Elias of an Ebute-Meta chief magistrate’s court, Lagos, has ordered a textile trader, Titilayo Momoh, to undergo psychiatric evaluation following her plea of not guilty to a charge of attempted suicide. Momoh, 51, was arraigned yesterday by the police attached to D4 Section of the Police Criminal Investigation and Intelligence Department, CIID, Yaba, before Magistrate Elias. She is facing a one-count charge of attempted suicide, preferred against her by the police.

The prosecutor, Sergeant Kehinde Omisakin, told the court that Momoh had, on 24 of March, at about 10a.m., on the Third Mainland Bridge, Lagos, attempted to commit suicide by jumping into the river. She said that the offence committed is punishable under Section 235 Cap C17, Volume 3 of the Criminal Law of Lagos State, 2015. The defendant, however, pleaded not guilty to the charge. However, her lawyer, Beauty Otigi, in an oral bail application, urged the court to grant her client bail in the most liberal term.

The magistrate consequently granted the defendant N500,000 bail with two sureties in like sum, who must be tax compliant. He ordered the defendant to submit herself to psychiatric evaluation before the next adjourned date— June 1.

It will be recalled that on March 24, Momoh, a Lagos Island fabrics dealer was rescued from jumping off the Third Mainland Bridge into the Lagoon by operatives of the Rapid Response Squad, RRS, of the state’s Police Command. According to Lagos State Police Commissioner, Fatai Owoseni, Momoh was in a taxi driving towards Oworonshoki when she asked the driver to stop on the bridge.

She was about to jump into the lagoon when a police patrol team stopped her.

In the last few days, PDP hack writers and masters of disinformation have again been spewing farts. The social media audiences have been told that Obaseki rushed to Supreme Court to appeal against the ruling of the appeal Court at a time that His Royal Majesty, Oba Ewuare 2 called the Petitioners to accept the Tribunal judgment in good faith. Nothing could be farther from the truth!

The facts of the issues are as follows :

1. In resolving one of the questions formulated in the subsidiary appeal of the second respondent in response to the main appeal filed by the petitioners, the Appeal Court held that ballot papers brought before the Tribunal didn't need to be pleaded as contended by the Counsels of the respondents. The Counsels are not satisfied by this position.

2. The Appeal Court restrained itself from making pronouncements on the result of ballot counting which the Tribunal ordered the Secretary of the Tribunal to make available on the ground that the Tribunal should be allowed to deliver judgment first thereby leaving the issue hanging.

3. Sequel to the above, the counsels of the respondents in the case are professionally motivated to advance the course of law and justice by ensuring that the issues are resolved by the Apex Court since no similar case has been decided previously. What they seek is the achievement of loco classicus in order to help their prosecution of future electoral cases.

Let it be clearly stated that Governor Obaseki outrightly won the case filed by the Petitioners at the Tribunal and has no personal need to go upstairs rather he needs all the time in the world to focus on governance and the challenge of taking Edo State to the next level.

Therefore, all the imputations of motive attributed to Governor Obaseki as reasons for going to the Supreme Court are not correct. They are the products of wild imagination of the writers. They are inaccurate and by no means reflect the truth! As usual, discountenance them.

Edo polls: Tribunal releases results of recounted ballot papers

The Edo State Election Petitions Tribunal has released results of the recounted ballot papers used for the September 28 governorship election.

In its ruling on February 9, 2017, the three-man tribunal headed by Justice Ahmed Badamasi granted the prayers of the People’s Democratic Party and Pastor Osagie Ize-Iyamu by ordering the recount of ballot papers in Egor, Akoko-Edo, Etsako West and Etsako East local government areas.

The APC won in all the four local government areas where the ballot papers were recounted.

However, the ballot papers which held for two days could not be concluded following the expiration of the period given to the petitioners to prove their cases.

From the results released, only eight wards were counted in three local government areas while no ballot papers were recounted in Estako East local government.

In the report signed by the Assistant Secretary to the tribunal, Buhari Sani, and given to parties in the case, the recounting exercise was concluded in Wards 1, 2, 3, 4 and 5 in Etsako West Local Government Area, Wards 1 and 2 in Akoko-Edo Local Government Area and Ward 1 of Egor Local Government Area.

The recounting from Estako West showed that Ward 1 had 1,281 votes, Ward 2 had 1,542 votes, Ward 3 had 1,490 votes, Ward 4 had 1,994 and Ward 5 had 3,025 votes.

In Akoko-Edo, Ward 1 had a total of 3,206 and Ward 2 had a total of 3,849 votes.

The only ward counted in Egor local government had 3,217 votes.

Thursday’s raid on the residence of the chairman of Senate Committee on Appropriation, Danjuma Goje, may affect the passage of the 2017 budget estimates, PREMIUM TIMES has been told.

A special team of officers from the Force Headquarters, Abuja on Thursday carried out a raid on the Asokoro residence of Mr. Goje, a former governor of Gombe State.
An aide to the senator on Friday told PREMIUM TIMES that apart from the cash and other documents, the police also carted away “18 files containing details of the budget estimates”.

The aide said Mr. Goje had been working for “almost 24 hours” everyday —including weekends and public holidays— because his committee is under pressure to lay its report for deliberation by the whole Senate and subsequent passage of the budget.
“In order to get full attention, he and many other members of the committee don’t just work in the office but even in their private offices to get the job done as quickly as possible

“But since this raid yesterday, he was not able to do anything, and you can say the work regarding the budget as far as the Senate is concerned has stopped,” he said.

The 2017 budget has been making gradual process in the National Assembly since President Muhammadu Buhari first proposed it in a speech before the joint-session of the legislature on December 14, 2016.

The proposed budget, estimated at N7.29 trillion, was initially slated to be passed before the end of March, 2017.

But lawmakers said they were sill working out the details after encountering some complexities in the figures of some ministries, department and agencies.

They later gave a May 5 deadline for the passage, but Mr. Goje hinted in late March that this might not be feasible.
The Senate appropriation chairman suggested that an extension might be required if the budget was not passed on the new deadline, adding that MDAs will get legal backing to continue spending after the 2016 budget expires on May 5.

It remained unclear if Mr. Goje would formally request that extension in the wake of his ordeal with the police.
Apart from the files and other documents, the police also allegedly carted away N18 million, $19,000 and 4,000 Saudi Riyal in cash from the residence of the former Gombe state governor.

The senator’s aide also told PREMIUM TIMES that the police were yet to communicate to Mr. Goje what the raid was about as at Friday evening.
When contacted Friday night, police spokesman, Jimoh Moshood, declined to speak in detail about the raid, saying further investigation had commenced.
“Investigation is currently ongoing,” Mr. Moshood, a chief superintendent of police, told PREMIUM TIMES by telephone.
“After the raid, the police still needed to do further investigation.”
“Upon completion, the findings of the police will be made public,” the spokesperson said.
Mr. Moshood’s position corroborated what a police source had earlier told PREMIUM TIMES.


The source, who pleaded strict anonymity because he was not authorised to speak on behalf of the police, said the team that carried out the raid commenced investigation shortly thereafter, adding that a preliminary report might be ready by Monday.

“The investigation is currently being done and I understand a preliminary report may be ready as early as Monday, April 24.”

The committee set up to investigate the suspended Director General of the National Intelligence Agency, Ambassador Ayo Oke, and the suspended Secretary to the Government of the Federation, Babachir Lawal, has shelved plans to invite former President Goodluck Jonathan, SUNDAY PUNCH has learnt.

The committee, which is led by Vice-President Yemi Osinbajo, also has the Attorney General of the Federation, Abubakar Malami (SAN), and the National Security Adviser, Babagana Moguno, as members.

Part of the tasks of the committee is to investigate why the NIA kept $43.4m, N23m and £27,000 (N13bn) in a house in Ikoyi. The money was seized by the Economic and Financial Crimes Commission, based on a tip-off from a whistle-blower.

The PUNCH had reported on Friday that the suspended NIA DG had informed Osinbajo and the NSA that the money, which was originally, $289,202,382, emanated from the National Petroleum Investment Management Service on February 25, 2015, based on the instruction of then President Goodluck Jonathan.

Following the revelation, there were reports that the panel would invite Jonathan to understand the rationale behind the transaction, following allegations by the EFCC that the money was meant for the prosecution of the 2015 presidential election.

Jonathan’s media aides have since refused to comment on the matter.

However, an impeccable source within the Federal Government told one of our correspondents that Jonathan would not be invited.

The source, who wished to remain anonymous because of the sensitivity of the case, told our correspondent that this was not the first time that Jonathan’s name had featured in a probe.

He explained that he was deliberately being left out for political reasons.

The source said, “We have carried out several probes, including the $2.1bn arms scam involving the (former) service chiefs and the former NSA, Col. Sambo Dasuki; we have probed the $1.3bn Malabu scam involving the former AGF, Mohammed Adoke (SAN), as well as dozens of other investigations.

“In all of these, the persons involved have all claimed to have received approval from Jonathan. But inviting or prosecuting a former President has a lot of implications.”

Also, another source familiar with the work of the committee told Sunday PUNCH on Saturday on condition of anonymity that it was unlikely that Jonathan would be invited over the matter.

The source said, “I can tell you that it is most unlikely that the committee will question the former President.

“Firstly, a former President cannot be treated that way. We are not talking about criminal prosecution here. But in this kind of case, he will be treated with the respect he deserves.

“Secondly, that he approved the money in itself is not a crime. The concern of the committee will be about what the money was used for after approval.

“It is possible for security agencies to seek approval for money and state the purpose. It is another thing for them to spend the money on the purpose for which it was approved.”


The source however added that if Jonathan of his own volition offers to assist investigation by providing helpful information through back channels, such information would be appreciated.

There were reports last week that Jonathan; the Governor of the Central Bank of Nigeria, Godwin Emefiele; and the EFCC Chairman, Ibrahim Magu, would be questioned by the presidential panel to answer questions on the recovered N13bn.

According to the reports, the panel would contact the former President and arrange a convenient way to meet him, rather than invite him.

Osinbajo committee to invite gov’t officials, individuals – Presidency

Meanwhile, the Presidency on Saturday said the presidential committee set up by Buhari to investigate Lawal and the suspended Director-General of the NIA would invite relevant government officials and private individuals connected to both cases.

The Senior Special Assistant to the Vice President on Media and Publicity, Mr. Laolu Akande, disclosed this in a statement made available to journalists.

Akande said the committee would also obtain and scrutinise documents that may shed more light on the issues raised in both cases.

He said the committee, which had started work in earnest, would be holding its proceedings behind closed doors to allow full disclosure.

The statement read, “The Presidential Committee set up earlier this week by President Muhammadu Buhari to probe certain allegations against the Secretary to the Government of the Federation, Mr. Babachir Lawal, and the Director General of the National Intelligence Agency, NIA, Mr. Ayo Oke, has commenced its work in earnest.

“In the discharge of its work, the panel is expected to invite all relevant officials and private individuals who may be connected to both cases. It will also obtain and scrutinise documents that may throw some light on the issues raised in both cases.

“All its proceedings will however be in closed sessions to avoid speculations, allow for full disclosure and enhance pace of work.

“The panel, which is expected to submit its report to the President at the expiration of the 14-day deadline, will conduct its work with utmost diligence and without fear or favour.”

Yes I did. I stand by that. The National Intelligence Agency (NIA), Mr Ayodele Oke is a fool. He took the fall (for Amaechi) and when he told me he was going to do it. I warned him they would use him to cover the former governor of Rivers state, Rotimi Amaechi and then mess him up, Chief Femi Fani-Kayode painfully narrated.

He knows the drill, that once he commits himself. That's all.We are in court soon. Wait and see what will happen. It is so easy for Nigerians to be fooled by their government. I have always known that. But for serious minded and well educated people to he fooled by this sort of cheap propaganda amazes me.

Ask yourself why a panel from the Villa is investigating this matter and not EFCC or DSS. Ask yourself why EFCC has not told you who owns the money. Ask yourself how much sense it makes for a security chief to keep $43 million USD in a flat with no security for two years.

Ask yourself all these questions. When you have the answers come back. When we get to court people like you will know why the Rivers State government, Ekiti state government, myself and others have said the money is Ameachi's. It is just a matter of time. Till then, I wil say no more on this.

If it had been anyone else that owned that money every single person that has a flat in that building would have been in detention by now. Ask yourself why this is not the case. Now they are putting a spin on their cover up and bringing former President Goodluck Jonathan into it. It is shameful but I guess that is what Nigerians deserve. They are so gullible.
