Some suspected Boko Haram insurgents have urged the Federal High Court in Lagos to declare their detention for 12 years without trial as illegal and unconstitutional. Through their lawyer Mr Ahmed Adetola-Kazeem of the Prisoners’ Rights Advocacy Initiative (PRAI), they are praying for an order directing their unconditional release forthwith. They also seek an order of perpetual injunction restraining the respondents from further interfering with their fundamental rights in any manner. The Attorney-General of the Federation, the Inspector-General of Police, the National Security Adviser (NSA) and the Controller-General of the Correctional Service are the respondents. The applicants seek an order directing the Federal Government to pay them N303million as compensation for their unlawful and unconstitutional arrest and detention. PRAI filed the fundamental rights enforcement suit on the suspects’ behalf. It argues that their being in custody since July 2009 was illegal. The suspects were moved to Lagos in March 2011 and are currently detained at the Kirikiri Maximum and Medium Custodial Centres without trial. They claimed they were denied access to their families and lawyers. In the suit numbered FHC/L/CS/166/2021, PRAI is praying for a declaration that their arrest and continued detention for 11 years without proper arraignment and trial in a court of competent jurisdiction is unlawful, unconstitutional and constitutes an infringement/violation of their fundamental rights to freedom of personal liberty and to be tried within a reasonable time. Armed bandits have invaded Government Technical College, Kagara in Rafi local government area of Niger State. Sources told Daily Trust that armed men broke into the school on Sunday night but met the place empty. The government had shut schools in the area after the abduction of students and staff of Government Science Secondary School, Kagara. Simeon Eze, an ex-Personal Assistant to former President Olusegun Obasanjo on Security and Protocols, has joined the All Progressives Congress (APC). Eze, from Echara/Isiagu Ward in Igboeze-South Local Government Area of Enugu State, joined the APC on Tuesday. NAN reports that he registered at the local government party secretariat in Ibagwa-Aka. Jonathan Zwingina, the Chairman of APC Registration and Revalidation Committee in Enugu, attended the event. Also present were Ben Nwoye, State Caretaker Committee Chairman and some executives and party chieftains. The APC also received some Peoples Democratic Party (PDP) youths from Unadu Ward of the LGA. “I decided to join the ruling party at the centre because President Buhari has done very well especially in his war against corruption. “I will support APC to change the narrative in Enugu state. The Commissioner of Police in Lagos State, Hakeem Odumosu has ordered the immediate release of End SARS protesters. President Muhammadu Buhari clearly does not understand the pervading herdsmen’s violent crisis in the country and that the president is not in charge of the situation. According to the Noble laureate, the manner with which the President has so far handled insecurity suggests that he doesn't have a full grasp of how bad it is. Soyinka stated these in an interview on Arise Television on Thursday, adding that he also did not believe herdsmen should be compensated as being preached in some quarters. “I have said this before and I wish to repeat this. Buhari does not appreciate the situation; he doesn’t understand. I see no evidence that he understands how grave the situation is. I have said it again and again, I don’t believe that he is in charge, because it is not possible in my view for a head of state, Commander-in-Chief of the armed forces to say he is presiding over a nation and things get to this level. “Something is critically wrong within the leadership of this nation and that is where we civilians must come in. You must pick up this slack for our own situation, our own salvation, and this is one of the things we engaged in and that is why I resent this becoming individualised. Wole Soyinka is just another individual, just like another farmer, another student and I wanted people to understand this. “What happened to me with this incident is just typical of what is happening to millions of people all over the country and we cannot just sit still. “I just read the reports that the herdsmen should be compensated. Inspector-General of Police (IGP), Mohammed Adamu, on Wednesday again showed up at the Force Headquarters in Abuja wearing his uniform despite attaining the statutory age of retirement, SaharaReporters has gathered Adamu, who was officially due for retirement on Monday, has not handed over the reins of leadership to the most senior officer as expected as President Muhammadu Buhari has continued to delay the appointment of a new IGP. The IGP, who joined the service on February 1, 1986, has attained the mandatory 35 years in service. Aside from Adamu, three Deputy Inspector-Generals of Police and 10 Assistant Inspector-Generals of Police have also attained the maximum years of service. While the other top police officers have all proceeded on retirement, sources at the Louis Edet House on Wednesday told SaharaReporters that the IGP is still performing his official duties as he has refused to hand over. The police boss was at the Nnamdi Azikiwe Airport on Tuesday to receive President Muhammadu Buhari who returned to Abuja after a four-day trip to his hometown Daura. Although there have been speculations over who will replace Adamu, Garba Shehu, presidential spokesman, insisted that the choice of a new IGP would not be based on ethnicity. “If you are going to appoint the service chiefs from every ethnic group in this country, you are going to have more than 250 inspector-generals of police, 250 chiefs of army staff, 250 chiefs of naval staff. It’s not going to work like that. And they have their own systems of producing leadership,” Shehu said in an interview on Channels Television on Monday. “If we say we are going to use ethnicity or region as the basis, then we have lost it. This is about law and order; it is not about ethnic identity. This country finished with tribalism in the 1960s; why are we back to it now? “But if you have two, three positions — look at what happened with the service chiefs just appointed. Two from the south, two from the north. If you are talking about religion, two Muslims, two Christians. So what do you want again? “The president will rather have an inspector-general of police who will make you and I safer, protect lives and property, than one who is more pronounced by his tribal marks.” Findings by SaharaReporters showed that Adamu's refusal to hand over is contrary to the provisions of the Police Act 2020 which in Section 7 (6) fixes a single term of four years without an option of extension of tenure for the holder of the office of the Inspector-General of Police. “A person appointed to the office of the Inspector-General of Police shall hold office for four years,” it read. The Presidency has condemned Governor Rotimi Akeredolu’s ultimatum to herdsmen to vacate Ondo forest reserves. In a statement on Tuesday, Garba Shehu, said the presidency has been keenly monitoring events occurring in Ondo State. The special assistant to President Muhammadu Buhari said what is emerging is a lack of consistency in messaging which in turn leads to various contradictions regarding accuracy and the intent behind the message. The presidency called for restraint on both sides. It urged the state government and the leadership of the Fulani communities to continue their dialogue for a good understanding that will bring to an urgent end the nightmarish security challenges. Shehu said Akeredolu, being a Senior Advocate of Nigeria (SAN) and a former President of the Nigerian Bar Association (NBA), has fought crime in his state with passion and commitment. “It will be the least expected to unilaterally oust thousands of herders who have lived all their lives in the state on account of the infiltration of the forests by criminals. “If this were to be the case, rights groups will be right in expressing worries that the action could set off a chain of events which the makers of our constitution foresaw and tried to guard against. “We want to make it clear that kidnapping, banditry and rustling are crimes, no matter the motive or who is involved. But, to define crime from the nameplates, as a number of commentators have erroneously done- which group they belong to, the language they speak, their geographical location or their faith is atavistic and cruel. “We need to delink terrorism and crimes from ethnicity, geographical origins and religion—to isolate the criminals who use this interchange of arguments to hinder law enforcement efforts as the only way to deal effectively with them. “The President, who swore to defend the constitution has spoken against the Indigenous People of Biafra (IPOB) in asking citizens of Northern origin to leave; he did not spare the group based in Sokoto, ‘Muslim Solidarity Forum,’ which asked the Bishop of Sokoto to leave and is prepared to do all that the law permits to protect citizens all over the country in their choice of where they wished to reside and are treated as equal citizens.” Shehu said the Ondo and all States must draw clear lines between the criminals and the law-abiding citizens. Another lockdown is likely in Nigeria with the rising COVID-19 cases, the Presidential Task Force (PTF) on the Novel Coronavirus Control has warned. The ad hoc body working on prevention of the virus is worried that despite the second wave whose effect is deadlier than the first wave, Nigerians have continued to shun the prescribed protocols. National Coordinator of the PTF, Dr Sani Aliyu, said the only way to prevent a re-introduction of a lockdown is by adhering to the advisories. Many business concerns and the generality of Nigerians have cautioned against another lockdown because it will hurt the economy that has already slumped into recession. Business leaders have advised the government to seek other options to control the spread of the virus. Aliyu, speaking on a television programme on Sunday, said: “If you don’t want a lockdown, the only way is to make sure we use our facemasks, avoid mass gatherings, avoid people who have respiratory tract infections, sanitise our hands and follow those non-pharmaceutical interventions. “The very vaccines that we currently have are those non-pharmaceutical interventions. “If numbers continue to go up, all options are on the table. There are countries in the world that have been able to control this pandemic simply by following these non-pharmaceutical interventions. They may be inconvenient, but they will not be as difficult as a lockdown”. Aliyu said cases were multiplying in recent weeks. “We are talking holistically here. All I can say is that 33 people died of COVID-19 in the last one week. Are we saying those people died for nothing? We have just recorded 6,000 cases in one week, far more than we ever recorded. “COVID-19 exists; anybody who says COVID-19 does not exist is probably living in a completely different world. In the last one week, we’ve had a tripling of cases. You can see what’s happening in the United States, you can see what’s happening in the UK. ” I’m sure most of those who have been following the numbers will realise that what we have now far exceeds what we had in June/July last year. “In week 52, which is the week we’ve just finished, we’ve seen a tripling in weekly number of cases, compared to what we had three weeks ago. The 6,000 cases per week is really huge. Our hospitals are already starting to get overloaded and we are already starting to feel the pressure within the healthcare system. “So, talking about the projection, the projection really depends on whether people will start taking this very seriously and start following those non-pharmaceutical interventions that we’ve been talking about for the last one year. “We’ve been able to demonstrate that it’s possible to flatten the curve, but we need the cooperation of everybody, we need the cooperation of the general public, we need the cooperation of the state governments”, he said. Aliyu said vaccines are expected to be available in Nigeria by the end of January, allaying fears being entertained in some quarters about its safety. He said the administration of the vaccine would be voluntary, as government would not force anyone to take it. “The vaccine, together with the non-pharmaceutical interventions, is the only way to get on top of this epidemic and by the way, Nigeria cannot afford to be a pariah nation. I can tell you that in the coming months, as more and more people start taking this vaccine, it will be very clear there’s not going to be an issue with safety. “If you don’t have the vaccine, you are going to be stuck because I am very certain that countries, internationally in the next six months to a year, will start insisting on a certificate before you get into their country. The Minister of Women Affairs, Dame Pauline Tallen has tested positive for COVID-19 after a routine test conducted on her and members of the family. According to a post on her Twitter handle @PaulineKTallen, the minister said she was asymptomatic but was advised to go for the test. The tweet stated: “Following interaction with individuals that later showed asymptomatic signs of COVID-19, I was advised by my medical team to undergo the test and self isolate for observation over the past few days.· “This is to inform the general public that after personally undergoing a test as well as members of my family, my result returned positive while that of members of my family tested negative. “Currently, I am asymptomatic and have gone into isolation for the period of treatment. The Federal Government says it is graceless and impious for any religious leader to use the period of Christmas, which is a season of peace, to stoke the embers of hatred, sectarian strife and national disunity. In a statement issued on Saturday in Lagos, the Minister of Information and Culture, Alhaji Lai Mohammed, warned religious leaders that resorting to scorched-earth rhetoric at this time could trigger unintended consequences. The statement was made available to newsmen by Mr Segun Adeyemi, Special Assistant to the President (Media), Office of the Minister of Information and Culture. The minister said that while religious leaders have a responsibility to speak truth to power, such truth must not come wrapped in anger, hatred, disunity and religious disharmony. ”Calling for a violent overthrow of a democratically-elected government, no matter how disguised such a call is, and casting a particular religion as violent is not what any religious leader should engage in, and certainly not in a season of peace,” he said. Mohammed stressed that instigating regime change outside the ballot box is not only unconstitutional but also an open call to anarchy. He said while some religious leaders, being human, may not be able to disguise their national leadership preference, they should refrain from stigmatising the leader they had never supported using well-worn and disproved allegations of nepotism. The minister said whatever challenges Nigeria may be going through at the moment could only be tackled when all leaders and indeed all Nigerians come together. He said such challenges could not be tackled “when some people arrogantly engage in name-calling and finger-pointing.” Recall that the Bishop of the Catholic Diocese of Sokoto, Rev. Matthew Kukah, in his 2020 Christmas Message, had alleged that President Muhammadu Buhari is presiding over a country with prospects of a failed state. The National Coordinator of Presidential Taskforce (PTF) on COVID-19 Sani Aliyu says the COVID-19 vaccine will be administered to Nigerians free when vaccination begins. Aliyu made this known on Wednesday during an interview on Channels Television’s breakfast programme, Sunrise Daily. He also revealed plans by the Nigerian government on delivering and administering the vaccine and gave the assurance that Nigerians will be freely vaccinated. “Yesterday, the President gave the PTF the mandate to proceed with preparations with regard to the vaccine. “The President has also given us a marching order that the COVID-19 vaccine be made available in Nigeria. “The COVID-19 vaccine will be available in Nigeria making use of the GAVI arrangement. We already have the assurance that we will have 20% of our population accommodated by GAVI, which is about 40 million Nigerians. They won’t need to pay for that (the vaccine),” the PTF coordinator said. He added that although there are fears that Nigerians may be reluctant to receive shots of the vaccines, efforts are being made to sensitise many and deliver the vaccines across the country. “We have continued to work with the Federal Ministry of Health and Primary Healthcare Development Agency. The NPHCDA has a lot of experience in delivering vaccines across the country. They were involved with the polio vaccination and even at the moment, they are responsible for the delivery of the growth in child vaccination across the country, so they have a lot of experience. “A lot of work is going on behind the scene. The Federal Government says it has met the five demands of the End SARS protesters. The Minister of Information and Culture, Lai Mohammed made the claims during a stakeholders’ meeting with members of the Broadcasting Organisation of Nigeria (BON) in Abuja. Mohammed said the End SARS protesters had demanded the immediate release of all arrested protesters, justice for all deceased victims of police brutality and appropriate compensation for their families. He said the protesters also requested that an independent body oversees the investigation and prosecution of all reports of police misconduct within ten days and the increase of Police salary to adequately compensate for the risks involved in protecting the lives and property of citizens. The minister noted that the Federal Government was not only responsive to the demands of the End SARS protesters but was also very responsible in its handling of their requests. Nigeria has officially slid into its worst economic recession in over three decades, TheCable can report. According to gross domestic product numbers released by the National Bureau of Statistics on Saturday, the nation recorded a contraction of 3.62 percent in the third quarter of 2020. This is the second consecutive quarterly GDP decline since the recession of 2016. The cumulative GDP for the first nine months of 2020, therefore, stood at -2.48 percent. The last time Nigeria recorded such cummulative GDP was in 1987, when GDP declined by 10.8 percent. According to World Bank and NBS figures monitored by TheCable, this is also the second recession under President Muhamadu Buhari’s democratic reign — and his fourth as head of state. President of the Senate, Ahmad Lawan, has warned that there could be anarchy if the Senate is scrapped as being clamoured by some Nigerians. Rather, he challenged those who are not comfortable with the senators in the current 9th Senate to vote them out in 2023 if they don’t like their faces. Lawan stated this on Friday while declaring open, a retreat for top management staff of the National Assembly and National Assembly Service Commission in Abuja. He described the Senate as a leveler which ensured that all parts of the country are equally represented unlike the House of Representatives where states with higher populations produce the highest number of lawmakers. The Senate President also faulted the argument of those clamouring for the scrapping of the Senate because of the perceived jumbo pay being earned by the senators. Bolaji Owasanoye, chairman of the Independent Corrupt Practices And Other Related Offences Commission (ICPC) has been named senior advocate of Nigeria. Owosanoye was one of 72 lawyers named by the Legal Practitioner’s Privilege Committee (LPPC) on Friday. A total of 137 lawyers were shortlisted for the rank in 2020 — with 116 advocate applicants and 21 academic applicants. Of the 137 candidates shortlisted, 72 were successful, while 60 did not make the cut. Owosanoye was shortlisted as one of the academic applicants, following his standing as a professor of law across major universities across the world. The Speaker of the House of Representatives, Femi Gbajabiamila, has disclosed that he will not sign the 2021 budget if provision for compensation to victims of police brutality is excluded. Mr. Gbajabiamila also disclosed that he will be visiting families of victims of police brutality across the country. He also appealed to the protesters to suspend the ongoing protests. Gbajabiamila stated these in a speech before the House went into a closed door session during Tuesday’s plenary. It would be recalled that the 2021 budget was passed through second reading on Wednesday, last week and committees of the House are due to commence budget defence process. Also, the House in its resolution 2 weeks ago resolved to make provisions in the 2021 budget to compensate the victims of police brutality in the country. “I will not sign off on a 2021 Budget that does not include adequate provisions to compensate those who have suffered violence and brutality at the hands of the police in Nigeria in the last two decades. "I will not sign off on a budget that does not meet the reasonable demands of the ASUU, to which government has already acceded. There is no better time to rethink the system of funding for higher education in Nigeria. The Murtala Muhammed Airport has become a no go area as the #EndSARs protesters blocked all the roads leading to the number one gateway airport as early as 7 am today in continuation of the over one-week protest across the country. Many passengers missed their flights just as some cancelled theirs while those who left for the airport as early 4 am were the lucky ones to escape from the crisis to meet up with their scheduled flights. The protesters in their hundreds marched through the Oshodi/Mafoluku axis with the intent to access the international wing of the airport through the tollgate but could not prevent vehicles from driving into the airport. It is the same story at the Ikeja axis where protesters from Computer Village/Medical Road, Awolowo Way and Maryland created serious gridlock with no movement which made it almost impossible for air travellers and other airport users to enter the airport. Many airport workers were seen trekking to the airport. A worker at the Federal Airports Authority of Nigeria (FAAN) who spoke to the Tribune Online declared; “I have been stranded on the road for more than 1hr 30 minutes now, no movement from Ajao axis.
