The chairman of the Peoples Democratic Party in Okitipupa Local Government Area, Niyi Pirisola, was in the early hours of Friday assassinated by yet-to-be identified gunmen.

The former caretaker chairman of the council, was said to have been shot as he was arriving his Ilu Tuntun residence in Okitipupa from the church.
The gunmen left the scene immediately after the shooting, witnesses said.

They told journalists that the deceased was blocked by the assailants as he arrived home, before they shot him.
He was said to have passed away as efforts were being made to take him to a hospital.
The State Police Public Relations Officers, Femi Joseph, confirmed the incident.

He described the shooting as an “ugly development” that would not be condoned in the state.
According to Mr. Joseph, the state police command was working to bring those behind the killing to book.

“The deceased was coming from the church and the assailants attacked him and killed him,” he said.
“We have commenced investigation on it and I am sure the killers will be brought to book.”

However, the Peoples Democratic Party (PDP) in the state expressed shock over the killing of the former council boss describing the death as “debasing.”
The state Publicity Secretary of the party, Banji Okunomo, called on the security agencies to investigate the killing and bring the perpetrators to book.

“While the PDP expresses shock at this inhuman act, we hereby call on all security agencies to bring the perpetrators of this dastardly act to book,” Mr. Okunomo said.

“This is necessary because of the sensitivity of the times that we are in Ondo State, considering that the state is preparing for its governorship election come November 26, 2016.

“The PDP cautions against anything that could heat up the polity and impede the transition process that is being prepared for in our dear Sunshine State.

“Ondo State has been widely acclaimed as one of the most peaceful States in the country. We must not allow hoodlums to tamper with this track record or dent our image in any way.”

Giving a ruling on an interlocutory application filed by Ibrahim on Thursday, September, 1, over the conducting of Ondo gubernatorial primary election by the Makarfi led faction of the PDP, Abang said he was only assigned to hear the matter because he is a vacation judge.

Ibrahim had in a suit asked the court to stop the Ahmed Makarfi-led caretaker committee from conducting its party primary election for Ondo state on August 22.

Abang however said following the end of the annual judicial vacation on Friday, September 9, he would have to refer the case file to the chief judge of the Federal High Court for reassignment.

Abang’s decision to send the file for reassignment is because he is standing in as a vacation judge, his own vacation starts on Monday, September 12.

Abang said the time left for him to preside over matter is less than a week.

Optionally, Abang also said the defendant “may” within seven days file a counter affidavit on the application or the plaintiff “may” seek leave of the court on the matter.

Earlier on, counsel to the plaintiff, O. Oyelami prayed the court for a short adjournment for hearing on the motion of injunction and interlocutory application filed by his team.

He also prayed the court to – within its discretion – allow his team adopt their processes on the matter.

But in his objection counsel to PDP Ifedayo Adedikpe said since the plaintiff claims to have adhered to substituted service as ordered by the court, progress can only be made on the matter if the court is satisfied by all verifiable evidence of compliance.

Adedikpe however told the court to consider the letters of Order 7 sub rule 1 of the Federal High Court procedure rule, 2009.

He said: “A defendant served shall within 30 days be allowed to enter his appearance before the court.”

Adedikpe said, while he does not object to an adjournment as proposed by the plaintiff, he expects the court to allow the defendants 30 days to make its appearance.

He further said, he expected Ibrahim’s counsel to draw the attention of the court to the fact that his interlocutory application being served has been overtaken by events – the already conducted party primary election by Makarfi faction in Ondo state.

The Makarfi faction of the party had on August 22, had its version of the PDP primary election despite the matter being in court.

Also, irrespective of a court injunction obtained by the Makarfi led caretaker committee in Ondo state, the Ali Modu-Sheriff faction of the PDP held its own Ondo gubernatorial primary election in Ibadan, Oyo state on Monday, August 29.

The Modu-Sheriff fection’s election witnessed the emergence of businessman Jimoh Ibrahim as the party’s flag bearer for Ondo gubernatorial election

THE Group Managing Director, Energy Group, Dr Jimoh Ibrahim, in the early hours of Monday, emerged the Peoples Democratic Party (PDP) candidate for Ondo State election for Senator Alimodu Sheriff’s faction in a gubernatorial primary election conducted at the Banquet Hall, Premier Hotel, Ibadan.

Ibrahim, contested the primary with Mr Olusola Ebiseni, Honourable Bamiduro Dada, Honourable Niran-Sule Akinsuyi and Mrs. Abiye Ademuyegun.

Three aspirants; Mrs Abiye Ademuyegun, Honourables Bamiduro Dada and Niran-Sule Akinsuyi, however, withdrew for Dr Ibrahim.

Accreditation of 801 delegates from the 18 local governments in the state were accredited by the Alhaji Ame Gulak-led electoral committee before the aspirants were recognised and spoke for three minutes each.

Other members of the electoral committee include Shetima Shehu, Chief Tunji Akinosi, Elder Layi Falaju, Mala Sheriff, Ozo Uchechukwu Ngwu, Bimbo Balogun, Prince Poroye Bill Biyi, Ikenna Nnajioffor, Lawan Gana Karasuwa and Bernand Mikko.

In the election which lasted over two hours, Dr Jimoh Ibrahim polled 502 votes to win the election which its process commenced on Sunday night with his co-contestant, Mr Olusola Ebiseni polling 41 votes while 17 votes were voided.

As the Chairman of the electoral committee announced the result, the hall erupted with celebration.

While Speaking, Dr Ibrahim promised to create jobs and improve the educational development in Ondo State. “I will only occupy one seat in Ondo State, the rest belongs to the people,” he said.

He said “I have managed over 8,000 workers, 16 companies and have two national honours. And when you talk of integrity, I have first class integrity.

“I will create jobs and make education meaningful by introducing school system to prepare a new standard future for our children,” Ibrahim said.

The National vice chairman and South-West Chairman, Makanjuola Ogundipe and the South-West Secretary, Otemole Adepegba were in attendance.

NJC panel to grill Judge Sept.

Following recent conflicting rulings over the governorship tussle in Abia State and the leadership crises rocking the Peoples Democratic Party, PDP, by Justice Okon Abang of the federal High Court Abuja, the National Judicial Council, NJC, has commenced discreet investigations on the judge.

Justice Abang is to face an NJC panel September. A highly placed Judiciary source at the weekend told Nigerian Pilot Sunday that some chieftain of the leading opposition party, PDP, have petitioned the Chief Justice of Nigeria, CJN, Justice Mahmud Mohammed and the NJC over alleged misconduct and abuse of office by Justice Abang.

According to the source, the NJC has already commenced secret investigation following the controversy in the botched convention of the PDP and the ruling that led to the sacking of Abia governor ,Okezie Ikpeazu, who was restored by the Appeal Court Thursday last week.


The source further added that the NJC in its September meeting will constitute a full blown panel that will grill the embattled controversial judge.

The Court of Appeal, Abuja division, restored Dr Okezie Ikpeazu as the duly elected governor of Abia State just as the court set aside the judgment of justice Okon Abang of the federal high court which on June 27th removed the governor from office.


Justice Abang removed Ikpeazu from office on account of supplying false information to obtain his party nomination for the 2015 governorship election.
The appellate court however, voided the legal action of justice Abang on the grounds that the originating summons relied upon by the judge to give the judgment did not comply with any known law in the country .

Justice Ibrahim Shata Bdliya who delivered one of the lead judgments in an appeal filed by Ikpeazu, held that Justice Abang erred in law by assuming jurisdiction in an originating summons that was not signed by any identifiable legal practitioner among the three lawyers that issued the said summons.


In the unanimous judgment of the court, the federal high court judgment delivered on June 27th was said not to have been competent, having been based on an originating summons that was invalid, null and void.
Apart from not signing the originating summons, the appeal court held that the suit filed by Dr. Samson Ogah did not disclose any cause of action because it was filed even before the appellant (Ikpeazu) submitted his documents to the Independent National Electoral Commission, INEC.

Justice Bdliya agreed with counsel to the governor, Chief Wole Olanipekunsan, that it was not the duty of the court to begin to search for the signatory to the originating summons to authenticate it as required by law.

Besides, the appeal court also held that although the originating summons was later amended, but said that an amended originating summon has no capacity to cure a defective and incurably bad originating summons being the foundation of the suit.

The appeal court further agreed with Olanipekun SAN that Justice Abang erred in law by making findings at the interlocutory level of case by taking a stance on issues in the main suit.

“He ought not to have given the final findings at the interlocutory level and his conclusion at the interlocutory level was a breach of fair hearing against the appellant (Ikpeazu) who was not given opportunity to use the substantive suit to prove his case.

The court also upheld the submission of Olanipekun SAN that because of the circumstances of the issues in the suit, the suit ought to have been instituted through the use of writ where witnesses can be called to make clarifications on the the disputed issues, rather than using originating summons that does not require the calling of witnesses.

In another Judgment by Justice Helen Morenikeji Ogunwumiju, the appellate court held that Justice Abang raped democracy in his order that the INEC should issue a certificate of return to Dr. Samson Ogah when there was no evidence of forgery of criminality against the appellant.

According to the court, the judgment of Justice Abang was grossly erroneous because it was based on inadequacy of tax receipt that cannot be visited on the appellant (Ikpeazu).

After reading through the judgment several times, I was amazed at how the trial Judge arrived at his conclusion of perjury against the appellant when there was no evidence of forgery. To say the least, his findings are ridiculous.

“The Judge must have sat in his chamber, unilaterally assessed and computed the tax of the appellant and came to the conclusion that he did not pay the required tax. But let me say that courts are not allowed to speculate as the trial Judge has done in the instant case.

The trial Judge spoke from both sides of his mouth when in one breath, he claimed that he based his findings on supply of false information and in another breath, he came to the conclusion that the appellant in this matter committed perjury, even when there was no allegation of forgery and no allegation that he did not pay tax.

Justice Ogunwumiju also agreed with Olanepekun SAN, that the Federal High Court Judge turned the head of the law upside down in his conclusion that it was the appellant that should bear the burden of proof on the allegation made by Ogah.

With respect, we disagree with him (Judge) in this conclusion because it is the person that makes allegation of falsehood that must prove it.”
The Appeal Court also held that Justice Abang erred when he imported the phrase ‘as at when do’ into the PDP 2014 guidelines.

“The Judge would not have imported the phrase into his findings if he had seen the copy of the PDP guideline. In this case, he violated the PDP guideline”.


“From whatever angle one looks at the judgment of the trial Judge, the decision of his court was grossly erroneous. The inadequacies of the tax receipt cannot be visited on Ikpeazu who scored the highest votes in the 2015 governorship elections as doing so will amount to rape of democracy.”

In all, the appeal court set aside the judgment of Justice Abang delivered on June 27 for being a nullity and a miscarriage of justice that must not be allowed in law.
The court also awarded various sums of money against Ogah as cost.
