Crisis appears to be deepening within the ranks of the main opposition Peoples Democratic Party (PDP) in Kogi State, ahead of the November 16 governorship election. The fresh crisis rocking the PDP is said to be a fallout of the party’s primary election, which saw the emergence of Musa Wada, an engineer, as the governorship flag-bearer for the November governorship election. Wada polled 748 votes to clinch the party’s ticket. But the senator representing Kogi West, Dino Melaye, and Abubakar Ibrahim, son of a former governor of the state, Ibrahim Idris, kicked against the emergence of Wada and consequently petitioned the National Working Committee of the party. Abubakar scored a total of 710 votes to emerge second while Senator Melaye scored 70 votes at a primary poll conducted in Lokoja on September 3. Senator Melaye said he rejected the outcome of the primary election on the ground that all the votes cast in his favour were not counted before gunmen disrupted the exercise. Daily Trust on Sunday learnt that both Melaye and Abubakar Ibrahim submitted their petitions to the party’s appeal committee, but the issue was not resolved in their favour. Consequently, Melaye turned down the appointment given to him by the party to serve as its campaign director-general for the November 16 governorship election. The senator, who made his position public via a tweet stated, “Let me state categorically that I have turned down the position of director-general of the PDP Kogi State Governorship Campaign Council. I wish the PDP all the best. When truth is a casualty, there is chaos. Melaye’s reaction indicates that the Kogi PDP is divided, less than two months to the governorship election in the state. On his part, Abubakar Ibrahim, who came second in the primary election, also questioned the emergence of Musa Wada as the party’s flag-bearer. He argued that he would have won if the election did not end violently. Meanwhile, Abubakar Ibrahim has gone to court seeking to be declared the candidate of the party. The spokesman of the Abubakar Ibrahim Campaign Organisation, Shaba Ibrahim, who briefed reporters on the legal action filed at the state High Court in Lokoja, faulted the processes that produced Musa Wada as candidate of the party. “As democratic and law-abiding people, we have taken steps to seek redress within the confines of the law. We have approached the court to seek redress and it is because this matter is not otherwise subjudiced; we will not go into further details. “But suffice it to state that we have won. We pray the court to declare Alhaji Abubakar Ibrahim the candidate of the PDP based on the valid votes recorded at the primary election,” he said. This is just as a former acting governor of the state and chieftain of the PDP, Chief Clarence Olafemi, has threatened to dump the party for the All Progressives Congress (APC) over an alleged injustice meted to him by the party’s leadership. Olafemi, who was the campaign director-general to Abubakar Ibrahim in the last primary election, said the party had “cheated” him on several occasions; hence he could no longer pitch his tent with them. He said his recent visit to Governor Yahaya Bello was because of impunity in the PDP. He said he was one of the strong members of the PDP in the state, yet the National Working Committee of the party failed to recognise his input and efforts. “I was the running mate to Jubril Isah Echocho in the 2015 governorship primary election of the party, but we were later replaced and they brought in Captain Idris Wada and Yomi Awoniyi as his running mate without any reason. “In the 2019 general elections, I was one of the senatorial aspirants from Kogi West, but I was denied the party’s ticket while they imposed Senator Dino Melaye, who just decamped from the APC. “My governorship aspirant in the just concluded primary of the party, Alhaji Abubakar Ibrahim Idris, was denied the ticket of the party by some powers to be in the party, who gave victory to Musa Wada because they hate Alhaji Ibrahim Idris, the former governor of the state. “With all these impunity, how do you expect me to continue staying in the PDP? I am not the first person to decamp from one party to another. President Muhammadu Buhari, and my mentor, Alhaji Abubakar Atiku, all decamped from one party to another. I am not going to be the first or the last. “I had a fruitful discussion with Governor Yahaya Bello and I am very satisfied with the outcome of our meeting,’’ he said. Meanwhile, a former governor of the state, Idris Wada and 9 other aspirants have resolved to support the party’s governorship candidate, Musa Wada. The former governorship aspirants, led by Idris Wada, on Friday, September 13, unanimously adopted Musa Wada and pledged to work for his victory at the poll. Speaking in Abuja, Mohammed Shaibu said the aspirants had reviewed the circumstances that led to Wada’s emergence and decided to close ranks and work with him for the total victory of the party at the poll. He said: “As members of the Kogi PDP 2019 G12, the urgent need for intra-party cohesion and unity of purpose at this critical moment is recognised. It is for this reason that the candidacy of Engr. Musa Wada is considered worthy of undivided support as the task to rebuild Kogi starts in earnest. “Considering the reconciliation efforts of Engr. Musa Wada and his preparedness to actively partner with the 2019 PDP aspirants in Kogi State, the Kogi PDP 2019 G-12, without reservation, accepts him as a partner in progress in the liberation struggle and also accepts to work with him in the overall interest of the PDP and Kogi State.” Political analysts have described the crisis rocking the PDP few months to the governorship election in Kogi as a bad signal. They maintained that if not speedily resolved, the crisis could affect the chances of the party in the forthcoming election negatively. There are fears that some of the aggrieved party stalwarts could move to the APC to scuttle the chances of the PDP in the election. In the meantime, the party’s leadership is also not leaving things to chances as it has commenced some fence-mending moves. The chairman of the PDP in the state, Sam Uhuotu, an engineer, recently inaugurated a reconciliation committee, with the task to identify all aggrieved persons as much as possible, so as to pacify and reconcile with them. The committee has a former deputy governor of the state, Patrick Adaba as chairman, Kabiru Usman, a lawyer, as vice chairman, while Henry Ojuola, a lawyer, is to serve as secretary. Other members of the committee are Dr Stephen Olorunfemi, Chief John Odawn, Olori Margaret Orebiyi, Princess Grace Iye Adejo, Chief Roberts Audu, Hon Chief Moses Ado Okino, Prof Olugbemiro Jegede, Hon (Dr) Musa Ahmadu and Hon JJ Idachaba. As it stands, the outcome of the reconciliatory efforts will, to some extent, determine how the PDP would fare in the forthcoming election in Kogi. Over 150 communities across nine local government areas of Kogi State have been submerge by flood. The state’s Commissioner for Environment and Natural Resources, Pharm. Sanusi Yahaya, disclosed this on Saturday while speaking to journalists after stakeholders meeting at the state emergency operation centre in Lokoja. The commissioner noted that the State Emergency Operation Centre had been activated as the state was already experiencing flood emergency as a result of river flooding. Yahaya, who also doubles as the state Coordinator, Emergency Operation Centre (EOC), said that, out of nine LGAs located along the banks of River Niger and Benue, seven LGAs were severely affected while other two were not so severe. According to him, the LGAs severely affected are: Ibaji, Kogi Koton Karfe, Lokoja, Ofu, Ajaokuta, Omala and Idah, saying over 90 per cent of Ibaji communities have been submerged. “Particularly, majority of communities at Ibaji are under water, and many households have been affected and displaced. “As we speak, the water level has risen very high to about 10.60m today (Saturday) in Lokoja from the report of the Nigeria Hydrological Services Agency (NIHSA). “In the last few days, many communities, settlements have been displaced as a result of flooding,” he said. He named some of the submerged communities as Adankolo, Gadumo, Egan, Budon, Kinani, Esikaku, Oreza, Edimose, Enumayi, Ogbangede, Iganumo, Bagana, Obakume, and Idirisu. Others are Edeha, Adabode, Edegaki, Akpaku, Okpaka, Adamogu, Kasemiya, Kpakpazi, Kelebe, Ozahi, Panda, Ikumo, Irenodu, Iganumo, Geregu, among several others. He said that over 20 camps had been opened to accommodate flood victims which were spread across the nine affected LGAs. He, therefore, advised residents of flood-prone and affected communities to relocate to safer places or move to the nearest camps which had been opened by the state and local governments, to avoid loss of lives and property. . We can defend our expenditure – APC . Battle for democracy doesn’t come cheap – Atiku President Muhammadu Buhari and former Vice President Atiku Abubakar as well as other agencies involved in the 2019 presidential election case spent billions of naira pursuing and defending the case at the Presidential Election Petitions Tribunal (PEPT), checks by Daily Trust revealed. The tribunal had on Wednesday last week dismissed the petition filed by the opposition Peoples Democratic Party (PDP) and its candidate, Atiku, challenging the election of President Buhari of the All Progressives Congress (APC) in the February 23 presidential election. The judgement came after 177 days of legal battle in which Atiku, PDP, Buhari, APC and Independent National Electoral Commission (INEC) deployed dozens of lawyers. A lawyer who participated in the tribunal’s proceedings said he was aware the legal fees for all the parties could be up to N5bn. Findings by the Daily Trust revealed that PDP had 20 SANs and 11 other lawyers on its team. APC had about 20 SANs and 50 other lawyers while INEC alongside some interested parties assembled 60 lawyers. Cost of filing a case at the tribunal was at a minimum of N5,000 and in some instances, it might cost up to N25,000 each, our findings showed. It was gathered that lawyers could charge between N5 to N10 billion to prosecute presidential election petition, depending on the nature of the case and the number of Senior Advocates of Nigeria (SAN) engaged in the matter. The stakes in cases relating to presidential elections were often very high compared to governorship, national and state assembly petitions. Similarly, it was learnt that INEC also spent a substantial size of its budget on getting competent and adequate lawyers to defend and prosecute their cases at national and state levels. INEC’s 2019 Election Project Plan showed that the electoral empire budgeted over N1.2bn for legal fees and other related matters, part of which would be expended on handling election cases by SANs and other lawyers apart from their in-house personnel who cannot handle one tenth of the cases involving the commission. The sum covered duty tour allowance and transport costs for the monitors at the hearing of election petitions and appeals, as well as the compilation and printing of reports of petitions and appeals. The Chief Press Secretary to the INEC Chairman, Mr Rotimi Oyekanmi, said six lawyers were used in prosecuting the petition. “It is common knowledge that INEC has several cases in court arising from the various elections it conducted. We have over 800 cases in courts at the moment,” Oyekanmi said. But another source said some interested parties had hired over 50 lawyers who teamed up with those commissioned by INEC in order to strengthened their arguments. Daily Trust reports that more than 15 applications and motions were filed at the Presidential Election Petition Tribunal, while 62 witnesses were invited. In most instances, petitioners that invited the witnesses shouldered their cost of transport, accommodation and feeding. More than 50, 000 documents were also tendered as exhibits of materials used for the election and paid for. These included ballot papers, Form EC8 series, INEC manuals, newspapers etc. They were gathered and tendered from across 36 states. However, some lawyers who represented Atiku and PDP denied receiving huge fees, saying they offered their services almost free of charge. One of the lawyers who does not want to be named, debunked the claim that a lot of money was expended on the election petition, questioning how such an amount could exchange hands considering “the strict monitoring by the present regime.” The source said majority of the lawyers appeared to defend the petition pro bono because they believed in Atiku’s ability to improve the lives of Nigerians. “This will not be the first time such thing (voluntary defence of clients by lawyers) happened,” he said. Another lawyer made reference to what happened in 2015. “Remember when Buhari joined the race for the presidency in 2015, and the issue of his certificate came up, quite a number of SANs came out to rally round him, including the SAN who led his defence.” He, however, admitted that the situation had changed saying, “this time around, the legal battle was not free of charge, but you should know that it is not always all about money but what you believe in.” Reacting to the allegation that Atiku had spent billions of naira in prosecuting his petition, Levy Uzoukwu (SAN) who was the lead counsel of the legal team, said people should disregard talks that such amount was expended to prosecute the case of the former vice president. He said, “The Buhari team made it an issue that we are in-charge of the media, the social media and mainstream media. Where is the money for them? Majority of the social media influencers came because of the passion they have for Nigeria.” Also reacting, counsel to INEC, Yunus Ustaz Usman (SAN), said the information that they collected huge amounts was not true, adding that he will not tell even his mother his professional fee. Also, another counsel to the respondents debunked the claim and said no such amount in legal fees was paid. But he admitted that filing of processes costs up to N5,000 each, while certification of documents cost in the region of N10m. Investigations revealed that what was spent in the last few months at the tribunal would not be the end of the battle, as lawyers who made a lot of money from political parties and politicians during the sitting would look forward to another fortune as the case moved to the Supreme Court. “This is because, as usual, political parties and their candidates are ready to spend any amount to ensure that they win elections either through the ballot box or through the courts,” a political analyst, Usaini Mohammed, said. “Also, remember that judges and other judicial officers receive some allowances…This makes prosecuting petitions very expensive,” he said. Battle for democracy not cheap – Atiku When contacted, Special Adviser to Atiku on Media Paul Ibe told our correspondent that a lot of money was spent at the tribunal. He however, could not be specific about the figures, saying he has no such information.“Well, I wouldn’t know that. I know much would have been spent but I don’t know exactly how much was spent. But I know it wouldn’t come cheap. The battle for democracy doesn’t come cheap; we know that. But I don’t have figures,” he said. At the time of filing this report, PDP National Publicity Secretary, Kola Ologbondiyan, did not answer his calls or respond to a text message sent to him by our correspondent to establish how much the party spent on the case. We can defend our expenditure – APC Also reacting, the ruling APC said it can defend the source of the money spent at the tribunal “no matter the amount.” APC’s National Publicity Secretary, Malam Lanre Issa-Onilu, told Daily Trust on telephone that the party was running its activities from its based internally generated revenue. On the specific amount APC spent at the tribunal, Issa-Onilu said, “I don’t work in the finance department. So, I don’t have an idea. Whatever we spend, on which I don’t know the figures, it is our money. It is internally generated revenue. Unlike the PDP, we didn’t go to any government agency or cover to get it. We can say that anywhere. Whatever the figure is, it’s our money.” Why cost of litigation is high – CSOs Speaking on the huge expenditure at the tribunal, the Lead Director, Centre for Social Justice (CSJ), Eze Onyekpere, said election related spending in Nigeria, especially for presidential elections had always been very expensive. “For the President, the challenge would arise when he spends public resources to finance his defence of the petition; while for the petitioner who is not in government, he is spending his private money. The technical nature of the election petition process is what drives up the costs,” Onyekpere said. On his part, the Chairman, Partners for Electoral Reform (PER), who is also the Convener of “Say No Campaign Nigeria (SNC-Nigeria)”, Ezenwa Nwagwu, said that while the tribunals oversight election and the electoral process, the concern should be if public funds were deployed for private gain. The huge spending by politicians and government agencies at election tribunals, on top of the huge spending during the last elections, raises concern because of the economic hardship in the country, poor public infrastructure and social services as well as delay in implementing the new national minimum wage. The Transmission Company of Nigeria (TCN) on Thursday said the 11 electricity Distribution Companies (DisCos) are not taking the full energy allocated to them according to the prevailing Multi Year tariff Order (MYTO) 2015. In a statement on Thursday, TCN faulted an earlier claim of Association of Nigerian Electricity Distributors (ANED) denying any form of energy load rejection by 10 DisCos that are its members. The MYTO allocation is a percentage of electricity on the grid that is made available to all the DisCos. The DisCos could nominate what they can off-take out of the MYTO allocation for the next day, but they may consume less or higher than that. The transmission company, through its Independent System Operator (ISO) arm, manages the data for daily operation in the electricity industry. It said ANED had misinterpreted energy load rejection analysis in a recent media report. According to it, the ANED claims that there was no load rejection by DisCos and that TCN has not been able to deliver the volume of power demanded daily by each DisCo were not true. TCN gave instance of Kano Disco where on 22nd of August, 2019, the Disco nominated to take 310.60 megawatts (MW) while the MYTO allocation to Kano Disco was 359.38MW. It only took 154.17MW, leaving a total of 205.21MW representing 57.10% of MYTO allocation to it unutilized. Similarly, Kaduna DisCo on the same day requested 280.00MW while MYTO allocation to them, was 359.38MW, but the DisCo only took 166.52MW from TCN substations, leaving 192.86MW (53%) MYTO allocation unutilized. Speaking in a press statement Wednesday, Ekanem advised candidates seeking admission into the polytechnic not to register online, adding that admission is only carried out in the school’s campus. He said the institution would not be responsible for anyone duped through any online admission site, noting that already some persons have fallen victims to the recruitment scam. “The general public is hereby informed that the advertised recruitment did not emanate from Federal Polytechnic, Ukana and should be ignored. “More so, candidates seeking admission into the polytechnic are strongly advised not to register online as registration is done in the polytechnic campus only,” he stated. The Joint National Public Service Negotiating Council has asked Nigerians to appeal to the Federal Government to implement the new minimum wage to avoid an imminent industrial crisis. The organised labour, under the stewardship of Trade Union Side of the council, made the call on Tuesday in Abuja. TUS Acting Chairman Mr Anchaver Simon and Secretary Mr Alade Lawal, in a statement, said efforts by the unions to persuade the government to implement the new minimum wage with appropriate consequential adjustment had proved abortive. They said the TUS had given the government enough time to come to term with workers’ demand, but that it appeared the only language necessary for government to act is strike. They said the union would give no further notice to the government before public servants in the states commence strike over the non-implementation of the new minimum wage and appropriate consequential adjustment.
