Eight days after operatives of the Department of State Services, DSS, raided their homes, Justices Nnamdi Dimgba and Adeniyi Ademola, yesterday, resumed sitting at the Abuja Division of the Federal High Court. This came on a day the Economic and Financial Crimes Commission, EFCC, began interrogation of two Federal High Court judges, Mohammed Nasir Yunusa and Hyeladzira Ajiya, accused of corruptly enriching themselves in the course of their duty.

However, Chairman of the Presidential Advisory Committee Against Corruption, Professor Itse Sagay, said corruption in the judiciary was worse than crimes against humanity, noting that as custodians of hope of the last man, judicial officers could not afford to be corrupt.

The DSS had in the process of a “sting operation” it conducted between October 8 and 9, ransacked the Abuja homes of both judges. The said operation had resulted in the arrest and detention of seven superior court judges, among whom were two Justices of the Supreme Court — Inyang Okoro and Sylvester Ngwuta. Though Justice Ademola was among judges arrested and subsequently granted administrative bail,

Justice Dimgba was freed after his house situated at the Apo Legislative Quarters was thoroughly searched by security operatives, who allegedly carted away several documents, including drafts of yet-to-be-delivered judgements. Since the incident occurred, the two judges have not sat to preside over cases pending before their respective courts until yesterday.

Whereas Justice Ademola sat at Court 7, his counterpart, Justice Dimgba presided over matters at Court 11. Justice Ademola, who sat for close to two hours, attended to 12 cases, with two of them pending cases against the DSS. Specifically, the two cases were fundamental rights enforcement applications by persons currently held in DSS custody. While the first suit marked CS/518/2016 was filed by one Olusegun Komolafe, with the Director-General of the DSS and another as respondents, the second suit, marked: CS/498/2016, was also lodged against the DSS by one Engr Chidiebere Onwudiwe.

Hearings in both matters were stalled by failure of the DSS to send any legal representation before Justice Ademola. Consequently, the judge deferred hearing in the suits after he ordered that fresh hearing notices should be served on the DSS.

Both Justices Dimgba and Ademola are currently awaiting the nod of the National Judicial Council, NJC, to drag the DSS to court over the “illegal invasion” of their homes, which they said amounted to gross violation of their constitutional rights. Among cases Justice Dimgba heard, yesterday, was a suit by a governorship aspirant of the All Progressives Congress, APC, in Ondo State, Mr. Olusegun Abraham.

The judge, in a bench ruling, ordered the service of all the relevant court processes, on APC National Chairman, John Odigie-Oyegun and the party’s purported governorship candidate, Oluwarotimi Akeredolu via substituted means. The order followed an application by counsel to the plaintiff, Professor Yemi Akinseye-George (SAN), who complained that his client found it difficult to serve the respondents personally.

The suit is, among others, challenging the competence of the governorship primary election the APC held in Ondo State on September 3. The plaintiff, who raised eight questions for determination, is praying the court to among others, declare that the primary was held in violation of provisions of the APC’s Electoral Guidelines for Governorship primary election 2014.

He said the primary also flouted the party’s constitution and was, therefore, invalid and incapable of validly producing Akeredolu as a candidate. He also seeks an order setting aside the primary for alleged non-compliance with provisions of the party’s primary election guidelines and constitution. Abraham, who emerged second in the primary, equally wants the court to set aside the purported submission of Akeredolu’s name to INEC by Odigie-Oyegun and the electoral body’s acceptance of the name as the APC’s candidate for the forthcoming governorship election.

He also sought an order compelling INEC to extend time within which the APC could conduct a fresh primary based “on the congress and congress appeal committee’s delegates’ list 2014 and in compliance with the provisions of the Electoral Act, the constitution of the APC, the party’s electoral guidelines 2014 and the 1999 Constitution, as amended.”

Two Federal High Court judges quizzed

The two Federal High Court judges, Mohammed Nasir Yunusa and Hyeladzira Ajiya Nganjiwa, were summoned to the Lagos Office of the EFCC, where they were being quizzed by top operatives. According to information available to Vanguard, the two men arrived EFCC’s office around 10.05 am and were immediately ushered into their interrogation room.

endent National Electoral Commission (INEC) has confirmed that John Ola Mafo will be the Deputy Governorship candidate of the Peoples Democratic Party (PDP) in Ondo State.


A source at the commission's office who pleaded anonymity confirmed this to a SaharaReporters correspondent in Akure on Tuesday night.

The source said the name of Mr. Ola Mafo was forwarded to the office of the Administrative Secretary of INEC and has been confirmed by the staff of the office at the Ondo State Headquarters.

"Yes, it is true that we received the name of Prince John Ola Mafo as the Deputy Governorship candidate of the Peoples Democratic Party (PDP) in Ondo State,” the source stated. “Mr. Ola Mafo will serve as the main running mate of Barrister Eyitayo Jegede, who has been chosen as the Governorship candidate of the PDP ahead of the November 26 governorship poll.”

Banji Okunomo, the Spokesman of the Peoples Democratic Party (PDP) in the State, said the decision to pick Mr. Ola Mafo was sealed by the party's highest decision-making body.

Mr. Okunomo disclosed that Mr. Ola Mafo's choice was also considered after several factors that could lead to victory for the party in the forthcoming poll were reached.

"At the highest decision-making body of the Ondo State Peoples Democratic Party today, the PDP resolved on the choice of John Ola Mafo as the Deputy Governorship candidate of the party. The party took this far-reaching decision after considering all factors that would lead to its victory at the poll.

"The party weighed a number of options, including the credentials of Ola Mafo which ranged from being a former Chairman of Ilaje local government area of Ondo State and former Commissioner for Information in Ondo State.

"Ola Mafo was also a former Special Adviser to Governor Mimiko and until his nomination, he was the Chairman of the Ondo State Football Association (ODSFA). He is also a founding member of the PDP, a veteran politician from the Southern senatorial district, particularly Ilaje local government, and a native of Zion Pepe," he said.

Mr. Okunomo also told SaharaReporters in a phone interview that the campaign of the ruling PDP would now begin with an Jegede-Mafo governorship ticket.

In the end, it was a sweet victory. It was the first time Nigeria would win a World Cup qualifying match away from home since defeating Ethiopia’s Walya Antelopes 2-1 in Addis Ababa in October 2013.

The Super Eagles of Nigeria returned into the country on Sunday night, October 9, amidst violence at the Nnamdi Azikiwe Airport where fully armed unknown gunmen were waiting to arrest the League Management Company (LMC) chairman Shehu Dikko.

Dikko was part of the delegation that led the Eagles to Ndola where the Super Eagles defeated the Chipolopolo of Zambia 2 – 1.


Two men who were in mufti claiming to be police officers stated that they were from the Jos police command, stressing that they have been given the order to arrest Dikko who is also the Nigeria Football Federation (NFF) vice chairman.

Our correspondent learnt that the acclaimed police officers failed to present identity cards or warrants to back their presence at the airport.


However, Dikko was said to be having a discussion with the Super Eagles’ players, and all efforts by the security agents to arrest him proved abortive.

The unknown men decided to shoot sporadically into the air when journalists, NFF officials and members of the club owners accosted them.

The Super Eagles players were hurriedly ushered into their bus before being driven off for the safety of their lives.

“It was hell last night for us as these two men just appeared from no where claiming they were police officers. They even threatened to shoot us, and we said they should go ahead, but they later left after shooting into the air,” a journalist told NAIJ.com.

The Super Eagles media personnel Toyin Ibitoye also confirmed the incident, but quickly added that he was not at the scene when it happened.

“Yes, but I was not around the place as I was at the place where we were offloading our bags, but I was later told of what happened,” he to NAIJ.com.

All players will now return to their respective clubs but will return for the in November for their next game against the Desert Foxes of Algeria who were held to a 1 – 1 draw by Cameroon.

A North Carolina Superior Court judge is charged with trying to bribe an FBI officer to collect text messages between two phone numbers in what the judge said was a family matter.

Federal prosecutors on Wednesday announced the charges against Judge Arnold Jones II, who hears cases in three rural eastern North Carolina counties – Wayne, Lenoir and Greene – and is chairman of the North Carolina Innocence Inquiry Commission.

The judge had his first court appearance Wednesday and was released with general probation requirements, including restrictions on travel and having firearms. His next court date has not been set.

Jones faces a maximum of 37 years in federal prison if convicted of all charges, prosecutors said, but a sentence that long would be unlikely. It's illegal for law officers to demand text or phone information from a phone company without an approved search warrant in an active case.

Elliot Abrams, a Raleigh defense attorney, says the charges and the threat of federal prison are excessive.

"In my mind, if you go to a friend who's an FBI agent and it's illegal, the FBI agent should say, 'I can't do that. It's illegal,'" Abrams said.

"There's a number of less serious crimes that could have been charged here that may have been more appropriate."

Prosecutors say Jones approached the unidentified FBI officer a month ago, and the two met in Goldsboro on Tuesday to exchange $100 for a disk supposedly containing the text messages. Jones initially offered to give the officer "a couple cases of beer" for his help but later agreed to $100 in cash.

Jones is charged with promising and paying a bribe to a public official, promising and paying a gratuity to a public official and corruptly attempting to influence an official proceeding, according to the U.S. Attorney's Office.

Jones was a private attorney in Goldsboro for 18 years before being elected to the Superior Court in 2008. He earned degrees from the University of North Carolina at Chapel Hill and the Wake Forest University law school.

The Nigerian Bar Association on Saturday declared a state of emergency in the judiciary following the midnight arrest of some judges by the Department of State Services.

The declaration of the state of emergency was made on Saturday evening in Lagos by the NBA President, Abubakar Mahmoud (SAN).

Mahmoud addressed the press alongside four past presidents of the association – Chief Wole Olanipekun (SAN), Dr. Olisa Agbakoba (SAN); Mr. J.B. Daudu (SAN) and Augustine Alegeh (SAN).



Others in attendance at the declaration, which held at Eko Hotel, Victoria Island, were Prof. Kayinsola Ajayi (SAN), Mr. Yusuf Ali (SAN), Mr. Dele Adesina (SAN), among others.

Mahmoud said two Supreme Court justices, Inyang Okoro and Sylvester Ngwuta were “abducted”, with their families, adding that he had yet to have the full detail of other judges who could have been involved.

Mahmoud said the NBA condemned what it termed the Gestapo-style operation of the DSS.
He announced the constitution of an emergency or crisis management team, comprising past NBA presidents to engage with the government.

Mahmoud, who said it was not the responsibility of the DSS to arrest judges, described the DSS action as an unconstitutional means of intimidating the judiciary and undermining its independence.

The NBA President called on President Muhammadu Buhari to order the immediate release of the arrested judges, vowing that there would be consequences should the demand be ignored.

Mahmoud said, “I want to emphasise again that we are not under military rule and we cannot accept this unholy event and Gestapo-style operation.

“We, therefore, call on President Muhammadu Buhari to immediately caution all the state security agencies and to respect the rule of law and to respect due process.

“Given the unfolding nature of the event and the seriousness of the situation, the NBA hereby declares a state of emergency as it affects the affairs of the judiciary and I hereby constitute a crisis management team, comprising all past presidents of the association.

“I want to, on behalf of the association, make the very following clear and unequivocal demands: we demand the immediate and unconditional release of all the judges abducted from about 9pm yesterday (Friday).

“The release must be done immediately and without any conditions. Two, we demand that the Department of State Services should limit itself to its statutory and constitutional responsibilities.

“I’ll be meeting with the CJN later tonight or tomorrow. There will be consequences should these demands are not met.”
