Please note that, the election will be for the

1. HoR Etche/Omuma Federal constituency representative
and

2the. HoA Etche Constituency 1 representative.

Gov. Ayo Fayose of Ekiti said on Friday that he attended the inauguration of Gov. Rotimi Akeredolu of Ondo for Yoruba unity.

Fayose, a prominent member of the opposition Peoples Democratic Party (PDP), said this in a statement issued by his Chief Press Secretary, Mr Idowu Adelusi, in Ado-Ekiti.

He said that he could not have done otherwise because the unity of Yoruba people was too important for anybody to play politics with.

“I see nothing wrong in attending the inauguration of an APC person in neigbouring Ondo State.

“Being a leader of the Peoples Democratic Party (PDP) should not stop me from attending the inauguration of an All Progressives Congress (APC) governor.”
According to him, such an occasion is a national one that well-meaning people should identify with.

“This is a Nigerian affair; when a governor is sworn in, we have to support him; we are talking of regional integration and unity here; Akeredolu is already one of us by virtue of his new position.

“We have to support him since electioneering has come and gone and a winner has emerged, and we have to work together in the spirit of the people of our region.

“We cannot play politics with the welfare of the people of our region; we have to support Akeredolu to make the difference.
“This is a matter of the Yoruba nation and after Nigeria, Yoruba nation comes first‎; we don’t need to play politics with the welfare of Yoruba people.”

He advised that his actions in recent times should not be mistaken for an attempt by him to dump his party, the PDP, insisting that nothing of such was in the offing.

“How can I join the APC? As you already know, I am the main issue of the APC.
“They don’t have my size. They are wearing `babaringa’ but they don’t have the size of my cloth,” he said.(NAN)

Nigerian army takes over INEC office at Etche, as the building is presently barricaded by over 700 heavily armed men of the Police and Army.

Inec had earlier slated Saturday 25th February 2016, for the conclusion of the Rerun election

Cross-Examination Continues:

The cross examination of the 6th witness, from Ovia South-west LGA took the panel of judges aback.

Otaru - It was the INEC official at your polling unit who did all the tickings?

Witness- Yes.

Otaru - Check your name on voter register, is there any ticking?

Witness- There was ticking on the right bit none on the left.

Otaru - And it was done by INEC?

Witness- Yes my Lord.

Otaru - Look at the entire voter register in front of you ,there are no tickings to the left .

Witness- If there are no tickings on the left , it's not my fault that there wasn't any tickings on the right , my lord

Otaru- So it was the fault of INEC.

Witness- Yes my Lord.

The judge adjourns sitting to 3pm.

Otaru asked the 5th witness;
Otaru: You just told my Lords under your examination-in-chief that accreditation and voting was done properly in your polling unit?

Witness: Yes.


Otaru: Take a look at the voters register that was used by INEC to conduct the election in your polling unit.

Witness: I'm seeing it.

Otaru: Check number 43 in that register, your name was ticked on the left for accreditation and on the right for voting, is that correct?

Witness: Yes my Lord.

Otaru: Have a look at numbers 123456789 and many others, their names were not ticked on both sides like your own yet they voted?

Witness: Yes that is correct.

Otaru: My Lords, there will be no need to push this one any further.

And the whole court thundered at his dexterity and thoroughness

The cross examination of the third witness, Mr. Monday from Ovia South-west LGA by counsel to all parties has been concluded.

"
When it was the turn of the fourth witness also from Ovia South-west LGA, he was given exhibit PO 290(9) and was asked to check item 298 and 299 on the voters register, it was again discovered as usual that these voters were accredited but also didn't vote as the box on the right hand side wasn't ticked but left blank.

To break it down he said "mine own was properly done unlike others"

The fourth witness for Obaseki the 2nd respondent, Mr. Ojo Patrick from ward 12, unit 9 in Ovia North East LGA confirmed to the court that he was both ticked for accreditation and voting but when he was shown that of others who where only ticked for voting without accreditation he told the tribunal that theirs was not properly done unlike my own

As cross examination continues the witness cries out.

A witness from ward 10 in unit 3 of Ovia North East LG has cried out in court saying. "It is not my fault that my name was not ticked in the voters register" when he was asked if he voted, to which he replied "I voted".

Cases like this have become common in the witnesses so far led to the witness box by counsel to Obaseki who is the 2nd respondent.

A similar scenario also occured yesterday. Nosa Ikponmwonsa was however roasted by the petitioners counsel Roland Otaru, SAN who also accused him of signing different signatures both on his result sheet and on his deposition on oath.

He maintained that he has one signature but when he was asked to sign the one he signed on his deposition, he signed a different one entirely which Roland Otaru hurriedly tendered as exhibit in order to completely nail the witness having lied on oath.

We are back here again for day 2 APC defense at Edo Tribunal.

The Edo governorship tribunal resumed sitting today as the 2nd respondent (Obaseki) continued his defense.


The first witness Mr. Nosa Ikponmwonsa, a farmer from Ovia South-west mounted the witness box, in his cross examination by counsel to all respondents ,he told
the court that he was with his counterpart from PDP polling unit as an agent ,all through the election they both supervised the election with no complains from him because the entire process was free and fair as the INEC officials followed due electoral procedure in the discharge of their duties.

But when it was time for counsel to the petitioner Roland Otaru (SAN) to cross examine the witness, it was discovered that he wasn't accredited neither did he vote because both boxes weren't ticked.

It was also discovered that he had two different signatures, one on the form EC8A and another in his disposition

The election, is to fill the Etche Constituency II seat in the House of Assembly and Etche/Omuma seat in the House of Representatives.

It said that the election would hold in 147 polling units in 19 Registration Areas in Etche and one polling unit (Umuogba Community I) in Omuma..

The Independent electoral commision had fixed Saturday 25th February 2017 for thr conclusion of the remaining 2 LGa in the state House of assembly of River's state.

Counsel to Obaseki jittery as he complained about the publishing of the result of the recounted ballot papers in various print and electronic media platforms.

But the judge in his wisdom who seems very abreast with happenings in the world of information told Olanipekun (SAN) that the panel of judges have all been following the reportage on the electronic media and stated that they were impressed he added that those in the print media are also doing same but cautioned that only proceedings within the tribunal sitting should be reported.

The judge adjourns proceedings to tomorrow February 24th 2017.

As the break resumes:


The 8th witness, Mr. Valentine Asuen is to be cross examined using exhibit PO 105(25) from Oredo LGA.

COUNSEL TO INEC-

Counsel - There was accreditation in your polling unit on the day of the election.

Witness- Yes my Lord.

Counsel- Everybody that voted were accredited simultaneously

Witness- Yes my lord.

Counsel- There was only 1 Voter register on the day of the election?

Witness- Yes my lord.

COUNSEL TO APC

Counsel- Do you know one Joseph Osagiobare.

Witness- Yes I do, before I joined APC we were together in PDP.

Counsel- Quickly look at Exhibit PO 324(26), that's the voters register for your polling unit, I put it to you that it contains ticking on the left and right.

Witness- Yes my Lord.

Counsel- The tickings means that there was both accreditation and voting in your unit.

Witness- Yes sir.

COUNSEL TO PDP.

Counsel- Valentine, your attention was drawn to exhibit 325(26) and you confirm that was the voters register used in your polling unit during the election.

Witness- Yes my Lord.

Counsel- It was duly certified by INEC

Witness- Yes

Counsel- Now look at your own name ,you will discover that there was tickings on both sides

Witness- Yes but when I accredited I was aware but I don't know if my voting box was ticked.

Counsel- Look at the total number of ballot papers issued which is 977,now you will also see that used ballot papers is 529, while unused ballot papers amounted to 199. When you add the used and unused ballot papers together, what will you get?

Witness- It's 728

My question is where did 249 ballot papers disappear into?

Where did APC get this dull youth leader who flopped

Another witness from ward 7 unit 2 was left helpless when he was made to calculate yhe ballot against what was used by the presiding officer.
What was issued by the presiding officer of INEC was 903 ballot papers, while yhe ballot papers used was 911.

To the second witness:

Witness number 2 not even registered to vote or trained by INEC to act as agent.

He is at best a mercenary engaged to come and bear false witness.

Obaseki’s witness from ward 5 unit 24 of Oredo LG said he voted but when he was given the voters register from his unit, his name wasn't found in the voters register but he voted.

The Judge again ruled that all parties stick to 4 minutes.

Sitting continues

After all formal introduction from all parties ,it was the turn of the 2nd respondent to commence their defense.

The 1st witness to the respondent was ushered into the witness box , as his disposition can be found on page 875-877 of their response.

Their 1st witness is Mr. Jimoh Osagiede Justice, a businessman who resides at 49, Lagos Street, Benin city , Oredo LGA.

INEC Counsel-

Counsel- Was it after the election you were invited to your secretariat to write your findings

Witness- Yes.

Counsel- Your findings were used to file your disposition?

Witness - yes

COUNSEL TO THE 3RD RESPONDENT-

Counsel- It will be wrong to tell anybody that there was accreditation.

Witness - There was good manner of accreditation, court thrown into laughter.

Counsel- Do you have your party agent card?

Witness- Yes.

Counsel- We seek to tender his party agent card as an evidence.

INEC's counsel - No Objection

PDP Counsel- My lord , i object with all seriousness because the witness never included this as an evidence in his written disposition , it wasn't listed and not included and with respect it's irrelevant to this application, so I thereby object to the admissibility of this item as an evidence.

The judge ruled that the document be admitted as evidence.

COUNSEL TO PDP-

Counsel to PDP pleads for 10 minutes to cross examine witnesses, all respondents objects.

The First witness is Mr Jimoh Osagiede Justice a businessman who reside at no 49 Lagos street, Benin City Oredo LGA.

Obaseki's 1st witness mounts the witness box.

The Edo Governorship Tribunal seating in Benin continue today with the APC 2nd respondent open their defense today after INEC closes their defense on monday without calling in any witnesses.

Part 2 a: Rivers Polls: INEC yet to receive police report on its indicted officials

The Independent National Electoral Commission (INEC) said it was yet to receive the official report of the Police Investigative Panel on the Dec. 10, 2016 Rivers parliamentary re-run elections.

The commission’s Director of Voter Education and Publicity, Mr Oluwole Osaze-Uzzi, disclosed this on Tuesday in Abuja in an interview with the News Agency of Nigeria (NAN).

The panel’s report submitted to Police authorities on Feb. 7, indicted 23 Electoral Officers, for allegedly collecting monetary inducements to rig the elections.

Out of over N360 million said to have been received by the INEC personnel, the panel publicly displayed N111 million which it recovered from the officials who participated in the polls.

The panel had added that three senior electoral officers collected N20 million each out of the N360 million believed to have been used by the Rivers Government to influence the officials, who conducted the elections.

Osaze-Uzzi also said that he was not aware that the indicted officials had been handed over to INEC for internal disciplinary measures in line with Public Service rules.

“The commission is yet to receive any report of the police investigative panel on the alleged indicted officers.

“The commission, like every other Nigerian, only read the outcome of the investigation in the news.

“What we read was that the officers were going to be handed over to the Attorney-General of the Federation for prosecution.

“I am not aware that the alleged indicted officers have been handed over to INEC either at our Rivers office or headquarters in Abuja for disciplinary actions,’’ he said.

The director, however, reiterated the commission’s commitment to investigating and punishing any of its staff accused or found guilty of receiving gratification or other misconducts to compromise the electoral system.

He said that any INEC official whose strong cases of misconduct had been established would be sanctioned and made as deterrent to others who would want to compromise the process.

“We have different levels of administrative punishments in accordance with the rules establishing the commission for erring officers.
