Butterflysio:Just as Alphamalekings recommended, make sure you fix your Passport issue. It's even better you forfeit the whole immigration process and start afresh than use the wrong Passport as it will come back to hunt you in the future. The mistake you made was to delay in getting your Passport. That should have been the first thing you should have done before starting the immigration process. But that's by the way. Just see it that the error is fixed asap. |

CreamRoyale:Just as Mayorr89 rightly said, i129F application is done via paper. However note that it's the fiancée in the States (the US Citizen) that sends in the application. It is recommended that he or she fills the form correctly and attach all supporting documents. The form can be gotten from the USCIS website along with the instructions on how to fill it. 3 Likes |

@DankbaresHerz Yes you can start the Immunization process and then complete the rest in the States....if you want to. Whether you actually complete the process or not is irrelevant in your K1 process. However you must use the recommended clinic where you will be assessed by health professionals. Things like blood pressure, urine analysis, X-ray, blood test will be done. Again, the results are irrelevant in the K1 process except if one is diagnosed with a treatable infectious disease. In that case, the disease will need to be treated before you go for the visa interview. However, each country's medical requirement is different. The country you reside in might be more thorough in regards to the medical examination. However the underlying similarity is that you won't be denied visa based on your medicals. 1 Like |

Was Statement taken after the arrest? If no Statement was taken, I'll be leaning towards saying no need to indicate it on the DS form. Paccus:Yes O, it's been a while. Trying to cope with the very fast and demanding culture of the US. It's very hard for a lazy man to survive here in Yankee o....lol. If one is not careful, one will find himself or herself living in makeshift shelters with his or her family within a matter of seconds. But if you are hardworking, you will survive . If you are hardworking and also innovative, you'll become a billionaire . That's the good thing about the US. Hi wale1437, If he is a permanent resident in Ghana and has documents to that effect then the visa interview will be in Ghana. All she needs to do is provide the permanent resident documents when filing for him. And yes, it is important that he goes to the interview with the divorce letter. I will even advice that she includes it in the document she will submit when filing for him. The US government don't joke with bigamy. It's a criminal offense. 2 Likes |

Hi lucaschukwuka, Like you said, it's almost impossible to get that waiver. So you have to figure out how to meet. Regarding your second question, it all depends on the VO that's interviewing you. The VO needs evidence to show that you will go back to Nigeria after visiting. Having a fiancée in the US is not an evidence, rather it suggests you might not go back to Nigeria. So I will suggest you don't make any reference to that unless you are being asked. 2 Likes |

brownesugar:USCIS have not mandated any WES evaluation. People can decide to include it but it's not mandatory. USCIS don't need WES to determine the authenticity of the Certificates. Theu already have eyes and ears in Nigeria....the US Embassy 2 Likes |

Update on my US journey. I went to the Social Security Administration to remove the restriction on my Social Security Card. The only document I showed them was my greencard. I also filled the SS5 form which is available within the SSA building. I got there by 8:45am. They attended to me exactly 9am and I left there at 9:05am. I'm told the New Card will get to me in 7 to 10 days time. 4 Likes |

select500:Appealing such denial is almost impossible. This is because the casefile is sent back to USCIS so the embassy can't be approached for any appeal since they've washed their hands off the case. And since it wasn't USCIS that denied the petition, appealing to the USCIS will almost not yield anything positive. The reason for the denial is mostly suspicion of fraud. So the best route moat people take after being denied is to get married, gather more evidence of genuine relationship and then apply via the Spousal Visa Route. 1 Like |

paosca20:I'm not a legal expert but I think it doesnt affect those who hold a valid immigrant who are arriving after 21st. This is because of the word "and". That is, the reason why one woild be denied entry is if he or she is outside the States, have no valid visa and does not qualify for a visa. Once he or she has a valid visa OR is already in the States OR qualifies for visa on entry then the rule doesnt affect the person. 2 Likes |

SmartKitty1:Not exactly. 250% of poverty level will be counted as a positive weight, not necessary as a compulsory requirement. What's is required and is a must is the 125% of poverty guideline. I will give instances: Instance 1: If the petitioner/beneficiary earns less than 125% of poverty guideline. He or she will be given an RFE to provide cosponsors who can help reach the statutory 125% poverty guideline. If the person fails to provide cosponsors, then the petition is denied. Instance 2: If the petitioner/beneficiary earns more than 125% of poverty guideline but less than 250%. He or she might still be approved if he or she has other positives like: is young, working, has life/health Insurance, and has no kids. Instance 3: If the petitioner/beneficiary earns more than 250%. He or she may be approved provided there are no other negative weights. But if he or she has more than 250% but has lots of other negatives like: is old, has a debilitating illness, has used government assistance in the past and has lots of kids from previous marriages, He or she may still be declared public charge and will be given RFE to provide a public charge bond of $8,000 (he or she will also need to fill the public charge bond form: i945). The second group of videos are also genuine because of the weather, the roads you crossed and the campaign posters (screenshot of Sai Krishna Poster attached) depicted in the videos. However this doesnt vindicate your lies regarding US immigration policies and other stuff. Contrary to what you think, majority of Nigerians don't engage in fraud marriage. disguy1:What it implies is that they have come up with stricter criteria to determining if one will become public charge. Before it used to simply be the petitioner earning a salary that's 125% of poverty guideline. Now they are looking at other things as well. Things like beneficiary's income, household size, health, age, educational status, etc. For example if someone has a terminal or debilitating illness, or someone is 75 years, or is a divorcee with 5 kids, or is a primary school dropout or is unemployed, etc. such person might end up being adjudged to likely be a public charge. Note however that it will be a holistic determination and not just based on one factor. For example, someone who is uneducated but earns a huge sum of money and is young and has no kids will not be deemed to be a public charge. In addition to the form i485 and i864, there is a proposed new form i944 (called declaration of self sufficiency form) that is be filled. It's the form that USCIS will use to determine if the applicant will be a public charge or not. However there's a place I read that even if someone is adjudged to be a public charge by USCIS, he or she can submit a bond of $8,000 to remove that public charge clause. A more detailed document by USCIS is coming out to clarify these issues. Conclusively, I believe all these policies will be voided. All it takes is the democrats to win either in Congress or to win the Presidency in Nov 2020. The reason why there is always a swing in immigration policies between the democrats and Republicans is because they've not be able to come up with a bipartisan immigration legislation.Very soon that will be addressed and all these immigration uncertainties will be resolved once and for all. 1 Like |
