It’s like the COs in the embassy have been changed. The questions being asked at the embassy from what I can see here look a lot more technical/harder than what I experienced on my own interview day.

Simple advice guys, ask a lot of questions before your interview date(that’s why LegitBachelor in his wisdom created this group so that those who have gone through the process can advise/assist in any way those who are yet to), prepare well (carry every evidence you have concerning the interview process. There is nothing worse than being asked for evidence and you answer by saying it isn’t in your possession. It will put you off straight), be confident and pray.

Good morning,so this is my first time here and I have a couple of questions tho my petition is yet to be approved,my fiancée filed in March
1. How long should I be looking at for the approval of the petition.
2. Are there any process to speed up approval
3.i saw a thing about some people who had traditional marriage been refused,in my own case,we just had a traditional engagement and she even put evidences of payment to the vendors for the engagement in the petition.does this mean that it may not be approved or even if it’s approved,can it jeopardize my chances of getting a visa?

Nothing to be done to speed the process. Just wait for it to be approved. Regarding the traditional engagement, you can explain, legitbachelor will explain more on that.

You'll be denied if you mention it during your interview. You can't be married and yet seek to get fiance visa at the same time, they will deny you and advice you go the spousal visa route.

Bro, do I need to book a date for the medicals or just straight walk in?

I have general question please. Does it indicate anything if after the interview, the VO request for a document and return the passport back with a comment that she was doing so because she doesn't know when the requested document will be submitted?

Send the requested documents via dhl with the passport back. Once they request for additional documents, they give you your passport back to send with the requssted documents.

I told her the birth cert which I showed her again n she was like why wait till a year after to get the birth cert
N I told her that was wen I had time to(at this moment I was scared)
She asked for other proof like their immunization or birth notifications n I told her I didn’t knw I have to bring that along
She asked of the birth notification n at this point I was just blabbing can’t even remember wat I said
She jotted sometins down n asked me to submit my kids original immunization copy
I explained to her I can only get her a re-write copy of the immunization record cos the other one got spoilt wt water n she asked how come n I explained to her(she cancelled it n asked me to submit an I-134 form filled by the spouse of the joint sponsor n our passports to an address written on the paper given to me (I guess this was because the tax record include her name too,both the husband n the wife file their tax together)
That all I can remember for now.

Yes, I would have scaled through if it were a different CO. I overhead one CO telling a male applicant to bring a proper divorce document through DHL. Most of the applicant were asked to bring one document or d other together with their passport.

Questions Asked:-

Who Filed for you
How and when did you meet
Have you been married before
Answered Yes,
Why did you divorce him!
What kind of marriage did you do!
Me, local govt registry
CO,: sorry you are not eligible to remarry because you did not divorce property. You cannot use a customary court divorce document to annul a Local Govt marriage. According to Nigerian Law, you can only divorce a court registry through a marriage decree from the High Court. I'm sorry but I have to deny you. Returned my passport.
Me: I get you but can you please permit me to get the document asap and send it to your office.
CO: No
Me: Stood there for like a minute thinking she will change her mind. After realising she has made up her mind said thank you and about walking away.
CO: OK, the only thing I can do for you is to continue the interview so that in case your Fiancée decides to come n marry you here in Nigeria, it will fastrack your approval. Tell him to file a CR1.
And then she continued the interview:
CO. Remind me how met, how did it happen
How many times have you met in person
Tell me about his life over there
How did he proposed
Show me pictures
When and where was this
How do you communicate
OK. That's all I can do for you.
Me: OK, thanks.and then walked away. I was pained but I tried to still answer properly.

Just like you said delay is not denial. My Fiancée is already talking to a Lawyer and we will not just rely on her advice. We'll look at the options and choose d best.

I am so sorry about this. She could have asked for proper divorce papers! Anyway God knows best. Please tell your man not to waste any money on any lawyer. Let him send an email to uscis about the petition being denied and then file CR1. Stay strong dear. All the best.

I'm sure the CO did and she told the CO that she don't have it. Even if she now go and get the divorce papers, it will not be accepted as the date on the divorce paper will be that of today and not the day before her fiancee filed for her. One of the eligibility requirement for K1 Visa is that both intending couple must not be married as at the time of filing the i129F petition. And since she didnt get the divorce document when her fiancee was filing for her, it means technically she was still married at the time.

That being said, I believe the CO was being too thorough. Some COs might not have noticed the error and would have approved her visa. Even me myself didn't know that a divorce document from the place where wedding was conducted is not enough unless a document from a competent High Court is gotten. But its well, God knows the reason for this delay. She will eventually be with her Love at God's own time which will be soon enough.

Yeah! So hurtful to know just a piece of document got her denied. Yes she will with her man soon.

No you can’t appeal K1. Only CR1/IR1

@Sisiorente, I'm so sorry for the delay. Perhaps you would have scaled through if it were another consular officer that isn't very thorough. But God knows best. Maybe this happened to prevent you from encountering something dangerous.

What I dont understand however is why the consular officer said your only option is through Spousal Visa. Based on what you just said, you can still apply using either Fiancee or Spousal Visa after obtaining the divorce document from the court. After all, you are not yet married to your man. But if you guys are married OR plan to marry outside the United States (bride price payment and/or traditional wedding), then your only option is Spousal Visa.

However the final decision is yours and your fiancee to make. Both Spousal and Fiancee visa has its pros and cons.

The same would have happened even if you told them what you had was a traditional marriage. They see traditional marriage or introduction as being too married for a K1 visa.

Like the VO mentioned, best is to do a spousal visa.....and you need to get a proper divorce from a court along with the divorce decree from the court.

It's just a delay..... not the end of the road.

She said she was divorced but didn’t have the high court divorce papers. They could have asked for additional papers tho.

I was denied.
Had my interview yesterday but it was denied.
I have been married before at d Local Govt Registry but I did not get a Divorce Decree from high court. I only presented a divorce document from the local govt. I didn't know I had to go to the high court to get a divorce decree. Apart from that, all my documents were complete. If I had said I did traditional marriage, I would have scale through. Knowledge is power.
No question is too small to ask. Always ask question for clarity sake.
The CO said my only option is to get married here after getting d necessary document. And then file for a CR1.
My Fiancée is going to talk to a lawyer about it.
I'm really devastated right now.

Go with at least 2 passport photos, international passport, appointment confirmation printout, DS-160 printout, GTBank Payment Receipt, Birth Certificate, Police Clearance Certificate, Medical Report (sealed), filled Affifavit of Support form along with its supporting documents (fiance's birth certificate, international passport, tax returns, bank statement, employment letter, etc), copy of documents your fiance submitted to USCIS when she petitioned for you (i129F along with supporting documents), proof of relationship (WhatsApp Chats, Call Logs, Pictures of you both together, copy of Flight Boarding Pass used to visit fiance, money transfers, etc) and other documents that supports what you filled in the DS-160 thats not listed here.

What is your means of communication (Our means of communication is email, I had a ton of emails, but she preferred screen shots of the email)

Hello guys! I am pleased to report that I had my interview today. It went well, but I was given the white paper to submit a copy of the evidence of the immigration status of my joint sponsor before my visa can be approved/issued. The CO gave my passport back to me because she said is not sure when I will be able to submit the requested documents and that she will request for the passport in due course. Has anyone had this experience before? What should be my expectation going forward in terms of the time frame when my case can be 'resolved' after submitting the document?

Photocopies can be in black and white. Also ensure to go with a copy of the letter from NVC...the one that has your Case number in it. The number starts with LGS....

Your Fiance. But if you guys also used a joint co-sponsor, then it should be filled by both your fiance and the joint co-sponsor. The party(ies) filling the form should include tax papers along with other documents as stated in the affidavit form.

@LegitBachelor what am asking is there is MMR vaccination given to me and the nurse told me that it is given every month. I dnt know may be you are told the same. She told me if I have not left for US I need to come to take it every month till I leave, the vaccination costs 10k . But since February have been given visa, I didn't go to the clinic for the vaccination.

Hope it won't affect me at the US border? Thanks

You should probably contact the hospital first. Were you given shots for measles? Thinking of getting some because of the outbreak in the US.
