The position of law is that illegally obtained evidence apart from confession is admissible in law. What matter is relevancy and not how it was obtained. See the case of MUSA SADAWU . V. THE STATE. However, if a crime or tort (civil wrongs) was committed in the course of obtaining such evidence, the person who so obtained such evidence illegally may be liable criminally or tortuously or both, but it does not affect the admissibility of such evidence in law court.

Relevancy is the yardstick for admissibility of evidence and not how the it was gotten. An illegally acquired evidence is admissible provided it is relevant before the court. Electronically generated evidence is admissible in law provided it is relevant to the issue before the court. That INEC does recognise results from its server is immaterial.

Why did it take INEC so long to deny the result? If the results from the server are fake, why the threat to arrest Atiku for hacking into INEC server? The truth will certainly come out during the hearing of the petition.

It is not the responsibility of PDP to ensure that the results they allegedly got from the INEC's server are correct. They are presenting the results the way they are on the server.

. The use of card readers is not back by the Electoral Act but it is back by regulations validly made by Inec. Regulations have the same force of law as Acts made by the National assembly.
