Sir,

I share the bolded sentiments with you, in its entirety.

Based on the principle of Separation of Powers, each arm of Government should be independent and able to discharge it duties without fear or favor from another arm of Govt.
Such fear would arise from issues of threat to "starve them of fund" (Executive => Judiciary and legislature), prosecute them (Executive => Legislature), with-hold the passing of financial legislation to run the Govt (legislature => Executive), Unfounded threat of impeachment (legislature => Executive) e.t.c

Immunity is a PROTECTION from Prosecution, while occupying a designated office.
But as has been identified above, such Immunity has to be assumed with a sound character, responsible personality and not abused to commit and act with impunity! fayose is a good example of the latter parts!

On the Legislature, we should ask ourselves: Why do they need Immunity? What level of "protection" do they currently have? and finally? What is their antecedents, that makes them a candidate for such immunity?

On a general note, everyone who occupies a Public office cannot enjoy immunity from prosecution because it is a very powerful constitutional protection!

1.) the legislature already enjoys "financial immunity" such that whether salary are not paid or Nigeria earns only ten Naira in a financial year, their own ALLOCATION from the Nation's purse is guaranteed! Yes, they would get their MONEY if me and you cannot be paid for work done to the public service, whether Hospitals cant buy Oxygen to attend to surgery patients, whether teachers cant get salary, e.t.c

This is explained a few months back when the Senate President, Bukola Saraki bought close to 50 Vehicles (cant remember the exact number now) at #36Million Naira each, as GIFT for his fellow Senators who followed him to the CCT tribunal ..... in a country that was so broke that majority of States were going abroad to borrow money to pay backlog of salaries to public servants!
He claimed that money was the money left from the previous years Budget..... but one might ask if unspent Budget are not supposed to be returned to the nations treasury and used judiciously?

The Executive Arm of Govt could have seized the money but then, the NASS money is under IMMUNITY! grin

Again, we know that a lot of our former Governors simply "transformed to Senators" by brazen rigging and using state funds to buy elections!

Question is why would someone who has governed a State for 8years, seek to become a Senator (Not even a Minister?)
The answer lies in the "partial protection" they enjoy (a sort of mini-immunity) as Senators!

Our own Senators want to use the Senate to "protect their criminality"..... as opposed to use it to make laws that better the citizens and protect the weak!
Thieves and treasury looters clamour to become Senators just so they can be shielded from their past crimes!
If the Govt agency tries to prosecute a former Governor (now Senator) who has looted his state's treasury (like most ex-Governors).. he will simply brandish the "they want to muzzle Legislative Arm of Govt Card"... so his mates can rally around him!
You know their is "protection/honor between thieves"! grin

Many Governors who are now Senators have killed people or organised assassinations of their political opponent! Remember Bola Ige was the nations Attorney General when he was murdered in his bedroom?

Now, imagine if such people are given constitutional immunity from ALL PROSECUTIONS, like the Governors! It would be MAYHEM on earth!

Finally, the 'reason detre' behind giving Federal and state Executives "immunity' was to prevent them from being subjected to frivolous, legal distractions which would prevent them from adequately discharging their responsibility to the Public (everyone will sue the President or Governor, if they can!)
It was not construed to be used as an instrument of oppression or abuse of office or to commit and cover-up crimes!... which is what it is mostly being used for, by some of those enjoying it now, despite their number being limited.

I have predicted before now that the first thing Fayose will do just before his immunity expires, is to become a Senator!
he wants to shield himself form answering for whatever crime he has been accused of!

So, if you give Senators immunity, Senators who by their antecedents have shown that they dont err on the side of the Citizens?
Senators who blatantly increase their own Salaries and Allowances when the same Govt is asking the citizens to "tighten and already tight belt"?
Senators who are known to collect Bribes and pervert the course of Justice?
Senators who collect salaries for doing virtually NOTHING, some dont even attend sessions and only do so when there is money to be shared?
Senators who cannot purge the criminals amongst themselves?


My point is you dont accrue such "absolute power" to irresponsible and very selfish people!
Everyone accused of a crime should be willing to go to the court to prove their innocence and defend their integrity. Even sue for Libel/Defamation/Character assassination.

No one should be able to say "I dont want to be charged o court", in the absolute sense..... Not even the President (though he gets "impeachment" on his neck, to checkmate him, something Senators dont get)!

I would rather Judges have immunity (and they also do to a little extent, in their own Court..... and the Judicial Council is also a disciplinary body for them..... whereas there is nothing like that to discipline Senators!)

As of now, only the Legislative arm of Govt (out of the three Arms) does not have a "check and balance" body to discipline them!
They cant even be recalled by their constituency or removed when they "jump ship" after being elected on the platform of a political party.

Its this bad already!


Do you also remember the Senator Farouk Lawan-Gate scandal? was he prosecuted or disciplined in anyway? NO!

Now, imagine adding immunity to the protection of such criminals!

Infact, if you ask me, l would suggest that the Senate be abolished "as it is" now, turned to a "part-time" body (where they are paid only a stipend as sitting allowance and can do their daily jobs elsewhere) while making laws for the country.

There is too much "money and power" attached to these political offices, that is why it has become a do-or-die affair and Criminals are attracted to it ......more than intelligent, patriotic people!


The IMMUNITY thing should even be restricted to the President alone and the V.P should only have it when they are acting in capacity as President
Forget giving it to Senators. That should NEVER happen!

Bro you've been absolutely spot on about this. God bless your sound mind and intelligence. My own take now is that we need CONSTITUTION AMMENDMENT so that this immunity of thing can be either removed OR changed from "Absolute immunity" to "conditional immunity"

I read the article and some paragrapgh, which l quote below, is worth "examining" for CLUES!

The lady that Fayose is currently accusing of being the "accused person" in the scandal, has a relationship of "HUSBAND and WIFE" with President Buhari... going over 30yrs and predating the scandal (which was between 2001 AND 2005)

Based on these FACTS (as against opinions), the President's wife cannot be the accused person, who was his daughter (adopted or biological) as shown in the witness depositions.

FAYOSE missed this one, except he can provide incontrovertible proof, that both are one and the same person.
As of this moment, he has not done that.

Thanks mate for giving your own take on this and I am glad we still have reasonable ppl who will comment on a post with logic and their own findings based on facts available. Well for me I just want this country rid of our corrupt leaders and it should be done soonest.

Meanwhile can you please tell me your take on this issue of the legislatures asking for immunity for their leaders just like the executive arm of the govt are enjoying?

i know the couple personally and i can CONFIRM that the husband's friend being talked here is KADRI TAIWO (KATAWA PROPERTIES) and Mide is the Ambassador of Katawa properties (a very big estate management company). The only person i pity in all these drama is Katawa's wife (Opeyemi Esan Kadri)
