In the mid hours of today, Lawyer Inibehe Effiong took to his social media platform (twitter handle) to speak about the ongoing Presidential Election Tribunal.

The well known Nigerian lawyer said, "if the electoral body, the Independent National Electoral Commission (INEC), had conducted credible elections, we should not be seeing the same institution objecting to documents it used during the (presidential or gubernatorial) elections."

Speaking further, the Akwa-Ibom lawyer said, "I think the election documents used by the Independent National Electoral Commission are enough to vindicate INEC’s claim of credible elections."

Lastly, Lawyer Inibehe Effiong said, "this I why I strongly opine that an objection to the documents by the electoral body simply imply they do not want the tribunal to rely on them."

It is pertinent to remind you all that a Nigerian court is presently attending to the presidential election petitions filed by Peter Obi, Atiku Abubakar and other parties against the 16th president's (Asiwaju Bola Ahmed Tinubu) emergence.

Asked how Nigeria could tackle its perennial electoral crisis through reforms in ARISE TV interview aired on Monday, Mr Jonathan lamented the “electoral process in Nigeria is still wobbling,” blaming INEC and security agencies.

“The problem we have is the electoral management body, INEC and the security. I used to give an example: If two soccer teams are playing and the referee decides to look the other way, they will injure themselves,” Mr Jonathan said.

The ex-president stated, “Election is like a soccer game. Everybody wants to win. And you must not allow it. The electoral management body shares more than 60 per cent of the blame. Because if they do their work well, the politicians will have no choice but to follow the rules.”

The former president explained that with “manual voting, we have (a) problem in this country.”

Amid contentions, President-elect Bola Tinubu will be sworn in Monday after INEC declared him the winner of the February 25 presidential election.

Opposition parties and their presidential flag bearers, including former Vice-President Atiku Abubakar (PDP) and ex-Governor Peter Obi (Labour Party), are contesting the victory of Mr Tinubu in court.

Both have refused to concede defeat or congratulate Mr Tinubu.

Labour Party and PDP Presidential candidates, Mr. Peter Obi and Alhaji Atiku Abubakar, have submitted a petition requesting a live broadcast of the proceedings of the Election tribunal in their case against President-elect Bola Ahmed Tinubu.

However, Lawyer and Public Policy Analyst, Liborous Oshoma, has expressed concerns that Atiku and Obi may have unintentionally harmed their own cause by pursuing an unnecessary lawsuit against the President-elect with the demand for live coverage.

According to Oshoma, the Tribunal is currently grappling with the challenge of effectively managing time to accommodate the hearings of both petitioners simultaneously.

He further explained that, as per the Nigerian constitution, the petition filed by the two main contenders will become null and void after 180 days. Thus, the rapidly ticking clock seems to favor President-elect Bola Tinubu.

Quoting the exact statement released by Liborous Oshoma, he said, “I can’t be silent for the face of evil, Tinubu stole people’s mandate, he can’t be president.”

“If you give seven weeks to each party, by the time one party finishes presenting its case, the petition would have elapsed. This means that the tribunal will be denied the opportunity to deliver a judgment.

After 180 days without a court ruling, Obi and Atiku’s petition is considered dead, and there is nothing that can resurrect it. To avoid this, the tribunal is trying to manage the time for the petitioners.”

The UK only thinks about money. And that is the overriding factor. The government will cave in. Otherwise it will have to fund universities if they don’t want fee increases for home students. And where is the funding coming from, when all social services are stretched beyond limit and poverty rate is increasing at alarming rate. It is the jobless and low income group that is anti-immigrant, not the educated and well to do people. They are always afraid that immigrants are coming to share in their pot of social benefits.

Candidate of the Labour Party (LP) during the 2023 presidential election, Peter Obi, has acknowledged that President-elect, Asiwaju Bola Ahmed Tinubu, could be sworn in as Nigeria’s next president come May 29.

The former Governor of Anambra State, however, has not given up on reclaiming his stolen mandate as he expressed confidence in getting justice in court even after Tinubu may have succeeded President Muhammadu Buhari.

Obi recalled how he reclaimed his mandate as Governor of Anambra State years ago from Chris Ngige (incumbent Minister of Labour and Employment of Nigeria), three years after he had been sworn in.

Naija News reports that Pre-trials at the Presidential Election Tribunal ended on Tuesday, while trial proper is slated to commence on Tuesday, May 30.

Petitioners have been given three weeks to present their case as opposed to the alleged seven weeks they asked for, beginning from May 30 to June 23.

Speaking, however, through his spokesperson, Diran Onifade, Obi cited multiple incidences where people were recalled after being sworn into office and expressed hope that the court will get him justice now or later.

Allegations of Perjury and Double Nomination Shadow Tinubu’s Swearing-In: Federal Court to Rule on Friday
ABUJA, Nigeria — On Friday, May 26, 2023, a federal high court in Abuja will decide on allegations of perjury and double nomination made against President-elect Bola Tinubu. The case was brought by a group of concerned Nigerians questioning Tinubu’s eligibility for the presidency.

This pending ruling adds further drama to Nigeria’s already tense political climate.

Justice Omotosho of the federal high court granted a substitute service order on Tinubu on Tuesday. This action followed a hearing in which the court heard the motion for an interim injunction aimed at stopping Tinubu from being sworn in as president.

“Upon listening to the plaintiffs’ counsel address the court on the locus standi of the plaintiffs and jurisdiction, I adjourned the matter to Friday for further hearing,” said Justice Omotosho.

In an unprecedented move, the court ordered hearing notices and all processes to be served on the defendants immediately. Among the defendants are Bola Tinubu, the All Progressives Congress, the Attorney-General of the Federation, the Director-General of the Department of State Service, the Inspector General of Police, and the Independent National Electoral Commission.

The concerned Nigerians – Praise Ilemona Isaiah, Pastor Paul Isaac Audu, and Dr Anongu Moses – allege that Tinubu, who was declared President-elect by the Independent National Electoral Commission (INEC), lied on oath about his possession of a Guinean passport.

Tinubu also faces accusations of dishonesty about his educational qualifications and forging education credentials.

The litigants seek to nullify Tinubu’s candidacy in the February 25 presidential election. Moreover, they demand an order to prevent Tinubu from being sworn in as president. Their claims include that Tinubu deliberately and falsely declared that he is not a citizen of any other country besides Nigeria, a statement which, if proven false, could prevent him from assuming the presidency.

In a separate case, the Incorporated Trustees of Governance Index Vs INEC, the court adjourned the proceedings to June 19, 2023.

The Govindex Leadership, Empowerment and Development Foundation led a group of Nigerians in this suit against the INEC.

They allege that INEC officials compromised the integrity of the February 25, 2023, Presidential election and demand their criminal prosecution. Their demands include that the INEC is mandated to electronically transmit, transfer, or upload the scanned copy of Form EC8A result of the polling units directly to the collation system.

The group is demanding five reliefs, two of which are: A DECLARATION that having regards to the provisions of the Section 160(1) of the Constitution of the Federal Republic of Nigeria 1999(As Amended), Sections 60(5) & 148 of the Electoral Act, 2022, paragraph (Clauses) 38 (i), (ii) & (iii) of the INEC Regulations and Guidelines for the Conduct of Elections, 2022, the Defendant through her presiding officers are mandatorily required to electronically transmit, transfer or upload the scanned copy of Form EC8A result of the polling units directly to the collation system as prescribed by the Commission, that is, the usage of Bimodial Voters Accreditation System (BVAS) or such other relevant technology to upload the result into the INEC Result Viewing Portal (IReV) immediately and in real-time after completion of the polling units voting and Results procedures but before taking the results to the ward collation Centre from the polling units.

AN ORDER OF THE COURT MANDATING the Defendant to compile names of the Presiding Officers, whether ad-hoc or permanent, who failed to upload or electronically transmit or transfer the Election results of the polling units directly to the collation system as prescribed by the Commission, that is the Bimodial Voters Accreditation System (BVAS) and send the said list to office of Inspector-General of Police for investigation and prosecution within 14 days of making the Order or such time as the Court may Order.

As Nigeria awaits the court’s decision, the future of the country’s leadership hangs in the balance, and the faith of the citizens in their electoral system is put to the test.

Three courts have turned down petitions by the Lamidi Apapa-led faction shopping for injunctions against the Labour Party (LP), the National Publicity Secretary of the Labour Party, Pastor Obiora Ifoh claimed.

In a statement he signed, Obiora Ifoh said Apapa and his group have continued their search for a court that would grant their injunction in spite of the failed attempt.

He said, “Labour Party sources who have been monitoring the clandestine movement of Akingbade and his team have informed us that the former Legal Adviser has visited three states in the North as at today, moving from one court to the other, shopping for a judge who will give them an injunction in order to enable the Independent National Electoral Commission, INEC to recognize them.

“They have visited three judges in the North who have all turned down their requests.

“They are still prowling the Northern states with enough liquidity at their disposal to influence the legal officers but we can confirm that as of today, none of the judges have agreed to their tempting offers.


“We therefore commend the judges who have refused their offers, and who are insisting that justice can not be bought.

“Notwithstanding, the unfortunate incident in Kano Federal High court last week where they deceived the judge to enter a judgement against Labour Party.

“We are happy that their motives was not defeated but also the clarification of His Lordship, that his judgement was misinterpreted to mean a blanket punishment against all elected members of the party across Nigeria was heart warming. Labour Party has also swiftly applied for notice of appeal. We believe that justice will also be dispensed accordingly.

“We use this opportunity to call on the judiciary to be up and doing, and to be on notice of the plots of these anti-democratic elements to derail our thriving democracy.

“We also call on the Chief Justice of the Federation and Chief Judge of the Federal High Court to advice judges under them not to allow the name of the judiciary to be dragged into the mud by desperate politicians.


“The judiciary has a duty to protect our democracy and we believe that this arm of government has done well but can still do more until the likes of Apapa and his cohorts are properly caged in accordance with the law and are made to pay for the injury and pains they have continued to inflict on our democracy,” Obiorah stated.
