Vicjustice: There is nothing incredible about staying in a hotel even though (you) his wife live in the country, it could just be that your house is inadequate to accommodate him: In fact, it is more reputable to state that he will stay in a lodging facility than to state that he intend to harbour in an accommodation that is deemed inappropriate. And booking-in a hotel does not mean that he is not entitled to leave and stay wherever he pleases whilst in the country: Remember that we are only trying to amend errors here so, i recommend that he books a hotel (for the sake of the presentation) in order to support his visa application since you (people) have already complicated the whole situation with messed up the stories. Thank you very much Vicjustice. The reason i mention his family in NI (Belfast) is because they do say on the form to state if you have family members in the UK. We will go for the option of booking a hotel and explain about the misunderstanding with my uncle. I really do appreciate this, thank you. |

fishhooks: His mom and brother live in Ireland also but we dont want to complicate matters even further by using them but he will, of course, have to list them on his form. We want to avoid using the family visit form so that the documents we have to present dont contradict one another. |

Vicjustice: Invitation letter is not a necessity, your husband doesn't need the letter in order to visit the UK, he can book a hotel or make arrangement for other accommodation facility: he would only need invitation letter from you (or any other person) if he states that his sole purpose of travelling to the UK is to visit you (or the person) Thank you VicJustice for your advice, it's most appreciated. As i said, I live in the UK so how credible would it be if he says he'll stay in a hotel. We are willing to ditch my uncle's documents if it will casue an issue. |

Vicjustice: That would not make sense; an English man would consider you a liar if you refer to your cousin as a cousin: perhaps it will make more of a sense if he refers to him as uncle in-law. No, his statement wasn't tampered with. The ECO said that the amount he stated did not correspond with the amount that goes into his account. |

Hello All I need some advice please. I came on here about a year ago when my husband was refused a visa. He was refused for the following reasons: • He said his sponsor, who is my uncle was his uncle but when they called my uncle, my uncle said he was a family friend. We are going to address this by explaining that as his wife, he is entitled to call him uncle • The amount he said he earns did not correspond with the amount on his bank statements – We are going to show his other sources of income by presenting his statement for his shares. Is this sufficient? • I live in the UK but cannot invite him because I am on a dependent visa but we don’t know where to put down as my address as we don’t want to raise any suspicion and questions – What do we do here? Do we just come clean and say I’m here but can’t invite him or put my address in Lagos down. We don’t want them to think he is coming to stay because he really isn’t. My uncle has sent the following documents to help the application: 1. A copy of his passport 2. Evidence of the job he does 3. Utility bill 4. A letter explaining that I am married to him which is the reason he called him his uncle. 5. Insurance of his property All these documents are photocopies as my uncle did not feel comfortable sending the originals. I hope this wont count against my husband Lastly, the application he made was a family one but this time he is going to apply for a general/tourist visa. I need your advice please. Are these documents sufficient to send or does he need to attach a letter explaining that I live here but he is going to stay with my uncle as I am not in a position to invite him. |

His mom and brother live in the UK but we didn’t use them which was a big mistake because they all have the same name. I won’t want us to use them now so that they don’t think he wants to leave Nigeria by all means. |

Hello everyone Well done on the wonderful job that you are doing here with all the valued advice you give. My husband was denied a visa last year because of the following reasons by the ECO: • The amount he stated he receives as a monthly income did not reflect what was going in his account. The reason for this is a lot of money is taken from his salary before the balance is paid for things such as ajo (collection), office upkeep • He did not present a pay slip because the company he works for does not issue one so the ECO said he couldn’t accept what he said he earns • He applied for a family visa and put my uncle down as the person he is going to stay with but when the ECO called my uncle to ask who my husband was to him, my uncle said family friend so the ECO took it as a lie but the truth is that he won’t refer to my uncle as anything else. • The ECO said my uncle did not show evidence of his job in the UK. All ,my uncle sent was a letter of IV and a copy of his British passport • The ECO was suspicious that he was not married at that time. He asked my uncle when he called but not my husband. Now, he has decided to apply again and whilst his status has changed (we got married in Aug), his salary hasn’t and it is not a lot (100k a month). We want to make sure we do everything right to ensure he gets the visa. Can you please advice if he should say he is sponsoring himself on the little he earns or if he can at his age (40) get someone to sponsor him and what documents would he need to provide? We intend to address all the points made by the ECO for his previous refusal. Please help ! |

Thank you Vic and Justwise. He didn't submit any pay slip, he stated on the form that he earns 200,000 which is his salary before tax but the ECO said the amount that goes into his monthly account is not consistent with the amount he claims he earns. |

I also note you have not submitted any original pay slips to confirm your stated salary. Second reason for refusal given was that he used my uncle and said he is his uncle but NOT his sponsor. They rang my uncle and my uncle said he is a family friend. These are the ECO’s words - You state that your sponsor is your uncle (He never did that. He said he was sponsoring himself) however I have contacted your sponsor today and he has confirmed you are not related as claimed. Your sponsor has confirmed that he is sponsoring your visit and that you are a family friend. Whilst I note that you will be accommodated by your sponsor, you have not provided any evidence that he has adequate accommodation available to you during your stay. You also state that he is a Doctor, however you have not provided any evidence of your sponsor’s employment in the UK. He attached a letter form my uncle and his British passport but nothing else as he never claimed to be his sponsor. He has been told he has no full right of appeal. Now the dilemma is this. Does he re-apply or do you think he’s been banned based on the inconsistencies above and though it says he hasn’t got full rights of appeal, can he still appeal ? |

Thanks Flawless, I just thought I’d explain my position regarding my status as I am seeking advice. I am completely helpless as to what to do if this route isn’t an option. I have a Q Flawless. Do you know where I can get information regarding the limitations of the dependant visa online? I am considering giving up the visa and going back to Nigeria because I still have a few more years to be eligible for indefinite stay and I am not sure I am prepared to wait. |

Justwise, Vicjustice and Flawless I completely understand you inability to understand this but it is the truth. I am not a minor, far from it and I did not get my dependant visa though arranged marriage otherwise I would not be seeking to bring my fiancé here. I am still on the dependent visa and seeking to marry someone else while married would be bigamy, which I believe is illegal. I got my visa as a family member as an external family member. My story is as plain as day which is the reason I am seeking genuine advice. |

Thank you Justwise. I have got a 5 year EU dependent visa which I am 2 years into. I got it by virtue of my brother who’s an EU citizen. I am entitled to work and all but not sure if that’s as far as my rights go. It’s very difficult getting information on this. |

In Nigeria. My fiance is in Nigeria and has never travelled but he is thinking of coming in April by God's grace. We were thinking of doing everything at once, i.e. registry, church, engagement all at once to make it look credible but I don't know if based on my status, I can apply for him as a spouse because I am a dependant. |

Met him through a friend while I was on holiday in Nigeria in March 2010. *Are you in an arranged relationship? No, we’re not and hope that we will get married by the grace of God later this year. *How much do you communicate? We communicate every single day but unfortunately, only via phone so not sure how we will be able to prove this. *How often do you see each other? Not regularly as he lives in Lagos and I, London. We went to Ghana together in Dec but that’s about it.*Are you in employment? Yes, I am. *Do you have substantial amount in your bank account? No, I don’t. I spend the money that comes into my account but I need to start saving towards my marriage. *Where would he be staying? He will be staying with me. *How is your accommodation details like? I[b] live in a one bedroom flat[/b] *Who is sponsoring the trip? He will be sponsoring his own trip. *Would he be returning to Nigeria? Yes, he is planning to come over only for 2 weeks *What obligation would he be returning home for? He is in full time employment back home. *Does he have a reliable job? Yes he does. *Is his bank account encouraging? I’m not so sure. *Does he have properties? No, he doesn’t. I am aware this may not look convincing to an ECO and would not want to jeopardise his chances of applying if we don’t stand a chance of being approved as I am praying that I may be able to file for him to join me here later in the year by God’s grace. Not sure if this will be possible based on my visa here, i.e. can a dependant bring in a dependant (spouse). Thank you again for your patience in responding and I look forward to hearing from you. Hello everyone I need your advice please. I am currently residing in the UK and just applied for as a family member of a European citizen. The dilemma now is that I have a job and I was given a 6-month work permit but my job now requires me to travel. My application is still with the home office but I have been asked by my job to travel next week. I have tried the home office line endlessly but to no avail.
