart from Aisha who turned out to be one of the most faithful and dutiful wives of the Prophet, he also got married to other young girls, some of whom were given to him by their parents.

He followed the tenets of Islam and the most important thing was that the parents and the Muslim Umma were in support of the marriage and they lived together in peace until Allah called him to Aljannah.

So tell me, if the Holy Prophet could marry young girls, what then is wrong with his followers who do the same? There is nothing wrong whatsoever.

I do not see why anyone should condemn child marriage because it is recorded in the Quran that many religious men who followed the teachings of Prophet Muhammed also got married to girls young enough to be their daughters.

Marrying off a girl when she is very young is a very good thing as it would stop her from mingling with children of the world to become spoiled.

The many cases of zinna (fornication) that we have today are because our girls are allowed to stay too long in their parents’ home without getting married. Why would a girl stay in her parents’ home till she is 14 or 15? Is that not calling for disaster?

That is a sin in the eyes of Allah. The Western education does not also help in these matters as parents now insist that their daughters should go to school. What are they going to school to learn that they cannot learn in Islamic schools? What will they learn that their mothers cannot teach them?

What is the use of their education and certificates when they will end up in a man’s bedroom and kitchen?

What is the use of acquiring all the certificates in the world when you will end up as a wife and a mother? Are you going to present the certificate to your husband on your wedding day?

I support child-marriage and I do not make any apologies for that. Three of my wives were between the ages of 10 and 15 when I married them and we are all living happily.


I was 57-years-old when I married my last wife who was 13 then and today, we have four children.

I give out my daughters in marriage before they get to the age of 12 and I am happy with what they have turned out to become.

So, if anyone tells you that getting married to a 12, 13, or 14-year-old girl is bad, tell them that I, Sheikh Abdulmalik Ibn Muhammad, say that they are not only ignorant but very stupid and do not know what the teachings of the Quran.

I am working with some lawmakers to push a bill in the National Assembly to legalize child marriage as that will help in curbing prostitution, fornication, adultery and other vices our young women indulge in.”

However, some women rights activists have condemned Sheikh Muhammad’s stance on child marriage, saying that he is not only archaic, but actually promoting a dangerous propaganda aimed at perpetually stifling the growth of the girl-child especially in the northern parts of the country.

Some of the activists have called on the government of Kano State to arrest the cleric and also rescue the young girl who was married off to the 65-year-old man.

Scandal Rocks Custom Boss' Marriage As Wife's Ex-Boyfriend Demands N9 Million Compensation

News filtered in yesterday May 30th, 2020, Saturday, that the no-nonsense Comptroller General of the Nigeria Customs Service, Colonel Hameed Ali (retd), had taken a new wife, Zainab Abdullahi Yahaya, at a low-key ceremony held in Kano State.

The Customs Boss who served as the military administrator of Kaduna State from 1996 to 1998, remarried nearly two years after losing his first wife Hajiya Hadiza Jummai Ali who died in Abuja on October 29, 2018. This marriage comes 2 years after the death of his first wife.



The first marriage is blessed with four children.

The wedding which held over the weekend was devoid of any fanfare because of the ravaging COVID-19 pandemic in the country.

However, a brewing scandal is in the works as a former boyfriend of the new wife has filed documents asking the new wife to return things bought for her as well as monetary gifts during the period of courtship.



The Ex-boyfriend, Zubairu Dalhatu Malamai had in a letter to Zainab through his lawyers, Buba Partners, described the custom’s new wife as a “cheat”.

According to the man, he has spent over N9m on her in the past years they have dated believing that they were going to get married and live as couples.

Malama had hinted that he had spent the money on Zainab as he opened shops for her, paid other rents and also for traveling expenses



The letter reads in part, “We are solicitors to Zubairu Dalhatu Malamai of No. 224 Durumin Zungura Kano Municipal, Kano State, hereinafter referred to as “our client" on whose instructions we write you.



“Our brief as disclosed to us, is that for the over three years you and our client have been in a relationship where he had invested so much in your life, future, and business even as you consistently promised to marry him, despite the fact that you knew deep down in your heart that you were deceiving our client but you allowed him to go ahead and spend his hard-earned money and resources on you while you made him believe that he was doing that to his future wife.



The total amount the man asked the custom boss’ wife to return stands at over N9 Million.

Born 15 January 1955, the current Customs CG previously served as Military Governor of Kaduna State from 1996 to 1998. After retirement, he became secretary of the Arewa Consultative Forum – a political and cultural association of leaders in Northern Nigeria befpre his appointment as Customs DG by president buhari 27th August 2015

Minority Leader, Enyinnaya Abaribe, has called on President Muhammadu Buhari to resign as Nigeria’s president.

He made the call during plenary on Wednesday, while the Senate discussed a motion on national security challenges and the need to restructure the current security architecture.

Mr Abaribe, who was the first to contribute to the motion, faulted the president for failing to tackle the security challenges in the country.

He wondered why the president would claim to be surprised at the rising insecurity in the country.

Mr Abaribe also called out a presidential media aide for referring to the Christian Association of Nigeria as a political party after the body condemned killings by Boko Haram.

“When I was coming, I saw a newspaper headline of THISDAY, the commander-in-chief expresses shock at the level of violent crime, in other words Mr president was expressing surprise, but, according to our rules – Order 53(13), I will not go into that but I can only say in pidgin English ‘this surprise, surprise me.’

“I want to say, Mr President, if you didn’t insist that we will not be partisan I’d have called out the presidential spokesman, Femi Adesina, who, when the CAN leaders complained about the killings of a priest, he turned around and said CAN was acting like a political party.

“Now that we are talking about it here, let me hear him say that all of us are acting like a political party when many are complaining about these incessant deaths in this country,” he said.

While stressing the need to “get to the root of this matter”, the lawmaker said, “those who live by propaganda will die by propaganda.”

At this point, he was interrupted by the Senate President, Ahmad Lawan, who asked the Minority Leader to “stick to the topic being discussed.”

But, Mr Abaribe continued: “Boko Haram has been defeated, Nigeria is now safer, everything that was being done to make sure that the hard work that was supposed to be done in securing Nigeria was not done because certain people did not do their work but preferred to cover the eyes of Nigerians with propaganda and trying to find all these excuses for non-performance, have now come to stare us in the face.

“Nigeria did not elect the IGP, we did not elect the chief of staff, we did not elect the joint-chiefs or national security adviser. We elected the government of APC in 2015 and re-elected them in 2019. The reason we re-elected them is that they continued to tell us that they had the key to security.

“When you want to deal with a matter, you go to the head, so we will go to government and ask this government to resign because they can no longer do anything,” he said.

He was again interrupted by Mr Lawan who warned him against being partisan.

“Let me remind you once again that Nigerians voted for APC in 2015 and because they saw improvement in their lives they voted APC again in 2019.

“I don’t want to be partisan and advise against hate speech,” the Senate President noted.

Making his final note, Mr Abaribe said “government even said if ‘we don’t perform, stone us’, we are going with the stones to stone them now.”

This time, he was stopped.

A Nasarawa senator, Abdullahi Adamu, stood up to condemn Mr Abaribe’s comments and demanded that he withdraw them.

The deliberations are still underway.

The lawmakers have set aside Wednesday to discuss security challenges in the country that have seen attacks by Boko Haram, kidnappers and so-called “bandits” increase, especially in the northern part of the country.

On Tuesday, Mr Buhari said he was surprised at the growing insecurity, and said his government will be “harder” on bandits.

PREMIUM TIMES has reported on the insecurity across the nation carried out by various armed groups and individuals.

These include resurgent Boko Haram attacks in the North-east and increased cases of killings and kidnappings across the country.

In one of the latest incidents, 13 people were killed in a Plateau community.

Amidst the insecurity, the presidency has said Nigerians have reasons to be grateful as the security situation is better than it was before President Muhammadu Buhari assumed office.

“We know what the situation was as at 2015 and we know what it is today. Despite the reversals in security, it is still not as bad as it used to be in this country,” Femi Adesina, President Buhari’s spokesperson, said recently.

A Scottish government minister has called for an end to the hunting of wild goats on Islay.

Mike Russell was responding to social media posts showing American TV presenter Larysa Switlyk posing beside dead goats on the island.

Ms Switlyk, who describes herself as a "hardcore huntress", hosts the Larysa Unleashed programme.

Mr Russell, who is the local MSP for the area, told BBC Scotland that the images were "horrific".

He said he had contacted Scotland's environment secretary, Roseanna Cunningham, to call for goat hunting to be "stopped immediately" on the island.

Several tourism companies offer the chance to stalk and shoot wild goats in Islay, Dumfries and Galloway and other parts of the UK.

The animals, which have no natural predator, are classed as an invasive, non-native species in the UK, and hunting them on private land is not illegal.

Controversial culls have been carried out in some areas to reduce their numbers, while contraceptive darts have also been used to stop the animals reproducing.

In her social media posts, which were made on Tuesday, Ms Switlyk is shown wearing camouflage clothing and aiming a sniper rifle on the island.

Two photographs show her posing next to a dead goat, while another shows a dead ram.

The caption on one photograph says: "Beautiful wild goat here on the Island of Islay in Scotland. Such a fun hunt!!"

She added: "They live on the edge of the cliffs of the island and know how to hide well. We hunted hard for a big one for 2 days and finally got on this group.

"Made a perfect 200 yard shot and dropped him."

Other posts from earlier this month show her posing next to dead red deer stags at Mingary Castle in Ardnamurchan.

Speaking to BBC Scotland's John Beattie programme, Mr Russell insisted that Ms Switlyk's goat hunting was worse than the hunting of red deer, which he said was "very firmly regulated" and "you don't see people glorifying in it very often."

The Brexit secretary added: "The pictures are horrific. Obviously deer culling and deer stalking is established on the island and it's a necessary thing to do considering the lack of control of deer numbers.

"But to see people in camouflage with highly powered sniper rifles rejoicing at the killing of a goat, let alone a ram, is simply unacceptable.

"The vast majority of people would just not regard this as something that should be happening in their country.

"There has been something of an outcry already about it and as a local MSP I have now raised it with the environment minister because I think it's really undesirable and unpleasant."

Mr Russell said it was not clear whether anything could be done to stop goat hunting from happening, but he said he had a duty to raise it as "this isn't 21st Century Scotland. This isn't 21st Century Islay".

'Barbaric practice'
Ms Switlyk was also condemned by Scottish Greens MSP Mark Ruskell, who urged the Scottish government to "make it known that bloodsport participants are unwelcome to visit Scotland for the barbaric practice".

But the Scottish Country Sports Tourism group said country sports tourism was worth £155m to the Scottish economy every year.

Ms Switlyk, who is understood to have been filming in Scotland, has not yet responded to requests for comment.

The Larysa Unleashed website says the presenter "promotes the outdoor lifestyle, offering a taste of the adventure as she blossoms into a hardcore huntress.

"Along the way Larysa wants to encourage the public, especially kids and females, to go hunting and experience the great outdoors.

"Whether it's teaching them to shoot a gun for the first time, or hunting alongside her for an amazing trophy, it will be nothing less than an extreme adventure".

Feral goats are thought to have roamed parts of Scotland and the north of England for about 5,000 years, when they were introduced by Stone Age humans.

There are currently estimated to be about 3,000 animals in herds spread across the country.
