Nigeria Electoral Act section 37 on candidate nomination on which the supreme court based its judgement.
|
Since yesterday APC warriors have been on overdrive on various distorted opinions on The Supreme court judgement between Uche Nwose vs APP in Imo state. What is saddened is that they failed to present the supreme court judgement on the said case. However they are on overdrive about one shuaibu opinion to drive home their points. Find below the portion of the supreme court judgement. SC.1384/2019: Ugwumba Uche Nwosu Vs Action Peoples Party (APP) & Ors. delivered on 20/12/2019 on the nomination of the appellant therein as the candidate of two political parties and held that the nomination was invalid, null and void and in violation of Section 37 of the Electoral Act 2010 (as amended). It is the 1st respondent’s contention that the judgment is a judgment in rem and is therefore binding on all parties. That is the instant case, the 2nd appellant also nominated the 1st appellant as its candidate for the same election with the effect that two candidates were projected for the 2nd appellant in the same election.I think APC should find something better to do if they want to win edo election not running from.pillar to post on frivolity. I therefore challenge them to present any contrary or contradictory judgement that said otherwise, or they should ever remain silent Cc: lalasticlala

Ojudu is a blackmailer, Ekiti PDP not ready to make any gain from any political opportunist - Fayose Former Governor of Ekiti State, Mr. Ayodele Fayose has said that the People's Democratic Party (PDP) in the State was not interested in making any gain from the ongoing political feud between Governor Kayode Fayemi and Special Adviser to the President on Political Matters, Senator Babafemi Ojudu. Ojudu, who is having a running battle with the State Governor, Dr. Kayode Fayemi, over the control of the All Progressives Congress (APC) in Ekiti State had reportedly said on a radio station on Saturday that; "If I die and they put PDP flag on my coffin I will wake up, tear it and go back to sleep." Responding, Fayose who spoke through his Media Aide, Lere Olayinka, likened the ruling APC to a "left hand used to clean asshole," saying; "Ojudu has no hand at all. He should not even be referred to as politician." The former governor described Senator Ojudu as a political opportunist, who is always fighting for his own selfish gains, saying; "He fought against Niyi Adebayo, myself, Segun Oni and he is fighting Fayemi now. Who will please him in Ekiti?" He disclosed that Ojudu was the one who sew the dress that he used for his inauguration as governor in 2003, adding that "the moment he realised that he won't be able to control my government then, he went into full-time blackmail, using his TheNews magazine and PM News." Speaking further, the former governor said; "Ojudu was the arrowhead of the people who went to the likes of Baba Afe Babalola to lie against me then. "He is political opportunist, a senator by accident, who is always striving to destroy any government in which he can't have his way. "Therefore, he can continue with his usual voyage of political blackmail, that is his business and that of his Coronavirus infected APC party. "As for us in the PDP, we are not interested in making any gain from the reckless political life of a man who does nothing other than to destroy the good works of others."

Fear grips Ondo APC guber aspirants over NWC dissolution – Kekemeke faults Nigeria’s constitution on the defection The dissolution of the All Progressives Congress’ (APC) National Working Committee (NWC) by President Muhammadu Buhari yesterday, no doubt, heightened tension among the APC fold, especially the Ondo State governorship aspirants. While speaking with journalists in Akure, one of the aspirants, who pleaded anonymity, raised serious concerns that the governors had finally taken over the party. He said that the intervention of the President would jeopardise the chances of the aspirants, saying they would be denied a level playing ground to confront the incumbent governor, Oluwarotimi Akeredolu, who is seeking re-election. “From the look of things, the governors have, at last, taken control of the APC. “We know that the governors were up to something when they made frantic efforts to save Obaseki but failed. “The Appeal Court ruling that caused this crisis did not come from nowhere, as the governors reactivated it to embarrass Oshiomhole when they could not persuade him to forgive Obaseki. “With this development, we doubt if there will be a level-playing ground because these governors are like a fraternity,” he said. Also, the sequel to the crisis over the alleged impeachment of Ondo State Deputy Governor, Agboola Ajayi, the pioneer state Chairman of the party, Isaac Kekemeke, has identified lacuna in the Nigerian constitution. Kekemeke, who is also a governorship aspirant, said: “The truth of the matter is that our constitution only asks that members of the legislature who decamp without a division in their party should lose their seat. Our constitution is silent about those in the offices of governor and deputy governor.” The former attorney-general and lawmaker, who stated that Nigeria’s constitution does not speak on how Ajayi can be removed from office since he left for Peoples Democratic Party (PDP), added: “But for governor and deputy governor, our constitution is silent and does not provide that such people should resign. It is left for the deputy governor to elect between honour and law; it is his choice.” He said that the defection of the deputy governor to the major opposition party would not have a damaging effect on the fortunes of the party in the forthcoming governorship election, promising that he would work hard to consolidate on his efforts that brought APC to power in 2016. https://guardian.ng/news/fear-grips-ondo-apc-guber-aspirants-over-nwc-dissolution/ |
BREAKING: Pro-Oshiomhole NWC members head to court over dissolution By By WazobiaReporters -June 25, 20200195 …As Caretaker Committee storms APC Secretariat Members of the pro-Adam Oshiomole National Working Committee (NWC) have resolved to take legal action over the resolution of the National Executive Committee (NEC) to dissolve the national leadership of the party. NEC had during an emergency virtual meeting resolved among other things to dissolve the national leadership, setting up caretaker committee headed by the former National Secretary and current Governor of Yobe state, Mai Mala Buni. However, reacting to the development, a member of the pro-Oshiomole NWC told Daily Sun in confidence that arrangements have been concluded to seek legal redress. Faulting NWC’s decision, the NWC member insisted that there is no provision of a Caretaker Committee in the constitution of the ruling party, insisting that they have many grounds of infractions committed from the resolutions of NEC. “We will soon issue statement but we have resolved to head to court for the legal interpretations of the decision of NEC especially as it concerns our dissolution. Yes, we know that Oshiomhole has his faults, but with all the positive contributions he has made to reposition the party, won’t he have been given to honours of telling him to resign?” he querried. Meanwhile, the APC Chairman caretaker committee has reported to formally takeover the running of the ruling party on Thursday afternoon shortly after the setting up of the committee, with no fewer than five other Progressive Governors Forum (PGF). Speaking to newsmen at the secretariat, he paid tribute to the dissolved National Working Committee (NWC) for the contributions made in the development of the party, stressing that with the decision, they have no role to play in the running of the party. He stormed the secretariat with the governors of Kano, Umar Ganduje, Kaduna, Mallam El-Rufai, Kogi, Yahaya Bello, Gombe, Inua Yahaya, among others. Similarly, a forum of the Non-National Working Committee of APC has dissolved its executive, hitherto led by Hon Nelso Alapa. The action followed the desion of NEC meeting to dissolve the NWC at the Thursday meeting earlier. Addressing newsmen in Abuja, the acting publicity secretary, Muhammad Sani Ibrahim, said: “the forum was dissolved for leadership failure, ineffectiveness, uncooperative attitude, lack of transparency and accountability in stewardship, financial misappropriation and party unfaithfulness.” https://wazobiareportersng.com/2020/06/25/breaking-pro-oshiomhole-nwc-members-head-to-court-over-dissolution/

Court authorises Giadom to proceed with APC NEC meeting A High Court of Justice sitting in Jos, Plateau State, has granted an Order compelling the Acting National Chairman of APC, Chief Victor Giadom, to proceed with the NEC meeting fixed for Thursday, June 25th, 2020. The Order was made upon the Application of the Chairman of Plataeu APC, Mr Latep Dabang, who is also a member of NEC. He complained that the provision of the APC Constitution regarding the convening of a quarterly NEC meeting has been serially abused and ignored by the present NWC, leading to a litany of illegalities by the NWC. It would be recalled that President Muhammadu Buhari gave his nod to the convening of an emergency NEC meeting to save the party from the multiple crises bedevilling it. Already letters have been sent out to all the Governors and members of the National Assembly who are NEC members. Whilst the Governors and lawmakers would be seated at the Council Chambers with Mr President, others would join by virtual means. Already, the visitors’ list at the Presidential Villa contains the names of NEC members expected to arrive tomorrow, confirming the clear endorsement of the meeting by President Muhammadu Buhari. “With this order, all is now set for a full reconciliatory meeting of the APC tomorrow led by the President himself. “The President has received very convincing advice on the position of the law as far as the situation in the party is concerned and has determined that the law is on the side of Victor Giadom as Acting National Chairman. “Because he will always act in accordance with the law, the President will be attending the virtual meeting Giadom called for tomorrow afternoon. “We urge the media to stop promoting manufactured controversies and to not give any further room for mischievous interpretations of the law on this matter. https://tribuneonlineng.com/court-authorises-giadom-to-proceed-with-apc-nec-meeting/

OPPPS:Is that the reason why you people keep galivating up and down on crooked lifting suspension. Hope your eyes is clear now |
ORIENTATION101:Pele hoo Go and explain that to Appeal Court |
BERNIMOORE:They not only welcome him back, also ask him to act as national secretary
|
ORIENTATION101:Take
|
fergie001:If its not that APC is looking for all means to edge Obaseki out, they could have simply ask him to get thr name corrected instead of chasing shadows |
ORIENTATION101:Seem you don't know the import of that letter. APC NWC under the leadership of Undertaker Oshiomole, Giadom continue your position as deputy national Secretary while you also continue with your Campiagn as deputy governor in river state. If you you that means another person will fill that post, If you did not win, that means nothing has changed. |
PVision2020:Kikikikikiki Giadom is having a High Court Order in his hand already which Port Harcourt Jankara did not vacate. Let APC approach Appeal Court to vacate that order |
helinues:I don't need to go back to your comment. Your comment show where you are and I take you for that. Come out with superior letter from APC that they don't grant him waiver. Giadom was able to present to the court the waiver granted him, While APC keeps showing Audio Speeches aboutm |
ORIENTATION101:Lol. Is that so. Fake letter. No wonder APC keep going down to discover lying petroleum products very soon. |
helinues:No wonder you could not predict how your party will have 3 Shia-man in just 24 hour. Shifting duties. Morning duty Shia-ma Afternoon Duty Shia-man Evening Duty Shia-ma |
BERNIMOORE:Exactly, Instead of them approaching higher court with superior letter, They keep moving about different court of same jurisdiction. Same way Oshiomole the undertaker was running to Kano the other time. |
helinues:Can you show me any other letter contradicting that letter saying he's no more a member of the NWC. Can You? I'm waiting for your reply |
helinues:If after seeing that you still go ahead to say this. It then means APC warriors got no shame to blatantly propagates lies like no other work again |
