The UN and European Union
condemned the United States on Friday
after the country’s first execution of an
inmate using nitrogen asphyxiation, an
untested method that has reignited a
debate about capital punishment.
The southern state of Alabama put
convicted murderer Kenneth Smith to
death on Thursday by pumping
nitrogen hypoxia into a facemask,
causing him to suffocate. It was the first
time the country had used the
execution method, rather than the more
common lethal injection.
Smith was pronounced dead at 8:25 pm
(0225 GMT Friday).
“Justice has been served. Tonight,
Kenneth Smith was put to death for the
heinous act he committed over 35 years
ago,” Alabama Attorney General Steve
Marshall said in a statement.
But United Nations human rights chief
Volker Turk expressed deep concern
about the execution.
“This novel and untested method of
suffocation by nitrogen gas may
amount to torture, or cruel, inhuman or
degrading treatment,” Turk said,
according to a statement.
The European Union, which opposes
the death penalty, also condemned the
execution.
“According to leading experts, this
method is a particularly cruel and
unusual punishment,” a spokesperson
for the 27-member bloc said.
Smith, 58, was on death row for more
than three decades after being
convicted of the 1988 murder-for-hire
of Elizabeth Sennett, a pastor’s wife.
After the gas was administered at
Alabama’s Holman Correctional Facility,
Smith “began writhing and thrashing
for approximately two to four minutes,
followed by around five minutes of
heavy breathing,” local news outlet
AL.com reported.
Smith appeared to be “holding his
breath as long as he could” and there
was “involuntary movement” and
gasping, Alabama Department of
Corrections Commissioner John Hamm
told reporters.
The curtain over the media witness
room opened at 7:53 pm, AL.com said,
with Smith pronounced dead 32
minutes later.
– ‘Step backward’ –
Robin Maher, executive director of the
Death Penalty Information Center,
called it “an untested, unproven
method of execution.”
“It’s never been used before to execute
anyone in the United States, or anyone
in the world as far as we know,” Maher
told AFP.
Smith was subjected to a botched
execution attempt in November 2022,
when prison officials were unable to set
intravenous lines to administer a lethal
injection.
The US Supreme Court rejected his
latest appeal for a stay of execution.
Smith’s last words Thursday were,
“Tonight, Alabama caused humanity to
take a step backward,” according to the
local CBS affiliate.
“I am leaving with love, peace and
light… I love you. Thank you for
supporting me. I love all of you.”
According to the Alabama Department
of Corrections, Smith had a last meal of
steak, hash browns and eggs.
The last US execution using gas was in
1999 when a convicted murderer was
put to death using hydrogen cyanide
gas.
There were 24 executions in the United
States in 2023, all of them carried out
by lethal injection.
Alabama is one of three US states that
have approved the use of nitrogen
hypoxia as an execution method, along
with Oklahoma and Mississippi.
– Calls for moratorium –
While nitrogen gas had never
previously been used to execute
humans in the United States, it is
sometimes used to kill animals.
But Turk’s office pointed out before the
execution that even the American
Veterinary Medical Association
recommends giving large animals a
sedative when they are euthanized in
this manner.
Alabama’s protocol for execution by
nitrogen asphyxiation makes no
provision for sedation.
The state defended the technique as
“perhaps the most humane method of
execution ever devised.”
Smith and an accomplice, John Parker,
were convicted of the 1988 murder of
Sennett, for which they were each paid
$1,000. Parker was executed by lethal
injection in 2010.
Charles Sennett, who had arranged his
wife’s murder, killed himself a week
after her death.
Speaking to reporters after the
execution, Elizabeth Sennett’s son Mike
said it had been a “bittersweet” day for
his family, as “nothing that happened
here today is going to bring Mom
back.”
According to a recent Gallup Poll, 53
percent of Americans support the death
penalty for someone convicted of
murder, the lowest level since 1972.
Capital punishment has been abolished
in 23 states, while the governors of six
others — Arizona, California, Ohio,
Oregon, Pennsylvania and Tennessee —
have put a hold on its use.
“The death penalty is inconsistent with
the fundamental right to life,” said UN
rights chief Turk.
“I urge all states to put in place a
moratorium on its use, as a step
towards universal abolition.”

A 14-year-old girl in Anambra State,
South-east Nigeria, has been allegedly
raped and impregnated by her uncle in
the state.
The survivor is said to be a junior
secondary school student in the state
while the man who allegedly raped her
has been identified simply as Simon.
A human rights activist, Harrison
Gwamnishu, in a post on his X handle
on Tuesday said the girl began staying
with the suspect after she lost her
father.
Mr Gwamnishu said the situation got
worse when her mother suffered
mental illness and was unable to care
for her.
The rights activist said the frustrated
girl began to stay with the suspect after
relatives asked her to do so, but the
uncle later “took advantage of her and
on several occasions raped and
threatened her never to disclose her
predicament to anyone.”
He said the girl is currently eight
months pregnant for the uncle.
When contacted on Wednesday
morning, Mr Gwamnishu said the
National Agency for the Prohibition of
Trafficking in Persons (NAPTIP) has
taken over the case, following his alarm
on X.
He added that the survivor had been
relocated to Abuja, by the anti-
trafficking agency.
The police spokesperson in Anambra
State, Tochukwu Ikenga, told PREMIUM
TIMES on Wednesday that the police in
the state learnt of the development
through the social media post.
Mr Ikenga, a deputy superintendent of
police, said the police were already
making efforts to confirm the true state
of the matter.
“I will get back to you as soon as I can,
please,” he assured.
NAPTIP spokesperson, Zachariah Duada,
confirmed the development to
PREMIUM TIMES on Wednesday
afternoon.
When asked if the man who raped the
girl had been arrested, Mr Duada said
he would get back to our reporter when
he finds out.

OPay, a leading financial technology company, said yesterday it has taken various measures to deepen the integrity and credibility of its platform, disclosing that as from March 1, any account not linked with the owner’s national identity number (NIN) and the bank’s biometric verification number (BVN) would be wielded out.

This is part of implementing the Know Your Customer (KYC) directive by the Central Bank of Nigeria (CBN).

The company stated this at a media briefing in Lagos to unveil their plans for the New Year.

Director, Partnership for Opay, Ik Kolawole Odiase said by March 1, any account holder that is non-compliant with the directive to link his/her BVN and NIN would be logged out of the platform.

“Any fraudulent account will be wiped off. Going forward, you have to link your NIN and BVN which must both align,” he said.

According to him, the platform has introduced a series of innovations and security measures to protect depositors’ funds, saying, “We are concerned about the safety of depositors’ funds.

Olayemi Priscilla, Head of Card Business disclosed that the company successfully issued more than 5 million Opay Verve cards to customers as of December 2023.

Priscillia added that the company has 17 physical locations across the country that can offer customer service physically in its drive to make financial services more inclusive.

She stated that a robust and responsive online customer service centre is being made available for users who prefer online inquiries and technical resolutions.

“Opay has established a network of 17 customer service centres across the country, catering to individuals who prefer face-to-face interactions for their service-related queries and concerns.

“For users who prefer online inquiries and technical resolutions, a robust and responsive online customer service centre awaits,” she added.

On corporate social responsibility, Olayemi noted that the company supported 1,300 children, five primary and secondary schools and five communities in two cities.

Priscillia noted that two tertiary institutions were reached in two cities, completed three projects, adding that the company is building branches in universities starting with the University of Lagos.

The United Nations has urged the Nigerian government to abolish the death penalty.

Currently, Nigeria’s correctional centres have 3,413 inmates on death row, Abubakar Umar, spokesperson for the Nigerian Correctional Services, said last December.

Member States of the global body called for an immediate moratorium on the death penalty pending its abolition from Nigeria’s criminal justice system.

The calls were made on Tuesday at the Universal Periodic Review (UPR) of Nigeria in Geneva, Switzerland.

Nigeria’s delegation led by the Attorney General of the Federation and Minister of Justice, Lateef Fagbemi, is currently in Geneva for the UPR, which happens every four to five years.

The UPR is a unique mechanism of the Human Rights Council that calls for each UN Member State to undergo a peer review of its human rights records every 4.5 years.

While presenting Nigeria’s report of its human rights efforts, Mr Fagbemi reeled out a plethora of laws and policies enacted by the government to curb rights abuses.

“Nigeria has enacted several legislations such as the Administration of Criminal Justice Act (2015), the Child Rights Act, and Anti-Torture Act amongst others to safeguard the rights of Nigerians,” the justice minister said, while being flanked by the Solicitor-General of the Federation and Permanent Secretary, Federal Ministry of Justice, Beatrice Jeddy-Agba.

A PREMIUM TIMES reporter was at the UN House in Abuja on Tuesday and monitored the Geneva proceedings of Nigeria’s presentation of its human rights status to the UN Human Rights Council.

Nigeria’s human rights report
The Attorney General said Nigeria’s quest for an improved human rights record led to the strengthening of public institutions to ensure accountability in the event of violations.

Mr Fagbemi explained that the country had taken steps to “promote and protect the enjoyment of fundamental human rights of Nigerians.”

“Nigeria remains committed to the promotion of the rule of law and obedience to court decisions. Nigeria has designated the National Human Rights Commission (NHRC) as the independent Nationa Preventive Mechanism against torture,” the AGF said.

He added that the Child Rights Act is now domesticated across the 36 states of Nigeria, while the Violence Against Persons Prohibition Act is already adopted in many States across the country.

Speaking further on other areas of rights enforcement, the minister noted that the government set up investigative panels following protests over police brutality in Nigeria in 2020, with outcomes of the probe leading to payment of compensations to victims of violations.

On the Nigerian delegation are Wale Fapohunda, a former Attorney-General of Ekiti State; Olumide Osoba, a member of the House of Representatives and Chairman, House Committee on Justice; Abdulrahman Yukubu, a director at the National Human Rights Commission; and the Solicitor-General of the Federation, Ms Jeddy-Agba.

They took turns to present Nigeria’s report of its implementation of human rights mechanisms, which were previously recommended by the UN Human Rights Council.

Nigeria was last reviewed by the 193-member body in 2018 when it made far-reaching recommendations aimed at bolstering the country’s human rights status.

However, the Nigerian government’s claims of its accomplishments in the “protection and promotion of Nigerians rights” are at variance with practical issues in the country.

Angela Uzoma-Nwandu, the country director of Avocats Sans Frontieres (ASF) in Nigeria, said “Policies and legislation are as good as their implementation.”

Ms Uzoma-Nwandu added policy implementation would guarantee the realisation of human rights in Nigeria.

She noted that it was time for Nigeria to abrogate the death penalty because it violates the right to life.

Issues of arbitrary arrests and detention, press freedom, torture, shrinking of civic space and religious intolerance continue to plague Nigerians.

For instance, Deborah Samuel, an undergraduate was gruesomely murdered in Sokoto State, north-west Nigeria in 2022. The government promised to bring the perpetrators of the dastardly act to justice, but it reneged on it.

Sexual and Gender-Based Violence incidents are rampant with many perpetrators going scot-free.

Last November, Amnesty International urged President Bola Tinubu to “make human rights protection its priority by ensuring that every Nigerian’s rights are protected and that perpetrators of rights breaches do not go unpunished.”

It accused President Tinubu of failing in his responsibility to uphold the rights of Nigerians owing to widespread violent crimes and poverty.

In their separate review of Nigeria’s human rights records, West African countries like Ghana, Togo, and Gabon urged the government to end the death penalty and tackle gender-based violence.

Other African countries in their broad assessment of various rights issues, recommended the strengthening of public institutions to deliver on qualitative healthcare and education for Nigerians.

The United States and Canada expressed their concerns about Nigeria’s human rights conditions, calling for the full implementation of recommendations by the EndSARS panels.

They said the Nigerian government must prioritise the prosecution and punishment of law enforcement officers indicted for rights breaches.

They also urged Nigeria to decriminalise same-sex marriage. The offence carries a 14-year jail term.

But in his response to the issue of LGBTQ, the justice minister said Nigeria’s laws are a reflection of the country’s cultural background.

Speaking further, Mr Fagbemi said Nigeria had begun commuting the death penalty to life imprisonment in line with the correctional services law.

Nigeria last had its death sentence execution in 2016 in Edo State, South-south Nigeria.

Adwoa Kufuor, senior human rights adviser at the UN in Abuja, told PREMIUM TIMES that the global body would collaborate with the Nigerian government in meeting its obligations in terms of human rights protection.

Ms Kufuor itemised key thematic rights issues upon which Nigeria was reviewed including – the death penalty, women’s empowerment, SGVB, qualitative education, universal health coverage, and rights of the aged, among others.

The ambassador of Belgium to Nigeria, Pieter Leenknegt, was at the UN House in Abuja, from where he watched the Geneva proceedings on Nigeria.

He noted the observations and recommendations of UN Member States to Nigeria on LGBTQS and social protection.

Femi Adesina, former media aide to ex-President
Muhammadu Buhari, has shared intriguing details
about President Buhari’s response upon learning
about Bola Tinubu’s ‘Emi Lokan’ speech.
The revelation comes from Adesina’s account in
his new book, “Working with Buhari: Reflections
of A Special Adviser, Media and Publicity
(2015-2023).”
In June 2022, Bola Tinubu, then the presidential
aspirant of the All Progressives Congress (APC),
made headlines with the ‘Emi Lokan’ remark
during a meeting with APC delegates in Ogun
State. Translated as “it is my turn” in Yoruba,
Tinubu asserted that without him, Buhari wouldn’t
have won the 2015 presidential election.
Adesina disclosed that when Tinubu made these
statements, President Buhari was not in the
country; they were in Spain for an event.
Concerned about varied interpretations reaching
the President, Adesina and other aides decided
to brief Buhari during their return flight to Nigeria.
Sharing the moment of revelation, Adesina
stated, “The visit concluded, and we were to
return home on Friday, June 3, when the social
media exploded with reports from Nigeria, of
comments made at a public event in Abeokuta,
Ogun State, by Asiwaju Bola Ahmed Tinubu, the
APC National Leader and an aspirant for
President in the forthcoming party primary.
“Asiwaju Tinubu said many things, but what
touched on President Buhari directly was that
without him (Asiwaju), Buhari would never have
been President, and that it was now his own turn
to rule. Emilokan, my turn, in Yoruba language.

“We the principal aides of the President were in a
dilemma on how to brief the President on what
had happened, as it would not be right for him to
get to Nigeria and be reading different versions
and interpretations of what happened, which may
be right or wrong.
“Myself, Ambassador Kazaure, (SCOP), Chief
Security Officer to the President, Idris Ahmed
Kasim, Mohammed Sarki Abba, Dr. Suhayb
Rafindadi, Col. Yusuf Dodo, the Aide-De-Camp,
and Tunde Sabiu, Special Assistant, put heads
together, and decided that I should brief the
President when we were airborne to Abuja. The
motive was so that he would not get varied and
possibly distorted versions.
“Few minutes into the flight, I approached the
President and said I needed to bring him up to
speed on something major that had happened
back home.”
President Buhari’s response was one of quiet
contemplation. Adesina continued, “Ever a willing
listener, the President told me to go ahead. I did
a summary of the Emilokan speech, and when I
ended, the President ruminated for some
moments and responded: ‘Asiwaju said all that?
Thank you for coming to brief me.'”
The ‘Emi Lokan’ speech had sparked various
interpretations and discussions on social media.
To address the unfolding narrative, Tinubu’s
campaign team felt a clarification was necessary,
asserting that the aspirant wasn’t deriding the
President in any way.
Upon their return to Nigeria on June 3, 2022,
President Buhari held a meeting with all APC
presidential aspirants at the State House on June
4.
Adesina noted that the ‘Emi Lokan’ reference was
palpable, but President Buhari avoided
mentioning it explicitly. Instead, he encouraged
aspirants to consult and build a consensus to
produce a formidable candidate.
“Next day, June 4, President Buhari held a
scheduled meeting with all APC presidential
aspirants at the Villa. Emilokan hung thick in the
air, but trust the President, not a word of it was
mentioned.
“He only appealed to the aspirants to consult
among themselves, build a consensus, and
produce a formidable candidate who could win
an election for the party,” Adesina added

A 20-year-old self acclaimed spiritualist, Emmanuel Ebeagbor, Aka Dr Walock, has been arrested by operatives of the Edo State Police Command.

DAILY POST reports that the suspect, said to be specialized in defrauding women while pretending that he has solutions to their spiritual problems, was arrested at Uromi, by operatives of the Intelligent Rapid Response Squad.

The State Commissioner of Police, CP, Funsho Adegboye, said the suspect was arrested by the operatives in the course of investigations into a case of cyber stalking reported at the station.

Adegboye said the suspect requested the sum of N240,000 from a lady to help solve her spiritual problem.

He disclosed that after the victim transferred the money to the suspect’s bank account, he (the suspect) also demanded her nude video.

According to the CP, the suspect asked the woman to record the nude video when she is taking her bath, for spiritual cleansing, and promised to delete it after use.

She did as he instructed and two weeks later, the suspect demanded for the sum of N400,000, and threatened to post her nude video on the internet,” he said.

The CP said during investigation, the complainant’s nude video and those of other ladies who were the suspect’s victims, were found in his phone.

He said the suspect will soon be charged to court.

In an interview with newsmen, the suspect said he introduced himself to the woman as a spiritualist, and promised to help her.

He said he had lost count of his victims as they are numerous.

The Edo State Police Command has
arrested two sexagenarians and a female
for the alleged stealing of Toyota Camry 2.4
cars valued at N7 million during a crusade
at Garrick Memorial School in Benin City.
DAILY POST reports that Edo State
Commissioner of Police Funsho Adeboye
disclosed this while parading 18 suspected
criminals in Benin City.
Adeboye said the sexagenarians committed
the offence on October 27, 2023.
He gave their names as Augustine
Ikponmwoba, 67, and Roland Ibizugbe, 63,
and the female suspect, Blessing Joseph,
36.
He said the Toyota Camry cars, with
registration numbers MUS 791GA and USL
93AM, each valued at N3.5 million, belonged
to Mrs Joy Mordi and Mr Peter E. Abiwo.
According to him, on November 27, 2023, at
about 8 pm, the Divisional Police Officer in
charge of Evbuotubu Division, Benin City,
received a complaint from Mordi of No. 4
Upper First Federal Road, Uselu and Abiwo
of No. 10 Omoruyi Street that they
individually parked their vehicles at Garrick
Memorial Ground, Ekehuan Road, Benin City,
to attend a crusade, but after the closing of
the crusade at about 8 pm they discovered
that their vehicles had been stolen.
“After a preliminary investigation, the case
was transferred from the Evbuotubu Division
to the Anti-Vehicle Theft Unit of the State
Criminal Investigation Division (CID),” he
said.
The arrest of Blessing Joseph, who had one
of the phones left in Mordi’s vehicle, led to
the arrest of Augustine Ikponmwoba, her
male friend.
Adeboye said Ikponmwoba, in turn, led
operatives of the command to arrest
Ibizugbe.
He explained that the suspects made
statements and confessed to the crime.
He added that the 18 suspects were
arrested for alleged kidnapping, cultism,
armed robbery, and illegal possession of
firearms, among others.

Operatives of different special units of the
National Drug Law Enforcement Agency,
NDLEA, have intercepted large
consignments of Cocaine and Colorado, a
strong strain of cannabis, concealed in
containerized household items and vehicles
imported from Durban, South Africa and
Canada at the Tincan Seaport in Lagos.
Following coordinated intelligence and
months of tracking of the containers by
three special units of NDLEA, the illicit
drugs along with arms, ammunition and
sundry military effects were seized during
joint examination of the three containers by
the Agency’s officers and their counterparts
from Customs Service and other security
agencies between Thursday 18 and Friday
19 January 2024. Some of the Agency’s
sniffer dogs were also deployed to help
identify locations and bags used in
concealing the illicit items.
Some of the items recovered from the
containers include: 1, 274 parcels of
Cocaine and Colorado with a total weight of
884.09 kilograms; four pistols; 197 rounds
of 9mm ammunition, 49 rounds of 7.62mm
ammunition, 275 rounds of 5.56mm
ammunition, 14 rounds of 9mm
ammunition and sundry military personnel
effects as well as some chemicals in kegs.
With the exception of 32.5kg shipment of
Colorado that came in used vehicles from
Canada, the rest of the items were found in
two of three containers that arrived the
Tincan port from Durban, South Africa
onboard a vessel marked MSC RESILIENT
III and discharged on New Year eve, 31st
December 2023. A suspect linked to one
of the containers, UACU 5348336, bearing
the 32.5kg Colorado, 41-year-old Akara
Chibugo has already been tracked and
arrested by NDLEA operatives.
Two vigilant freight agents and a traveler
escaped being roped into two drug
trafficking operations by desperate
traffickers at the Murtala Muhammed
International Airport, MMIA Ikeja Lagos. The
two agents were contacted to send a
consignment of 1kg cannabis concealed in
tins of Milo beverage to Turkey but chose
to submit the shipment to NDLEA checks
before processing the cargo. The
psychoactive substance was later
discovered to be hidden inside the
shipment.
In the same vein, NDLEA operatives on
Friday 19 January arrested one Okosun
Paul Punitt, the consignee of a
consignment of tramadol concealed in a
bottle of dietary supplements, which a staff
of Pathfinder International Ltd, Ajuzieogu
Mac-Elvis Ugochukwu attempted sending
through an intending passenger on Ibom Air
to Accra, Ghana at the Lagos airport on
Tuesday 16 January. A video of the face-
off between the passenger and Ajuzieogu
later went viral after the vigilant passenger
suspected the consignment contained illicit
substances. Both Ajuzieogu and the exhibit
were later transferred to NDLEA on
Thursday 18 January by the Federal
Airports Authority of Nigeria, FAAN for
investigation. Preliminary findings by
NDLEA showed the parcel contained 50
pills of tramadol 225mg concealed in a
bottle of dietary supplements. A follow up
operation by the Agency led to the arrest of
Okosun upon his return from Ghana on
Friday. He has in his statement confirmed
ownership of the drug.
