Justice Oluwatoyin Ipaye of a Lagos High Court sitting in Ikeja Wednesday ordered the service of all processes including the motion for interlocutory injunction on the Peoples Democratic Party, PDP, spokesman, Chief Olisa Metuh in the N500m defamation suit by Alhaji Lai Mohammed of the All Peoples Congress, APC. At the resumed hearing of the case, the court after hearing Wahab Shittu for the Claimant, ordered the service of the processes while adjourned further proceedings till November 17, 2015 for report of service and the hearing of the pending application for interlocutory Injunction filed by Mohammed. The ministerial nominee and spokesman of APC, Alhaji Mohammed, had filed the libel suit asking for N500m as special and general damages against Metuh of the PDP. According to Mohammed in his suit, claimed Metuh had defamed him in a press release, authoured and circulated on September 20, 2015, where he alleged that he (Mohammed) embezzled the funds meant for fencing of an airport in one of the APC-controlled states in the South-West. https://www.vanguardngr.com/wp-content/uploads/2015/10/Lai-Metuh22.jpg Olisa Metuh of the Peoples Democratic Party, PDP and Alhaji Lai Mohammed, Mohammed also claimed that Metuh alleged he (Mohammed) obtained money to supply ambulances to one APC-controlled state in the South-West, which he never did. In the statement, Metuh was quoted to have wondered where the APC chieftain got the courage to speak on corruption when indeed he had mastered the art of corruption having been “a personal aide to one of the most corrupt politicians to ever bestride the political space of the country.” Mohammed, who noted he was a one-time coordinator of the Bola Ahmed Tinubu Campaign Organisation, disclosed that the statement credited to Metuh was “carefully calculated to inflict damage on my reputation and to lessen me in the estimation of the public.” According to him, Metuh in the statement had said, “…our final word for the APC spokesman on this, is that being ethically challenged, includes embezzling funds meant for fencing an airport in an APC-led South-West state. “It also includes when one fraudulently refuses to supply ambulances after collecting monies from another APC South-West state. “It is a comedy of roles when Alhaji Lai Mohammed speaks on corruption, a topic he practices and has well learnt, being a personal aide to one of the most corrupt politicians to ever bestride the political landscape of the country.” Claiming monetary damaged, Mohammed claimed that Mehuh had injured his “character in a grave manner and caused him considerable reputational destruction and embarrassment.” He added that Metuh admitted authorising the statement in a letter by his lawyer, Emeka Etiaba (SAN) dated September 25, 2015 to the claimant’s lawyer, Wahab Shittu, but denied that it was Mohammed that was being referred to. Mohammed, however, quoted Etiaba to have also referred to an earlier statement where Mohammed also attacked Metuh by stating that “the allegations of corruption hanging on his (Metuh) neck, from within his own party, is a clear indication that he is mortally afraid that the wind will soon blow hard enough to expose the fowl’s rump…” Mohammed, however, insisted that he made the said statement based on a petition to the Economic and Financial Crimes Commission written against Metuh on July 15, 2015 by the PDP, Nkwelle-Ezunaka Ward 1, in the Oyi Local Government chapter of Anambra State. To this end, Mohammed is seeking an order mandating Metuh to not only retract his statement but to also tender published apology to him in a widely read newspaper for seven consecutive days. The Nigerian Government on Tuesday asked Justice Gabriel Kolawole of the Federal High Court in Abuja, to put the alleged mastermind of the 2010 Independence Day bombing, Charles Okah, in chains. Mr. Okah, who is standing trial on charges of terrorism alongside Obi Nwabueze, had on October 6 attempted to jump out of the court located at the third floor of a five-storey building. At the resumed hearing, the prosecution, Alex Iziyon, a Senior Advocate of Nigeria, made an oral application requesting Mr. Okah to be chained to avoid a possible abortion of justice. Mr. Iziyon, who referred the court to Section 269 of the Administration of Criminal Justice Act, 2015, urged it to grant the application to save the life of the accused person henceforth during proceedings. “Where a defendant or an accused person misbehaves or displays misconduct in the course of proceedings in such magnitude, he or she should be placed under fetters. “I urge the court to take judicial notice of the proceedings of Oct. 6 and grant our prayer,’’ he said. Responding, Samuel Ozidiri, counsel to Mr. Okah, apologised to the court on behalf of his client and urged the court to discountenance the prosecution’s request. He argued that the application was premature and not worthy of any sympathetic consideration, arguing that the prosecution failed to put the defence on notice before coming up with such an application. Delivering a bench ruling on the application, Justice Kolawole said granting the prosecution’s request might turn out to be the greatest distraction in the suit. He said: “By the provisions of section 6 subsection 6 paragraph 8 of the 1999 constitution, this court, as one of the superior courts of record, created by the constitution, is imbued with discretionary jurisdiction. “This can be exercised without the need for an application from the prosecution once it is of the view that the conduct of the 1st defendant (Okah) is such that it may impede a smooth administration of proceedings. “I have therefore decided to pull back the court’s exercise of discretionary jurisdiction on the apologies given by the defence counsel. “But the powers to make any of the orders prescribed in Section 269 and 71 of the ACJ Act, are exercisable once the court forms the view that the 1st defendant needs to be restrained. “Okah may see this as perhaps the last opportunity not to test the resolve of this court to exercise such powers that are conferred on it by both the constitution and the ACJ Act,’’ Mr. Kolawole said. Goandie:Just that someone has to beat in the message to losers who feel that Metuh is enough to distract the current administration. They had a whole lengthy 6 years to right the wrongs but they turned everything upside. Yet they come here to defend their failures. What a shame! |

Being the mouthpiece for PDP does not mean his job is to bad-mouth every step taken by this administration especially when it is a clear-cut step. In fact, whichever way you view, this guy is only trying to seek relevance for himself and not even for pdp. Don't be surprised if this same metuh decides to switch to apc in the future. Taiwo, a Higher National Diploma 1 student of Computer Science was allegedly attacked by Ogunlesi at about 11:00pm last Thursday at Olatidoye Street in the Oluwo area of the state capital. When our correspondent visited him on his sick bed at the hospital on Monday afternoon, the victim who looked emaciated was in a state of near-coma. He could neither open his eyes nor utter any word . He was also so weak that he almost fell off a chair when attempts were made to sit him up. According an witness, Kehinde Bello said Ogunlesi came to the student-dominated area on a motorcycle in company of another policeman and had earlier beaten two female students in the area with his baton on their buttocks and breasts before they escaped. Bello further alleged that the police officer accosted Taiwo while in pursuit of the two female students who had taken to their heels, following the beatings they received from him. Another witness alleged that Ogunlesi and his colleague however turned their attention to Taiwo who they pursued into his residence where he caught up with the fleeing student and allegedly dealt on him several blows on the head with his baton. The policeman was said to have left the student unconscious in a pool of blood and escaped from the scene along with his colleague who rode the motorcycle. Reacting to the incident, the Acting Police Public Relations Officer for the Command, Abimbola Oyeyemi told our correspondent that the police officer involved had already been summoned to the Eleweran headquarters of the Command and was currently undergoing interrogation. Oyeyemi disclosed that the state Commissioner of Police, Abdulmajid Ali has also ordered a comprehensive investigation of the incident. He added that the police high command in the state would not condone any form of violation of human rights of the citizens. Meanwhile, the state Chairman of the Committee for the Defence of Human Rights, Mr. Olayinka Folarin said that the CDHR would employ all legal means to ensure that justice was done concerning the matter. Back in the days, TV stations like NTA used to fund and assist independent producers. But these days, we have very few networks like Africa Magic and EbonyLife TV supporting and funding TV series. There are also without doubt filmmakers passionate about bringing back the days of passionate series. The Committee which began hearing today observed that the Petition was addressed to President Muhammadu Buhari and not the President of the Senate as is the guiding rule of the Senate that has powers of investigation. Senator Dino Melaye observed: “I have gone through the petition and I discovered that it was not addressed to the Senate President in compliance with Section 41 of Senate rules which requires that all petitions be addressed to the Senate President. Therefore, this petition against Sokoto Ministerial nominee, Aisha Abubakar is dead on arrival,” he said. The sitting which lasted less than 10 minutes began when Dino Melaye and Senior Special Adviser to the President on National Assembly, Ita Enang had a brief discussion with the nominee behind close doors, but in what appears to be premeditated, Melaye said that Abubakar Aisha seems to have met the requirements as enshrined in section 147 and 14(3), section 66 of the Constitution of the Federal Republic of Nigeria 1999 as amended, which stipulates the qualifications of a potential minister, hence, it should be dismissed Responding to inquiries whether she belongs to any political party, the nominee responded that she is a public servant and that she is still in service. Look, I will continue to say that PDP totally turned this country upside down. As such, they should just shut up and sit down and let the current administration dispense its duties. PDP have no say in this dispensation. Whatever Metuh is trying to achieve would not impact on Nigerians. He had his opportunity and he failed. Someone else is now there. Let him do his job. |
hinwazaka:I don't see where Adesina has fallen or is falling for any trap. Metuh is a noise maker and that's why he needs to be responded to with uneasiness. Adesina does need to explain anything about the administration to Metuh and that's why he referred to him as a broken record. That's the cutest answer to send to a lowlife like Metuh. With that phrase alone, he has put Metuh in his right space. |

Recall that the Presidential spokesman had on Sunday, while reacting to accusations by the PDP’s spokesman, Chief Olisa Metuh that President Buhari’s anti-corruption war was one-sided, described Metuh as a “broken record” repeating the same lines. “Mr Olisa Metuh is sounding like a broken record. It’s the same thing that he says all the time,” Adesina had said, assuring “that the President has always maintained that even when it affects APC members, the person concerned must go and defend himself. I think what is of interest to Nigerians is ‘did these people commit the crime?’ It is not whether it is one-sided.” But reacting through a statement signed by Metuh on Monday, the PDP said: “Mr Adesina, in his habitual deceptive and diversionary manner, left the critical issues of governance raised by Sunday’s press conference addressed by the PDP national publicity secretary, Chief Olisa Metuh, and as usual, embarked on insults, shadow-chasing and fouling of the media space with uncouth language.” “This office has noted Mr Adesina’s several previous unwarranted personal attacks and insults deliberately targeted at the person of the PDP National Publicity Secretary, in his desperate attempt to impress his paymaster and retain his job. “Our answer remains that inasmuch as we know that this presidency aide lacks depth on his current assignment and has no credible defence, being overwhelmed in his job of trying to launder the image of this government, the characteristic resort always, to lies, malice and vituperations should not be an option.
