First of all, it is not about the portals (using yours or your wife) that determines or influence outcomes. It's fixing the refusal reason so I am happy you are getting a gcms note to get that detail.

Secondly, now that you and your son are going to join your wife what can serve as a good home ties.

1) Do you have a good job that you can ask for a year release to remotely work from Canada or the one they can give you an absence from work if you can't work remotely but assure you that upon return you will be reinstated your position.

2) If you don't have the above then set up a biz that brings returns that have documents e.g biz registration, tax filing, contract awards, receipts of sale or services. Also find a way of getting someone to handle it while you can remotely oversee what's going on when you travel abroad shortly. This can be a good economic ties.

3) Your siblings and parents could also be a tie why you will always want to return but not as effective as the two above.

4) Do you have family properties? If yes request that your portion be given to you. Get a propert evaluation and then get it set up either for rent or some commercial activities. That can serve as a good home tie both as inheritance and biz.

5) Are you in any serious organization like church, mosque, peer group, volunteer group, running any programme with future benefits etc. You could explore these options as home ties.

Pls take your time and resolve this refusal because just applying via your spouse portal will not do the magic.

Good day all. I had 2 refusals already in which I applied from my own portal. First was when my spouse was on study permit which was rejected based on funds and second was recently based on 'they don't know what TEER my spouse it.
Moving forward I am waiting for gcms note to seeking reconsideration if possible then reapplication.

1. I don't want to use my portal any longer... I want to use my spouse portal from Canada. Is this a good idea?
2. How do one convince the officer about home ties if using my spouse portal. Spouse previously use myself and our son as home ties. Now what can be use for the 3 of us that we are coming back home after expiring of her pgwp aside family, my job.. No land or properties

Well I understand how you feel but you can't blame them for either saying the truth.

IRCC will use your case study and learn not to approve study permit to Nigerians even if they show 100 million Naira. This may affect even your own relative and others.

Reason they refuse so many show fund account in Nigeria. These things have consequences. I just think you should make as much money you can in Canada now before the system sorts you out because it is a very tough scenario and only stuff like Asylum (which is hard to get now) can bail you out. You cannot justify your actions to IRCC under any circumstances. They will know you deceive them to get that study permit 100%.

There are some case that are very clear and dicey. I will also say work hard and save up in case decisions go against you then you can have something to rely on should you need to come back home as a millionaire. You can startup a viable biz or loom for one of the unpopular Europe country and start again. Don't go and spend too much (over 5k CAD) on this case and at the end if you don't succeed the money would have gone down the drain. Plan very well and have alternatives.

Believe me I understand the case scenario and it's not what a 5 years experoece consultant can do.

It has to be someone who is long in the Game as a registered consultant who can use provisons and loop holes to bail him. It's an intelligent and daunting task.

If you are in New Brunswick, I can assist you with the contact of a consultant in Woodstock.

I think finding a consultant in your area shouldn't be a problem. There are websites you can get such info for consultant in every province.

Obviously you will need the service of an immigration consultant who knows his onions as IRCC is the one responsible for issueing you PGWP and to them it is not about you enrolling in a course that is in high demand in the province (as claimed) but staying out of school (default 1) for a year to work (default 2) which on its own are defaults to your study permit. These are the major and contending issue with the IRCC.

The consultant service mainly will be how to navigate the consequenece of those default by IRCC so you can have a soft landing ground. This may require you not telling the truth because it may mean you dont have the funds originally and dont deserve the study permit. Alternatively if you put out the issue of exchange rate as you said,
IRCC will frowm at the fact you didnt inform them as they already have provision for unexpected negative circumstances for destitute student which I believe you didn't follow. So just get a good consultant and hopefully you get it sorted. I also want you to have alternative plans as a earned certificate in Canada can open opportunities for you in other developed countries too. It is well.

The issue is that I came to Canada last year on a study visa of 3year. While I was doing the processing naira to cad rate was stable, and I could afford my tuition. After my application, naija happened and everything scattered. I was left with either travelling here when I did or staying back in Nigeria. I decided to come here...I was admitted to a university which was crazy expensive. To cut long story short. I had to voluntarily withdrawn last year. About a month into my program and I was working.. put money together and I moved to the Atlantic region and was able to resume school this yr Sept. I know the rules and yes I have been out of school for a year. My current program is in demand in my province. I just want to know what's the way forward now that am back in school. My program now is a 1yr program and I will be done by spring next yr.
I also want to know if there is a page on here where i can get any advise ....pls help

please i need help. I got nomination with AAIP under rural Renewal stream path way. But had issue with employer business name not being active on CAC website, it is actually struck off as we speak,during the PNP the officer noted this and asked for clarifications which I was able to proof to the officer handling my file that though the company is not active on CAC portal, but it is active physically. I sent in taxes paid, signage and contracts gotten from state government, and was given nomination on that basis. Now my employer have started the process of reactivation and has made necessary payment but the portal did not allow to pay for the last year and we are asked to go to court for court order so the process can be completed and this always takes months before judge seat. Now the court hearing date is next year June. This means the employer business name would be inactive while my application is ongoing. Please note the PNP also saw this infact then it was even struck off but I was later granted nomination after my loe and submitted documents. Now I have applied for PR and waiting for AOR. I am scared cos of employment verification, I might not have the luck I had during PNP.

Don't Know if i should inform IRCC OR wait if they will contact me just like PNP did, but my fear is, what if they did not reach out and reject my application

Well from my experience since I started requesting for GCMS notes (back-to-back) from August this year till date, I have NEVER seen the gcms request on the GCMS note itself, but I see things like updated information via webform/mail/ircc helpdesk etc from Applicants or even MP Calls. Still, I have to agree with @Bobomaigida that these VOs may have that visibility whenever Applicants request for their GCMS notes and they know it could have legal implications where an Applicants decides to seek redress on immigration laws applied wrongly against them.

Case Officers must enter all processing notes/actions on GCMS, in fact all action/activities that occur on an app are captured on GCMS as it is a standard practice, and you think the case officer does not see that a request for the notes has been made something that will be captured in the GCMS itself.

Take this advise at your risk. There are some risk that are not worth it, a risk that can put US, UK, New Zealand, Canada and Japan away from your reach no matter how wealthy you become after for as much as 5 years, 10 years or for life. I will never be that desperate.

Applying for study inside Canada with a visit visa may become impossible as flagpole is usually involved when receiving the study permit and converting from visitor.

The link you posted is flagpoling for PGWP by students who complete an educational credential from an accredited post-secondary Canadian DLI.

Yes a foreign National can actually apply for Study Visa from Canada or convert their visit visa to study visa but his application will be treated like he is applying from outside Canada or his home country. In fact it may come with some disadvantage in the sense that if you finally get the study permit while in Canada, you must ensure you didnt violate your existing Visitor Visa and you might need to explain to CBSA (Border) officers why you applied for the student permit from inside Canada rather than from your country when getting your study permit at the border.

So the choice is his if he has enough reasons to defend applying from inside Canada instead of applying outside Canada or from his home country.

If anyone will do this, do yourself a favour by consulting who has done same and succeeded so you dont go and complicate your case.

Again, is your option 1 based on the fact that I will be in Canada?

What if I am outside Canada at the point of her applying for PGWP, will option 1 still be the best?

Hi guys,

Just needed our suggestions based on case scenario.

If as a spouse i want to apply for SOWP based on my wife completing a program and getting PGWP, what's the best option:

1) Apply for SOWP together with my graduated spouse when she is also applying for PGWP so approvals can tickle in either same time or maybe PGWP comes 1st and the SOWP follows

2)Allow my student spouse to apply 1st and get the PGWP and then I the spouse can apply for SOWP outside Canada which of course might take more time.

3)Allow my student spouse to apply first and get approved on PGWP and thereafter I can go and apply for SOWP through flagpole if I have a valid visitor permit in Canada and my spouse accompany me with all other relevant doc like PGWP, full time offer, pay stubs, bank statement etc

Please share your thoughts.

So actually what Affoncad shared is right. If you choose No all through it will make you fill the form as though you are in Nigeria or outside Canada.

You are even advised to choose your home country of residence and not Canada to avoid not filling the wrong form.

So if you meet in country application criteria, it gives you the in country form and you can use a Canadaian resident address and the primary visa office for your application will be Canada.

If you do not meet in-country application criteria just because you visited Canada and you just want to apply for the study permit while on visit in Canada, it will treat your application as though you are applying from your home country residence.

Reason for the flagpole when you are successful and still on visit in Canada but it comes with interview from the CBSA to find out your intent if you re not planning to use study as a means to overstay perpetually in Canada.

Pls let's not have dissent among ourselves.

Yes you can apply from inside Canada with a visitor visa but your application will follow the format of an out-country application. That is no incountry advantage like people who are extending study or work permits.

Am a senior Business Analyst and one of the things I do professionally is to digest and understand requirements. Student education via permit is a Direct Investment to Canada and so they will not want to lose legit FDI because someone visits Canada.

(1)The question was can the SOWP be revoked if student differs enrollment,you didn't answered the question.

Students has 150 day rules to begin studies after deffer of enrollment and must be approved by DLI.
If approved by DLI it is safer for both SOWP and study permit holder.

There can be genuine reasons for differ, it is the abusers that spoil things for the genuine ones,the obvious reasons of changes in immigration rules.
