Palpable fears has engulfed in major cities in Rivers State over fears that the Supreme Court may after hearing and adopting briefs of arguement from both the Rivers State governor Barr Nyesom Wike and Counsels to the governorship candidate of the All Progressive Congress in the April 11th 2015 governorship election Dr. Dakuku Adol Peterside. It was gathered that parties to the Appeal before the Apex Court over the Judgement of Justice Dougban Mensem led Five-member Appeal Court Panel were notified last week that the Appeal brought by Governor Nyesom Wike will be heard on Wednesday 27th January 2016. Palpable fear however gripped both members of the All Progressive Congress and the Peoples Democratic Party in Rivers State due to how the Supreme Court delivered Judgement on the Nassarawa State Governorship election Dispute merely 2hrs afters it was heard and briefs of arguement from both parties were adopted. "Tomorrow is for hearing of the appeal which is adoption of briefs of argument already filed. People suspect that just like in Nasarawa appeal the court can decide to rise for a few hours and return to give judgement and give their reasons later". The Appeal filed by the Rivers State governor Barrister Nyesom Wike against the Judgement of Justice Dougban Mensen led five member Appeal court panel of Justices which upheld the Judgement of Justice Sulieman Ambursa led Rivers State governorship election petition Tribunal which ordered the Independent National Electoral Commission to conduct a fresh poll in Rivers will be coming up for hearing on Wednesday 27th January 2016,PUO REPORTShas learnt. Governor Nyesom Wike of Rivers State had filed an Appeal at the Apex Court praying a reversal of the Judgement of the Abuja Court of Appeal last month which gave a go ahead order to INEC to conduct a fresh poll in Rivers state within 90days. Dakuku Peterside of the All Progressive Congress in Rivers state had after the April 11th governorship election filed a petition at the Rivers State governorship election petition Tribunal seeking an order that the Governorship election which took place in Rivers state failed integrity test,therefore INEC should be ordered to conduct a fresh Poll. That prayers was answered by Justice Suleiman Ambursa led Rivers State governorship election petition Tribunal in October 24th 2015,the Judgement of the Tribunal was also upheld by the Court of Appeal. It was gathered that the Supreme Court will fix a date for its Judgement once the Appeal has been heard this wednesday

The Independent National Electoral Commission (INEC) has rejected the judgment of the Court of Appeal, Owerri Division which declared Alex Otti, the governorship candidate of the All Progressives Grand Alliance (APGA) winner of the state governorship elections. The commission has therefore asked the Supreme Court to set aside the judgment of the Court of Appeal and its place to uphold the judgment of the Abia Governorship Election Tribunal which upheld INEC's declaration of Dr Okezie Ipeazu of the Peoples Democratic Party as winner of the election. In a brief or argument settled by INEC's lead counsel, Chief Adegboyega Awomolo, SAN who led a team of other senior lawyers including, Dr Livy Uzoukwu, SAN, A.B. Mahmoud, SAN, H.M. Liman, SAN, Ahmed Raji, SAN among others, the commission said that it was Ikpeazu who won the election and not Otti. INEC informed the Supreme Court that another panel of the Court of Appeal upheld elections in respect of House of Assembly seats in Osisioma Local Government Area and Isiala Ngwa North Local Government Area which took place on the same day the governorship election was conduct. > It will be recalled that in declaring Otti winner of the election, the Court nullified the governorship election in the local government areas stated above. INEC said: "Before concluding, we crave the indulgence of the court to very respectfully refer to an intriguing issue. "It is the fact that the court below, though differently constituted confirmed on appeal elections in respect of House of Assembly seats in Osisioma LGA and Isiala North LGA which took place simultaneously with the Abia Governorship same day, time, in the same polling units and where voters were accredited using the same voters; registers and card readers." INEC further said that the Court of Appeal was wrong in law when it cancelled the results of elections in three local government areas of Abia State. It said "The conclusion that Otti and not Ikpeazu won majority of the valid votes cast at the election is neither borne out of the record nor justified under the law." According to the commission, the court of appeal should have dismissed Otti's appeal having found that a Returning Officer has no power to cancel election results having regard to the provisions of Section 68 (1) of the Electoral Act 2010 as amended. The commission also said that Otti's notice of appeal at court of appeal was incompetent and should have been dismissed for lack of jurisdiction. Labels PUO Politics

The stage is now set for the final Legal fight to begin between the Rivers State Governor Barrister Nyesom Wike and the candidate of the All Progressives Congress Dr Dakuku Adol Peterside over the outcome of the April 11 Governorship election in Rivers State. The Supreme Court had fixed today Friday 15th January 2016 for hearing of the Appeal by Governor Nyesom Wike against the December 16 2015 Judgement of Justice Dougban Memsen led five-member Appeal court panel which upheld the nullification of the governorship election conducted by the Independent National Electoral Commission in Rivers State. Recall that both the Rivers State Governorship election petition tribunal headed by Justice Sulieman Ambursa and Appeal Court headed by Justice Dougban Memsen had ordered the Independent National Electoral Commission to conduct a fresh election in the entire Rivers State within 90days. But Governor Nyesom Wike in exercise of his Legal right Appealed both Judgement at the Apex court. It was exclusively learnt that the matter would have come up today for hearing, but the Court shifted it to Next Week.

The Chief Judge of Rivers State Justice Daisy Okocha will be Retiring from Service Tomorow Friday 15 January 2016, this is coming Barely two weeks she was confirmed as the substansive Chief Judge of Rivers State by governor Nyesom Wike. Justice Daisy Okocha was appointed as an Acting Chief Judge of Rivers State on May 29 2015 during the Inauguration of Governor Nyesom Wike. On 23rd of December 2015, the Port Harcourt division of the Court of Appeal sitting in MOSCOW ROAD, removed all legal challenges as result of the Judgement of Retired Justice Lambo Akanbi during the Administration of Chibuike Amaechi. Rivers State Governor Barrister Nyesom Wike on 4th January 2016 sworn in Justice Daisy Okocha As the substansive Chief Judge of Rivers State. Although her retirement from Service seems to be raising some mixed reactions from some lawyers in Rivers State, while some are of the View that the retirement of Justice Daisy Okocha may leave a lacuna in Rivers State since the Rivers State House of Assembly cannot performe any legislative duty, others are of the View that Governor Nyesom Wike has the powers to appoint the most Senior Judge as an Acting Chief Judge
