#OndoAppealUpdates The president of the Court of Appeal, Zainab Bulkachuwa, on Wednesday raised a new panel to hear all the appeals emanating from the leadership crisis in the Ondo State chapter of the Peoples Democratic Party, PDP. The PDP was plunged into a fresh crisis after the Independent National Electoral Commission accepted Jimoh Ibrahim as the candidate of the party in the upcoming gubernatorial election in the state. The decision effectively replaced Eyitayo Jegede as the party’s candidate. INEC’s decision followed the ruling of Okon Abang of the Abuja Division of the Federal High Court, which endorsed the Ali Modu Sheriff faction of the party. Mr. Ibrahim belongs to Sheriff-led faction of the party. The decision was immediately challenged by the faction led by Ahmed Makarfi, whose candidate is Mr. Jegede. The losing faction appealed the decision of Mr. Abang and the matter was slated for hearing at the Court of Appeal on Tuesday. But the proceeding stalled after members of the panel recused themselves from the matter following allegations of bribery against them. A petitioner, Biyi Poroye, accused the head of the panel, Jummai Sankey, of taking a N350 million bribe from Governor Segun Mimiko, who belongs to Mr. Makarfi’s faction. In a letter with reference number PCA/Abuja/VII/2016, Justice Bulkachuwa named Justice Ibrahim Saulawa as chairman of the new panel. The panel also has Justices Ignatius Agube and Godwin Mbaba as members. A statement by the court’s spokesperson, Saadatu Musa, said the panel will handle appeals by the PDP and Benson Akingboye and two others. The panel will also handle appeals by Diri Adony, INEC and two others, Mr. Poroye and 10 others and the appeal by Clement Faboyede. “You are hereby empanelled to sit and determine the above appeals in Abuja Division expeditiously. Fixation of dates to be worked out with the presiding Justice of the Abuja Division,” Mrs. Musa quoted Mrs. Bulkachuwa as saying in the letter. Hearing continues Tommorrows Thursday 3rd November 2016

The factional leader of the Peoples Democratic Party, PDP, Senator Ahmed Mohammed Makarfi, other national leadership of the party and its state chapter chairmen have, Tuesday, declared support for Eyitayo Jegede, SAN as the true candidate for the party in the upcoming governorship election in the state. In a statement signed by the party’s National Publicity Secretary, Prince Dayo Adeyeye and made available to newsmen on Tuesday evening, the statement said party members were briefed of the happenings in Ondo state where, afterwards, the members unanimously declared support for Jegede. “PDP State Chapter Chairmen Meets With The National Leadership, declare Support For Hon. The three-man panel of Judges specially constituted to give accelerated hearing to the appeal of the PDP and it’s candidate, Eyitayo Jegede over the candidature of the PDP in the Ondo governorship election has withdrawn from presiding over the case after it had been bartered and bludgeoned by cheap and unverified claims and blackmail by Jimoh Ibrahim and his self-acclaimed PDP chairman, Biyi Poroye. The Appeal Court sitting in Abuja, had fixed today (Tuesday) to begin hearing in the case, but could not proceed due to the unfounded petition written against it by Jimoh and Poroye. The case file has been returned to the President of the Court of Appeal to be reassigned to a new panel of Judges to begin hearing of the case soon. Poroye, who earlier appeared at the court with Jimoh Ibrahim, vanished into the thin air as the court was about to begin hearing over fear of being jailed over his petition addressed to the Nigerian Judicial Council (NJC), on Monday. The Appeal Court Judges, who were visibly infuriated about the petition, blew hot over the petition written by Poroye, challenging his counsel if he was aware of the petition written by his client. The Judges had insisted that the issue must be sorted out before matter progresses as the petition contains myriads of baseless allegations against their personality. The Judges, while challenging Alex Iziyon, counsel to Poroye over the petition written by his client, said “we are shocked that your client, Biyi Poroye could engage in this malicious act that can obstruct Justice” The leading Judge, Justice Jumai Sankey, who was almost in tears while withdrawing from the case, said Jimoh Ibrahim and co did not only accuse her of greed but of poverty owning to her protracted ill health. Justice Jumai Sankey while taking her hands off the case rued the personal attack on her by Jimoh Ibrahim and Poroye. Jimoh and Poroye in their petition had alleged that since the lead Judge (Sankey) was “ill and so poor”, she was susceptible to inducement and bribery! Meanwhile, Chief Wole Olanipekun (SAN) counsel to Eyitayo Jegede, while speaking with journalists, assured that his client would explore all legal means to retrive his mandate before the poll on November 26. In his reaction, counsel to Poroye, Iziyon said “I didn’t know about it, it didn’t have my contribution or suggestion. Poroye is like the proverbial Judas Iscariot for writing that petition. If he was in court he would have defended himself and tell the court who told him to write it, but unfortunately he was nowhere to be found.” “The Judges decided that for the sake of fair hearing, they have to excuse themselves.” he said. Iziyon however said the withdrawal of the Judges does not stop the case, as a new panel of Judges would be constituted soon by the President of the Court of Appeal to begin hearing of the case.
