In as much as I love Buhari and supported him and actually campaigned for him, in as much as I commend him on going against all permutation to appoint people with no known history of sleaze, in as much as I respect him for not bowing to pressure from the hawks around him, I just can't bear this is Northernisation policy any longer. Come on, there are other tribes apart from the Hausas/Fulanis and other regions apart from the north. Remember President Buhari, you're president of Nigeria and not the president of the north. Apart from Osinbajo, all other top executive positions are occupied by northerners. The SGF which is the third most important executive position after the president and vice is now northern occupied. So also the office of the chief of staff. What about the SouthSouthern/SouthEastern region? Are we also not a part of Nigeria? Or is the north the only region where credible people are? |

JUDGES handling cases of corruption against public officers are under surveillance, Nigerian Tribune learnt on Wednesday. The monitoring was said to be civil and security in nature. Chairman, presidential advisory committee on anti-corruption, Professor Itse Sagay, made this known during an exclusive chat. The surveillance is meant to monitor their performances, professionally, ethically and morally. The inability of the committee and other partnering government agencies to find upright judges across board, who will handle alleged corruption cases the President Muhammadu Buhari administration would so institute against alleged looters of the economy in the administration of former President Goodluck Jonathan compelled the monitoring, according to Sagay. Nigerian Tribune had exclusively reported the failure of many nominee-judges for the proposed special looters' courts in the integrity test conducted by security agencies. Sagay, however, did not reveal the identity of those monitoring the judges. He disclosed that the rot in the judiciary had made the search for the desired upright judges a Herculean task. The sought-upright judges are to take off with the planned trial of alleged looters, while the constitution amendment for the establishment of the special looters' courts is being pursued, which Sagay said could run into next year. The reform being planned in the anti-corruption war would also see anti-corruption agencies being monitored by the advisory body as a way of checking with the inside from the outside. Sagay's committee may also become the warehouse for petitions for the public before they are sent to the appropriate anti-corruption bodies, after being sieved by the presidential team. To check corruption within, the committee would also have moles within the anti-corruption bodies for insider information, he said. According to him, "with all the relevant agencies like EFCC, ICPC and others, we intend to effectively collaborate with them. "They have nothing to fear. We are not out to take their jobs from them. All this hostility must stop. We have been vested with the powers to recommend people for prosecution. A lot of people who are supposed to welcome us have been hostile. We are here to make their work lighter. All we are going to do is to increase the investigative capacity of these agencies." He also did not rule out the merger of the existing anti-corruption bodies, though noted that such move would not be immediate, considering the bodies being creations of the constitution. In order to further cleanse the judiciary which Sagay said stinks right now, Sagay said the popular Eso panel report and Babalakin review panel report, which indicted many judges still in service up till the Supreme Court, would be revisited. Debunking the insinuation that he was rewarded with the current assignment for saving Governor Rauf Aregbesola from impeachment, Sagay said he weighed in on the Osun matter because Justice Olamide Oloyede brought judiciary into disrepute. According to him, "Oloyede submitted her claims to the appropriate quarters and nobody is blaming her for this. "As a judge, you don't bring yourself down. You don't turn yourself into a street fighter who has no care about dignity. These people (judges) have been placed on a pedestal for us to have confidence in them. What she is doing is a show of shame. "This woman went to the gutter, discarded her robes and effectively walked about naked. She is a disgrace to the judiciary. I am still calling for her exit." Strong indications emerged wednesday that the Economic and Financial Crimes Commission (EFCC) has commenced a detailed investigation into some financial transactions during the tenure of the immediate past Governor of Rivers State, Mr. Chibuike Amaechi. The investigation, THISDAY gathered, was based on a petition by a Port Harcourt-based group, The Integrity Group, which on July 29, wrote to the EFCC, detailing three instances of alleged corruption, graft and abuse of office under Amaechi’s government. In the petition, the group alleged that Rivers State electric power projects were sold and the proceeds converted to other uses through payments amounting to N60 billion to three companies all located at Trans Amadi, Port Harcourt. The petitioners alleged that the transfers, made in US dollars, occurred within a space of one week between December 1 and 8, 2014. The Integrity Group also alleged that the proposed Karibi Whyte Specialist Hospital in Port Harcourt was a failed contract, which cost the state a whooping N4.63 billion in what the petitioners described as questionable circumstances. In the third allegation in their petition to the EFCC, the group stated that Amaechi as governor, appointed a firm of tax consultants, which was given a relatively exorbitant fee of 12 per cent of taxes collected on a much lower monthly collection target of N2.5 billion, even as the Rivers State Internal Revenue Service was raking in about N7.5 billion monthly at five per cent administrative cost, as prescribed by law. The consultants were said to have collected over N1.5 billion in fees within weeks of their being engaged by Amaechi’s government. Responding to the petition, the EFCC in three separate letters titled, “Investigation Activities”, and dated August 13, 2015, swung into a detailed probe of Amaechi’s dealings as alleged by the petitioners. All the three letters by the anti-graft commission exclusively obtained by THISDAY, were signed by the Head, Economic Governance, Olufunke Adetayo-Ogunbode. While two of the letters with reference numbers CR: 30/EFCC/ABJ/EG/T4/Vol.26/386 and CR: 30/EFCC/ABJ/EG/T4/Vol.26/379, respectively were addressed to the Permanent Secretary, state Ministry of Finance, in respect of the sale of the state power projects as well as Clinoriv Specialist Hospital and Leisure Limited, which was engaged to have constructed the still-born Karibi Whyte Specialist Hospital, the third one with reference number CR: 30/EFCC/ABJ/EG/T4/ Vol.26/380 was addressed to the state Accountant-General in respect of the activities of Messrs Collect Nigeria Limited on the collection of internally generated revenue (IGR) on behalf of the state. One of the EFCC letters to the Permanent Secretary, Ministry of Finance, read in part: “The commission is investigating a case of conspiracy, abuse of office and fraud. In view of the above, you are kindly requested to furnish the following: Details of all the assets sold to the NG Power-HPS Limited; total amount received and the account it was paid into; Sales Agreement/Memorandum of Understanding; House of Assembly resolution/approval; investments made from the proceeds if any; documents indicating due process; and any other information that will assist the commission in its investigation.” In respect of the Karibi Whyte Specialist Hospital, the EFCC also requested the permanent secretary to furnish it with the following: MoU with Clinoriv Specialist Hospital and Leisure Limited; evidence of due process in the award of the contract; executive council resolution/approval; total sum allocated for the project; account number and bank where the funds were paid; status of the contract awarded to the company; payment certificates issued/ valuation reports; contract award documents and; any other information that will assist the commission in its investigation. On the tax consultancy allegation, the EFCC asked the state accountant-general to supply it with the following information: Details of internally generated revenue between 2007 to date; evidence of disbursement and five per cent retained within the period; the MoU between the state government and Messrs Collect Nigeria Limited; details of due process in the award of the contract; details of payment made to Messrs Collect Nig. Limited; House of Assembly resolution/approval; state executives (that is, State Executive Council) resolution/ approval; and any other information that will assist the commission in its investigation. The anti-graft commission concluded in each of the letters that the request for the specific information in the on-going investigation of the allegations against Amaechi’s government was “made pursuant to Section 38 (1) and (2) of the EFCC (Establishment) Act 2004". Senators, House of Representatives members and members of other legislative houses in the country who are lawyers, on Monday intensified their desire to be conferred with the prestigious rank of Senior Advocate of Nigeria, SAN.
The desire also affects all lawyers working in legislative houses in various capacities.
Besides claiming that they worked harder than judicial officers, the lawmakers argued that regular lawyers and other legal practitioners were not better qualified for the rank than the legislators.
The members pressed for the recognition during the inaugural meeting of “The Forum of Lawyers in the Nigerian Legislature”, held at the National Assembly in Abuja.
Convener of the forum, Senator Ita Enang, while speaking for the group, said since the lawyers in the legislature participated in passing all the laws used for legal practice in the country, they were qualified for the rank of SAN.
Enang, a former Chairman, Senate Committee on Rules and Business, stated that it was an “insult” to say somebody who made a law was not qualified to become a SAN, while another person who practised it could become one.
He spoke more, “It is an insult not to make legislature lawyers SANs.
“They make laws that the magistrate interprets and makes his way to the Supreme Court. Yet, you say that a lawmaker is not qualified to be honoured with the rank of SAN.
“The legislator is not qualified but the lawyer who practises the law passed by the legislature is qualified.
“Legislative practice is an arm of legal practice and should be recognised as such.
“It is the legislature and the legislator that know the laws more than the practitioners because they draft the laws.
“All the laws that practitioners practise and they are celebrated and honoured are passed by the legislature, but you say that same legislator is not qualified to be a SAN.”
Speaker of the House of Representatives, Mr. Yakubu Dogara, told the session that the aim of the forum was to promote the productivity of lawyers in the legislature through capacity-building programmes.
Dogara, who is a lawyer, was represented by another member and lawyer from Abia State, Mr. Uzoma Nkem-Abonta.
He added, “The association is to promote cooperation, networking and interaction among its members.
“Develop legislative practice as an enviable area of legal practice in Nigeria.”

MAJORITY of the judges nominated for probable appointment as heads of the proposed anti-corruption specialised courts failed the integrity test being conducted by security agencies, Nigerian Tribune learnt on Sunday evening.
Nigerian Tribune learnt that the major criteria are that the nominee must be a bold judge that does not give sentimental judgments.
The judge must also have less judgments thrown out at the court of appeal.
One hundred judges selected from courts across the country by the leadership of the judiciary were reportedly placed before security agencies for a deeper look into their stewardship, before the final pick for the sensitive assignment.
Thirty-seven specialised courts are reportedly being planned by the administration of President Muhammadu Buhari in all the states and Federal Capital Territory (FCT), Abuja, to solely and speedily try alleged looters.
An involved security source told the Nigerian Tribune that the assignment was yet to be concluded, because majority of those picked for screening failed the integrity test.
Those picked by the judiciary were said to have been carefully selected as the best of the pack. The source further disclosed that fresh nominations had to be made for consideration, after majority of those initially provided could not scale the integrity hurdles.
The source added that the development had elongated the exercise because such delicate assignment must be conducted diligently, in order not to add to the problem which their appointment was meant to solve.
When asked about the statistics of performance, the source said though some of the nominees scaled the hurdle, a lot of them could not. “You know what judiciary is like in Nigeria today. The entire place (judiciary) is in a complete mess,” the source said, though it could not say exactly when the screening exercise would end.
The source also faulted the comment credited to Professor Itse Sagay, head of the presidential advisory committee on anti-corruption war, calling on suspected looters to take the advantage of its existence to return stolen wealth in exchange for reduced punishment.
“Either Sagay or his committee cannot make such an offer. It is not within their power to do that. That can never be part of their brief,” the source added. It said Sagay’s committee would do well by having an interface with anti-corruption bodies and other relevant security bodies in the country and know more about their workings before making any recommendations to the president.
When asked if such contact had been made by the committee, the source answered in the negative, though certain that the desired interface would still happen.
When the Nigerian Tribune contacted Sagay on the modalities and the call by Nigerians for an unconventional method for fighting corruption, he said the committee was open to suggestions that would effectively tackle corruption.
On the call for the involvement of other professional bodies and prosecuting looters more on tax evasion on illegally-acquired properties, Sagay welcomed the idea as long as it would take care of looters and their activities.

THE camps of Senate President, Dr Bukola Saraki and that of former governor of Lagos State, Senator Bola Tinubu, appear to be playing a cat and mouse game, following the appointment of a former chairman, Lagos State Board of Internally Generated Revenue, Dr William Babatunde Fowler, as the acting Executive Chairman of Federal Inland Revenue Service (FIRS). Fowler is to assume duty in acting capacity, pending the confirmation of his appointment by the Senate. Fowler was appointed Chairman, Lagos State Inland Revenue Service in 2005 by then Governor Tinubu, a position he held till 2013. It is believed that his achievements as head of the Lagos State tax office, coupled with his closeness to Senator Tinubu, got him the nomination for the FIRS job. However, the camps of two notable leaders of the All Progressives Congress (APC) appeared at loggerheads over Senate’s screening and confirmation of the former Lagos taxman. Fowler is regarded as Tinubu’s man, which is making some loyalists of the ex-governor to reach out, in view of the fear that some senators were aware that Tinubu would need the Senate under Saraki to confirm their associates. A senator said media reports in recent times, which portray Saraki as kowtowing to Tinubu, had not helped matters, as, according to them, the APC leader needed Saraki more at this time. “Rather than Saraki eating the humble pie to plead with Tinubu and others, it is the other way round, but the media has portrayed things otherwise,” a senator in the know had said. Those loyal to the Tinubu’s camp are, however, said to be mindful of the powers of the Senate over nominees of the president, especially going by the rejection of the last nominee to the office under President Goodluck Jonathan, Mrs Mfon Akpan from Akwa Ibom State. The nominee was blocked from being confirmed by senators of the Seventh Assembly. Nigerian Tribune gathered that some politicians may fuel the anti-Fowler war because they see the office of the FIRS chairman as strategic, which should not be zoned to any politician. Also, Nigerian Tribune gathered that, “the Like- Mind Senators are particularly irked that while Tinubu is the one who needs them for the successful confirmation of his allies, who would be named by the president, things are being portrayed as if it is the Senate that needs him.” Another senator said many pro-Saraki senators, especially those that appended their signature to the vote of confidence for Saraki, were insisting on a payback time for Tinubu’s men. The Tinubu loyalists, looking for ways to ease the path of Fowler during screening, had realised that they actually needed the Senate President’s support. “They can’t afford to fight him now,” a senator told the Nigerian Tribune. “There will be a lot of trade-off as we get to the period of ministerial nomination and confirmation hearings. What we do not like is this idea of running with the hare and hunting with the hounds. Those who need us for their own interest, different from the interest of President Buhari, are now making it look like we need them,” one of the pro-Saraki senators said.
