ganisucks: Wrong. A comma before AND is an Oxford comma. Oxford commas are simply for fancy. Whether you put a comma or not, the conjunction AND satisfies the function. AND is the conjunction, not the comma.
Also Nigeria is a big man country. Our law givers always like inputing the maths and English credits clause in most of our laws. They borrowed this thinking from the British: the masters of class and levels. Throwback just like his fellows are irredeemable. No amount of understanding can give him a iota of understanding. The constitution does not say anything about this but by reasoning, you and I know this scenario is not possible. More over, it is not compulsory to win in FCT. 25% in FCT is the bone of contention here. |

I never understood the much difference between the use of two important conjunctions i.e. AND & OR until I reflected on what I have been teaching my students in Logic, Probability and Concord classes. Today I want to use my knowledge of Logic to prove that it is mandatory for a presidential candidate to win one-quarter of votes in FCT before he/she could be declared winner. So as to make my explanation short, simple and straightforward, I would be using Probability and Concord for further explanation at a later time.
Firstly, what does the constitution says: There are two (2) conditions for determining a winner of a presidential election:
1. A presidential candidate must secure the highest number of votes cast at the election
2. He/she must secure not less than 25% of votes cast in at least two-thirds of all the States of the federation and FCT.
The main cause of argument is at the bolded (and).
In Logical Reasoning, AND & OR are not synonymous. These two words have distinct meaning. While AND is a CONJUNCTION, OR is a DISJUNCTION.
In set notation the intersection of two substatements represent the conjunction of every statement. A conjunction is true only if both of the substatements are true.
True + True = True True + False = False False +True = False False + False = False
Also, in set notation the union of two substatements represent the disnjunction of every substatement. A disnjunction is true if either of its substatements is true or if they are both true (it is only false if they are both false.
True + True = True True + False = True False + True = True False + False = False
My thought
The second electoral criteria above consists of two substatements separated by "and." For the whole statement to be true (fulfilled), the two substatements must be fulfilled.
I think those who drafted the constitution intended to use OR but mistakenly use AND out of ignorance. Their motive was to use OR instead of AND after all the people living in Abuja are not more special than the people living in other parts of the country. So the only condition by which Tinubu can win this argument in court is if the supreme court judges decide to help him out by looking at "technicalities'' instead of what Nigeria Constitution actually says.
In conclusion, to be declared Presidential winner, a candidate must secure at least 1/4th (25%) of votes cast in 2/3rd of the entire 36 States of Nigeria (that is in 24 states). Also, the candidate must also secure not less than 25% of the votes cast at the FCT. |

Summary of What Happened in Court Today at the Presidential Election Petitions Tribunal Pre-hearing: Case Against Tinubu/APC/INEC Begins.
● The presiding Judge is Justice Haruna Simon Tsammani. He heads a 5 Man Pannel of Justices.
● Tribunal Listened To Peter Obi's Case Against Tinubu, APC and INEC.
● The Plea By Obi's Lawyers To Televise The Proceedings was REJECTED.
● They announced That All Cameras Should Be Taken Out Of The Court Room And Everyone Should Keep Away Their Phones.
● AA party lawyers who came to represnt same party didn't know each other and when there is no clarity on who is the real lawyer, they both withdrew their petition against Tinubu, leaving another party called APM.
● Peter Obi's pre-hearing case was to verify if all parties have filed their responses.
● Gov. of Plateau state created his own drama too when he claimed to be representing and he was told he can't represent respondent, he changed it to "I will represent APC then". Looks like this whole this is a joke to APC by the way they have acted.
● Atiku's pre-hearing moved to tomorrow because of time.
● Journalists were barred by police who barricaded the court entrance while some Nigerians were seen protesting far away from the court.
● All parties involved agreed to cooperate with the Court during the course of the matter.
● The Presiding Justice set the tone for all the Election Petitions, stating that the Court will look at every matter on its merit and timeously, not only on grounds of technicalities.
● Lamidi Apapa abi Tincan didn't show up at the court today, but I suspect that Channels & TVC will likely invite him for interview this evening or tomorrow, just to give impression that LP is divided.
● A coalition of civil society groups protesting outside the Court of Appeal building in Abuja during the pre-hearing of the Presidential Election Petitions Tribunal on Monday.

Initially, I thought Drug Daddy's surpporters are blinded by party politics but I was wrong. I came to this realization when I begin to see that these guys are always on the side of evil even when Tinubu or APC is not involved. They are hell bent to always be on the wrong side.
For instance, check their views on Ekeremadu's court case in United Kingdom. Tinubu's surpporters are boldly defending Ekeremadu but cursing and insulting Ekeremadu's victims (that innocent young man). Who in his right sense commend a criminal but condemn his victim. These guys' minds are programmed to be on the evil side. They are Putin's fans, they rejoice at killings by Fulani herdsmen, and they celebrate criminals like corrupt politicians and drug barons.
What manner of men are Drug Daddy surpporters? Tinubu's surpporters are a different breed entirely. May I never meet such people in real life. To them black is white and black is white. Evil is good and good is evil. What can turn human beings to monsters? |

The Director of the Abuja School of Social and Political Thoughts, Sam Amadi, has insisted “the nation can’t build legitimate governance without electoral justice.”
He said it is “completely dumb” to run an electoral system that puts someone in power and asks him to defend his election as commander-in-chief.
Recall that Amadi had claimed the President-elect, Bola Tinubu’s inauguration could be stopped before May 29, insisting that he has a serious case before the tribunal that could go either way.
The former Chairman of the Nigerian Electricity Regulatory Commission, NERC, in a tweet on Sunday, urged his critics to “exit track of electoral triumphalism and get on electoral justice”.
He wrote, “Those who think they have big brains should be thinking hard about the future. Nigeria will have a new government with limited and contested mandate. Instead of thinking how to enjoy Aso Rock, think about how to deal with this crisis on top of an almost vanished state power.
