Thanks buddy
I am in the process of getting it corrected at the moment ...very frustrating and tedious
Just as Alphamalekings recommended, make sure you fix your Passport issue. It's even better you forfeit the whole immigration process and start afresh than use the wrong Passport as it will come back to hunt you in the future. The mistake you made was to delay in getting your Passport. That should have been the first thing you should have done before starting the immigration process. But that's by the way. Just see it that the error is fixed asap.

Hello House Good Evening!!!! Please I want to know if I can apply for the K1 visa via online or it has to be on paper mode application... plus secondly is it only I-129F we submit with our supporting documents and when we mail them or other forms would be attached also. Have been confused here. Read and made research’s on here but haven’t come across yet .... please kindly help me . Need your assistance
Just as Mayorr89 rightly said, i129F application is done via paper. However note that it's the fiancée in the States (the US Citizen) that sends in the application. It is recommended that he or she fills the form correctly and attach all supporting documents. The form can be gotten from the USCIS website along with the instructions on how to fill it.

@DankbaresHerz

Yes you can start the Immunization process and then complete the rest in the States....if you want to. Whether you actually complete the process or not is irrelevant in your K1 process.

However you must use the recommended clinic where you will be assessed by health professionals. Things like blood pressure, urine analysis, X-ray, blood test will be done. Again, the results are irrelevant in the K1 process except if one is diagnosed with a treatable infectious disease. In that case, the disease will need to be treated before you go for the visa interview.

However, each country's medical requirement is different. The country you reside in might be more thorough in regards to the medical examination. However the underlying similarity is that you won't be denied visa based on your medicals.

Good day. If one was arrested but later released the same day after questioning and lack of evidence, does the person need to indicate on the DS form that they were once arrested? Besides, the police were intimidating and wouldn’t let go unless money was dropped.
How was the question asked on the DS form? I can't remember exactly how the question is asked. That will determine your response.

Also where was the arrest done? In Nigeria? Was Statement taken after the arrest? If no Statement was taken, I'll be leaning towards saying no need to indicate it on the DS form. But again, like I said earlier, I also need to know how the question was coined in the DS form.

Long time legit... hope to see your update on life in US soon
Yes O, it's been a while. Trying to cope with the very fast and demanding culture of the US. It's very hard for a lazy man to survive here in Yankee o....lol. If one is not careful, one will find himself or herself living in makeshift shelters with his or her family within a matter of seconds. But if you are hardworking, you will survive smiley. If you are hardworking and also innovative, you'll become a billionaire cool. That's the good thing about the US.

Regarding my fiancée Visa journey, I'm waiting for my window period to begin the removal of the conditions on my greencard. The window period is 90 days to the expiration of the greencard.

Hi wale1437,

If he is a permanent resident in Ghana and has documents to that effect then the visa interview will be in Ghana. All she needs to do is provide the permanent resident documents when filing for him.

And yes, it is important that he goes to the interview with the divorce letter. I will even advice that she includes it in the document she will submit when filing for him. The US government don't joke with bigamy. It's a criminal offense.

Hi lucaschukwuka,

Like you said, it's almost impossible to get that waiver. So you have to figure out how to meet.

Regarding your second question, it all depends on the VO that's interviewing you. The VO needs evidence to show that you will go back to Nigeria after visiting. Having a fiancée in the US is not an evidence, rather it suggests you might not go back to Nigeria. So I will suggest you don't make any reference to that unless you are being asked.

Hello House,
I’m so impressed to be on a forum like this as i have gone through to read so much success stories as regards K-1 fiancée Visa which bring about my question.
1. After submitting to the USCIS, How long does it takes to get the Next NOA2 ?? Cos my case was received by USCIS Oct 19th 2020, which has make it Over 5months now.
Hi Lakeside, it usually takes an average of 6 months, I think. The duration might change now due to the pandemic. If you go through the entirety of this thread you should have an idea on how long it might take.

2. What do I & My petitioner needs to start putting in place ahead of the NOA2 In terms of Documents & Finance?
I recommend you read the entire thread. For example, this link listed the documents you'll need before the visa interview: https://www.nairaland.com/4800968/usa-fiancee-k1-visa-thread/27#78272256

3-. Like how long does it take for the whole process to be completed after the NOA2 Has arrived and Approved since it’s going to get to the NVC ?
It usually takes 2 weeks or thereabout. Again, this thread should provide answers if you read it from the beginning to the end. It's a tall order, but it can be done.

4- After that generally how long is the time between NOA2 and NVC and then INTERVIEW?
NVC sends it almost immediately to the embassy. So the limiting step is the embassy and it all depends on how busy the embassy is. It is recommended you shoot the embassy an email the moment you've confirmed that the embassy has gotten your casefile from NVC. There is a website that you can use to track your case file. I can't remember the website link but you'll find it on this thread if you read through thoroughly.

Any assurance that if things goes smoothly by the special Grace of God, Can Checking out of this country be ascertain this Year ??
Yes it's possible. And like you pointed out...you'll need God's Grace...we all do.

Hi everyone, this was posted on VJ and I thought I post it here for any interested person.

So we have been waiting for news on international flight resumption and some of us visas are almost expiring. After all the stress just to see ones visa expire to go through a renewal process again. So some Nigerians that are residents in the US contacted Ethiopian airlines who are willing to get Nigeria govt approval for a flight from Niger to the US but that the passengers must be over 150. So I joined the group with this link and in case anyone here is interested. You too can

https:///KWZMBuLEDeb8UHXKuQjqB8
This is commendable.

The WhatsApp link you posted is actually faulty. Its not your fault though, it is purposely done by the nairaland forum. Perhaps you can also post the VJ link so people can get the correct WhatsApp link there.

Thanks for sharing this info. I think we need to post this info in other relevant threads here on nairaland.

This information is just for those undergoing adjustment of Status. I read that if you file AOS when your k1 is still active (you got married within 90days ). The public charge rule wont affect, you will fill the i-944 forms but it won't be admissible. But if you file AOS after 90days of entry and your K1 non immigrant status is expired, omo the i-944 public charge forms will be scrutinized 100%. And that forms no be small thing. You need evaluation of your transcript or certificates by NACEs member, you need statement of account of the cash you have as at the time of filling as evidence...U convert it to dollars etc, even though you will put your spouse assets etc, you need something for yourself cos the form is about you proving you won't be a public charge.

You can research on this info...for those yet to be here or those filling. Congrats to you all!
There are lots of changes in this AOS process. Current AOS applicants really need to update us with the latest as this is an uncharted territory for everyone.

Actually, according to the USCIS instructions for filling the I-944 form, evaluation of any foreign education should be included in the application..... Not WES specifically...

USCIS have not mandated any WES evaluation. People can decide to include it but it's not mandatory. USCIS don't need WES to determine the authenticity of the Certificates. Theu already have eyes and ears in Nigeria....the US Embassy

Update on my US journey.

I went to the Social Security Administration to remove the restriction on my Social Security Card. The only document I showed them was my greencard. I also filled the SS5 form which is available within the SSA building. I got there by 8:45am. They attended to me exactly 9am and I left there at 9:05am. I'm told the New Card will get to me in 7 to 10 days time.

However I must advice that we all make sure we cross our 'i's and dot our 't's in preparation for the interview so that the CO will see the genuineness in your relationship during the interview. Also don't forget to put everything in God's Hands.

@codemaster2much

Sorry about the denial. However, I don't think there's any need of getting an Immigration lawyer because you can't appeal a K-1 Visa denial.

I believe the rule is that you can only appeal a Spousal (CR-1) Visa denial.

I stand to be corrected though.

@LegitBachelor, @Drenimarcus, @sharpman1, & others...... your thoughts please

All the best.
Appealing such denial is almost impossible. This is because the casefile is sent back to USCIS so the embassy can't be approached for any appeal since they've washed their hands off the case. And since it wasn't USCIS that denied the petition, appealing to the USCIS will almost not yield anything positive.

The reason for the denial is mostly suspicion of fraud. So the best route moat people take after being denied is to get married, gather more evidence of genuine relationship and then apply via the Spousal Visa Route.

Somebody should explain this to me! Does it mean that even if you hold a valid immigrant visa but arrive after 21st, you’ll be affected?
I'm not a legal expert but I think it doesnt affect those who hold a valid immigrant who are arriving after 21st. This is because of the word "and". That is, the reason why one woild be denied entry is if he or she is outside the States, have no valid visa and does not qualify for a visa. Once he or she has a valid visa OR is already in the States OR qualifies for visa on entry then the rule doesnt affect the person.

Now with new rules it will be 250% of poverty level.
Not exactly. 250% of poverty level will be counted as a positive weight, not necessary as a compulsory requirement. What's is required and is a must is the 125% of poverty guideline.

I will give instances:

Instance 1: If the petitioner/beneficiary earns less than 125% of poverty guideline. He or she will be given an RFE to provide cosponsors who can help reach the statutory 125% poverty guideline. If the person fails to provide cosponsors, then the petition is denied.

Instance 2: If the petitioner/beneficiary earns more than 125% of poverty guideline but less than 250%. He or she might still be approved if he or she has other positives like: is young, working, has life/health Insurance, and has no kids.

Instance 3: If the petitioner/beneficiary earns more than 250%. He or she may be approved provided there are no other negative weights. But if he or she has more than 250% but has lots of other negatives like: is old, has a debilitating illness, has used government assistance in the past and has lots of kids from previous marriages, He or she may still be declared public charge and will be given RFE to provide a public charge bond of $8,000 (he or she will also need to fill the public charge bond form: i945). If he or she can't provide the bond, the petition will be denied.

However this doesnt vindicate your lies regarding US immigration policies and other stuff. Contrary to what you think, majority of Nigerians don't engage in fraud marriage. It's just a few bag egg that indulge in such and we have such bad eggs in other countries as well....even here in America.

Bro, u Neva commot? Got to Boston last Friday o. Cold is maad o!

Meanwhile, don’t waste time o see below image. Not too sure what it portends
What it implies is that they have come up with stricter criteria to determining if one will become public charge. Before it used to simply be the petitioner earning a salary that's 125% of poverty guideline. Now they are looking at other things as well. Things like beneficiary's income, household size, health, age, educational status, etc.

For example if someone has a terminal or debilitating illness, or someone is 75 years, or is a divorcee with 5 kids, or is a primary school dropout or is unemployed, etc. such person might end up being adjudged to likely be a public charge. Note however that it will be a holistic determination and not just based on one factor. For example, someone who is uneducated but earns a huge sum of money and is young and has no kids will not be deemed to be a public charge.

In addition to the form i485 and i864, there is a proposed new form i944 (called declaration of self sufficiency form) that is be filled. It's the form that USCIS will use to determine if the applicant will be a public charge or not.

However there's a place I read that even if someone is adjudged to be a public charge by USCIS, he or she can submit a bond of $8,000 to remove that public charge clause. A more detailed document by USCIS is coming out to clarify these issues.

Conclusively, I believe all these policies will be voided. All it takes is the democrats to win either in Congress or to win the Presidency in Nov 2020. The reason why there is always a swing in immigration policies between the democrats and Republicans is because they've not be able to come up with a bipartisan immigration legislation.Very soon that will be addressed and all these immigration uncertainties will be resolved once and for all.
