The judge in his rulling stated that: "It smacks of gross incompetence and an irritant. The candidate's right has been adversely affected and has the right to ventilate his grievances. To deny him this right is vexatious and oppressive and an attempt to pervert the course of justice. It is a mischief and the application is dismissed. Eyitayo has the right of appeal. The application is absurd and strange. It is unimaginable. Hence, Eyitayo is hereby granted right of Appeal by this honourable court." |
The special panel of the Appeal Court sitting on the Ondo Peoples Democratic Party, PDP, Governorship candidate tussle has dismissed the application of sacked factional chairman, Biyi poroye challenging it’s jurisdiction and asking for its disbandment. Justice Salauwa says poroye’s application is stinking, has no merit and hereby dismissed. Two other justices on the panel, Ignatius Agube and George Baba agreed with justice Salauwa that the application is absurd, blackmail, utmost mischief, abuse of court process aimed at annoying the appellant and obstructing justice. The appeal Court justices added that it is a misnomer for the Appeal Court President to consult with parties before setting up any panel which would undermine his administrative powers as enshrined in the constitution. The special panel also granted Mr Eyitayo Jegede’s application to appeal justice Okon Abang judgement which ordered the substitution of his name with that of Jimoh Ibrahim as the pdp governorship candidate. In his lead ruling, justice Salauwa said the application is of merit having critically examined the grounds of appeal and supporting affidavits as well as counters from the other parties. He said Eyitayo Jegede clearly established with copious evidence that he was affected by the ruling though not a party to the suit having successfully gone through a primaries in Akure. The two other Justices concurred with justice Salauwa ruling. Appeal Court Panel to rule on Applications on Ondo PDP Guber case on Thursday.. The Special Panel of the Appeal Court sitting in Abuja has reserved till Thursday ruling on several applications on cases with respect to the Peoples Democratic Party Governorship candidacy tussle for this month's election in Ondo State. Head of the Three Man panel, Justice Ibrahim Salauwa announced this after counsels to concerned parties had concluded arguments in respect of their applications at the resumed hearing today. Some of the applications for which the panel would give ruling include Biyi Poroye 's application challenging the jurisdiction of the special appeal panel to hear the cases, Jegede application for leave of appeal against justice Okon Abang's ruling which ordered his substitution, as well as Ahmed Markarfi and Ben obi versus Biyi Poroye's application. Justice Salauwa thanked all the parties for their cooerperation and assured of their reading to speedily dispense all the cases in a manner that Justice will be served on everybody. " I want to thank all counsels for their cooperation which has made the sittings hitch free so far. We want to assure you that will not waste time is dispensing this case as we all have waiting for us, our primary assignments in our respective divisions " The panel also today heard two applications in respect to the Ahmed Markarfi case versus Benson Akingboye on Edo elections. While one of the applications bothering on the Edo election was adjourned indefinitely due to a pending motion on the case at the Supreme Court, the other application was adjourned till Thursday. Speaking to newsmen, Counsel to Biyi Poroye, Ben Nwofor SAN said they were in court to challenge the panel's jurisdiction, counsel to Eyitayo Jegede SAN, Chief Wole Olanipekun said they have properly argued their case and confident the panel would come up with a ruling based on justice having done a thorough job all through the hearings so far. |
