Justice Ibrahim Buba of a Federal High Court in Lagos on Tuesday dismissed a suit seeking to fire Assistant Inspector General of Police, Joseph Mbu, over his alleged abuse of power. In his ruling, Mr. Buba said no court in Nigeria could declare the office of a police officer of the rank of AIG vacant, saying that such action was the responsibility of the Nigeria Police. “If any threat is made against any person, it is the duty of the police to investigate and punish the officer who made it accordingly, even if it is an AIG. “No court in Nigeria can declare the office of such officer vacant; it is the duty of the police,“ he said. Mr. Buba said that the case of the plaintiff had no merit and was therefore dismissed. In the substantive suit numbered FHC/L/CS/149/15, the plaintiff, Tope Alabi, a lawyer, sought a declaration that the first defendant, Mr. Mbu, “is unfit to be a police officer in Nigeria.” Mr. Alabi hinged his prayers before the court on an alleged statement by Mbu, in which he threatened to kill 20 civilians in place of a murdered policeman during the April general elections. The plaintiff had asked the court to direct relevant police authorities to declare Mr. Mbu’s office vacant and replace him, without further delay. The second to fourth defendants were the then Inspector General of Police, Suleiman Abba, the Police Service Commission and the then Attorney General of the Federation, Mohammed Adoke. Mr. Alabi had said that Mr. Mbu, as a senior police officer, swore to uphold the rule of law and abide by the constitution, but instead, behaved as if he was above the law. The Counsel to the Applicant, Femi Falana, had in his originating summons, urged the court to grant the prayers sought by his client. But Mr. Mbu, who is in charge of Zone 2, comprising Lagos and Ogun States, in his counter-affidavit, denied ordering the police to kill civilians in place of any policeman killed during the elections. The counter-affidavit was deposed to on Mr. Mbu’s behalf by a policeman, Olugbemiga Adeoye. Mr. Mbu denied ever making the alleged statement, and added that he only ordered that any policeman shot by any person could shoot back in self-defence. Mr. Mbu averred that the newspaper publication containing the said allegation was “completely false, exaggerated, twisted and totally quoted out of context.” Mr. Adeoye said he was at the briefing where Mbu made the alleged statement. Mr. Adeoye noted that to the contrary, “the true position is that during the official tour and briefing of police officers at Lagos and Ogun State Commands, Mbu directed every police officer to be law- abiding. “Mbu urged us to work hard and wake up to our constitutional/statutory duties, and that we must respect every citizen’s rights in the course of the performance of our duties. “He advised us that any policeman shot by any person could shoot back in self-defence.” The Legal Officer-in-Charge of Zone 2 Police Command, Chukwu Agu, urged the court to dismiss the suit with substantial cost. Mr. Agu, further urged the court, not to rely on newspaper publications tendered as exhibit because they contained unverifiable and uncertified facts. The Christian Association of Nigeria has appealed to church leaders in Osun State to rally food aid and money to assist Osun State civil servants who are going through hardship because of the delay in the payment of their salaries for the past seven months. The Chairman of CAN in Osun State, Rev. Elisha Ogundiya, said this in an interview with journalists in Osogbo on Tuesday, after the meeting of the executives of CAN in the state. Ogundiya said that churches should go beyond feeding their congregations with spiritual food, especially at this time but should also rally round to offer them succour. He said, “I talk about Christians and Muslims and others who are passing through hardship in Osun State because of the non-payment of their salaries for months. “Workers are passing through hardship and some who have retired have died because of lack of money to take care of themselves. We Christians have to emulate the action of the Good Samaritan in the Bible, who assisted somebody he should not assist ordinarily. So, we should assist our brothers and sisters. “I urge church leaders and local government chairmen in attendance to go back home, contribute food and other items to assist all these people who are in need. “To the government, we are appealing to the government to look for whatever means to make life beautiful for these people. We know that the problem is not peculiar to Osun State alone, but this is lingering too much. The state government should do something urgently to put smile on the faces of the workers.” He implored members of the association to be united in order to further propagate the gospel. The Chairman of CAN in Osogbo Local Government Area, Rev. Adesola Olubadejo, thanked the leadership of the association for taking the step in the right direction. Olubadejo said he believed that the situation was not beyond what God could rescue. He urged members to commit the state to God’s hands in prayers. He said, “One of the challenges facing our local branch of OSLG CAN is that majority of our churches are finding it difficult to cooperate with CAN by attending meetings and paying their dues. “We shall be grateful if heads of churches can encourage their members to participate more by giving what is CAN’s to CAN regularly and faithfully.” It will be recalled that Pastor Olumuyiwa Emmanulel of the Winners’ Chapel, Osogbo, on Sunday made an appeal to members of the church to bring foodstuffs and money to the church for distribution to civil servants within the congregation. Meanwhile, the National Association of Nigerian Students has called on the state government to find means to pay the workers their seven-month salaries without further delay. The students body said the state should prepare for its “revolutionary movement” if the salaries were not paid by June 22. The Chairman of Osun State axis of NANS, Mr. Lukman Adekitan, said this in a statement in Osogbo on Tuesday. He blamed lack of sound economic management by the administration of Governor Rauf Aregbesola for its inability to pay workers for the past seven months. But Aregbesola had earlier said his administration had lived within its means trying at all times to fulfil government’s financial obligation to workers. The governor said his administration had in no way exposed the state unnecessarily to financial hardship, contrary to the accusation of financial recklessness levelled against the government in some quarters. The governor blamed the financial hardship in the state on dwindling revenue and hike in minimum wage which started in 2012. http://www.punchng.com/news/can-urges-churches-to-donate-food-to-osun-workers/ |

A group of elected lawmakers on the platform of the All Progressives Congress, APC, has accused their party of carrying out fraudulent activities in the race for the position of Speaker of the House of Representatives. The group dismissed a mock election the APC held for the representatives elected on its platform. The election held on Saturday by the ruling party was won by Femi Gbajabiamila (Lagos), one of the two APC aspirants vying for the position of speaker. However, the Consolidation group of APC lawmakers-elect, which is rooting for Yakubu Dogara (Bauchi), also a member of the party, boycotted the poll. In a statement on Sunday, following their meeting at Bolingo Hotel and Towers Abuja, the Consolidation group said it rejects the mock election because it was “fraudulent” and “not in tandem with the constitution.” The group added that the John Odigie-Oyegun-led leadership of the APC brought ridicule to the party in an attempt to “allow the number four citizen of this country to be pocketed by one selfish and greedy individual.” Although the group did not mention the “selfish and greedy individual,” its is believed to be referring to Bola Tinubu, a national and influential leader of the APC who is perceived to be supporting Mr. Gbajabiamila’s candidacy. The latter has denied being sponsored by Mr. Tinubu, saying the former Lagos governor was very reluctant to support his candidacy despite appeals by other party leaders including the Kaduna State governor, Nasir El-Rufai. Our fraudulent party In its statement by Abdulmumin Jubrin (Kano), the Consolidated group said,”The APC leadership keep telling the public that an election was conducted and Hon. Femi Gbajabiamila got 154 votes while Hon. Yakubu Dogara got 3 votes. It is a blatant lie, fraud and shameful for the APC leaders to descend so low.” “The mock election actually showed that APC has made a mockery of itself because we walked out of the venue even before they perpetrated the illegality. “Hon. Dogara was not in the hall as at the time they said he was nominated but the APC leaders planted someone who impersonated one of us and another person was also planted and he accepted the nomination. This is fraudulent, shameful, and dishonest. It was all arranged and done by APC.” “The stability of the House is very important and the the House to be left alone to elect its speaker. We will never allow the number four citizen of this country to be pocketed by one selfish (individual). We want a courageous speaker who is free from the apron strings of a godfather and not one that will create special bedroom in the pocket of an individual,” Mr. Jubrin, who had earlier showed interest in the speakership position but stepped down for Mr. Dogara said. The group expressed optimism that its candidate would emerge Speaker on Tuesday when all the members, including those of other parties, would elect the principal officers of the House. “On Tuesday the real picture of the strength of our candidate Hon. Yakubu Dogara will emerge. “We are shocked and surprised that barely two weeks after taking over as the ruling party, is this the change we want to offer to Nigerians? Is this the departure from the past that Nigerians wanted? “We have never seen this kind of manipulation in the political history of Nigeria. We are being intimidated and threatened because we tow the path of honour. “We decided to follow our conscience and do the right thing for our country. “We won’t let this country down. Despite the mockery of an election by the APC we are going ahead on the 9th June 2015 to nominate Hon. Yakubu Dogara on the floor of the House as speaker. They don’t understand the dynamics of an election of House leadership “This is the House of the Nigerian people, we are going ahead to nominate our aspirant who has what it takes to lead us. Dogara is stainless, he comes with integrity similar to that of President Muhammadu Buhari. “We have decided that the only place we can also take our case to, because of the huge amount of threat and intimidation to some of us, we have decided to write a petition to the President of the Federal Republic to intervene and call the party leaders to order. We are very confident that the president will look at the matter in a very just manner.” Both groups within the APC reps-elect are lobbying to get the support of the Peoples Democratic Party reps-elect who form the second largest party representation in the House. APC appeals for calm In a reaction to the anger of the Consolidation group and a similar one among aggrieved senators-elect on its platform, the APC has appealed for support for its actions. The party said in a statement issued in Abuja on Sunday by its National Secretary, Mala Buni, that it is natural for some members to be disappointed by the outcome of the straw poll that was conducted to select the party’s official candidates for the post. ”However, we must put the interest of our party above personal interests and avoid a situation whereby any other candidates, apart from those picked by the party, will emerge as Senate President and House Speaker on Tuesday. ”Any outstanding issues will be resolved by the party so we won’t go into Tuesday’s election with more than one candidate each for the two posts, Senate President and Speaker, House of Representatives,” it said. The party added that it would be a shame if, despite its majority in both chambers of the National Assembly, the APC is unable to produce a Senate President and a House Speaker of its choice. The APC said its role in the business of ensuring a common front within the party ahead of Tuesday’s election is that of an honest broker, saying its goal of ensuring that the party does not go into the election with more than one candidate for each post has now been achieved. The party appealed to all aggrieved members to sheathe their swords and allow peace to reign, in the overall interest of not just the party but the entire nation. http://www.premiumtimesng.com/news/headlines/184510-apc-lawmakers-elect-accuse-party-of-fraud.html |
