A Court just removed Elisha Abbo of APC for the same reason. you cannot contest election unless you belong to a political party.
It's even coming rather late.

Abbo issue is totally different, he was removed by his ward, Nnamdi Constituency can go ahead and pass vote of confidence in him and it will rest the case. A court was also approached followed by his removal by his ward in case of Abbo.
