Oh yeah. The NPC Birth Certificate should suffice, I think (not 100% sure). It's the NPC Attestation Letter that must be accompanied with the Court Affidavit from a Federal High Court, that I'm 100% sure.

It starts counting the day it is signed by the physician. Yes you can do your medicals immediately but it is advisable you wait till you get an appointment date before you gonfor your medicals because it might take a while to get a date.

You can study and write exams while waiting for greencard but can't work. However you can volunteer as long as you are not being paid while volunteering and you are not depriving someone else of being paid.

@Paccus, according to the rules, a one time meeting within 2 years is enough for K1 Visa and is the basic requirement. However meeting more than once will strengthen your case.

The only advantage K1 Visa has over CR1 Visa is that it's faster. You'll get to be with your woman within a short period of time with K1 Visa. The disadvantage however is that it takes a longer time before you get your greencard with K1 Visa.

You can print out WhatsApp conversations. You can also screenshot your WhatsApp calls and print.

More update.

My documents have been verified and it came out positive. I now have a Drivers License thats valid till October next year (one year and 2 months validity). Hopefully My greencard will be out before this license expires so that I will get a 6 year validity on next renewal.

One of the beauty of having a State issued drivers license is that you don't need to carry your international passport and/or your AOS NOA1 along with you anywhere you go. I flew to Miami Florida and the only travel document I took with me were my flight ticket and my texas drivers license.

What Angela777 is saying is that one of the requirements to apply for a K1 visa is that you must have met your fiance physically within the last 2 years.

No need to send any mail to the embassy as long as the approval you got from USCIS is not close to expiration date. Just wait till a date pops up. Just keep checking. NPC Attestation along with a Sworn Affidavit by a Federal High Court should suffice. The documents should contain basic info such as your full names, your date of birth, place of birth, state of origin, parents full names, etc.

You however said the court affidavit you got was from a Magistrate Court. I don't think they accept Magistrate Court documents. I think it's safer to go with an affidavit from a Fedral High Court.

I think the auhor of that piece you quoted got it wrong. So I think this October 15 date is the start off date unless the Courts says otherwise. I learnt a group has taken this new rule to court. Lets see how this pans out. But I think this rule has come to stay.

The only reason I might want to believe this rule might be quashed in the future either by the courts or by a democrat controlled Congress or by a newly elected democrat executive is because of the fate of legal residents seeking naturalization. According to this new rule, a legal resident might have problems becoming a citizen if he is deemed to be a public charge or a potential. And this is not good. Imagine someone who has resided in the States for over 5 years and yet cannot naturalize to become a citizen because at some point he benefited from govt food stamps or housing projects. I feel that he should not be denied cotizemship. This is because he had contributed to the economy in the past before having those financial challenges. I feel they can enforce this public charge rule for visa application (i129F) and AOS (i485) but they shouldn't do it for those seeking naturalization (N400). My opinion.

I think you can but it might mean you'll have some delays.

After getting your NOA2, you'll need to contact NVC and inform them of the need to change embassy the moment you think they've received your casefile from USCIS. You'll need to provide them with reasons and with supporting documents (such as copy of Nigerian Passport which confirms citizenship or Residency Permit which confirms Residency). If they don't respond on time and couldn't effect the change for you then you'll have to contact the two embassies involved and request the switch from one embassy to the other. Most of the time, its the US Embassy in Nigeria that will determine if the switch is possible or not since they are ones you want to take up the case.

I don't think the bar was raised from 125% to 250%. I think its still 125%. However the changes I noticed are:
1. Household Size definition.
2. Beneficiary is now also a reference point in the calculation to determine public charge
3. Other factors such as age, health, income, qualifications, etc also counts and a wholistic approach will be used.
4. The Public Charge Bond of over $8000.

I noticed that household size is now defined as the number of people living the same house as the beneficiary and petitioner. Also included are dependents of both beneficiary and petitioner regardless of whether he or she lives in the same house. Also included in the size is the co-sponsor. For instance if the petitioner is a divorcee and has 2 kids from the former marriage and has parents he take care of. If the petitioner also has a cosponsor and the beneficiary has a kid who will be immigrating with her. The household size will be 9 (beneficiary, beneficiary's kid, petitioner, petitioner's former wife, petitioner' s two kids, petitioner's mum and dad, cosponsor). Note that all these people are counted regardless of whether they are physically staying in the house or not. Imagine if the petitioner is staying in a family house where there are four siblings. Thats 9 + 4!

I also noticed the amount the co-sponsor makes is only used if and only if the sponsor makes up to 50% of the 125% poverty line.

So if the fiancee is financially independent, resides by herself and has no kids and the beneficiary has no kids as well and intends moving in with her, the household size is just two (2). This number however becomes more complex if the fiancee and/or the beneficiary are divorcee and have kids and/or are still living with their parents and not financially independent.

I must however state that this wholistic determination of public charge based on income as well as other factors such as age, health, qualifications, could be tricky. One might be declared a public charge even if he meets the 125% requirement because of his age or his health. But the good thing is that there's the option of Public Charge Bond.

At the facility here in Abuja, results are ready for pick 2-4working days. For instance, I did mine on 22nd and I got a call to pick my result on 24th. I think it’s advisable to get the vaccines there because it’s part of the medical process.

Wow Its nice to know that theirs take only 2 - 4 days unlike in QLife, Lagos that takes a minimum of 2 weeks. I must however say that they are expensive. It's unfortunate that they are the only ones in Abuja so Abuja residents have no other choice......The power of monopoly.

I honestly don't know how to get an earlier date. Some say they cancel and then monitor the site for any random early date that might pop up. Some monitor by using the check4change app. But it's too risky because you might not get any date after canceling and that means you'll lose the October 31 date you had gotten earlier.

My advice is that you work with the date given. Don't rush as it could be dangerous.

@abisolaarshow you'll need the interview confirmation printout and the email from NVC (it should have your casenumber as they will need it). You don't need the letter from Embassy.

@abisolaarshow, now that it says READY, you should do a mail to the US Embassy (LagosIV@state.gov) and ask for update on your casefile so you can schedule your appointment. You'll have to provide info such full names, date of birth, case number, phone numbers, passport number. They will respond in a weeks time. Some people wait till they get a go ahead from the US Embassy before scheduling while others just go ahead to schedule after getting the READY message on the tracking site. Whichever is fine.

Since you want to get the interview this month, you can go ahead and schedule after making the necessary payments and filling the form. Notw however that you must choose a date 3 weeks from now so that you can do your medicals. This is because Medical report takes a minimum of 2 weeks for it to be out and you can't go for your visa interview without it.

No it's not a mistake. K1 visa has both immigrant and non-immigrant features. It starts off as non-immigrant and ends as immigrant visa during processing. Its confusing to me sometimes but its fine.

Regarding Payment, just go to GTBank and tell them you are paying for K Visa.

Also, when I tracked the application like you advised, it said your case is in transit to the consular section Your interview date was provided by the National Visa Centre, but we didn't get any interview date sent.

Yeah, the NVC schedules interview for those who are doing Spousal Visa or Family Based Visa. But Fiancee Visa is not scheduled by NVC but by the applicant using the ustraveldoc portal at the appropriate time. Once the tracking site says READY you can go ahead and make payments, fill the DS160 form and schedule an appointment. Also send an email to the Embassy informing them of your case so they can confirm receipt of your casefile and send you the Packet.

Update on my Texas Drivers License

I went to renew my Drivers License and it went well. My license wasnt renewed at the spot because I don't have greencard or workpermit. However they requested for my NOA1 for the pending AOS application and said they'll get back to me in a weeks time.

So what they will do is verify my documents and if okay will send me a mail confirming my successful verification. Then I will use that mail when going to the Drivers License office to get a new License. It should be valid for one year. Will update you guys.

After approval, they will send your casefile to NVC who will then forward your case to the appropriate embassy. In your case, it might be sent to the US Embassy in Germany if you are resident there.

I advice your fiance call the NVC after a week of receiving the NOA2 to update them with certain info (such as phone numbers, email address, etc). You can also click on page 47 of this thread for some additional info on this.

When the NVC sends your casefile to the embassy, you will then fill the DS-160 form and schedule an appointment with the embassy for a K1 visa interview.

You will need those documents you mentioned (and more) during the interview. For Police Report, you'll need Police Report from Nigeria and Germany and any other country you've resided for up to 6 months. Someone you trust in Nigeria can help you get Police Report. The person can also help you get the NPC Birth Certificate. Bachelorhood Certificate is not compulsory. It only helps strengthen your case in the initial petition which you have already scaled through.
