PoliticsRe: 3 Possible Basis For Court's Upturning INEC Election Declaration by Firstorderwizard(m): 9:08am On Mar 09, 2023
Very apt analysis op.
INEC goofed by not adhering to their own set electoral guidelines (which according to the constitution is automatically an electoral law)
I guess they under rated Obi only to enter into fire brigade mode when they saw the inevitable defeat of APC their by shooting themselves on the leg.
Even if Tinubu's twin brother is the SC Chief justice, they cannot pull this through because the evidence is too overwhelming and the whole world is watching
PoliticsRe: Fulani Herdsmen Kill 8 Mourners At Burial Of Herdsmen Attack Victims In Benue by Firstorderwizard(m): 8:50am On Mar 09, 2023
INEC result cannot be trusted but if Benue people truly voted for APC, know that they are the dumbest people in black Africa.
What happened to protest vote to send a message to your oppressors?
PoliticsRe: Is INEC Really Working For APC ? by Firstorderwizard(op): 7:44am On Mar 05, 2023
Go and read the details of Uzodimma's supreme court judgement.
INEC's own result was rejected and the result tendered by Uzodimma was approved simply because he was able to prove to the court that his results was changed in a few polling units.
Forget about the emotional brouhaha, Uzodimma proved his case.

HarunaWest:
Nothing will be cancelled. The courts will admit what was uploaded as evidence and not what was snapped from polling units. If INEC did work for a party, it's the PDP or LP. Where you not in this country in year 2003 and 2007 when Obasanjo rigged PDP into power? That is what you call rigging. An election that the major parties shared 12 states each wasn't rigged. There were infractions here and there, manipulation and voter bribery but that wouldn't change much the overall outcome of the election. If only the LP and our party PDP merged before the election and one of the candidates stepped down, things would have taken a different turn. Both parties didn't even meet up to the required 25% spread in 2/3 of states. The tribuna will just ask for isolated recounts in some polling units or throw the case out entirely . Make we prepare for 2027.
PoliticsIs INEC Really Working For APC ? by Firstorderwizard(op): 6:57am On Mar 05, 2023
How come the polling unit result they are uploading on their server is different from what was declared ?

I see all this as a deliberate attempt to annul the election at the last minute and install an interim govt.
The evidence so far is already enough to cancel the process.
Whoever think Buhari ( an unrepentant dictator) will easily leave power should think twice

It's now that the business started. It is not the job of the INEC to interprete the constitution.

Like I said earlier, no too rejoice to avoid high BP cos what is ahead is big

I did some law courses in the university though am not a lawyer. I guess we'll leave it for senior lawyers to interpret then.
Remember that Mike Igini himself, a Lawyer and former INEC rec said on national tv that the 25% for FCT is mandatory.
Nobody saw this coming seriously. It's really thrilling
Democracy sweet, na Africans just dey spoil am with ethnicity and religion

seunmsg:
I don’t have a link to the judgement.

24 or 25 was not stated in the constitution. People are simply doing their own calculation based on their understanding of the provision of the constitution. For me, getting 25% in 25 is enough to fulfill the requirement of the constitution. My opinion is based on the fact that FCT is treated as a state In constitution matter like this.
Section 299 of the constitution says: “The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation.”

PoliticsRe: FCT: A Run Off Is Likely by Firstorderwizard(op): 11:45pm On Feb 28, 2023
Fine, first of all I advise we keep the argument civil cos I'm interested in this clause of our constitution of and researching on it.
Mind you, BAT govt will even favour me through my boss who may likely get a Parastatal appointment so I'm apolitical right now.

Back to the case, can you provide a link to the judgement?
Based on the section you quoted. If the law sees Abuja as a state why is the 2/3 of states regarded as 24 states which is actually 2/3 x 36 ? Instead of 25 states ?

seunmsg:
There is already a judgement of the Supreme Court on this matter and I hope to get my hand on it soon. However, section 299 of the constitution is very clear, FCT is to be treated as a state. Section 299 of the constitution says: “The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation.”
PoliticsRe: FCT: A Run Off Is Likely by Firstorderwizard(op): 11:25pm On Feb 28, 2023
Nope, they under rated LP's influence in Abuja.

I could remember a prominent lawyer approached the supreme court for interpretation of that clause.
Can't find the outcome of the case. Help with a link if you have one.

I guess the SC will summon Senior Lawyers and the NBA to put the records straight even after the final result is declared.
What it means is that the winner of this election shouldn't rejoice much

PoliticsRe: FCT: A Run Off Is Likely by Firstorderwizard(op): 11:20pm On Feb 28, 2023
The law envisage Abuja as a melting pot of Nigeria's unity (center of unity) it's the real no man's land in the eyes of the law.
The President is the administrative head of Abuja who now appoints a Minister . The people of Abuja must approve him.

This forum is meant to be some eye witness forum where members post their thoughts and observations on issues whether it's official or not.
Dunno why some urchins are taking it personal and even insulting my uncle.

jackcanfield:
But would APC not go and get Kangaroo Judges to seat and misinterpret the constitution.. you can see what Chief Falana is saying already quoting one yeye section as if the word State and Federal are the same . Moreover the constitution was very clear when it says and the FCT.
PoliticsRe: FCT: A Run Off Is Likely by Firstorderwizard(op): 10:52pm On Feb 28, 2023
Sorry, He's no longer interested in Nigerian politics.
I casually sought for his opinion on the case.
Abuja was actually designed as a WAZOBIA territory according to him but He is of the opinion that the clause itself is outdated in the constitution and needs to be amended

dat9jaguy:
Let us start by knowing this your uncle, then we can contact him to personally hear from him. We no want 3rd party gist.
PoliticsFCT: A Run Off Is Likely by Firstorderwizard(op): 10:41pm On Feb 28, 2023
I personally consulted my uncle (a retired judge in his 80's) on the interpretation of the constitution.
Mind you He is a member of the 1997/98 constitutional conference that drafted the 1999 constitution.
He said that the FCT 25% clause was added because the President is like the FCT "governor" who now appoints a Minister to run the territory for him.
Therefore, for the President to be the Legitimate head of the FCT, He must have 25% approval of the people in FCT.

Do you know Buhari?
Right now he is very unpredictable.
The way he openly disobeyed the supreme court got me thinking.
To leave power is not as easy as you think.

What if this charade degenerates and he declares nationwide state of emergency?

I took time to go through the entire electoral act and I'm already seeing wide spread illegalities capable of outright cancellation of the election.
What if this is a deliberate attempt to illegalize the election and make room for military take over or Interim govt.?

The way they rushed FFK when He twitted about this made me suspicious.
PMB is very unpredictable these days

They are not decamping, the National assembly is highly mixed right now we have PDP, APC, LP and NNPP and possibly YPP .

On a serious note, Nigerians irrespective of our political affiliation should appreciate OBi for restoring LP.
Do you think Buhari would have succeeded with all these anti-people policy if we have such a diverse national assembly?
They would have impeached the Senate President if he tries his rubber stamp nonsense.
Another good news is that the next FG will be forced to be on its toe 24/7.
Imagine an opposition made up of three strong parties that are very capable of winning election.
The era of decamping is over. As a political scientist, I can tell you we are gradually entering into ideological politics with the level of political competition I'm seeing in the coming political era

Kapeter:

PoliticsRe: Nigeria Presidential Election Results 2023: INEC Official Announcement by Firstorderwizard(m): 3:00pm On Feb 26, 2023
Not true, He really built up APGA but unfortunately, the party can't take him anywhere outside the SE I guess that's why He left for PDP.

PDP is not good for him because his political phylosophy is far different from what PDP is doing.

I think He just discovered his political trajectory.
Let him nurture LP and the Governor's (possibly), Senators and Reps under his political empire .
Good enough, they are mostly political novices who rode on his back and can be easily blended to the Obidient political phylosophy.

I'm very happy with how our politics is evolving, we have a real third force on our hands.
OBi just earned himself the new " Southern Buhari".

Obi is not a politician that keep allies, he will fade off very soon.
PoliticsRe: Nigeria Presidential Election Results 2023: INEC Official Announcement by Firstorderwizard(m): 2:50pm On Feb 26, 2023
Nope, OBi have to contest, this election gave him another political level.
Like I said, OBi is now a strong force blowing from the South. Let him consolidate on his wins and seek for more partnership in the North especially.
Bookmark this thread, Atiku or BAT govt. have no solution to the level of damage Buhari have caused. The usual Nigerian Lamentations will start in 5-8 months time of their tenure.
OBi will enjoy his efforts with LP in years to come. The progress He is making is faster than I anticipated.

If he can have one or two state governors under his political empire, trust me he is their.
No matter what you are told, Nigeria have very high level of ignorance and illiteracy.
Playing structureless politics here is difficult.

betshopagent:
if I were in Obi's shoe, I would never contest again.Let the masses suffer for their sins. If Obi looses this Election, then the number of fools in this country overpopulates the wise one.
PoliticsRe: Nigeria Presidential Election Results 2023: INEC Official Announcement by Firstorderwizard(m): 2:29pm On Feb 26, 2023
I fully understand you. From my observation so far in this election. OBi did not lose,He just emerged the new "Buhari" of the South.
The next step for him is to use the next four years to build strong alliance with the North.
If he can do that, trust me He will displace whoever emerges President from this election.

Atiku and Tinubu have no solution to the level of wahala we are in now.
In 8 months time the Lamentation will continue.

OBI should consolidate his wins and most especially try to have one or two state governors. I'm impressed with their showing in the HOR and Senate so far

franchasofficia:
Obi won, the election was massively rigged. Don't you hav eyes?

Tinubu was rejected by people, maybe only those in Northeast and some Northwest voted Tinubu.

Obi won Lagos landslide but where is the result?

Didn't you hear what Wike is doing in Rivers?

Obi won without Kwankwaso's alliance, they are rigging the election for Tinubu.

INEC promised to upload results from polling units same hour election is concluded at PUs, but it is 24hrs now nothing.

Election was concluded in my PU before 2pm and we started counting by 2:35pm and finished everything before 4pm and the guys uploaded and everybody left, but I got home logged into INEC server and couldn't see my PU result on the INEC server even up till this moment after 24hrs, haba na.

I followed Osun State own and they were uploading the results from the PUs almost immediately as election ends, what happened to this one?

I never knew Yakubu is this corrupt and compromised and he didn't even acknowledge the issues and give reasons, he didn't even comment on all the issues election observers and journalists on ground at different PUs raised, ah, this is heartbreaking angry
PoliticsRe: Nigeria Presidential Election Results 2023: INEC Official Announcement by Firstorderwizard(m): 2:03pm On Feb 26, 2023
Remember Buhari contested severally before he won. OBI should consolidate his grip on the South and partner with Kwankwaso in the next election

Party politics is the only way to success in Nigeria politics

There are so many illiterates within the Nigerian electorate, if they dont see PDP on the ballot box, its APC

There are only 2 parties in Nigeria

Obi choice of a not known LP party was his mistake

He should have easily done a deal with Atiku for PDP slot

Good man but wrong strategy
