First and foremost tell your friend to get a lawyer. On the bank account opening form there is a column for first childs' name and details(apart from column for next of kin), and the bank would also ask for the death certificate of both parents and some paper work from the court, so also tell her to have a valid means of ID which has the same details as the one the dad filled on the account opening(DOB,name and so on). This might take a little while and long process but if the lawyer knows his way around your friend would get the dads' money back; Usually the lawyers charge between 20-30percent of the total amount of money in the bank account.
