Yes, that was what the VO stated in the gcms note.

Members on this forum then were of the view that having stated that her family was non-accompanying, we should have waited for my wife to travel and settle down first, fir at least 3 months prior to submission of our applications.

I think I agree with that notion, except one had indicated that the family would accompany.

I paid total of N9,410.00 x 3 as transmission fees. Courier to and from Abuja was N16,300.

My SOWP and my 3 children's Study Visa applications have been approved by IRCC.

1st Applications

Our 1st applications made in June 2021 were all refused on 25th September 2021. The main concern of the VO, as revealed in the GCMS note, was that my wife, who is a Masters student in BC, filled on her application form that her family would not accompany her to Canada. The VO questioned the truthfulness of my wife's statement in her application, when we now applied for visas while she was still in Nigeria. VO said other things which we considered circumstantial.

I came on this platform then to seek for advice and I really obtained valuable advice from members. What did we do?

2nd Applications

We filed another set of applications on 8th November 2021 with my wife explaining the reasons for her change in plan. We filed additional documents showing stronger home ties by exhibition of pictures of our parents, affidavits of birth of our parents and affidavit of births of my siblings. I also exhibited share certificate, receipt of payment of professional dues, together with landed property. I showed rent receipts issued to our tenants.

Along the line, my wife wrote her MP sometime in February 2022 seeking for a status update on our applications. The response was that criminality check was passed and nothing more. Our upfront medicals expired in April 2022, but I refused to go for any more upfront medicals. If they are ready, they will contact us. I was drained, both emotionally and psychologically, noting that the journey began in June 2021. I only held on to God, as a lot was at stake.

There was a time I read an email IRCC had sent to someone here requesting for updated transcripts of his student spouse. I took the initiative by sending my wife's updated transcripts sometime in late April 2022. I have a feeling this had a positive impact on our applications.

Boom, medical request showed for my children and I on 16th May 2022. We quickly sent an email to QLife who gave us an appointment in about 9 days later. Medicals were updated to "pass" for my children on 7th June, while they got their PPR on 9th June. For me, my medical was updated to "pass" on 8th June, while my PPR only came on 29th June.

In between my children's PPR and 29th June, I sent their passports to Abuja the penultimate Monday and we received the stamped passports on 28th June. I almost sent another webform on 29th June with the plan to exhibit my children's visas and seeking a quick response on my application. By 9am on 29th June, 2 "donotreply" emails had come into my inbox.

My wife travelled to BC since September 2021, leaving me with 3 active boys, while IRCC kept playing the delay game. Thank God it has ended in praise.

I wish to say a big thank you to members on this forum who were responsive to my questions at the relevant times. Really appreciate.

To everyone still waiting, hang on there. It's not over until you have won. You can't afford to give up. Keep praying and sending the webforms, the golden emails will surface shortly.

Point no. 4 is very ingenious.

Naijaforeigner:
First thing I need to tell you is your situation is not that difficult, so don’t let anyone scare you. You are seeing your family soon, stay strong and hopeful.

(1) Your finance has to be strong. You have 3 kids, so you need to show a very strong bank statement that demonstrates you being capable of taking care of your kids and yourself.

(2) if you did not do this in your initial allocation, your wife needs to send you a letter from her school and her transcript in your next application. This will prove she has registered for her courses and fully active.

Also, has she paid her tuition for the session? Trust me, that is also a big factor. If she has not finished paying her fees, please do ASAP and attach evidence in next application.

(3) If your wife is staying in a place that is conducive and can comfortably accommodate you and the kids at the moment, you will need to attach the lease of her current apartment.

Otherwise, you can explain on the same letter stating you will be getting a bigger place once you arrive. Also point out that you have money to pay for the bigger apartment. Your bank statement comes in here.

(4) Your wife needs to get a letter from her school stating the -ve impact the absence of her hubby and her kids is having on her mental strength and adjusting to the new environment. Her Dean or program coordinator can easily give her this letter.

Yes, she thought she could cope without you guys but now the reality set in and she has observed that she needs her family closer to her now than ever. You can add additional details and this will address the non accompanying issue/ concern which the Visa officer mentioned.

(5) Visa officer mentions issue of not finding work to support yourself and kids. This is a valid concern by the visa officer with the growing cases of covid plus the recent Omicron virus. This is why I mentioned earlier, you need a hoooge bank statement.

Showing a hooooooge bank statement will easily take care of this concern.

I will strongly advise it has to be a bank statement that can easily take care of you and your kids for at least some months in Canada. It is important you are specific and very detailed in your LOE.

For example;

On or before your arrival to Canada, you and your wife will get a comfortable 3 bedroom apartment that will cost $1,500
Feeding for yourself, your wife and 3 kids will cost $1,000 monthly.

Total monthly spend = $2,5000

Based on my calculation above, I have $50,000 that will comfortably take care of my wife, myself and my kids on arrival to Canada for X amount of moths and ……..

These visa officers, you need to spell it out for them in such a way that even a lay man will understand.

(6) Visa officer mentions not coming back and other stuff. Do you have properties in Nigeria?

Do you have a land? You will come back and do business in your country. There is always something to do back home, explain.

Explain all of the refusal reasons with a detailed LOE with subsections and you are good.




I know a very close family here in Ontario with 5 kids. Hubby (late 40’s) was the first to come to Canada on study permit. Wife applied to join him with their 5 kids but got refused.
She applied the second time and as I speak, they are in Canada.

As we speak, the family will be getting their PR soon via the TR to PR pathway.

Oh, lest I forget, the wife is a Nairalander.

The truth is, at the time of filling imm5645, we were not 100% sure what the phrase 'non accompany' meant. To us, it meant either 'not traveling on the same flight with' or 'not joining in Canada for the duration of study permit'. We were confused, but the VO, am sure, cannot buy our story now.

Now that the deed has been done, what is the way forward? I would be glad to hear from anyone found himself in a similar situation, but came out successfully. Or is my family the only one that used spouse and children as home ties?

The lawyer option would be costly o.

you guys were not truthful and it has caught up with you. Just wait for madam to finish school get a good job or pr shikena. Providing for 3 kids on a temporary visa is not child’s play.

By the way, we showed a lot of economic ties to Nigeria such as developed property, landed property, pension accounts, though we didn't show enough family ties. I am a partner in a firm and I showed I would return.

Just sharing my opinion.

I guess SP used you and the kids has ties to Nigeria. A lot of us do that but I think you need to explain in your SOP a sudden change of decision on why you and the kids need to be with your wife.

Secondly you need some strong ties to Nigeria like properties, Job promotion In your office a “juicy offer” that will proof you will return to Nigeria, or a company commitment, family commitment like grand parents and so on.

Gurus in the house please advise.

Please can you explain what you mean by the VO's excuse not being valid? Are you saying he is not correct by making allegation of us giving untrue statements in our imm5645?

I am very sorry hearing about this because the VO's excuse is not valid unless your application was not watertight enough. I won't advise you to reapply without consulting an expert on this. I am not an expert so please don't contact me for this. There are two possible pathways here. A judicial review or a reapplication but in both cases you need an expert immigration consultant.

Yes you can join your wife
What dat question imply is that you are not going together on same trip
But nothing stop you from coming later
All she needs to do is apply for you after she has settled down, and gotten SIN, Home address and study permit proper those are the documents required to apply for you

Just be patient and allow her go alone first and you join later.

This is totally dependent on the VO that would handle your case. While some vo might be generous some have no joy (because you folks presented the opportunity to them).

Find an immigration lawyer or wait for a year before you apply.

In fact once she get to Canada, let her look for an immigration lawyer and narrate to them. They would advice accordingly.

PS: She shouldn’t have said no. There are other things/people she could have used as home ties. In fact , once a married person is applying for study visa, the expectation most of the vo’s have is that their family will join them. I am sure she would have still gotten the visa even if she says you guys are coming with her.

Hello Folla,

The SP is a finalized case and prior since then, intentions must have changed. It is just a natural language that IRCC also speaks. Nothing will be used against you. All you should do is meeting the subcategory visa requirements.

Despite it being linked to the SP, the eligibility requirements and assessment grounds are different. Some fact verification can be done or compared to your spouse finalized application, but that aspect of your concern is far from it.

Hi Everyone

Just providing helpful update on my wife's study visa which was approved last week.

She sent her international passport to Abuja Visa Application Centre (VAC), using the DHL 2-way courier, on Monday 7/06/2021. It got to Abuja VAC the next day. Counterfoil notification on 9/06/2021. Letter of Introduction issued on 10/06/2021.

Thankfully, she received her stamped passport on Friday 11/06/2021.

If you can, please send your international passport to Abuja VAC for stamping. Though costlier, it's faster. My wife's took just 5 days in all.

Wishing all study visa hopefuls, good success.

Please I still need the confirmation from people who had successfully obtained their SOWP and study visas, notwithstanding that it was earlier stated in the family information form that they would not accompany the principal applicant to Canada.

Please our seniors should assist.

Well my SOWP is still in progress but that's what we did. She got to Canada first before I put in my application. She applied for her study visa and visitor's visa for our 10 months old baby. So I think it's in order.

A land purchase agreement is a document showing title to land. It could bear other names such as, contract of sale of land, deed of assignment, deed of conveyance.

In my wife's case, she presented documents showing title to land in 3 different places. We also included the land survey documents. These pieces of land are jointly owned by us both.

Hope this is clear now.
