Angelfrost: Yes, you are right about such offenses being wrong and criminal... But, they are a civil matter.
They are not in the league of crimes like armed robbery, battery, or homicide.
Civil offenses are handled by courts... This means the petition should be filed with the court, a judge should SUMMON the offender (note the keyword), and he should be made to explain himself.
The judge can thereafter award fines against the offender.
Remember the case between the Falanas and VDM?!!
Why didn't they have him arrested, imprisoned and his fundamental rights trampled upon?!!
You only arrest the offender if he refuses to show up in court or obey a judge's summon.
You didn't sue someone for alleged defamation, but quickly got the police to arrest and dehumanise him... That doesn't make sense. Unfortunately most of the arrest were not based on the civil cases of libel, but on the cyber crime Act as Amendments in 2024. Once the allege defamation is posted online it becomes a cyber crime. If our judiciary system is fixed and cases are decided promptly, victims can get justice. But where civil cases runs for 15years, victims are forced to seek justice somewhere else.
