The 2nd witness Mr Charles Otasowie Adenomo (3RWO2) , ward 6 collation agent, a farmer from Ikpoba Okha LGA. When Counsel to the petitioner Kemi Penheiro (SAN) asked whether he was trained by his Party with INEC manual 2016 he answered, ,No. So because you weren't trained with the INEC manual 2016, its clear that you don't know what Over voting means? The witness said I don't know. Asked if it will be correct to say that because you didn't visit other polling units in your ward, can you tell if you saw proper accreditation. his reply was that l don't know because l didn't visit other units other than my own unit, so l can't tell. |
Kemi - You agree accreditation is a must before voting? Witness- Yes sir. Kemi - Do you also agree that if accreditation isn't done, the election in that polling unit will be invalidated and deeclared void? Witness - Yes sir. When he was asked by P Penheiro .(SAN) to confirm that his name was ticked during accreditation by the INEC official, he answered yes he did tick. Penheiro (SAN) asked the witness to be showed exhibit PO 318(13). item 23, page 3, that is your name, please confirm how many tickings are besides it, his replied was, I don't know. |
The 3rd respondent (APC) commenced their defence today after the usual ritual of introducing counsel to all parties present in court. The 1st witness was ushered into the witness box by counsel to the 3rd respondent S.L Akintola, Mr Charles Otasowie Adenomo (3RWO01), ward 6 collation agent, a businessman who resides at 72 Uwa street_Benin City, ikpoba Okha LGA. During cross examination by counsel to both the 1st and 2nd respondents, the witness told the court that there was proper accreditation and the voting process went Wel But when it as the turn of the Counsel to the petitioner Kemi Penheiro (SAN) to cross examine the witness the story changed, When asked to confirm to the tribunal that all APC agents were not trained with the INEC manual 2016. he answered, we weren't trained at all, Asked if it will be correct to say that both you and all others trained by your party do not know anything about voting process and accreditation. His reply was that i dont know. |

The 5th witness (2RW70) is Mr. Adams Ozimede Andrew, a teacher from Uzairue in Etsako West LGA, he functioned as the ward collation agent for ward 10, to be cross examined with exhibits PO 4(60) and PO 64(1-16). During the cross examination by F. Orbih (SAN) , the witness was asked I accreditation is done using the voters register, Do you agree he went further and the witness answer was "I don't know" Counsel to the petitioner to the witness, have you ever seen the witness deposition? No, the witness answered. Have you seen the endorsements of the voters register for your units in your ward at anytime before today? ,the witness answered "No". Do you agree that there can be cases of over voting from the voters register? The witness said he disagrees because he is not INEC. Orbih - Show him exhibits PO 235(1,2,3) of the voters register from his unit were he voted, are those the voters register? He said " I don't know" You voted in unit 3, so check if there are tickings to the left? The witness said "I can see tickings but I can't tell where it is". The witness is then discharged. |

Can over voting be determined by comparing the voters register with the entries in form ECBA, F Orbih (SAN) asked. The witness said yes he agrees. Did you see the endorsements on the voters register before your deposition was written. The witness answered that in paragraph 18 of his deposition, the information that formed his statement was gotten from his polling unit agents |
The 2nd witness (2RW67) after the replacement mounted he witness box. He is Mr. kheafe lghodaro Dennis, from Otuo in Owan East LGA. He is to be cross examined with exhibit PO 97(1-17). Counsel to the petitioner asked the witness if before his deposition he had seen the Voters register from his ward, he replied No my Lord. FOrbih (SAN), again asked do you agree with me that before you can determine over Voting you must have seen the voters register, i repeat do you need the voters register to determine over voting, he said No. He was also given exhibit PO 299 (6,5 & 10) to identify if they were the voters register used in your ward which he supervised, he confirmed, yes my Lord |

After the usual introduction by counsel to all parties, the 2nd respondent (Obaseki) who 8W be closing their defence today, commenced the defence of their case with The calling of their first deponent into the witness box Mr. Igbinijesu Cookey Nosa (2RW66), a businessman from Ward 9 in Egor LGA were he functioned as the ward collation agent. He is to be cross examined with exhibit PO 23(1-19). During cross examination, after he was showed Exhibit PO 21 (1,9,10,11& 16) by F Orbih (SAN) to confirm the documents, counsel to the 2nd respondent objected this move on the grounds that the said witness didn't handle Form EC8A but EC8B which he signed as a ward collation officer. Responding, Chief F. Orbih (SAN) told the court that this I issue shouldn't dragged by A. Oyeyepo counsel to the 2nd respondent but that on the 7th of February 2017, your lordship earlier ruled in favour of the petitioner concerning this issue, he referred the judge to paragraph 15 were the witness deposited that there was over voting in his Ward so going by his statement, he needs to test the veracity the deponent's claims. He also added that in his paragraph 10 he also stated in his deposition that he received all Polling unit results from his PU agent, so my lordship I in order not to shutout justice, may I be allowed to continue with my cross examination F, Orbih asserted. Counsel to INEC Mr. Anumwonye Onyinye objected to the cross examination by the petitioner on the grounds that he wasn't the maker of the said document. Chief F. Orbih (SAN) cited section 215(2) of the evidence act, which he said doesn't support the submission and contentions fie the 1st and 3rd respondents having regards to the evidence the witness has earlier sworn to. He also argued that if the 1st respondent is saying that because the witness isn't the maker of the document he shouldn't be cross examined then that particular section of his statement should be expunged from his deposition since he isn't the maker. O. Oyeyepo (SAN) prayed the court not to allow counsel to the petitioner go on with asking his witness questions concerning the above subject matter because it lacks competence. This argument has lingered for over 2 hour and 15 minutes, but in a short ruling, Justice Ahmed Badamosi upheld the objections of the 2nd respondent. |

Owonikoko (SAN) counsel to the 2nd respondent told the judge that they are opting for an adjournment, we have called 65 witnesses so far and we need to reappraise the level of our defence till Monday. We don't want to be working and calling witnesses without focus. We need to put our house in order, My lord it's important for us to appraise ourselves and in order to know where we are going. In the light of the above, we want to move for an adjournment to Monday, the 6th of March 2017. We are willing to forfeit two and half days of the 10 days given to us by the Tribunal. After no objection from the petitioners and 1st and 3rd respondents counsels, the Judge adjourned siting to Monday, the 6th of March and also admonished the 3rd respondent to endeavour to open its case on Tuesday. |

The 3rd witness (2RW65) Hon. Ifedayo Esheshi, a businessman from Okpella , Etsako East, he is cross examined with exhibit PO 51-59, PO 4(46). Adelodu - In paragraph 6 of your desposition you said accreditation and voting took place at your polling unit. Witness - Yes. Adelodu- Which came 1st accreditation or Voting? Witness- Accreditation came first followed by voting. Adelodu - Show the witness exhibit PO 264(2,3,4,6,7) tell this honourable court if there are no tickings to the left of the document. Witness - There are tickings but I don't know whether its to the left or right , I need to be educated. The witness was then discharged by the judge. |
The 2nd witness (2RW64), Comrade Ogun John Oleghe , a public servant from Agenebode in Etsako East LGA, he is been cross examined with exhibit PO 4(40), PO 45(1-9), PO 259(1- .When asked if he knows the meaning of over voting ,he said No. On what document was the accreditation done in your polling unit, A. Adelodu [SAN] asked. Witness - The voters register was used. Adelodu - Please give the witness exhibit PO 259(1)and confirm that those are the voters register used in units 1& 6? Witness- I don't know, I didn't vote in unit 6, but you were the ward collation of your party the counsel asked. |
