The 1st witness (2RW63) for today is Mr. Mike Awahigheme from Agenebode in Etsako East LGA, he is to be cross examined with exhibit PO 46(1), PO 46 (6), PO 4(42).

During cross examination by counsel to INEC, the witness informed the tribunal that the election was very free and fair , he also added that he was never in possession of the voters register and results during the election.

Senior counsel to the petitioner, Mallam Yesuf Ali (SAN) introduced A.Adelodu (SAN) to handle cross examination on behalf of the PDP.
A. Adelodu (SAN) started by asking the witness to confirm using exhibit PO 260(1-7) was used in your ward?

In his usual Interjection, Ken Mozia (SAN) objected the question saying that the question was immaterial to the Cross examination

But responding Adelodu (SAN) refreshed the mind of the judge back to the 7th day of February 2017 were he ruled in favour of this issue being debated, that the evidence which is already in court can be identified by the witness.

He was asked again and his reply was that he doesn't know, I haven't seen that document he added.

Adelodu (SAN) told the witness to look at exhibit PO 206(6) and confirm if there are any tickings to either side of that document?

This question was again objected by Ken Mozia (SAN) counsel to the 2nd respondent, upon the premise that the witness can be used to interpret the document in favour of the petitioner.

However, counsel to the petitioner, A.Adelodu (SAN) told the court that since the witness had earlier said there was accreditation and no over voting, he should be allowed to cross examine him in order ascertain if there was anything contrary to his claims.

This move was objected by counsel to the 2nd respondent Ken Mozia (SAN), but in short ruling, the judge instructed A.Adelodu to continue with the cross examination of the witness in view of paragraph 15 of his deposition.

Adelodu - Is there any tickings to the left or right of that document?

Witness- I don't know if its to the left or right but there are tickings on the photographs.

Adelodu - Please confirm on same page 2 the same question on that document.

Witness- There are tickings but I don't know if there are tickings to the left or right but on the voters register.

We are back again for the 4th day of the edo governorship election petition tribunal.

So far the 2 respondent (Obaseki) had called several witnesses to testimony but this has left much yo be desired going by the sceneroes observed from the crossed-examination of the witnesses so far.

Be that as it may today is another day.

The 12th witness (2RW62) Mr. Felix Orobosa John ,a teacher with a private school from Ebelle in Igueben LGA just mounted the box, he is been cross examined with exhibit PO 4(31), PO 216(5).

During cross examination by Chief Ferdinand Orbih (SAN) it was again discovered that the witness doesn't know what the boxes on the voters register stands for.

Orbih - Show him exhibit PO 216(5),now confirm that in the voters register ,there are no tickings to the left.

Witness- Only to the left.

The 11th witness (2RW61) Mr. Edughase Emmanuel from Ebelle in Igueben LGA, he is been cross examined with exhibit PO 222(4), PO 216.

During his cross examination by the 3rd respondent, the witness was asked if he knew the PDP ward collation officer (PW46) he answered, No.

But when Chief F.Orbih asked him that same question, he told the court he knows (PW46) PDP ward collation officer for his ward.

Orbih - Now over voting is when the number of votes returned is higher than the accredited voters on the voters register, do you agree?

Witness- Yes my Lord.

Orbih- Are you aware that in exhibit PO 222(4) there are no tickings to the left and right on the voters register, am I correct?

Witness - You are correct.

Orbih - Are there tickings?

Witness - Yes there are tickings.

The 10th witness (2RW60) , Mr. Ugbehu Osarumwense is from Ebelle in Igueben LGA. He is to be cross examined with exhibit PO 40(5), PO 221(5).

This particular witness kept on contradicting himself, at one time he said the tickings to the left in the voters register doesn't signify accreditation, later he said yes, it does.

The 9th witness (2RW59) , Mr. Igbinedion Clifford is a businessman from Igueben LGA. He is to be cross examined with exhibit PO 4(27), PO 41(1), PO 222(2).

Chief Ferdinand Orbih (SAN) just introduced the petitioner's lead counsel Mallam Yesuf Ali (SAN) and his colleague A. Adelodu (SAN) who walked into the tribunal.

During cross examination by the counsel to the petitioner it was discovered that there wasn't accreditation in his polling unit, as confirmed in exhibit PO 222(2).

It was also discovered that the witness doesn't know what the boxes on the left and right of the voters register stands for ,because he isn't an INEC staff.

The 8th witness (2RW58) Mr. Paul .A. Alazi , a student from Ekperi ,Etsako Central LGA, he is to cross examined with exhibit PO 308(cool, PO 308(7).

During cross examination, the witness agreed with counsel to INEC that he voted and there was accreditation in his polling unit through the voters register and also added that he isn't aware his name was ticked when asked by counsel to the 3rd respondent.

Chief Ferdinand Orbih (SAN) told the witness to be given exhibit PO 254(cool, item 79, please confirm you are item 79?, are you the one there?

Witness- No my Lord.

Orbih- I put it to you that your name isn't on the voters register.

Witness- After looking for his name on the voters register for over 10 minutes, he said my name is on item 38, page 4.

Orbih- Please read out the name there.

Witness - Adolphus Apeahiokhai Paul

The name on the voters register is different from the name of the witness standing inside the witness box.

Orbih- No voter was ticked the left of that voters.

Witness - No tickings to the left my lord.

That means there was no accreditation in his polling unit.

The 7th witness (2RW57), Mr. Emmanuel Macaulay , a businessman from Akoko-Edo LGA, was cross examined with exhibit PO 9(1-16), PO 202(1-16), PO 4(5).

Counsel to PDP asked the witness if he was trained with the INEC register and he answered, No.

When he was asked if it will be right to say that because he wasn't trained, he don't know what the tickings to the left and right stands for, his response was Let me see the voters register.

Chief Ferdinand Orbih (SAN) to the witness "I put it to you that in exhibit PO 200(1), there was no tickings to the left hand side of that voters register corresponding with the tickings to the right, please take your time and go through the entire document"

After the witness had checked the said document for over 28 minutes he couldn't find any tickings to the left.

Witness- I don't know but there are 3.

Counsel - Do you know the functions of each of the 3 INEC official?

Counsel- Do you maintain that the PDP polling unit agent in your unit signed the pink result? Look at exhibit PO 14(2) Is there any PDP signature there? Is it signed?

Witness- He said Yes whereas ,there wasn't any signature.

The 5th witness (2RW55), Mrs. Justina Joseph, a trader from Ologboto in Akoko-Edo LGA, was cross examined with exhibit PO 13(6).

In her polling unit also it was discovered that there was no accreditation because there are no tickings to the left when exhibit PO 204(6) (Voters Register) was checked by her.

Counsel to PDP- So without accreditation voting can't be possible.

Witness- Yes sir ,without accreditation how can a voter vote.

The 4th witness (2RW54), Mr. Aruku Morris an applicant from Akoko-Edo LGA, was cross examined with exhibit PO 11(15).

The witness told the tribunal that he observed that INEC officials were ticking the voters register and that there was proper accreditation and no case of over voting in his Polling unit.

Counsel to PDP- Is accreditation compulsory?

Witness- Yes.

Show him exhibit PO 202(15), serial number 415, that is your name ,is there ticking to the left and right?

Witness- Yes.

Counsel to PDP- Look at serial number 165 ,page 12 in exhibit PO 202 ,can you see that unlike your own there are no tickings to the left?

Witness- No.

The 3rd witness (2RW53), Mr. Enoch Bishop ,a farmer from Ososo in Akoko-Edo LGA, was cross examined with exhibit PO 4(9), PO 14(1-13), PO 205(1-15).

During cross examination he established that there was proper accreditation was carried out.

Roland Otaru (SAN) takes over cross examination for the petitioner.

Counsel to PDP asked the witness if voter can vote without accreditation? The witness answered, Yes all voter was accredited.

Counsel to PDP, asked again so accreditation is compulsory for all voters? He replied Yes.

But when told to look at exhibit PO 205(9), it was discovered that there were no tickings to the left hand side of the voters register.

Thereafter, Kemi Penheiro (SAN) again asked the witness if he agrees that it's only the voters register that can be used for accreditation, he answered, Yes.

The 2nd witness (2RW52), Mr. Amos Tom Udughele from Ososo in Akoko-Edo LGA, was cross examined with exhibit PO 12(2), PO 309(1), PO 203(2).

This witness confirmed that there was accreditation in his polling unit, through the vetting of the voters register in the course of his cross examination.

kick starting deliberations Ken Mozia (SAN) led the 1st witness, Jolly Sunday Joseph, a businessman who resides at 78, Central Quarters Akoko-Edo LGA into evidence.

He is to be cross examined with exhibit PO 4(5), PO 9(1-16), PO 200(1-16).

During his cross examination by counsel to the 1st and 2nd respondents respectively, the witness told the court the election conducted in his polling unit was devoid of any electoral irregularities, free and fair with proper accreditation in strict accordance with INEC's guidelines.


When it was time for counsel to the petitioner Kemi Pinheiro (SAN) to cross examine the witness


Counsel to PDP- Your party trained you on what the presiding officer is suppose to do on the day of election.


Witness- Yes.


Counsel - Did your party train you about tickings on the voters register?

Witness- No my Lord.


Counsel - Witness look at exhibit PO 200(1), page 2, beside each photograph there are boxes on the left, do you know what they stand for?

Witness- No.


Counsel- Look at the boxes on the right under the box "GHA", do you know what it stands for?

Witness - No.


Counsel - Again look at that same page 2 and confirm if there are any tickings to the Left of the boxes?

Witness- No my Lord.


Counsel- Go to page 9 of exhibit PO 200(1), confirm that there are no tickings to the box on the Left.

We are back again for the continuation of the 2nd Respondent (Obaseki) as his witnesses are crossed-examinied by the various counsels aás regarding their dispositions concerning the last year edo state governorship election in which INEC declared Godwin Obaseki of the APC winner.

Not satisfied with the result Pastor Ize-Iyamu approached the tribunal for the reversal of that declaration.

The 7th witness (2RW47), Mr. Ebhos Michael from Ogwa in Esan west L is a farmer and was crossexamined with exhibit PO 174(cool.

Under cross examination of this witness, it was also discovered that in exhibit PO 174, there were tickings on the right on a box tagged "GHA" Also confirm that there are no tickings to the left, No tickings.

The counsel referred him to look at the right side of pages 16 & 36 same thing on pages 8 & 36, are there tickings to the right ? The witness replied Yes.

Kemi Penheiro (SAN) suggested to the witness that the entire PO 173 (Voters register), there are no tickings to the left of that document, after he was allowed to go through the document for close to 20 minutes he said ,there are no tickings at all.

Clearly, there was no accreditation in that unit.

At the resumption from break.

The 6th witness (2RW46) ,Mr. Austin Omoriagho , just mounted the witness box for the 2nd respondent. He is a businessman from Esan West LGA, to be cross examined with exhibit PO 174(1), PO 345(1).

During cross examination by Kemi Pinheiro (SAN) counsel to the petitioner, it was discovered that on exhibit PO 345(1), page 36, item 548 which is the vote register, that on the right there was tickings inside the box called "GHA" while the tickings on the left was done on the photographs.

When told to look at exhibit 391(INEC manual for the 2016 election) he was asked if he saw this document during training, his response was No.

Finally, the witness wrote in his desposition that he is a businessman but on his particulars in the voters register it was stated there that he is a civil servant, when confronted with his contradicting statement ,he said he left service 2 years ago.

The 4th witness (2RW44) Mrs. Felicia Amadin , a businesswoman from Orihonmwon LGA, she is to be cross examined with exhibit PO 185(10) PO 356(10).

Kemi Penheiro (SAN) counsel to the petitioner commenced his cross examination by asking the witness if she assisted INEC tick the voters register,

she answered, No.

The counsel to the petitioner asked the registrar to show exhibit 356(10) to the witness ,he added you voted as item 105 in the voters register, are there two tickings there? Her response was that she left her eye glasses at home so she can't see.

Kemi Penheiro (SAN) again asked the witness to look at items 357 and 535, are there tickings on the left and right?

Responding the witness shouted is it, because am a woman that's why you are pressing me? This threw the court into great laughter!

The 3rd witness (2RW43) Mr. Monday Ofure from Orihonmwon LGA, a businessman and he will be cross examined with exhibit PO 417(4) PO 185(1- 12) and PO 350(2-5).

During cross examination by counsel to the 1st and 3rd respondent, the witness told the court that accreditation was adequately carried out in his polling unit.

But when it was time for counsel to the petitioner Kemi Penheiro (SAN) ,he asked the witness that the procedure in paragraph 11 of your desposition was derived from your training by INEC?,

Witness answered, No!

He asked again, I suggest to you that the procedure stated here in your desposition is not complete going by the guidelines of INEC, Yes or No?

Witness- I wasn't trained by INEC, so I don't know.

Counsel to PDP- Give the witness exhibit PO 350(2) which was the voters register used in your polling unit, I suggest to you that there wasn't any accreditation in your polling unit at all!

Witness- There was.

Counsel to PDP asked the witness to look at page 3, 20, 38 and 45 of the voters register, are there any tickings to the left?

Witness- No ticking sir ,not at all.

The 2nd witness for today (2RW42) Mr. Amegor Osariemen, resides at the Enogie's Palace Uwelu, Egor LGA, a businessman and he will be cross examined with exhibit PO 19(1-12) PO 210(1) and PO 4(14).


Again ,during cross examination of the witness by Kemi Penheiro (SAN), the witness was asked if he was in custody of the voters register before ,during and after the election, he answered Yes!

Thereafter, he was asked by Kemi Penheiro (SAN), do you still stand by your deposition, could you assist the court to explain the meaning of "Figment of his imagination", do you know the meaning? , responding the witness told the court that it was one of the lawyer who used that grammar not him.

While leading the witness into evidence, Ken Mozia (SAN) pleaded to change Oredo LGA to Egor LGA in the witness desposition, this was vehemently objected by Kemi Penheiro (SAN) counsel to the petitioner (PDP), but in a short ruling the judge granted the amendment in favour of the 2nd respondent.

The witness during cross examination by Kemi Penheiro (SAN) claimed that he wasn't trained by INEC but by his party, when asked if his party trained him on how tickings on the voters register are carried out, he said No!

The 10th subpoenaed witness by the 2nd respondent ,Mr. Hamington Osa functioned as a ward collation officer for APC, he is a politician who resides at 10 Market road, Ehor, Uhunmwonde LGA was cross examined with exhibit PO 16(5), PO 33(5)

Through out his cross examination by K.K Eleja (SAN) ,he was busy checking documents labelled exhibit PO 335(1-10) for form EC8A and PO 165(1-10) for voters register for over 25 minutes, in a bid to waste the petitioner's time not knowing he was harming himself and his legal team, it took the intervention of his counsel who seem frustrated to come to his aid

The witness was asked by K.K Eleja (SAN) if he was trained, he said Yes.
