I am a supporter of GEJ but on this tenure issue, I disagree with him, particularly when he has not fulfill any of his promises. |
By Ikechukwu Nnochiri, Abuja A Federal High Court sitting in Abuja, yesterday, held that Charles Okah, Obi Nwabueze, Edmund Ebiware and Tiemkemfa Francis Osvwo, a.k.a General Gbokos, have questions to answer over the October 1 twin bomb blasts that killed 12 persons in Abuja whilst Nigeria celebrated its 50th Independence day anniversary last year. The trial court presided by Justice Gabriel Kolawole, maintained that the proof of evidence tendered against the accused persons by the federal government, successfully established a prima-facie case that would warrant further explanations, saying the preliminary objections that were raised against the trial by the defence counsels, grossly lacked in merit. The accused persons who were initially arraigned before the High Court on December 7, 2010 and subsequently re-arraigned on January 12, had in their separate applications, asked the trial court to quash the entire criminal charges against them for lack of incriminating evidence linking them to the alleged crime. Aside allegations that they committed series of kidnappings and sundry acts of terrorism within the oil reach Niger Delta region of the country, they were equally charged with treason. The charges against them attract death penalty upon conviction. While challenging their continued detention in prison custody, the accused quartet contended that the federal government failed to either establish a convincing prima-facie nexus linking them to the October 1 bombing, even as they relied on the statutory provisions of Section 72 and 77 of the Criminal Procedure Act, CPA, to question the procedure adopted by the government in the trial. Counsel to Okah, Mr Festus Keyamo, further relied on the decided case law of Abacha Vs State and FRN Vs Uwazurike, to argue that the inability of the prosecuting counsel, Dr Alex Izinyon, SAN, to file the mandatory proof-of-evidence alongside the substantive charges against them, contravened the procedural requirements for criminal proceedings. But Izinyon prayed the court to dismiss their objections and assume full jurisdiction of the matter. The government lawyer maintained that Section 77 of the CPA cited by the accused persons was subject to Section 33 of the Federal High Court Act, which he said empowered him to commence summary proceeding against them on the basis of information from preliminary investigations earlier conducted into the matter by the State Security Service, SSS. He pleaded the court to allow the prosecution to open its case against them, insisting that so many witnesses have indicated their willingness to appear in court to testify against accused persons. Izinyon submitted that the onus was on the trial court to look at the charges before it with a view to determining whether there is anything therein that requires explanation from the accused persons, stressing that Charles must explain his involvement in the purchase of the vehicles he said were used to perpetrate the violent bombings of October 1, as well as his connection with a welder who he said has already confessed that he was engaged by him to construct fake compartments in the said cars. The accused persons in their arguments, also challenged the propriety of two separate criminal charges that were preferred against them in the same court, over the same facts, circumstances and proof of evidence, arguing that it was not only an abuse of judicial process, but tantamount to “double jeopardy” as envisaged by section 36(9) of the 1999 constitution. The 4th accused person, Osvwo, a.k.a General Gbokos, specifically urged the court to declare section 33(1) of the Federal High Court Act, upon which the charge was predicated, as illegal and oppressive, a request that was refused by the trial court yesterday. The judge in his ruling, held that “having read the proof of evidence, I am of the view that the accused persons have some explanations to make.” On the splitting of charges, the court noted that the sanctions attached to the offences contained in the two charges are distinct upon conviction, adding that whereas the 1st charge would attract life imprisonment, the 2nd charge carries a death penalty. Consequently, justice Kolawole dismissed all the objections and fixed October 10, 11 and 12 to commence full-blown hearing on the substantive charges against the accused quartet. It would be recalled that government alleged that the accused persons conspired with the ex-leader of the Movement for the Emancipation of the Niger Delta, MEND, Henry Okah, and one Emmanuel Allison, to make a direct attempt at endangering the life of President Goodluck Jonathan by seeking to drive two motor vehicles wired with time-regulated explosive devices to the Eagle Square where the Independence celebration took place. FG also alleged that the accused persons between January 2 and March 15, 2010, within Port-Harcourt Rivers State and diverse places, conspired with Henry, Chima Orlu, (at large), and persons unknown, to make a direct attempt to endanger the lives of the Governor of Delta state, Edo state and Imo state by seeking to drive two motors vehicles wired with time regulated explosive devices into government house annex, Warri, Delta State, the venue of the Vanguard Post Amnesty Dialogue, where the said governors were in attendance, in order to cause a bomb blast for the purpose of levying war against the state. It told the court that a man lost his life as a result of that explosion. Charles who is a younger brother to Henry, was expressly accused of engaging the services of one Bassey Umoren, a welder, and paid him N50, 000, to construct hidden compartments into four motor cars, two of which were subsequently loaded with explosive devices at Port-Harcourt by Obi Nwabueze and Chima Orlu, at large, and positioned on 1st October at 0830 hours near the venue of the anniversary for the purpose of levying war against the state. He was also accused of sending two consignments of army camouflage torches, bullet proof vests and boots to Allison for onward transmission to one Segun Llori alias Stone face, at large, for use by terrorists recruited by Henry Okah in the creeks of the Niger Delta. Meantime, sequel to complaints of inhumane treatment by prison officers, which was raised by the accused persons in the open court yesterday, Justice Kolawole yesterday directed the Superintendent of Prisons, to ensure that the accused were kept and treated like awaiting trial inmates, adding that they should be allowed access to medical facilities. Ibimeyee, you are confusing Bomadi with Warri, you may be right in the past when all Ijaws in delta were claiming to be Itsekiri but you are presently very wrong to say Ijaws migrated from the present Warri kingdon to river state. In the past ,the whole of Bomadi, Burutu and Patani were under Warri province.(not warri kingdom). May be that is why your grand father told you they are from Warri. Moreover if he had told you Patani or Burutu, you may be thinking that the town is in Bayelsa state that is why he use Warri which is more popular and Itsekiri made it so. The accommodating nature of Itsekiri is what is causing all this rubbish and hence fort Ijaw fisher men will no longer be allowed into Itsekiri and Urhobo community to fish. Their settlement is very easy to construct, they don't need cement. They just peg four sticks, raft the floor with wood, get raffia palm to cover the top. they start producing minimalistic children without any form of education. The next thing you hear na my community yeee. They know you will win them in court, they don't believe in court all they use is violence. The benefit of the violence to them is already on the line of regression, because other ethnic groups are already acquiring weapons of mass destruction to curtail them effectively. 10 years ago Itsekiris produce land mines locally and use it to massacre Ijaws. The 2010 and 2011 model of the land mine is out, we are progressing, very soon we will have a mini nuclear reactor, Itsekiris are the Israelis of Niger Delta. When the war started newly, Itsekiris were not prepared, they were just running into Itsekiri villages at will and it became a tea party for them. They use to come from the creek into Warri city to mark Itsekiri house for destruction, they will over power the army and enter warri and start misbehaving. The irony is that they don't have houses in Warri, all the beautiful houses in Warri are owned by Itsekiris and other tribes. They live in tactch house in the creek. Along the line Itsekiri develop resistance and when we started bringing our weapons they became newer and more sophisticated than their own. The last time their warriors attempted to enter Warri, they were dessimated by our land mines and rockets. The remnant of them living in rented apartment in Warri city threatened to avenge the death of their warrors in 48 hrs, withing the 48hrs we ran into them under the rain, we chase all of them from the city of Warri, our young girls were on top of vehichcle shooting sporadically with AK47 and Bazuka. It was a war film, the sound of our guns were different from the sound of their guns, while their AK47 were sounding kaka, our Bazuka were sounding Gudum, our Ogbunigbi were sounding gbudum! Our bullets had unconventional sizes as confirmed by the army. "We have not seen this size of bulet" army spokes man. They were specially made for the Isrealis of Niger Delta, Egbesu could no longer stop our bulet and Ijaws surrenderd for peace after the battle and channelled their energy towards hostage taking and attack on oil installation which is cheaper and more economical to them. They usually give fish to Benis in exchange for garri, plantain,stach, etc and the point of exchange are two Beni villages called Gelegele and Ekewan(Eki-owan), The road leading to the two villages is the road where the University of Benin Ekewan campus is situated. In the process of the business, they establish Ijaw quarter there, the Itsekiris bringing fishes from Ita-Eko and Oghoye also extablish Itsekiri quarters there and the both groups were under the rep of Oba of Benin called Okakuro. In less than 50 years Ijaws said they dont want to be under the Okakuro that they want to make their own Pere as ruler that Gelegele is now their property. They attack Itsekiri quarter and the Oba became angry and ordered the demolition of Ijaw quarter in Ekewan. They ran away like fugitive and later came back to plead for mercy. Under GEJ now they have started again that they want to include Gelegele in their proposed Toru Ebe state. I think Ijaws have a genetic problem.That was why when we taught of developing a locally made biological weapon to further alter their gene, we consildered so many things including their closeness to us. Very soon people will start denying their Ijawism, they are even constituting embarrazment to the president.The president got the highest resistance from his people before he became president.They never wanted him to be president, the total vote of Bayelsa state is less than the vote of delta central. @ chyz I would have responded to you very well if you were an Ijaw man, you are just a neophyte on this issue. Ijaws are not arguing that they have any land in Warri City, which is Warri south, they are settlers in Warri South-west. Ogbijo in Warri South west is known as Ijaw quarter, like we have Hausa quarter too. Why are the Hausas not laying claim to Hausa quarters? They want to collect Urhobo land in Udu LG through that Ijaw quarter too, that is what is causing fight between Urhobo and Ijaw in Aladja. In fact they have fight with Urhobos in 5 different communities and you said Urhobomena is supporting them. You said Ijaws gave land to Itsekiri in Warri and yet Ijaws have no land in Warri main city, They have no kingdom in warri, the schools in warri teach Itsekiri language, they prefer to call their kingdom Gbaramatu kingdom, why did they not call it Warri kingdom? Because they know that if they call it Warri kingdom, they are directly calling themselves Itsekiri. If you are familiar with warri main town, kindly point Ijaw land in Warri city to me. You said Ijaw gave warri to Itsekiri and yet Ijaws have no land in Warri main town. That is how they chase Ilaje from Opuama and tsekelewu and took over the place unto this day, they cant do that to Itsekiri. Did Tompolo not fight in Warri war in 1999, why was he not able to take Warri from Itsekiri. Check the map of delta state, you will see the map of Itsekiri nation, Ijaw nation, Ndokwa nation and the rest. 20 years ago Ijaw had no traditional ruler in that area, they were clearly under the Olu of Warri in Warri Kingdom, they used to have their representative in the Olu's palace, just the way Igbo have Eze Ndigbo in Lagos. Look at Kantu community in Warri SW, they want to take it by force but the people are resisting them even though the people of Kantu are related to Ijaw, they still went there to attack them and yet they want Kantu to recognize them as brothers. |

It quickly lead to instability in the Niger Delta and when there is instability, oil production will drop which will translate into poor performance on the part of GEJ + Boko Haram. Any Ijaw in the three Warri LG who is not confortable with Oduduwa rep should relocate to Bayelsa. Ijaws are customary tenant in Warri. Warri is the same as Itsekiri, Itsekiri is Warri(Iwere) , any one who say he is from Warri is indirectly or directly saying he is Itsekiri. If an Ijaw man is allowed to set up a fishing camp anywhere, after 20 years, he will say that is his community, even though he clearly knows he is from Bayelsa. MEND is not an Ijaw organisation even though they are more in MEND. MEND is powerful because it is a multi-ethnic organization, Yorubas and Ilajes are in MEND. MEND does not fight tribal war as the name implies. That is why they can strike from anywhere including cross river state. |

If Okpe and Uwie decided to separate from Urhobo for political reason the way Isoko did and demand for their own slot , what will happen? A pure Urhobo man will understand Isoko better than Okpe and Uwie, if you doubt me I will make some sentence in Okpe and Uwie for you to see the variation. [b] By Emma Amaize, Austin Ogwuda & Bulou Kosin ASABA – A Federal High Court sitting in Asaba, Delta State, yesterday, held that the gubernatorial candidate of the Democratic People’s Party, DPP, Chief Great Ogboru, was not validly nominated for the January 6, 2011 governorship re-run election in the state, the result of which he is currently challenging at the election tribunal also sitting in Asaba. Trial judge, Justice I. Buba, in his judgment, held that Ogboru was not nominated by 50 registered members of his party, as provided for in the Electoral Act. The Court of Appeal, Benin City, Edo State had in November, 2010, ordered a re-run election in the state after Governor Emmanuel Uduaghan’s election in the 2007 governorship election was nullified. However, Chief Ogboru, who reacted to the judgment on phone, said he will appeal the verdict, describing it as “unfortunate and irresponsible”. The governorship re-run tribunal was scheduled to hear the address of the respective counsel to Governor Uduaghan, Chief Ogboru and INEC today. But it was not clear, yesterday, whether the tribunal will go on with the matter in view of the High Court judgment. The judgment followed the suit by the chairman of the PDP in the state, Chief Peter Nwaboshi and his party, challenging the eligibility of Chief Ogboru to contest the election on grounds that he was not validly nominated for the poll by DPP. Reacting to the judgment, Ogboru said he had travelled a “similar road” in the past, adding that the judgment was not a “big issue” as far as he was concerned. THAT IS MY MAN I felt my spirit moving in him, he has touched on the burning issues that are hurting my body and soul that is always making me to have the tendency to kill any Hausa Fulani on sight. I look at those living in my area as living corpse. This man has given me one reason to like Igbo people for their boldnes in addressing issues without fear. In spite of the killings during the civil war, they are not afraid of war because they are very sure of their prosperity in a new country. Unlike those sycophants in government now who will be incarcerated tomorrow if Hausa take over government. One thing is sure, if Jonathan fail to do the right thing now, he will be killed by his own people when he is out of power. Nigeria will eventually end up in civil war if the right thing is not done. In the the course of fighting, they will shoot GEJ with annoyance for being responsible for the war for not doing the right thing. This is a universal law: When an imbalance is created in a system that is in equilibrium(West R, Eastern R and Northern R) there must be a continuous reaction until the balance is restored. The Ijaws in the creek don't even see GEJ presidency as a solution to their problem, they still come all the way from Beniseide and Ogbotobo in Bayelsa state through the creek to buy pure water and petrol from Warri because there is no portable water there. Jonathan cannot solve their problem with this present structure, imagine the northerners boasting that they stop the increment of derivation from 13% to 25% because it was not in the interest of the north, is that not an insult to my grand father in the village who has over 10 oil well behind his house? History was made in Delta state on Saturday, June 19, 2010, as the first President and Commander-in-Chief of the Federal Republic of Nigeria ever produced from Niger Delta region and the South-South geopolitical zone of the country, Dr. Goodluck Ebele Jonathan paid a one day working visit to the state. According to Cicero a Roman historian, lawyer, philosopher, orator and powerful writer of blessed memory who lived about 40 years before the Birth of Jesus Christ one remarked that “History is the witness of the times, the touch of truth and the life of memory.” The purpose of the President’s visit to the Niger Delta oil rich state can not be far fetched other than to commission the multi-billion Delta State University Teaching Hospital (DSUTH) and the Navy Logistic Headquarters all in Oghara, headquarters of Ethiope West Local Government Area of Delta State and home town of the embattled former governor of the state, Chief James Onanefe Ibori whose administration also initiated the gigantic projects and only completed by the incumbent governor, Dr.Emmanuel Uduaghan. Shortly after the news of the visit of the number one citizen was let out of the bag Deltans in their thousands started dusting their celebration drums and regalia in preparation to welcome one of their own occupying the exalted and highest position in the country. Major cities including the state capital, Oghara among others were wearing new looks while roads in the state capital as well as Oghara were all shot down in honour of the visiting first President produced by Niger Delta region. No doubt Delta state right from inception has always shoulder some of the responsibilities of the Federal government without any cause to regret. Without mincing words, it is of the fact that the Delta State Government bankrolled the building of the Naval Logistics Command which is otherwise, a Federal Government responsibility. Among such responsibilities the state government has also taken up is the dualisation of the 170 kilometre Asaba-Ughelli expressway as well as the building, equipping, furnishing of three Nigeria Television Authority (NTA) stations in Asaba, Warri and Amukpe-Sapele which was donated to the Federal Government. State’s intervention in Federal Government responsibilities demonstrates that co-ordinated energies is fundamental in making the wheels of nation turn, after all, a nation is only as strong as its component parts. Delta state is evidently a wheel within the wheel of our nation, Nigeria . A presidential visit to the state, or even any state, is important as this will afford the number one citizen, the opportunity of further experience the people and understands their challenges of governance. It will also enable the President to know where the state stands in terms of development and encourage her to a higher development. The governor of Delta state Dr. E.E Uduaghan has concluded all arrangement to establish airforce base at Asaba and Warri airport. All necessary facilities have been provided to ensure the take off of the base with a pledge to assist the FG with fund for acquiring war jets to ensure security for the people of delta state. This is the first time I am praising the governor since he was sworn in as a governor for his fore sight to be able to understand the drum beat of a section of this country and dance according to the tune. They have become desperate to force the president to grant them unconditional amnesty and negotiate with them (B(o)an(k)o Robbers) because they are running out of fund to sustain the war. The niger delta youths who have relied on fishing before the oil exploration activities started became jobless as a result of oil production activities that polluted the water and reduce the population of fishes and they became agitated and demanded for resource control and true federalism through militant activities since all effort to dialog with the government proved abortive. The militants didn't beg for amnesty, so why this desperation for amnesty? Is the oil exploration affecting their cattle and tomato in the north? If the purpose of the fighting is to get amnesty, then why the attachment of Boko and Haram? If they are envious of the niger delta militants who were given amnesty, they should remember that amed robbers will be envious of them if they are given amnesty because many armed robbers are graduates and they are watching the unfolding drama. If FG make the mistake of given them amnesty, he should be prepared to give all armed robbers amnesty as the Boko Haram have no much difference from armed robbers without a course.
