Apology not accepted. He should be dealt with. It takes just a comment or tweet to set a country ablaze. Why can’t people just let the judiciary do their job? Asiwaju court case in the US happened more than 25 years ago and is not within the jurisdiction of Nigeria.

I wonder what always excites these obidient folks. They read the law and give it an interpretation that suits them thinking that the law runs with emotions. Tinubu was indicted and not convicted neither was he fined. Legally, there’s a different between an indictment and a conviction. In the case in question, after the indictment, parties decided to settle out of court and agreed that the sum of 450,000 dollars found in his account be forfeited.

Forfeiture is different from a fine. A fine arises after a conviction whereby the court can ask the accused to pay as an option for a term sentence. A fine can only be imposed after a trial is completed in which the accused was declared guilty.

Someone should show us the judgement where the term “conviction” or “sentence” was used in the case against Tinubu.

So the section cited doesn’t apply to Tinubu

Sometimes I wonder where all these lawyers learn their law. It is trite law and procedure that it’s only the election tribunal that has the jurisdiction to entertain a post election matter. False narrative. FCT is considered a state in this regard and does not have a special 25% of its own.
Exactly. The word used was “and” which didn’t give the FCT a special recognition of its own. It only sees FCT as an addition of the 36 states. So the 25% puts all of the 36 states and Abuja altogether

The interpretation of any section of the constitution lies with the courts and not with even the INEC section to interpret. Mike was giving his own personal interpretation and not speaking for INEC. The said Section 134 (2) of the constitution doesn’t form part of any policy or election guideline to be interpreted by INEC.

At the end of the day, I guess it’s the court that will settle the matter.

Mike Igini interpretation must be in line with the intent of the drafters of the section of the constitution. And I think that the section should be amended so as to clear what people might call ambiguous.

However as it stand now the right interpretation should be that the FCT must be included as a State in the Federation for the calculation of the two-thirds. That’s the only way the conjunction of “and” can make sense. The two-thirds of the Federation should stand at 24.7 States of the “36 + 1” States” in consideration. Going by the mathematical rule of approximation when a figure is higher than 5, it then means that for a candidate to be declared the President, the candidate must have the majority of votes cast at the election; and also has not less than one-quarter of the votes cast at the election in at least 25 of all the States in the Federation and the Federal Capital Territory, Abuja.

Falana got it right. What the law says is “….36 stars and the FCT” meaning all put together. There’s no way u would expect the drafters of the constitution to say “37 states”. The section isn’t isolating Abuja as a separate unit.

This is just grammar. In every context, whether in nysc, census, etc, Nigeria division is referred to as 36 states and fct. If they now say something (24) in 36 states and fct, that means if you won in 23 states + fct making 24, then you're qualified because fct is seen as one of the states. It doesn't mean fct is a mandatory or compulsory.
Leave them let them be interpreting the law wrongly. The law doesn’t say u mush have 25 percent in Abuja to be declared the president. What the law says in the constitution as well as in decided cases is that, joining all the 36 states together with Abuja, a candidate must in addition to having the highest number of votes, he much also have 25 percent spread altogether.

Secondly, even if there is going to be a rerun, it would be between the two candidates with the highest scores. And as it stand it’s APC and PDP that has the highest scores.
