I promised and I will do that.
As for the ex classmate she is in the UK with her boys. I don’t know if you guys felt I was just making stories up.

The UK based lawyer didn’t collect any consultation fee from me actually.

Strong reasons will be peculiar to her. My strong reasons might not be her strong reasons

Whatever becomes the outcome of my daughter’s visa will be shared here lol. I have nothing to hide.

Maybe her number of kids and age played a role in her case anyway.
Single mothers move with their kids to the UK. If they can cope, she can cope as well.

Do you know people have left good jobs to balance child welfare because a spouse choose to relocate?

Some not all UK based lawyer are more interested in consultation fee even when they know the reasons are not enough to grant a visa without the other parent.

Also, I remember you said some ex classmates applied without their husbands and got visa and that you would update the thread when you confirm this

Have you applied for yourself and your kids without your husband and were they granted visa?

I got in touch with a UK based lawyer. According to him, all you needed was a consent letter giving strong reasons why your husband cannot move with you guys.

Did you submit a consent letter, signed by your and your husband? The letter was meant to explain that you will have sole responsibility of the kids for the period of your masters. Get in touch with a good lawyer
I don’t even understand why they want to force people to move with MA for masters.

Good evening everyone! Please I need help as I am currently in a dilemma with UKVI issues.

@dduchess90, @justwise or anyone with advice on this issue please.

I moved with my spouse to another African country about 2 years ago after he got a better job offer here. We are blessed with 3 kids aged 8, 6 and 2. Unfortunately, I couldn't find a job here, (the country has a small economy), so I decided to switch careers to give myself a better chance of getting a good job.

I then applied for an MSc in the UK, and was able to secure admission, get my CAS and apply for my visa. We also applied for dependent visas for our kids but not for my husband, considering he has a good job which would also fund the expenses for myself and the kids. He also has a subsisting visit visa.

However, we received the notification email today that 2 of our kids' visas were denied dependent visas based on Paragraph ST34.2 of the Immigration rules and based on the following statement: " I am not satisfied that the required level of documentation has been shown in order to prove that your mother has sole responsibility. " We are yet to receive any information on the application of the 2 year old.

Please bear in mind that the supporting documents for the kids' visa applications were from both parents and we even indicated in their forms that we both have parental responsibility for the kids. I do not have sole responsibility for the kids, neither did I claim that in our applications. We also included details of my husband's job and the necessary documents pertaining to that.

In applying for the visas, we read all the requirements on the GOV.UK website but none of the information on the student visa/dependent partner of a student/ dependent child of a student mentions anything about this issue.

Now, we are at crossroads because based on this rule, the interpretation is that the other parent, who is not the main applicant must be willing to be a dependent, which would necessitate them living in the UK with the main applicant and the child dependent(s). This is not an option for us. Also, the kids cannot remain with my husband due to the nature of his job, as it requires a lot of travelling and we do not have any form of social/family support here, as all our family members live in different countries.

The only exception to this rule is subparagraph (C) of Paragraph ST34.2 of the Immigration rules which states that, "unless the decision maker is satisfied that there are serious and compelling reasons to grant the child entry clearance or permission to stay with the parent who
has permission on the Student route or as a dependent partner of a Student."

We do not know what to do next, whether to write to the Home Office directly, apply for an administrative review or reapply for the visa based of the provision in subparagraph (c) as we do not know if our situation constitutes serious and compelling reasons to grant the exception. So far, what I have read online depicts circumstances that are very different from ours.

Please, help a sister! I am trying to be a supportive wife, good mother and still want to build a life for myself. Please anyone with any advice/experience on how to tackle this issue. I would deeply appreciate it. May God bless our hustle!

Just manage, it’s just for 12 months.

If it was ulster sef eh, I wouldn’t be pained because the tuition is lower and they give very good discounts and scholarships, so it doesn’t hurt but I paid a lot of fees and I should get value for it. The most painful part is their misleading rating online, only to see that it is a total different case. So far, I am the only Nigerian in my class and all my other Indian/Chinese classmates are all complaining. A case of what I ordered versus what I got, lol.
I have decided to console myself with the fact that it is japa that I just used it to japa and rest.
The reality is unless you don’t really want much from the education, you will be pained like me that you are not getting value for the money you paid in tuition.

Hello

It is not mandatory to submit an evidence of booked accommodation for study visa that is what your maintenance funds show and tell them

Submitting an Airbnb booking was not necessary and cancelling it will have no effect on your visa application

If you don't cancel you will get the funds debited from whatever debit card you put in

Your assumption about the non refundable deposit is a bit flawed.

When booking on sites like Agoda and Booking.com, you should filter based on ‘Free Cancellation’ that way you are guaranteed your card will not be debited until a future date that would be shown to you on their site.

Any implication of not submitting visa with a booked accommodation like hotel or Airbnb
Some of them won’t refund the full money after cancellations if you decide to have other plans.
I don’t even have any idea of when I will travel.

After applying, you would most likely get a biometrics date that is 3 or 4 weeks from your application date.
Visa processing takes 3-6 weeks from biometrics date.

It depends on her future goals. I can’t choose for her but if she decides to do her masters in biomedical sciences and intends to get a job in that field then, she has to be HCPC registered to practice as a registered biomedical scientist if not she won’t get a job in that field.

I have a graduate of Microbiology who is going to the UK for a Master's degree. She said she intends to Master in Public Health but I suggested MSc. Biomedical Science. I told her that she can apply for a Master's programme with placement. Thereafter, she will proceed to apply for a Licence to practice as a registered Biomedical Scientist in the UK.

I hope I did not advise her wrongly? grin grin grin

She is a Medical lab technician and there is nothing wrong with that but she is not a scientist.
I am already registered with HCPC in the uk as a BMS because I am a medical lab scientist here in Nigeria.

First, i like to start by saying congratulations. However, if it is for career progression, I do not think you have helped your self. I know alot of people have reacted to this post with very little knowledge about the field of biomedical sciences. 1. You deliberately concealed facts and that's not good. You are trained as a medical laboratory technician and as such possess an MLT certificate with 2.2. You are also registered as an MLT with MLSCN. However, you have gone to secure a master degree in the field of Biomedical sciences when you should have pursued a degree.
2. Do you honestly think, that you have received enough lessons in Biochemistry, Physiology, Anatomy, and all other medical laboratory course? To warrant you to jump to masters degree in the UK? A certificate course as a technician in medical laboratory is different from a 4 year degree in medical laboratory science.
Do you also know that as a master student you specialise in a more narrower area. In fact from most of our university at degree levels, you would have chosen your path and specialise before graduation writing your professional exams in those areas you have chosen to specialise like Chemical pathology, Hematology and blood transfusion, Medical Microbiology, and Histopathology. Which area have you specialised in?
3. Have you heard of HCPC in the UK. This is the body that licences you to practice as a biomedical scientist in the UK. And without a Bmls degree from an accredited university, you can't even register as an HCPC professional let alone practice as a biomedical scientist in the UK.
4. I don't know who you consulted before taking that decision but you would have been better off with a degree in Biomedical science than this height you have gone.

Let me correct you on this. You cannot have OND and be a registered medical lab scientist. You must graduate with a BSc to be a medical
Lab scientist.
Maybe this person studied science lab tech which is different.
The UK take other science based courses for Biomedical science not only medical lab scientist.

They gave her admission because she is a Registered professional with Medical Laboratory Science Council of Nigeria

If you are a registered nurse and you went to the college of nursing, you will still gain Masters of Nursing admission directly.

Experience matters and being certified as a registered professional shows prowess and competence .

Not all these theoretical people we have in Nigeria who arent competent and are unemployable.

So sad to read this but this is normal; it is not peculiar to your school. If you attempt to travel, you will be denied entry at the border. As your school said, you'll need to defer to the next academic intake for your course, reapply with a new CAS, and pay visa and IHS fees for the next year as you will not be refunded. Whether you updated the school or not, they did not extend the final resumption date beyond July 5th which automatically meant that your CAS had to be withdrawn. The visa will not be updated to reflect your new reality.

The above is based on a real-life situation like yours. The school stuck to its guns and UKVI did nothing to help. Positive side was that the visa for the next application was granted within 7 working days on a standard application process.

A part of me wishes that something will give in this situation but the most likely reality is the above. I apologise if that is dampening to your mood.

I stated previously that I have a letter from my husband and his documents to back it up.

It’s either one parent is dead, separated, divorced or not in child’s life and then you must get documents to back this up…
For anything else there must be strong compelling reasons why the other party will not be travelling.
They can not grant the child or children visa without this.
Follow guidelines.. the simplest way… all of you apply together… when the visa comes out… your husband is left to do what he so pleases with his visa.
You say you know ppl tht applied without their husbands yess.. pls reach out to them.. no visa will be granted to the child if UKVI can not establish father’s own application or extenuating circumstances around your situation.
Even here in the UK, I helped a relation with her renewal application for her child within the UK… child and father submitted same time but somehow UKVI did not see father’s application..
The child’s visa was put on hold and nsf was sent for same reason… there has to be an explanation…

I am meant to do my masters and return to Nigeria right? That is the ideal way. Not everyone believes in the abroad dream especially if they are doing well in Nigeria
He is offshore sometimes for 3 months so where should the child be at that time if I don’t go with her?

I can’t lie that we are separated when we are not. Applying with us will mean more POF and he is not ready for all that and I don’t have more than enough for his POF.
I have seen people get visa without their husbands.

Is his work a compelling reason why he is not applying at the same time with you? It's up to you to prove that otherwise I fear a possible refusal .

So in my case are you saying I might need a legal document since my husband is not applying with us?

The consent letter from both of us and his documents should be okay right?
He can’t apply due to the nature of his job( offshore)

My point was responsibility is not just an affidavit, or a letter of consent when it comes to a minor especially when the second parent can't apply.

Thinking about it, I know someone who has sole responsibility because the other parent has some mental health issues and can't take decisions for the child. They had to prove and provide evidence for that sha

I agree with your take on this. Judging from the letter, I think she can reapply for the child if she can prove sole responsibility for the child while in UK. It shows from the guidance that to establish primary responsibility, a consent letter from the father letter should serve, showing he approves the travel. Then care arrangements should be made since the mother is studying full time.
In my opinion… pls I no be expert. This is just an effort to interpret what I saw in the screenshot. Thanks.
