So he chose the pursue criminal defamation case in which Dele committed a crime under the criminal code section 373 and 375, in the case, it's the police that will investigate and prosecute the case. SmartPolician: The problem is that it's a bailable offence but he's being denied bail probably because of the personality involved or because he accused the Supreme Court of being corrupt. They only adjourned the bail hearing and wasn't denied bail. I think Dele should have weighed all these possibilities. He comes to me as a human right lawyer and never an advocate. Farotimi said the truth about the man and the way he was arrested and remanded corroborated everything he said in the book. In a just society, which is what we want, he hasn't slandered or libeled anybody - he said the truth about them. Afebabalola can write his own book to defend himself. Dele is in court, he should go and prove his case, it's very simple, and can go help him also. He needs to prove all the elements of what he claimed, he's a Lawyer and must be accountable for his actions. He shouldn't have problems with that. He was formally invited by the Police, he refused to honor invitation, he didn't go to court to stop the warrant of arrest issued against him, he left the police and the court with no option than to arrest him. |

It baffles me when Sowore and co begin to tell an aggrieved person how to seek redress. Under Nigeria law, Afe Babalola has an option to either pursue a criminal charge or file for libel, he made his choice, why should that be a problem. I imagine that Dele as a lawyer already knows the options available to Afe Babalola, and was prepared to damn either of it. Why the fuss. Why should Sowore take this as oppression and didn't see that Dele has severely injured Afe. Let's be fair to all. |

When are we going to get it right in this country? He's in court already. You can't dictate to the aggrieved how to seek redress. He's gone to court on the basis of Nigeria Criminal Code section 373 and 375 and not even under the cyber crime Act 2024 as ammended (so we all thought before). The accused made so many defamatory statements that I do not see how he's going to prove all of them. He's a lawyer and should have known the possible consequences |
