My problem with your response is you answered it towards Asylum claims which is not my line of thoughts. Even when i shared IRCC website link where people with genuine situations can use you re still referring to google search. Read bro you can do better. Nobody knows too much even if you stay in IRCC Headquarters in Canada.

Students can also plan ahead and something unexpected can happen to there sponsors or source of funds...should it be the end of life? IRCC made that provision for a reason, and you cannot tell us it cannot be utilized if there is a genuine case for such student. Open your mind please. This is not to support lack of planning or coming to Canada without your funds but also arm yourself with information you may need along the line. Shit can happen to anyone unexpectedly.

Just like my lawyer friend said It's easy to stay in Africa and interpret the canadian law as a visa applicant via google engine, like you are doing, because I'm 100% sure you're not even in Canada. But my advice to students coming to Canada, especially Nigerians, is to also consider Express Entry. If you plan to come to Canada via the student route, make sure you have your tuition fees and living expenses fully covered. The 20-hour work limit, which is now extremely difficult to secure, cannot cover your tuition fees and rent. Dropping out of school and claiming health issues or homosexuality/domestic violence is an outdated strategy that no longer works. Anyone can sit in their room in Africa and quote the law, but the reality sets in when you land in Canada. Many students are stressed, tired, and frustrated. I wish everyone the wisdom to plan accordingly.thank u

The student wouldn't have qualified for open work permit for destitute student..as required the student needs to maintain status as a full time student to be eligible, and open work permit for the purpose is issued based on duration of the study permit issued,and student must attend classes and fulfill the requirements as a full time student, that is student will have study permit and open work permit at same time..since the student is sick and can't attend classes likewise the student can't work with open work permit ,application is dead on arrival for given that reason that the student is sick to apply.
And must proof that they meet other immigration requirements to be eligible based on financial support in canada.

The student based on the circumstances would have applied for (TRP) Temporary resident permit, since the person has lost status and have violated immigration and refugee protection act canada.

if permit is granted this will give the person time to sought out the issues they have in canada and must adhere to duration of permit issued.

If TRP is granted the person can apply for study permit without leaving canada and this must be done before TRP expires..as TRP will not authorise the person to work or study in Canada,it is just another status to remain in Canada and cannot be used as travel document.

Again I never said student claiming distressed student as reason to claim Asylum. I get your point clearly on the path to work permit process.

I will check the pre-requisite again and share. I don't think you need to change to visit status before applying. It's a direct approach from student to work. In the case of the poster, as at the time he had health challenge and may have expended funds he should have used for study for his health, he is qualified to access the destitute student application for Open Work Permit which is usually at no cost because it is an application based on humanitarian grounds.

I dont think its impossible because of many cases of drop out student, just be able to proof your own case as unique as possible which I felt the poster should have duly explored rather than going for Asylum. This path has nothing to do with tribunal. Just as you apply for PGWP, SOWP etc; the distressed student will apply and attach all the neccessary proofs. It is advisable to use an immigration consultant in this case. It is way different from your scenario reference that is Asylum and tribunal based.

Note that when a student arrives in Canada in 2024, immediately collecting a student permit and work permit at the point of entry and then arriving at school, if they later drop out, any asylum claim made afterwards is likely to face a significant risk of failure!

The option I shared is you can claim being a genuine distress student with proofs (which I believe the poster could easily defend with his experience of sickness and medical proofs) and get open work permit not Asylum as you have just concluded.

Read again please as you are distorting the information I have shared. I believe you re not aware of this option and what everyone knows and goes for is Asylum which is very convenient but complex with damaging outcome if not done rightly. The post is to enable us aware of options in cases where one is genuinely affected.

Finally, you dont get Canadian asylum by stating that you are in financial distress otherwise people will be getting the asylum. They claim something else that is complex to proof.

All these options might have worked 3 to 5 years ago in Canada, but not now in 2024. The employer who sold you the LMIA won't go down without a fight because you're putting them in trouble with a criminal case, and they'll go all out against you, knowing exactly how you got the LMIA. The distressed student option no longer works, with over 13,000 international students out of school within 9 month , and the system ,the government and the public knows it's due to financial reasons, which are now becoming political. This is the worst time for any student to drop out of school and claim asylum, with the chances of winning the case being extremely low!

It's not ONLY about gathering the documents, do you have his kind of UK and Scheghen travel history? Most Nigerians don't usually travel to these countries and return so if you have, it's a trust advantage for your application.

It is a positive sign that the application will be approved but it is not an automatic guarantee. I will say it has close to 80% chance of approval based on experience from the past applications.

Its not easier but if you go out of status with that option, you have opportunity to reapply again should you have to leave Canada.

Can you do same with failed Asylum? Let us learn to think long term when taking decision not easy pathway.

That option you narrated is not easy either

There are provisions for distressed workers too if you can proof your LMIA employer violates your employment contract and you are unable to continue working under them, you may be granted Open Work Permit based the proof of your case. Everything is not Asylum, it can backfire a great deal.

The mistake you did was to go for Asylum which is not your best bet. Even if you have the best lawyer, when facts are not convincing the Asylum case will be lost.

For others here, when you find yourself unable to pay school fees due to illness or fund (mind you if you are using fund you must explain what happened to your PoF because it was based on that you were given study permit), what you need to do is to apply for Open Work permit under distressed student. It is a provision by IRCC for International students with genuine reasons for not been able to continue there program maybe due to death of their sponsor or illness or some drastic events that can actually stall your study progression. You may be lucky to get two years Open Work Permit and its enough for you to forge your future in Canada. Asylum should not be your 1st option. A lot of people dont know about this option and I hope people will not start abusing it either, cos our people can abuse privileges.

I know the failed asylum records makes it a bad case especially among the 5 eyes countries that collaborates with Canada to share info yet I will advise this fellow to approach the service of an experienced Canadian Lawyer who can examine your situation and advise accordingly. Sorry for your experience.

Good day,
I was given a removal order because I couldn't not continue my education in Canada and I had serious health issues along the line.I was admitted in a public hospital for long period of time and in this period I applied for asylum but the lawyer that helped to process the application did not do a good job as my doctor was telling me,the lawyer should reach out to him for supporting documents.

When I the day for removal was almost due the doctor narrated my ordeal to a canadian(white) lawyer and the lawyer felt bad about my situation and asked the doctor to drive down to my house on the day I was scheduled to removed from canada and both of them whisked me away to the hospital for admission.
The lawyer was able to file 2 months extension for me but finally the 2 months extension elapsed and I arrived in Nigeria early this month.

My question, can I apply for PR from Nigeria or what should I do as my visa will expire in December 2025

The implementation of the courses in long term demand for PGWP eligibikity takes effect from study permit application dated November 1st 2024. Always analyze requirements before you apply it to yourself.

Mr J, that spouse must work in Mgt or Professional teer has a loophole, from the Minister's speaking notes there is a latter part where he said workers in Key labour shortage areas and since we know the areas that have labour shortage we need to pursue opportunities there. So a worker might not necessarily need to be a mgt position, they only need to be a labour shortage profession to qualify to bring their spouse on SOWP.

With the new rules on SOWP that includes Masters of 16-month program, spouse in Mgt or Professional NOC....I am of the opinion new application for SOWP will be tough. I pray for those who have there's ongoing before the new rule to be able to get PPR.

Canada is really trying to tone down on Foreign Workers so if you re a new SOWP applicants, I will advise you wait till your spouse has finished her program to apply for SOWP. For now just do visit and study the country labour process and make connections in preparation for your labour market launch.

1)is he applying for a Masters or professional degree course where Masters must be at least 2yrs? (Updated rule)

2) Applying for both of them means the other spouse cannot be used as home tie. In the absence of that do you guys have other strong home ties: work employment, business, assets, close family members and others?

3) Does he have enough money to cater for tuition and living cost for all family members for himself (student) and spouse applicants?

4) Does he have strong reason why he want his spouse to accompany him?

5) Is his spouse occupatiom in management or professional classification (Teer 0 or 1) in the Canada NOC. (Based on new rule)

These are the critical questions.

If your programme allows your spouse to apply for SOWP and you have the required POF then you are good to go.

He doesn't need to cos it's waste of money and efforts.

The PNP approval comes with 600 CRS mark and it's the icing on the cake. Even if they have a zero initial CRS score on EE profile, that 600 from PNP nomination makes them qualify for ITA automatically on EE profile.

So what stops her from applying for TRV inside Canada?

The main thing is she will have the permit to study for the length of time she needs. She can however apply for TRV separately when she needs it

I think the aim of this is not to give visitor permit privileges to study permit holders. When her visitor permits expires she can always apply for visitor and get as much as her passport can accommodate. They don't want to give you double for one as they also have revenue targets for visa issuance. Canada don dey stingy with visa approvals.

Finally, maybe they don't want to give her opportunity to delay her entering Canada to start the program. We ve seen many people abuse their 2 yrs Travel Visa (attached to 2 years study permit) by trying to defer an admission and enter Canada in a later date without informing IRCC just because the TRV period accommodates the program deferment. We caused all this harshness to ourselves by abuse of priviledges and IRCC seems to be closing loopholes that breeds abuse.

There are professions with a local community, talk about how you intend to learn from the community and what you can also do for the community as a member. I thought that itself is a red flag that is we must all must pretend and give them an impression that whether study, visit or work are returning home. My BVL dropped 24 hours before my PPR came.
My application timeline was 13 weeks. There was no update on the New portal tracker and the tracker account I registered on. Even when my BVL dropped before the PPR. Nothing changed on the tracker.
IRCC will humble you, but trust in Jesus, he's forever faithful and merciful.

I'm a first time applicant and I did my application process myself. I used the New portal. My POF documents alone was almost 100 pages. SOP documents was like 30 pages and I compressed it to 1.8mb. I used almost a month to write my SOP, because I needed to sell myself, not just as a mere student, but as someone who will make valuable contributions to the Canadian economy with my professional skills.

A total of 45k CAD was my budget for this application.
Documents used:
1. GIC (20,650)

2. First semester tuition receipt (11k CAD)

3. Tuition balance in my domiciliary account(8k CAD)

4. Flight and ancillary expenses of 5k CAD.

5. 15 months payslips and invoices from previous employer to my current employer and side gigs. Bureau de Change deposit slips.

6. Housing deed of gift which was legalized by the court.

7. Promotion letters (I had like 3 promotions in a year and 5 payrise when I worked for some Nigerian companies). Reference letter as a volunteer for an NGO.

8. My sponsor notorized the sponsorship letter. He also sent the full money I needed to my account. He gave me a copy of his residency permit, passport data page, investment account statement, employment letter and work permit, payslips for a year and his most recent picture.

9. I used my parents as home ties. I hardly take pictures of myself and I had no recent picture with my family, so I used family pictures of when I was a teenager and I added a recent family picture which I wasn't in.
I have a registered business which has never been operational since it was registered almost 2 years ago. I explained the reason my course program would give me the required skill needed in running the business when I return to Nigeria (I didn't submit a tax clearance because the business has never operated. But I submitted the CAC and shareholder documents).

10. Previous study visa rejection letter from another country's embassy. The admission letter of the school that admitted me (Still the same study program as in Canada. My study program is on the list of the programs Canada wants and would give PGWP for). The full tuition receipt I paid and the tuition refund receipt.

11. I'm in tech and I have been in the same job role for almost a decade. (I have worked remotely for companies in the top 10 tech countries in the world list). As a remote worker in Nigeria, you need to have multiple receiving accounts because of different clients and employers would give you their best option to send your money. I had 4 different foreign receiving accounts. I explained each and every transactions I got in them (I had lump sum transfers) and why I had 4 different receiving accounts and their pros. Even when I realized that I didn't attach some lump sum receipts to my POF documents 2 months after my application, I sent it with Webform and explained it.

12. My SOP explanation letter alone was almost 10 pages. I was truthful with my application. Where I had an error, I stated it and I showed proof on how the error came about.

13. I did upfront medical at Q-life because it was cheaper than IOM a week before I submitted my application.


This whole Canada thing was orchestrated and led by God, and all the glory, honor, and thanks belongs to him.

To others waiting, it's just a matter of time for your own testimony too in Jesus name. At a time I got tired of waiting. My admission process took over 2 months. My visa application process took over 3 months.
Never stop praying and never stop trusting God. Please, be truthful in your application. If you are stuck and need help with your application, you can shoot me a mail and I'll try my best to reply to them.

Hi everyone. Please I need your advice. I received a letter from IRCC requesting for an updated statement of account from April till date. The problem is that I did POF and I pulled the funds after my application. Even if I get the money together now, how do I explain why I moved the money?

P.S I have valuable real estate with buyers lined up to buy, so money for japa won't be a problem. I just did not want to sell until I was sure of the visa, hence the POF.
What do I do?

The new requirement are two for College Student:

1. Those that applied for study permit before November 1st 2024 and got approved will be eligible for PGWP for whatever course they graduated from if they passed the required English test CLB

2. Those that applied for study permit on or after November 1st 2024 and got approved to Study and complete their courses will only be eligible for PGWP if their study falls in the range of courses listed as long-term shortage and they also write the English CLB test.

I think you fall under number 1 if you have applied for your study and it leads to your approval, consequent study, and completion of the program.
