Did the police cart away Budget 2017 documents from the home of a senator?

That remained a knotty question yesterday.

The police denied that they took such documents during a raid on the Abuja home of Senator Danjuma Goje. The Senate said they did and that the budget could be delayed for that reason.
But, said the Senate yesterday in a statement, less than 24 hours after it demanded the immediate return of the documents, the police had complied with its directive.

Senate President Bukola Saraki’s office said the police returned all the documents, cash and laptop they took away from the house of the Chairman, Senate Committee on Appropriation.

Goje had, on Wednesday, told the Senate that policemen who raided his house on April 20 took away budget documents.

The Gombe Central lawmaker said besides 18 files, the police also took away his personal laptop where information on the budget was stored.

He said that N18 million, $19,000 and 4,000 Saudi Riyals were also taken away from his house by the police raiders.

The Senate resolved to ask the police to return the documents.

The Senate President also demanded an explanation of what informed the raid and an unreserved apology.

He constituted a seven-man committee to unravel the circumstances that led to the raid.

The Special Assistant to the Senate President on New Media, Bankole Omisore, said the police returned everything they took.

He said that the police claimed that they acted on wrong information by a whistle-blower.

Omisore twitted: “Nigerian police this morning returned every thing they took from Senator Goje’s house, including cash and documents relating to the 2017 Budget.

”They claim the raid was based on wrong information from a whistleblower.”

Also the Senior Special Assistant to the President on National Assembly Matters (Senate), Senator Ita Enang, in a statement entitled: “Resolution of issues: Re-Nigerian Police Force and Senator Danjuma Goje”, confirmed the items taken away from Goje’s home by the police have been returned.

A source close to Goje told our reporter that a deputy commissioner of police and some plain clothe officers returned the items early yesterday.

The police said the search warrant executed in Goje’s home had nothing to do with the budget.

The police searched Goje’s 10, Haile Salasie Street, Asokoro District, Abuja home, following an intelligence report.

Force spokesman CSP Jimoh Moshood, in a statement in Abuja, said the report that budget documents were taken away was false, misleading and capable of misinforming Nigerians.

He said that the search warrant was professionally executed.

”It is pertinent to set the record straight and inform Nigerians on the facts of the matter,”he said.

He said that on arrival of the Police team at Goje’s house, the house keeper, Ango Usman, informed him of the presence and mission of the team and he promised to come but later switched off his phone.

”The search warrant was successfully executed in the presence of three close relatives of Goje who reside in the house and the recoveries were made in their presence,”he said.

The relatives are: Danjuma Mohammed, Ango Usman, house keeper to Goje and Aisha Umar, a step daughter to Goje.

He said that the relatives opened the house, took the police team round the building, and endorsed their signatures after the completion of the search as required by law.

He said the items on the search warrant contained the money, documents and laptop recovered, and that none of the items included the budget document.

Moshood said the items recovered include: N18 million; 19,850 US dollars; 9, 400 Saudi Riyals; 38 files and six envelopes containing documents; file on funds spent on security administration and information gathering in 2009.

Others are: file on release of fund for special operations in 2009;file on Gombe State Government cash inflow, 2005; file on Project 2007 and executive briefs on how to fight opposition in Gombe State, Strategies and tactics.

He said there were also envelopes containing permit to operate as an oil industry service company (special categories) 2011; file containing write-ups on how a former governor plotted the assassination of Sheikh Jafaru and letters from Mohammed Goje to the MD, LUBELL Nigeria Ltd. of proposed residential development at Kashere Phase II dated Jan. 1, 2007 and Nov.19, 2010.

The spokesman said that there was no document relating to the 2017 Budget sighted or removed by the Pplice team.

He said that the Inspector-General of Police, Mr Ibrahim Idris, honoured the invitation of the National Assembly to explain the legality of the search warrant in Goje’s house.

Moshood said that further investigation was ongoing into the matter, adding that police actions were in line with the provisions of Sec. 4 and 28 of the Police Act and Regulations.

”The Nigeria Police Force sees the report in the media credited to Sen. Danjuma Goje as a deliberate distraction to cast aspersion on police investigation to pervert the end of justice,”he said.

He implored the public to disregard the report as the search warrant was professionally executed.

Economic and Financial Crime Commission (EFCC) on Tuesday withdrew a motion before a Federal High Court Lagos for stay of execution of a judgment which unfroze the account of a former first lady, Patience Jonathan.

Justice Mojisola Olatoregun had on April 6 unfreeze the account after Jonathan’s lawyer, Mr Ifedayo Adedipe (SAN), challenged the propriety of EFCC’s action.

He had challenged the commission for joining her in a suit, which he said, she was not a party to, and urged the court to unfreeze Jonathan’s account.



Dissatisfied with the unfreezing order, EFCC had filed an application for a stay of execution of the order as well as a notice of appeal challenging the judgment.

The two applications, according to EFCC counsel, Mr Rotimi Oyedepo, were dated April 6 and filed on April 7.

At the resumed hearing of the case on Tuesday, Oyedepo informed the court of his agency’s intention to withdraw the two applications.

He did not give reasons for the withdrawal.

Following the withdrawal of the applications, Adedipe confirmed service of the application for withdrawal on the defendants.

He equally informed the court of his intention to withdraw Form 48 (notice of Committal to prison) and Form 49 (Committal to prison), which he said, was filed against Skye Bank in anticipation of a failure to obey the order of the court.

After the submissions of both counsel, Olatoregun granted the withdrawal of both the EFCC’s two applications and Patience Jonathan’s Form 48 and Form 49 respectively.

Olatoregun had in 2016 following the application of EFCC, ordered that the account of the former first lady which housed the sum of about 5.8 million dollars be frozen on the grounds that the money was suspected to be proceeds of a crime.

Also affected by the order were five liability companies habouring a total sum of N7.4 billion.

The five companies are Finchley Top Homes Ltd, Aribawa Aruera, Magel Resort Ltd, AM -PM Global Network Ltd, Pansy Oil and Gas Ltd. Also, affected was an account belonging to one Esther Oba having the sum of 429,000 dollars.

The freezing order was sequel to a further and better affidavit in support of an ex-parte originating summons deposed to by Abdulahi Tukur, an investigating officer of the EFCC.

Tukur had averred that there was urgent need for the court to direct the managers of the bank accounts contained in the schedule to in the interim forfeit the money contained to prevent further dissipation.

While granting the freezing order, the judge had ordered the anti -graft agency to file an undertaking as to damages if it turned out that the order should not have been made.

Magistrate T. A. Elias of an Ebute-Meta chief magistrate’s court, Lagos, has ordered a textile trader, Titilayo Momoh, to undergo psychiatric evaluation following her plea of not guilty to a charge of attempted suicide. Momoh, 51, was arraigned yesterday by the police attached to D4 Section of the Police Criminal Investigation and Intelligence Department, CIID, Yaba, before Magistrate Elias. She is facing a one-count charge of attempted suicide, preferred against her by the police.

The prosecutor, Sergeant Kehinde Omisakin, told the court that Momoh had, on 24 of March, at about 10a.m., on the Third Mainland Bridge, Lagos, attempted to commit suicide by jumping into the river. She said that the offence committed is punishable under Section 235 Cap C17, Volume 3 of the Criminal Law of Lagos State, 2015. The defendant, however, pleaded not guilty to the charge. However, her lawyer, Beauty Otigi, in an oral bail application, urged the court to grant her client bail in the most liberal term.

The magistrate consequently granted the defendant N500,000 bail with two sureties in like sum, who must be tax compliant. He ordered the defendant to submit herself to psychiatric evaluation before the next adjourned date— June 1.

It will be recalled that on March 24, Momoh, a Lagos Island fabrics dealer was rescued from jumping off the Third Mainland Bridge into the Lagoon by operatives of the Rapid Response Squad, RRS, of the state’s Police Command. According to Lagos State Police Commissioner, Fatai Owoseni, Momoh was in a taxi driving towards Oworonshoki when she asked the driver to stop on the bridge.

She was about to jump into the lagoon when a police patrol team stopped her.

In the last few days, PDP hack writers and masters of disinformation have again been spewing farts. The social media audiences have been told that Obaseki rushed to Supreme Court to appeal against the ruling of the appeal Court at a time that His Royal Majesty, Oba Ewuare 2 called the Petitioners to accept the Tribunal judgment in good faith. Nothing could be farther from the truth!

The facts of the issues are as follows :

1. In resolving one of the questions formulated in the subsidiary appeal of the second respondent in response to the main appeal filed by the petitioners, the Appeal Court held that ballot papers brought before the Tribunal didn't need to be pleaded as contended by the Counsels of the respondents. The Counsels are not satisfied by this position.

2. The Appeal Court restrained itself from making pronouncements on the result of ballot counting which the Tribunal ordered the Secretary of the Tribunal to make available on the ground that the Tribunal should be allowed to deliver judgment first thereby leaving the issue hanging.

3. Sequel to the above, the counsels of the respondents in the case are professionally motivated to advance the course of law and justice by ensuring that the issues are resolved by the Apex Court since no similar case has been decided previously. What they seek is the achievement of loco classicus in order to help their prosecution of future electoral cases.

Let it be clearly stated that Governor Obaseki outrightly won the case filed by the Petitioners at the Tribunal and has no personal need to go upstairs rather he needs all the time in the world to focus on governance and the challenge of taking Edo State to the next level.

Therefore, all the imputations of motive attributed to Governor Obaseki as reasons for going to the Supreme Court are not correct. They are the products of wild imagination of the writers. They are inaccurate and by no means reflect the truth! As usual, discountenance them.
