Counsel to Obaseki jittery as he complained about the publishing of the result of the recounted ballot papers in various print and electronic media platforms.

But the judge in his wisdom who seems very abreast with happenings in the world of information told Olanipekun (SAN) that the panel of judges have all been following the reportage on the electronic media and stated that they were impressed he added that those in the print media are also doing same but cautioned that only proceedings within the tribunal sitting should be reported.

The judge adjourns proceedings to tomorrow February 24th 2017.

Another witness from ward 7 unit 2 was left helpless when he was made to calculate yhe ballot against what was used by the presiding officer.
What was issued by the presiding officer of INEC was 903 ballot papers, while yhe ballot papers used was 911.

After all formal introduction from all parties ,it was the turn of the 2nd respondent to commence their defense.

The 1st witness to the respondent was ushered into the witness box , as his disposition can be found on page 875-877 of their response.

Their 1st witness is Mr. Jimoh Osagiede Justice, a businessman who resides at 49, Lagos Street, Benin city , Oredo LGA.

PDP Counsel- My lord , i object with all seriousness because the witness never included this as an evidence in his written disposition , it wasn't listed and not included and with respect it's irrelevant to this application, so I thereby object to the admissibility of this item as an evidence.

The judge ruled that the document be admitted as evidence.

Part 2 a: Rivers Polls: INEC yet to receive police report on its indicted officials

The Independent National Electoral Commission (INEC) said it was yet to receive the official report of the Police Investigative Panel on the Dec. 10, 2016 Rivers parliamentary re-run elections.

The commission’s Director of Voter Education and Publicity, Mr Oluwole Osaze-Uzzi, disclosed this on Tuesday in Abuja in an interview with the News Agency of Nigeria (NAN).

The panel’s report submitted to Police authorities on Feb. 7, indicted 23 Electoral Officers, for allegedly collecting monetary inducements to rig the elections.

Out of over N360 million said to have been received by the INEC personnel, the panel publicly displayed N111 million which it recovered from the officials who participated in the polls.

The panel had added that three senior electoral officers collected N20 million each out of the N360 million believed to have been used by the Rivers Government to influence the officials, who conducted the elections.

Osaze-Uzzi also said that he was not aware that the indicted officials had been handed over to INEC for internal disciplinary measures in line with Public Service rules.

“The commission is yet to receive any report of the police investigative panel on the alleged indicted officers.

“The commission, like every other Nigerian, only read the outcome of the investigation in the news.

“What we read was that the officers were going to be handed over to the Attorney-General of the Federation for prosecution.

“I am not aware that the alleged indicted officers have been handed over to INEC either at our Rivers office or headquarters in Abuja for disciplinary actions,’’ he said.

The director, however, reiterated the commission’s commitment to investigating and punishing any of its staff accused or found guilty of receiving gratification or other misconducts to compromise the electoral system.

He said that any INEC official whose strong cases of misconduct had been established would be sanctioned and made as deterrent to others who would want to compromise the process.

“We have different levels of administrative punishments in accordance with the rules establishing the commission for erring officers.

Part 2: Rivers rerun: We have not been informed of police panel report – INEC

The Independent National Electoral Commission (INEC) said it was yet to receive the report of the Police panel that investigated activities surrounding the Dec. 10, 2016 parliamentary re-run polls in Rivers.

The panel, which was constituted by police high command submitted report to the Inspector-General of Police on Tuesday in Abuja.

The report said that N111 million was recovered from 23 INEC officials that participated in the elections.

The recovered cash was displayed during the presentation of the report at Police Headquarters,

INEC’s Director of Voter Education and Publicity, Mr Oluwole Osaze-Uzzi, told the News Agency of Nigeria (NAN) in Abuja that the commission had not been briefed on the report by anybody on it.

He said that when it would see the report and the indictment, INEC would support all processes to prosecute the people allegedly involved the alleged bribery.

Chairman of the panel, Damian Okoro, a Deputy Commissioner of Police, made the allegation while presenting the team’s report to the Inspector-General of Police, Ibrahim Idris, in Abuja on Tuesday.

He alleged that three senior election officials collected N20 million each out of the N360 million allegedly given to key officials by the state governor, Nyesom Wike.

He said the other officials received N15 million each.

According to Okoro, there are some cases of misconduct on the part of some electoral officers, who were compromised in the line of duty

Osaze-Uzzi said “we await the police report; just like everybody saw it on the media that was how we also saw it.

“As at today, they have not communicated to say this is the report.

“We know the panel has submit report to the IG, maybe, he will study it and avail us with the report if need be.”

The director said that the commission would allow the law to take its course on any of its staff members indicted in the alleged bribe.

“If any of our staff has been found culpable, we will deal with him appropriately and then allow the law to take its course.

“If they are charged to court, then normal administrative process will follow.

“If they are convicted, necessary action will be taken. If they are not convicted, we will examine if they have committed any administrative breach.

“If they have committed any administrative breach we will deal with that administratively, while the police will deal with the criminal aspect of it.”

Osaze-Uzzi said that the commission had been cooperating with the special investigative panel and the police on the matter.

“We are determined to weed out any bad egg from the system,” he said

Part 3: Police fault INEC’s report on Rivers rerun poll



The Nigeria Police has faulted the report purportedly released by the Independent National Electoral Commission (INEC) indicting the force in the commission’s findings on the irregularities that bedevilled the December 10, 2016 rerun poll in Rivers State.

A statement yesterday by the Force Public Relations Officer (FPRO), Jimoh Moshood, said the “report as quoted is a disservice to the Nigeria Police Force because all the issues raised were discovered by the Joint Investigative Panel and have been dealt with.

A security source told The Guardian that the report issued by INEC is just to douse the tension already created by the indictment of some officials of the electoral body by the panel of investigation commissioned by the Inspector General of Police after the election.


According to Moshood: “The Nigeria Police Force identified and proactively took action against six (6) police officers who were indicted by the Joint Investigation Panel (JIP) report to have compromised, engaged in serious misconduct, misuse of fire arms, and for other conducts in violation of the electoral act and other enabling laws during the Rivers rerun election.
“They were arrested, investigated and subjected to internal disciplinary measures, after being found guilty were dismissed from the Force and paraded before the media on January 6, 2017 and are awaiting prosecution. Other agencies whose personnel were also indicted by the Joint Investigation Panel are expected to do the same to their personnel indicted in the report without any further delay.

“Twenty three (23) INEC Electoral Officers and two (2) administrative officials, who were indicted by the panel were arrested, investigated and total sum of N111, 300,000 confessed to have been collected from Rivers State Governor Nyesom Wike was recovered from them. They were granted bail to the Director of Human Resources, INEC Headquarters Abuja,” Moshood said.

PDP had tendered to produce 1119 witnesses out of which they were only able to produce just 95 at the end of the day, INEC reviewed the situation and decided not to waste the tribunal's time since they have nothing to hide as the petitioner has failed in proving its case.

At the resumption of hearing on Monday, counsel for INEC, Onyinye Anumonye, however, tendered no fewer than 200 copies of the ward results (Form EC8B) for the remaining 17 local government areas, all of which were admitted in evidence and marked as exhibits.

Anumonye also sought to tender a supplement to the 2015 guidelines and regulations for the conduct of the election.

Counsel for the petitioners, Roland Otaru, objected the admissibility of the document, which he said ought to have been tendered by a witness.

But the Chairman of the three-man panel, Justice Ahmed Badamasi, admitted the evidence and marked the Certified True Copy of the document as exhibit 1R022.

INEC had used five out of the 10 days allotted to it by the tribunal to open its defence and had been expected to call its witnesses.

But its counsel said that it would amount to a waste of the tribunal’s time to call witnesses to support the case of the first respondent.

Anumonye explained that having reviewed the evidence presented thus far, it was the position of the first respondent that it had sufficiently established a defence to the petition.

“We, therefore, consider it an unnecessary waste of the tribunal’s precious time to call witnesses who would merely repeat evidence that had already been elicited under cross-examination,” he added.

The independent Electoral Commission closes its defense case at the Edo election petition tribunal without calling in any witnesses as promised last week, instead, they decided to tender documents already tendered by the petitioners.


The Edo elections tribunal sitting in Benin City has admitted in evidence copies of INEC forms EC8B and EC8C used in the 2016 Edo governorship election, for all of the eighteen local government areas in the state.

The forms were presented to the court by INEC counsel Onyinye Anumonye, without any objection by counsel to the PDP and its governorship candidate, Pastor Osagie Ize-Iyamu, Roland Otaru, SAN. The documents were labelled exhibits by chairman of the three member tribunal, Justice Ahmed Badamasi.

The documents are apparently the same documents that the petitioners in the case, People’s Democratic Party (PDP) and Pastor Osagie Ize-Iyamu (POI) submitted in their petitions.

It can be reported that many of the youth corp members approached to testify refused, claiming that they can’t lie under oath. Even the professors from Ekiti university who superintended over the flawed election also failed to come to court to testify.

The implications of this according to pundits is that INEC is unable to defend the results that they declared, which awarded victory to Mr Godwin Obaseki of the All Progressives Party (APC).

The next in line to make submission is the APC, after which the judges will consider all the documents and give their verdict.

The Petitioners have asked the Edo State Elections Petition Tribunal to declare them winner of the September 28 Gubernatorial election in Edo state because, according to facts in their petition, they scored highest number of valid votes in the election.

Senator Ali-modu Sheriff, today during his live intetview witj Seun Okinbaloye of channels tv categorically said the statement credited to him of accusing Govenor Wike and Fayose of causiny shame to PDP are not from him but from the imaginatiom of the writer.

Senator Sherriff further stressed that
"he is not interested in leading the embattled party any longer"

Senator Sheriff explained that his next plans are no longer about leading the party but helping to organise convention that will replace him.

According to him ,the victory at the court was a victory for all PDP members including those belonging to the Makarfi faction .According to him,he ll start consulting every stakeholder in the P...arty including the Governors ,National Assembly and BOT in order to organize a unified National convention of the Party...

He assured that everyone will come back to the Party as one unified Party.According to him ,by the court verdict,there were no victors or losers...Mr Sheriff said the party is tired of losing elections .He stated that all the State Congresses held prior to the Port Harcourt convention stands ..He stated that the State Executives remain as it were.

According to him,he has started reconciliatory moves ,as at this morning he has spoken to the chairman of the reconciliatory committee,Governor Seriake Dickson and the Deputy Senator Ibrahim Mantu as well as the BOT Chairman of PDP in a move to reconcile all aggrieved members as soon as possible..He said ,a successful reconciled National Convention that will be acceptable to all will be held soon..

A timetable for that will be released soon immediately all consultation is concluded ....He said the team will take over the Party headquarters at Wadata House next week once he gets the court papers.
