Can over voting be determined by comparing
the voters register with the entries in form

yes he agrees.

Did you see the endorsements on the voters
register before your deposition was written.
The witness answered that in paragraph 18
of his deposition, the information that
formed his statement was gotten from his
polling unit agents

in Owan East LGA. He is to be cross
examined with exhibit PO 97(1-17).

Counsel to the petitioner asked the witness if
before his deposition he had seen the Voters
register from his ward, he replied No my
Lord.

FOrbih (SAN), again asked do you agree
with me that before you can determine over
Voting you must have seen the voters
register, i repeat do you need the voters
register to determine over voting, he said No.

He was also given exhibit PO 299 (6,5 & 10)
to identify if they were the voters register
used in your ward which he supervised, he
confirmed, yes my Lord

Confusion sets in for the 2nd respondent
(Obaseki) as they just withdrew their 2nd
Witness for today, we need to present our most
important witnesses, O. Oyeyepo (SAN)

After the usual introduction by counsel to all
parties, the 2nd respondent (Obaseki) who

commenced the defence of their case with The calling of their first deponent into the
witness box Mr. Igbinijesu Cookey Nosa
(2RW66), a businessman from Ward 9 in
Egor LGA were he functioned as the ward
collation agent. He is to be cross examined with exhibit PO 23(1-19).

During cross examination, after he was
showed Exhibit PO 21 (1,9,10,11& 16) by F
Orbih (SAN) to confirm the documents,
counsel to the 2nd respondent objected this
move on the grounds that the said witness
didn't handle Form EC8A but EC8B which he
signed as a ward collation officer.

Responding, Chief F. Orbih (SAN) told the
court that this I issue shouldn't dragged by A.
Oyeyepo counsel to the 2nd respondent but
that on the 7th of February 2017, your
lordship earlier ruled in favour of the
petitioner concerning this issue, he referred
the judge to paragraph 15 were the witness
deposited that there was over voting in his
Ward so going by his statement, he needs to
test the veracity the deponent's claims.

He also added that in his paragraph 10 he
also stated in his deposition that he received
all Polling unit results from his PU agent, so
my lordship I in order not to shutout justice,
may I be allowed to continue with my cross
examination F, Orbih asserted.

Counsel to INEC Mr. Anumwonye Onyinye
objected to the cross examination by the
petitioner on the grounds that he wasn't the
maker of the said document.

Chief F. Orbih (SAN) cited section 215(2) of
the evidence act, which he said doesn't
support the submission and contentions fie
the 1st and 3rd respondents having regards
to the evidence the witness has earlier sworn
to. He also argued that if the 1st respondent
is saying that because the witness isn't the
maker of the document he shouldn't be cross
examined then that particular section of his
statement should be expunged from his
deposition since he isn't the maker.

O. Oyeyepo (SAN) prayed the court not to
allow counsel to the petitioner go on with
asking his witness questions concerning the
above subject matter because it lacks
competence.

This argument has lingered for over 2 hour
and 15 minutes, but in a short ruling, Justice Ahmed Badamosi upheld the objections of the 2nd respondent.

Obaseki the 2nd Respodent is expected to close his case today after seeking for adjournment last week wednesday.

I guess the following indicate they were having dinner with the opposition back then:

1. Governors Forum Crises (2013):

A lot of political pundits insist this marked the beginning of Jonathan downfall, forget his crass incompetence.

In a simple election involving 35 participants and two contestants, Jonathan's interference saw to it that this more or less political pressure group was fractured beyond redemption resulting in the formation of the PDP Governors Forum chaired by his stooge Godswill Akpabio and another faction of the forum chaired by his preferred candidate who lost in the contest, Jonah Jang.

The election whose video went rival at that time due to its outcome saw Amaechi pulling 19 votes while Jonah Jang pulled 16. Democrat Jonathan insisted Jang won the election and recognised him as the Chairman of the forum giving rise to the much publicised PDP arithmetics where 16 is greater than 19.

This set the precedence for the scenarios that played out in Rivers and Ekiti Houses of Assembly while our "Hero" stood idly by, giving a tacit nod to the obvious anomalies as state police were used to suppress the opposition.

2. APC National Leader Harassed by the Military:

During the heat of the campaigns, keeping faith with their doctrine of hounding and intimidating opposition figures, Bola Tinubu had his house placed under surveillance by the military when he wasn't indicted for any federal offence. The national leader responded to this in a manner that set social media on fire, placing a banner in front of his house that seemingly pointed the military where they should be looking- Sambisa.

4. APC Office Raided:

This was another very dark day in our democratic experience and marked an upsurge in the use of state security agents to harass and gag the opposition. Under the guise of carrying out an investigation, offices of the opposition were raided with computers and other instruments confiscated and destroyed. It was one of the lowest points of the DSS and somewhat signalled its complete evolution into an arm of the PDP.

The DSS at a press conference displayed items "discovered" at the office during the raid and they were computers, hard drives and other electronic accessories- hell it was a data centre!! Were they expecting to find chopsticks and stoves

5. Buhari's Plane Barred from Landing:

Another shameful incident where a plane conveying opposition bigwigs (then), including her flag bearer, on a campaign trail was refused landing rights in Makurdi and they had to return to Abuja. My question is, what if there wasn't sufficient fuel to take them back to Abuja as they made the u-turn mid-air?? Your guess is as good as mine.

6. Protesters and Senator Shot in Rivers:

Another gut wrenching incident that demonstrated the partisan nature of our security apparatus under ex president Jonathan. In a continuation of the government's crackdown on the opposition, citizens who were on a peaceful protest in Rivers state were shot at with live and rubber bullets and a Senator was hit twice in the chest. Thankfully, he
survived and a serious crises was averted.

7. APC Women Protesters Teargassed:

This was another horrid incident that demonstrated the ex president's disdain for opposition and civil liberties.

8. Jonathan Orders Withdrawal of Speaker's Security Detail:

Arguably the most vicious assault on our democracy by the ex president. This much publicised incident that needs no introduction earned the ex president (and deservedly so) local and international disrepute and condemnation. People had started to see him as the worst civilian dictator in the country's history.
If you ask me, this incident drove the last nail into the coffin of Jonathan's 2015 ambition.

Tribunal Adjourned till Monday for the 2nd Respondent (Obaseki) to close their defense.

Owonikoko (SAN) counsel to the 2nd respondent told the judge that they are opting for an adjournment, we have called 65 witnesses so far and we need to reappraise the level of our defence till Monday.

We don't want to be working and calling witnesses without focus. We need to put our house in order,

My lord it's important for us to appraise ourselves and in order to know where we are going. In the light of the above, we want to move for an adjournment to Monday, the 6th of March 2017.

We are willing to forfeit two and half days of the 10 days given to us by the Tribunal. After no objection from the petitioners and 1st and 3rd respondents counsels, the Judge adjourned siting to Monday, the 6th of March and also admonished the 3rd respondent to endeavour to open its case on Tuesday.

Here is a twist to the 2nd Respondent (Obaseki) Defense.

The 3rd witness (2RW65) Hon. Ifedayo Esheshi, a businessman from Okpella , Etsako East, he is cross examined with exhibit PO 51-59, PO 4(46).

Adelodu - In paragraph 6 of your desposition you said accreditation and voting took place at your polling unit.

Witness - Yes.

Adelodu- Which came 1st accreditation or Voting?

Witness- Accreditation came first followed by voting.

Adelodu - Show the witness exhibit PO 264(2,3,4,6,7) tell this honourable court if there are no tickings to the left of the document.

Witness - There are tickings but I don't know whether its to the left or right , I need to be educated.

The witness was then discharged by the judge.

The 2nd witness (2RW64), Comrade Ogun John Oleghe , a public servant from Agenebode in Etsako East LGA, he is been cross examined with exhibit PO 4(40), PO 45(1-9), PO 259(1-.

When asked if he knows the meaning of over voting ,he said No.

On what document was the accreditation done in your polling unit, A. Adelodu [SAN] asked.

Witness - The voters register was used.

Adelodu - Please give the witness exhibit PO 259(1)and confirm that those are the voters register used in units 1& 6?

Witness- I don't know, I didn't vote in unit 6, but you were the ward collation of your party the counsel asked.

The 1st witness (2RW63) for today is Mr. Mike Awahigheme from Agenebode in Etsako East LGA, he is to be cross examined with exhibit PO 46(1), PO 46 (6), PO 4(42).

During cross examination by counsel to INEC, the witness informed the tribunal that the election was very free and fair , he also added that he was never in possession of the voters register and results during the election.

Senior counsel to the petitioner, Mallam Yesuf Ali (SAN) introduced A.Adelodu (SAN) to handle cross examination on behalf of the PDP.
A. Adelodu (SAN) started by asking the witness to confirm using exhibit PO 260(1-7) was used in your ward?

In his usual Interjection, Ken Mozia (SAN) objected the question saying that the question was immaterial to the Cross examination

But responding Adelodu (SAN) refreshed the mind of the judge back to the 7th day of February 2017 were he ruled in favour of this issue being debated, that the evidence which is already in court can be identified by the witness.

He was asked again and his reply was that he doesn't know, I haven't seen that document he added.

Adelodu (SAN) told the witness to look at exhibit PO 206(6) and confirm if there are any tickings to either side of that document?

This question was again objected by Ken Mozia (SAN) counsel to the 2nd respondent, upon the premise that the witness can be used to interpret the document in favour of the petitioner.

However, counsel to the petitioner, A.Adelodu (SAN) told the court that since the witness had earlier said there was accreditation and no over voting, he should be allowed to cross examine him in order ascertain if there was anything contrary to his claims.

This move was objected by counsel to the 2nd respondent Ken Mozia (SAN), but in short ruling, the judge instructed A.Adelodu to continue with the cross examination of the witness in view of paragraph 15 of his deposition.

Adelodu - Is there any tickings to the left or right of that document?

Witness- I don't know if its to the left or right but there are tickings on the photographs.

Adelodu - Please confirm on same page 2 the same question on that document.

Witness- There are tickings but I don't know if there are tickings to the left or right but on the voters register.

We are back again for the 4th day of the edo governorship election petition tribunal.

So far the 2 respondent (Obaseki) had called several witnesses to testimony but this has left much yo be desired going by the sceneroes observed from the crossed-examination of the witnesses so far.

Be that as it may today is another day.

The Judge adjourns sitting till tomorrow, Thursday 02/03/2017.

The 12th witness (2RW62) Mr. Felix Orobosa John ,a teacher with a private school from Ebelle in Igueben LGA just mounted the box, he is been cross examined with exhibit PO 4(31), PO 216(5).

During cross examination by Chief Ferdinand Orbih (SAN) it was again discovered that the witness doesn't know what the boxes on the voters register stands for.

Orbih - Show him exhibit PO 216(5),now confirm that in the voters register ,there are no tickings to the left.

Witness- Only to the left.

The 11th witness (2RW61) Mr. Edughase Emmanuel from Ebelle in Igueben LGA, he is been cross examined with exhibit PO 222(4), PO 216.

During his cross examination by the 3rd respondent, the witness was asked if he knew the PDP ward collation officer (PW46) he answered, No.

But when Chief F.Orbih asked him that same question, he told the court he knows (PW46) PDP ward collation officer for his ward.

Orbih - Now over voting is when the number of votes returned is higher than the accredited voters on the voters register, do you agree?

Witness- Yes my Lord.

Orbih- Are you aware that in exhibit PO 222(4) there are no tickings to the left and right on the voters register, am I correct?

Witness - You are correct.

Orbih - Are there tickings?

Witness - Yes there are tickings.

The 10th witness (2RW60) , Mr. Ugbehu Osarumwense is from Ebelle in Igueben LGA. He is to be cross examined with exhibit PO 40(5), PO 221(5).

This particular witness kept on contradicting himself, at one time he said the tickings to the left in the voters register doesn't signify accreditation, later he said yes, it does.

The 9th witness (2RW59) , Mr. Igbinedion Clifford is a businessman from Igueben LGA. He is to be cross examined with exhibit PO 4(27), PO 41(1), PO 222(2).

Chief Ferdinand Orbih (SAN) just introduced the petitioner's lead counsel Mallam Yesuf Ali (SAN) and his colleague A. Adelodu (SAN) who walked into the tribunal.

During cross examination by the counsel to the petitioner it was discovered that there wasn't accreditation in his polling unit, as confirmed in exhibit PO 222(2).

It was also discovered that the witness doesn't know what the boxes on the left and right of the voters register stands for ,because he isn't an INEC staff.

The 8th witness (2RW58) Mr. Paul .A. Alazi , a student from Ekperi ,Etsako Central LGA, he is to cross examined with exhibit PO 308(, PO 308(7).

During cross examination, the witness agreed with counsel to INEC that he voted and there was accreditation in his polling unit through the voters register and also added that he isn't aware his name was ticked when asked by counsel to the 3rd respondent.

Chief Ferdinand Orbih (SAN) told the witness to be given exhibit PO 254(, item 79, please confirm you are item 79?, are you the one there?

Witness- No my Lord.

Orbih- I put it to you that your name isn't on the voters register.

Witness- After looking for his name on the voters register for over 10 minutes, he said my name is on item 38, page 4.

Orbih- Please read out the name there.

Witness - Adolphus Apeahiokhai Paul

The name on the voters register is different from the name of the witness standing inside the witness box.

Orbih- No voter was ticked the left of that voters.

Witness - No tickings to the left my lord.

That means there was no accreditation in his polling unit.
