Security operatives, on Monday, re-arrested a former Director General of the Nigerian Maritime Administration and Safety Agency, Patrick Akpobolokemi, outside the premises of the Federal High Court on Oyinkan Abayomi Drive in Ikoyi, Lagos. Akpobolokemi was picked up by mobile policemen and plain clothes operatives, who bundled him up and forced him into an awaiting bus just as he stepped out of the court premises. His re-arrest came shortly after his trial over alleged N2.6bn fraud before Justice Ibrahim Buba was adjourned till January 18, 2016. Aside his ongoing criminal trial before Justice Buba, there is another N3.4bn fraud charges pending against him and nine others before Justice Saliu Saidu of the same court, which has been adjourned till January 29, 2016. Akpobolokemi, who was dressed in white on Monday, had just been released from the prison custody on Friday after he perfected a bail of N50m granted him by Justice Buba. He had resisted the move to re-arrest him, claiming that he was on bail, but he was pushed, overpowered and bundled into a waiting bus by security operatives, while his lawyer, Dr. Joseph Nwobike (SAN), looked on helplessly. …………………………………………………………………………………………………….. NAN Justice Ibrahim Buba of a Federal High Court, Lagos, today fixed January 18, 2016 for the trial of former boss of the Nigerian Maritime Administration and Safety Agency, Patrick Akpobolokemi and five others, charged with N2.6 billion theft. Akpobolokemi is standing trial alongside Ezekiel Agaba, Ekene Nwakuche, Amaechi Juan and two companies, Blockz and Stonez Limited and Al-Kenzo Logistic Limited, on 22 counts. The accused were charged by the Economic and Financial Crimes Commission. They were first arraigned before Justice Saliu Saidu of the same court, on December 3, on 30 counts bordering on conversion and stealing. They were again arraigned before Justice Ibrahim Buba on December 4 on a fresh 22 counts, also bordering on conversion and theft. They had all pleaded not guilty to the charge and justice Buba had granted them bail in the sum of N50 million each, with two sureties each in like sum. The court had also ordered the accused to sign an undertaking not to unnecessarily delay speedy trial. Buba had then adjourned the case for trial. When the case was called on Monday, counsel to the third, fifth, and sixth accused, Mr Seni Adio, informed the court that he required some time to prepare for trial, having been briefed. He, therefore, prayed the court for time to peruse the documents and prepare for trial. The prayer for adjournment was also adopted by counsel to the other accused. FORMER Deputy National Chairman of Peoples Demcoratic Party, PDP, Chief Olabode George, has denied collecting N100 million from former Minister of Finance (State), Mr Bashir Yuguda, saying it is another blatant falsehood, stripped of any iota of truth. George, who is also the Atona Oodua of Yorubaland, described the claim as “mischievous and deliberately fraudulent.” The PDP leader, in a statement said: “My attention has been drawn to another mischievous and deliberately fraudulent claim that I collected N100 million from Bashir Yuguda, the former Minister of State for Finance. This is another blatant falsehood, stripped of any iota of truth. This is yet again a depraved continuation of lynch mob journalism orchestrated by an online newspaper.” In an effort to set the records straight, he said: “The salient fact is that very early this year, long before the election period, the party set up Contact and Mobilization Commttee for each zone to reconcile various factions and ensure a firm unity of purpose within the zones before the election. I was elected as the Chairman for the South-West zone. “The committee which was made up of 18 senior members of the party with distinguished history of honour and exemplary leadership, met at least 10 times in my office in Lagos. These people travelled all the way from every corner of the South-West, with three members representing each state. All of them are very much alive to testify to my assertions. Sometime in the middle of these deliberations, Yuguda came to me and said the party was reimbursing the 18 elders of the committee for their transportation, accommodation and feeding allowance for the work that was done. “The committee later submitted the report of its deliberations to the party and then wound up. For all these efforts Yuguda gave the committee only $30,000. That was less than N6 million at that time. Yuguda can never claim that he gave the Committee N100 million. Whenever there is a case of copyright infringement in the music industry, it is usually between a recording artiste on one hand and an individual or organisation, on the other. In most cases, the artiste would be the one accusing the other party – most likely to be a records pirate – of stealing his intellectual property. But a music producer, Divine Austins, aka Deevee, who is also the official producer of D’banj, changed the norm when he took to Twitter a few days ago to accuse popular rapper, Olamide, of stealing ideas for new songs from his boss. In three tweets, Deevee claimed that Olamide had been stealing concepts from D’banj’s recording outlet, DB Records, each time he visited the place in the past. Addressing Olamide directly, he said, “With due respect, have you run out of ideas? Every time you come to our zones, you always got to steal some idea. I won’t let this fly.” The producer went on to provide a link to ‘Shake it’, a song by D’banj, which is one of the reasons for the outburst on the social media network. The other song believed to have been lifted off an original idea by D’banj and his team is Olamide’s ‘Don’t Stop’. Then, as if sensing that his action might annoy his boss, he apologised to D’banj, tweeting, “I am very sorry boss. I mean no disrespect, but I have stayed silent for too long and I am ready to face the consequences for dropping the link.” Olamide, who has just been named the Hottest Nigerian Artiste in 2015 by MTV Base, is yet to respond to the allegations and efforts made by our correspondent to get his reaction through his manager, Alexander, failed to yield positive results. Also, two songs recently released by Five Star Music and the star-studded Mavin Records, titled ‘Ebeano’ and ‘Jantamanta’, respectively, are the subjects of a controversy currently raging in the music industry. According to watchers of the industry, both songs are too similar in terms of the beats to be taken as coincidental. It is speculated that one of the two music companies must have copied or ‘stolen’ the original idea for the beat from the other. But investigation by our correspondent showed that the beat actually originated from the boss of Mavin Records, Don Jazzy, and it leaked to the wrong hands after he sent out snippets of it. While the accusing finger has not been pointed at anyone, so far, the lack of reactions on both sides seems ominous. Pundits say the current controversies may be a sign of a rupture that is bound to come as many of the artistes appear to be contented with mutual but subtle copyright infringement. Her Majesty the Queen of England, Elizabeh Alexandra; President Muhammadu Buhari; Vice President, Prof. Yemi Osinbajo (SAN);and governors from at least 20 states, ministers and other dignitaries are expected to attend the coronation of the new Ooni of Ife, Oba Adeyeye Enitan Ogunwusi Ojaja II. The Chairman, Media Committee of the coronation, Mr. Biyi Odunlade, said this at a press conference that started a series of activities lined up for the coronation scheduled to hold on December 7. Odunlade, however, explained that the queen might be represented at the ceremony. He added that guests from many nations of the world had been invited for the ceremony. The Ooni also said he was ready to fast-track the development of Ife with a series of policies, which he said, would make the Yoruba people proud anywhere they found themselves. The monarch, who was represented at the press conference by his elder brother, Prince Adegboyega Ogunwusi, said he would do everything possible to address the problem of youth unemployment in the town. Ogunwusi, who donated 50 transformers to some communities in Ife before he emerged as the new Ooni, said he would donate additional 50 transformers within the next 30 days to boost electricity supply in the ancient town. He noted that this gesture would make small scale businesses in the town to thrive because power problem would have been reduced. He said, “Let me acquaint you with what I have done in less than 70 days. I have given out over 20 electricity transformers worth about N250m. “I donated 50 transformers when I was a prince. I will buy another 50 transformers within the next 30 days to further enhance electricity distribution. With this, small scale businesses of welders, tailors and others will naturally witness improvement. “Providentially, I know the core investor and the Chairman, Ibadan Electricity Distribution Company, Mr. Tunde Ayeni, personally and very well. Contractors handling the re-construction of the Lagos-Ibadan Expressway, Julius Berger Plc and Raynolds Construction Company (Nigeria), are back on site in continuation of the job. Julius Berger’s men were seen working at the Redemption Camp and Arepo areas at the Lagos end of the road on Friday. But the work was more of a palliative as the firms only attended to the failed sections of the road. No reconstruction or expansion was done. The News Agency of Nigeria also indicated in a report on Sunday that while palliative work was ongoing at the failed spots around the Redemption Camp area of the road, major construction work was being done at the Arepo area. The repair on the Arepo spot caused gridlock on the Long Bridge on Friday and travellers spent about two hours moving from the Berger Bus to Arepo, a distance that should take less than seven minutes. It was, however, not clear the role of the Ogun State Government in the return of Julius Berger to the site. A signpost erected by the state government was still at the Arepo spot as of Sunday, showing that it was responsible for the palliative work. Julius Berger is handling Section One of the project, which stretches from the Sagamu Inter-Change to Lagos, while RCC is in charge of Section Two, stretching from the Sagamu Inter-Change to Ojoo, Ibadan. Motorists have clamoured for an early completion of the road, which is about the busiest highway in the country. A source at the Julius Berger end of the road, who spoke on condition of anonymity, said that the company was back on the road for good, saying: “It is time to move forward on the project.” The expected date for the completion of the project, which is being financed through Public-Private Partnership, is July 3, 2017. Meanwhile, motorists and commuters who use the road have continued to appeal to the Federal Government to speed up work to make travelling on the road pleasurable. A commercial vehicle driver plying the road daily, Ojo Agege, told NAN that it was high time the government ensured the speedy completion of the project. Another commercial driver, Lateef Mohammed, said motorists would continue to have nightmares on the road until the Federal Government fixed it. “All we are saying is that the government should help to fast-track the construction of the road to ease the delay being experienced daily by travellers,” he said. A female trader, Simisola Joseph, expressed optimism that with the coming of Babatunde Fashola as Power, Works and Housing Minister, the construction would soon be completed. A driver, Femi Ajegun, told NAN that vehicular movement was now easy with the completion of work on some critical areas at the Ibadan end of the road. “With the quality of job done and removal of long stretch of diversion by the RCC, motorists and travellers now experience some pleasurable ride,” he said. Sule Maito, a bus passenger, at Ogere area of the road, told NAN that if the contractor could continue with the way it was going, the job would be completed on schedule. The Federal Ministry of Works last week, after a meeting of stakeholders with the Presidency, said that the government had committed N50bn to the project. A former President of the Nigerian Bar Association, Chief Olisa Agbakoba (SAN), in this interview with GBENRO ADEOYE, speaks on Kogi and Bayelsa states’ governorship elections and the challenge Nigeria has had with leadership over the years Kogi election is here and that of Bayelsa State is also near but all Nigerians know are the two major parties, the All Progressives Congress and the Peoples Democratic Party and their candidates. How healthy is this for our democracy? It is a process. You cannot cook democracy overnight; you cannot force it. It evolves and development is tied to things like democracy, education, literacy, which are concepts people don’t understand. So Nigeria is actually a feudal state masquerading as the ideals of rule of law and democracy. But it is not. It is a highly, cultural, feudal, traditional system, where we still rightly or wrongly glorify traditional institutions. So we are absolutely a feudal non-democratic society, forced by western concepts of rule of law to go the way we are going. It is more like Christianity, which is not in our DNA. Our DNA is highly cultural and traditional. So if you look into very many families and scratch deep, you will find traditional practice masquerading as the context of Christian and Muslim worship. So this is not a democratic society. But we now see that democracy is the tool of power. There was a time when it was fashionable to use a military coup as a tool of power. People were killing themselves to be officers but there is no glamour in that again because it is no longer fashionable. It will take roots which could take up to 100 years when you cannot see a guy on the street begging. Then you will see waves of protests by people because of the values they espouse. The streets will be full of Nigerians saying we don’t want this or that because it is wrong. In Europe, you see that protests are easily organised, but it is not so here. People quickly run to the ruling party here. So today, it is sexy to talk about the APC, but don’t forget that just about six months ago, it was all about the PDP. And that is because the APC has the presidency. So that is why contest is as narrow as it is. Why is it so difficult for the electorate to vote for other parties in Nigeria even if they have come up with agendas that are better than what the two strongest parties are offering? The electorate is uninformed which is what I’m telling you. An electorate has to be educated to be able to make choices. If our poverty level is running at about 75 per cent in the country, and unemployment rate is about 50-60 per cent, and the average daily income or the daily disposable income of a Nigerian is between N100 and N300, he can’t make any choice. He is going to be swayed by money. So there is a traditional net to which everyone belongs. For instance, you will hear people say the traditional ruler says we should close down this place. So such decisions are made in that way. Even religious leaders have an influence; they drive the choice. That is not democracy. At what stage can we say that now we have a true democracy? Look everywhere, people are poor, they have no money, they have no choices, they steal, they are incompetent and the system makes Nigerians to steal. A Nigerian can kill his mother and do anything for money, let’s speak the truth. So how do you expect that to throw up choices? How many people can say to a governor that ‘I don’t like you and will not vote for you?’ Nobody! The PDP government in Kogi State has accused the APC and the CBN of intentionally delaying the release of bailout to the state to frustrate its government and make it unpopular. What do you make of this kind of politics if the allegations are true? I’m not interested in such questions. All these schemes are for power and money, you have to understand that. I just told you that when the scheme was to be a colonel and become a governor, it was the fashionable thing. It is about power. For instance, if it is true that Col. Sambo Dasuki (retd.) awarded all those contracts knowing full well that we needed arms and ammunition to fight Boko Haram, it tells you the level to which we have fallen. I don’t know that most Nigerian politicians, with respect to them, are doing anything for altruism. So everything you hear about one man fighting another man is not to develop the place, it is just access to wealth. So whether you give me the Kogi example or any other example, you will find out that it comes down to the same thing. How can I access power and use it to my benefit? That is the bottom line of Nigerian politics, so I’m not interested in your Kogi scenario. I was asking because of the workers because they are the ones bearing the brunt of it all. Who cares about the workers? When does the political class ever care about anybody? If they cared, why is the Lagos-Ibadan Expressway the way it is? If they cared, why is the Onitsha-Enugu Road like that? I was 34 years old when government started saying it would fix it, but up till today when I’m 62, it’s not been fixed. There have been many talks coming from Abuja about schemes and award of contracts that government would award it to this company or that company, but the next Minister of Transport came, the next Minister of Works came and it is still not finished. It is the same with the Lagos-Ibadan Expressway, so who is fooling who? We have to tell ourselves the truth. The political class is unaccountable to the electorate because the electorate is too illiterate and uneducated to make demands. That is the problem. How can the electorate get themselves out of this situation you have described? How many of us can make informed decisions? If there are 70 million Nigerians on the electoral poll, how many of them can do that? And you have to look at demography to determine that. How many Nigerians are well off? How many are educated? I suggest to you that they are less than five per cent. To get to a stage where the electorate can make informed decisions and hold the leaders accountable is to look at the number of many years it will take to train our people. It will take about 30 years. You cannot create a literate electorate overnight. The decline is so deep that even if you give birth to the best political leader, it will take at least, 30 years to create a viable educated society because of the decay. If you go to the schools, they are rubbish. You cannot have an educated electorate before 30 years because they have to be trained and that means they have to go to school and have jobs. All we can do now is to stop the decline. Let us have schools with competent teachers and where students pass well. When they pass well, they go out and get jobs. Then they will have their independent minds and depend on nobody. They have keys to their flats, to go in and out as they please. When nobody pays them, they can make that choice, and not before that. So I give that a long time. The level of information available to Nigerians before the Ekiti and Osun states’ governorship elections was better than what we have now with the Kogi election. Does it mean that the Independent National Electoral Commission is not well prepared for this election? I think it is because the new man came in rather late. So I think the election is happening so soon after the big one. But most importantly, it is that INEC was depleted of its relevant resources and so it is not up to speed. There is no question, when you have just appointed the INEC Chairman (Prof. Mahmud Yakubu) two or three weeks ago, there is no way you can say that INEC is at a peak condition. So that may be the reason why there is a seeming lack of preparedness because as usual, it is do or die affair for politicians. The politicians can kill anybody to get to power. So what are your expectations for the Kogi and Bayelsa elections? It will be the same as usual because expectations in Nigeria are too low. I don’t know whether expectation is the right word. I just hope that the elections will be concluded without unusual violence. Expectations will be the usual nightmare. INEC materials will come late; there will be accusations of rigging or no rigging and the losers will go to court. So what am I going to expect? I’m not excited. Nigeria doesn’t excite me. It doesn’t unless Buhari is going to surprise me. I’m looking forward to that and waiting to be surprised. I’m so used to expectations that I would rather not expect (anything). The nation is too strong at the centre and too weak at the bottom, so just rearrange power so that a lot of things the federal people do will be done at the state level. It will free a lot of the resources so that state or a combination of states will get the action going. While we wait for the educated electorate to come in the next 30 years, we can be doing something to sort out our backwardness. I find it a disgrace that I live in the prime part of Nigeria- Ikoyi and I have no water. It is unbelievable. How can that be? By all parameters, Nigeria is really underdeveloped. You ask why all the resources are not being put to good use. So on the one hand, you have the electorate that is not educated or informed and so cannot make strong choices. On the other hand, you have a political class that are educated and can make good choices for them but which are not doing that. You said earlier that unless Buhari surprises you. What would surprise you? Leadership! Just basic things. National Health Insurance Scheme is a no-brainer. All you need to do is to say that all Nigerians are compulsorily required to have health insurance. It could be from N1,000 to N5,000 to N10,000, then people can make a choice of what they want up to N50,000 and so on. The NHIS we have now is not working. Mr. Femi Falana (SAN) once described the INEC as not properly constituted at the time it fixed dates for the Kogi and Bayelsa elections. Do you also foresee the losers challenging the outcomes of the elections in court based on this? Yes, of course, every loser goes to court. I have been involved in election petitions for, at least, 15 years and I have seen all manner of excuses when a loser loses. Most losers look for an excuse. I hope that there will be no constitutional issue. I don’t know the subject very well so I cannot make any comments on it. But I do hope that when a loser loses, he does not try to pull the house down. A loser gets two votes and then because voting started at 10am rather than 9am, he wants to go to court. If you keep complaining about every little thing, then there will be no elections. Elections are subject to all kinds of factors; so long as the issue in question is not one that will be fundamentally glaring and make people say ‘No, this is wrong’, we should let it go. And the reason they do that is because of their desperation. People sell their houses and borrow money, so they just can’t accept that they have lost because between them and their loss is the tribunal. And if the tribunal overturns the election, they will go and borrow money, not considering if they will win if they go for a rerun. The reason is that a lot a of people see a Mr. No Good suddenly become a commissioner under Governor Idiot and his life changes, so they say ‘I have to be like that too.’ Then they don’t want to go to school. Why should I go to school for seven years and then start looking for a job when I can become a thug or an agent to one politician, break heads here and there and my boss makes me special adviser on media, SA on communication or SA on ‘Find me girlfriend’. Let us put a peg on what political office holders can earn with no emoluments and see the situation change. Give them no car and no house. People who say they want to be members of parliament should go and look for their own accommodation in Abuja. But now, government will build a multibillion naira estate and when a senator is leaving, it is sold to him. Why won’t I be tempted to go there too? The PDP recently accused the President of trying to rig the Kogi election after it was learnt that he met with senior INEC officials and some security operatives. Some people wonder if it is right for the President to be holding such meetings at this time. If the meeting was an open meeting, it means it was harmless. I don’t see what is wrong especially if it was open where the president reminded the INEC officials of the need to do their jobs in an impartial way. The Economic and Financial Crimes Commission has invited a former National Security Adviser, Col. Sambo Dasuki (retd). Saturday PUNCH learnt that the anti-graft commission sent the letter of invitation to Dasuki earlier in the week to answer questions in connection with the ongoing probe into procurement of arms during the administration of former President Goodluck Jonathan. A source said the EFCC also put a 27-man strong team of operatives on standby since Thursday for the mission to Dasuki’s residence. The source said that the operatives had been given a directive to be on standby and were waiting for the final directive from the Acting Chairman of the commission, Mr. Ibrahim Magu, for the commencement of the assignment. The source said, “The commission has invited the former NSA to appear before it. Already, a team of 27 operatives has been told to remain on standby. “They are waiting for further directives. They are told not to go anywhere.” However, a source close to the former NSA, who confirmed the invitation, said that Dasuki had not honoured the invitation because of the continuing siege on his house by operatives of the Department of State Services. The source explained that he could not leave his house because he was under house arrest. “It is true that the EFCC sent an invitation letter to him. The man would have honoured the invitation by now, but the DSS’s siege on his house is still in place. “As we are talking, the DSS operatives are in the place. So, how can Dasuki come out to the EFCC? A Federal High Court in Abuja has rejected a fresh application by Senate President Bukola Saraki seeking an order of interim injunction halting his trial on charges of false assets declaration preferred against him before the Code of Conduct Tribunal. Rather than grant the ex parte application filed and moved by the Senate President’s lawyer, Mr. Ajibola Oluyede, on Monday (November 16), Justice Abdulkadir Abdul-Kafarati ordered the respondents to the suit to appear before the court on Friday to show cause why the prayers sought by Saraki should not be granted. A copy of the order sighted by our correspondent on Wednesday showed that the fresh suit was filed by Saraki the same day a similar one which he filed before Justice Ibrahim Buba of the Lagos Division of the Federal High Court was struck out for lack of jurisdiction. Justice Buba had struck out the suit on the grounds that it ought to have been filed in Abuja where he said was the place issues that were being complained of by Saraki arose instead of Lagos. The Supreme Court had earlier on November 12 granted an order of stay of proceedings of Saraki’s trial before the CCT, pending when his main appeal challenging the competence of the charges and the jurisdiction of the tribunal to try him would be determined by the apex court. The 11 respondents to the fresh suit are Attorney-General of the Federation, Mr. Abubakar Malami (SAN), the Economic and Financial Crimes Commission, the Independent Corrupt Practices and other related offences Commission, and the Inspector General of Police, Mr. Solomon Arase.
