The Federal High Court in Warri, Delta State, has awarded N50m damages against the Nigerian Army for the murder of Ajayi Oladele, who was said to have died as a result of a spinal cord injury he sustained when he was arrested and beaten by some soldiers in Warri in 2017.

Oladele was said to have been arrested and beaten by soldiers in their bid to help a businessman to recover a debt from the deceased.

Following his death, his widow, Esther Oladele, and their three children, filed the fundamental rights enforcement suit marked FHC/WR/CS/93/2017 against the Nigerian Army, one Lt. Col. T. A. Yakubu and Sergeant Hassan Hassan.

The suit was instituted on behalf of the plaintiffs by their lawyer, Mr Kunle Edun, who prosecuted the case for them free of charge.

Justice Emeka Nwite in the judgment delivered on December 10, 2019, declared that the four “plaintiffs’ right to life and therefore good and reasonable comfort of life have been violated by the acts of the defendants by the unlawful killing of Otunba Ajayi Oladele being that the deceased was the parent of the 2nd, 3rd, and 4th plaintiffs and husband to the 1st plaintiff and also the breadwinner of the family.”


In the copy of the judgment seen by Punch correspondent on Wednesday, the judge made an order, “awarding the sum of N50,000,000 as general and exemplary damages jointly and severally against the defendants in favour of the plaintiffs as a result of the unlawful/wrongful death of Otunba Ajayi Oladele and for loss of consort, fatherly love/care, comfort and disruption of the family life of the plaintiffs.”

The judge also awarded N100,000 against the defendants and in favour of the plaintiffs as cost of prosecuting the case.

President Muhammadu Buhari has once again longed for the absolute prosecutorial powers he wielded when he led a military junta in Nigeria in the 1980s.

As the president clocks 77 on Tuesday, he granted a brief interview to state-run television, NTA, telling the station that he was unhappy about democracy’s ‘slow’ method of justice.

“When I came in uniform, I collected those who were leading, took them to Kirikiri (Maximum Security Prison) and told them they were guilty until they could prove themselves innocent,” Mr Buhari said, lamenting that he had “learned the hard way” that he could not do that in a democracy.


“I put based on almost all the geopolitical zones committees to investigate them. Those that were found to have lived beyond their means, the balance was taken and were given to the states.

“But I myself was arrested, detained and they were given back what they have stolen.

“So under this system which is supposed to be more accountable, but it is too slow for my liking, but I have to follow it,” Mr Buhari said.

Body parts of woman believed to have been murdered has been found on a road side in Abuja. The parts where found dumped at Area 3 Junction in Abuja on Tuesday, December 10, 2019.

The severed parts of the woman's body -- her head, hands, and limbs, were found in different polythene bags at the junction that leads to Living Faith Church.

Passersby who discovered the body contacted the police who Later arrived and took the body parts away.

The Lagos State Film and Video Censors Board (LSFVCB) on Tuesday said that 30 traders had been arrested in clampdown on sellers of pirated films in the state.

The Executive Secretary of the board, Mr Dele Balogun, said in a statement that the traders were arrested after a week-long raid on pirated films outlets in eight local governments areas across the state.

He said that between Dec. 3 and Dec. 10, the board, in collaboration with security agencies, raided Kosofe, Alimosho, Mushin, Surulere, Oshodi-Isolo, Agege, Lagos Island and Ikorodu council areas.

He said that tens of pirated DVDs, CDs, unclassified films, film production equipment, as well as pornographic materials, were seized within the period.


Balogun added that during the raid, which was met with some resistance in some areas, cameras and other equipment were seized from presumed movie practitioners for shooting movies in the state without the approval of LSFVCB.

He said the raid was part of efforts to rid the state of pirated and unclassified movies and ensure that producers of movies compiler with laid down rules in the production of films.

The LSFCVB boss said the sale of pirated and unclassified films had become a thriving business in the state, saying the board would do all possible to check the problem.

Boboye Oyeyemi, corps marshal of the Federal Road Safety Corps (FRSC), says no driver should transport corps members leaving orientation camp from 6pm.

He gave the warning during the FRSC end-of-the-year meeting with transport union stakeholders, in Abuja, on Tuesday.

The meeting is one of the programmes done in preparation for the end of the year activities. It particularly looks at how vehicular accidents can be reduced during the festive periods.

The National Youth Service Corps (NYSC) members for Batch C Stream II had resumed orientation camps on November 28 and would end December 19.

Boboye said any driver that transports the corps members from 6pm above, will face serious consequences.

“No transport union should convey any corp member and those leaving the orientation camp on Thursday, December 19, 2019 from 6pm. Any vehicle that violates this order will be dealt with seriously, as the FRSC is committed to the safety of lives and properties,” he said.

“I want to urge the state coordinators of different NYSC orientation camps to send signals to the corps members to be aware of the information. This has become necessary to address road accidents and crashes that occur during the festive periods across the country. The safety of the youths, goods and Nigerians’ lives at large is our major concern.”

The FRSC also boss urged corps members to use motor parks while boarding vehicles. He urged them to avoid roadside vehicles for security reasons.

He called on the transporters to reduce prices of transportation fares for corps members in order to make it affordable for them.

“This is the main reason why you see corps members boarding vehicles at night and, sometimes, on the roadside,” he said.

“The belief is that the prices of transportation would reduce at night by boarding at the roadside. This is not safe at all.”

In reaction, Yusuf Adeniyi, national secretary, Road Transport Employer’s Association of Nigeria (RTEAN), said the directive will be complied with, adding that the transportation fare will be reduces for corps members during the period.

“We will direct all the offices nationwide to bring down the prices and provide good vehicles for their safety,” he said.

The Nigerian Bar Association, NBA, has demanded for the immediate suspension of the Director-General, DG, of the Department of l State Security Services, DSS, Yusuf Bichi.
The Lawyers Association was reacting to Friday’s invasion of a Federal High Court, in Abuja, by armed Officials of the DSS.

The Officials disrupted the court proceedings, in their bid to re-arrest Omoyele Sowore and Olawale Bakare. Both Activists, arrested for planning a nationwide protest, were released by the DSS, on Thursday night, about 125 days after their arrest.

They had been granted bail by two different Judges, but the DSS refused to release them.

The Agency, however, released them on Thursday, after Justice Ijeoma Ojukwu gave the DSS 24 hours to release the Activists, who are being tried for treasonable felony and insulting President Muhammadu Buhari.

They were however, re-arrested on Friday.

In its statement, on Friday, the NBA said that it was “dismayed at the exhibition of primitivity, thuggery, insane passion for lawlessness, contempt and disrespect for the rule of law by the Agents of the Department of State Services, DSS, within the precints of the Federal High Court, Abuja”.
The NBA, therefore, made four demands including the “immediate suspension of the Director-General of the Department of State Security from Office”.

“We make this demand bearing in mind the fact that the DSS under his leadership has established itself as a brutish and irresponsible agency that derives immense pleasure from violating the fundamental rights of Nigerians and disrespecting court orders”, Kunle Edun, the National Publicity Secretary of the NBA, said in a statement.
The Association also called for an investigation of the DSS’ action, as well as a review of the law establishing the Agency.

“Nigerian Bar Association is greatly dismayed at the exhibition of primitivity, thuggery, insane passion for lawlessness, contempt and disrespect for the rule of law by the agents of the Department of State Services (DSS) within the precints of the Federal High Court, Abuja while attempting to re-arrest Citizens Omoyele Sowore and Olawale Bakare earlier today. Eventually Sowore and Bakare were re-arrested by the DSS inspite of being on bail granted by the Federal High Court.

“The NBA has been properly briefed – beyond the shameful videos of the incident in public domain- by our members who witnessed the disgraceful and crass violation of the hallowed precincts of the law by the officers of the Department of State Services, an agency of the Federal Government of Nigeria. The NBA finds it disgraceful that this ‘court riot’ occasioned by the high handedness and insensitivity of the security operatives interrupted judicial proceedings and made the Presiding Judge to abandon judicial proceedings because of safety concerns.

“The Nigerian Bar Association strongly condemns the action of the Department of State Security, which is another in the series of impunity and lawlessness exhibited by the DSS. The invasion of the court by the agency of the Gederal Government of Nigeria runs contrary to the avowed assurances of the President of the Federal Republic of Nigeria that he will ensure that the Federal Government and agencies under it obeys court orders. The disrespect of the court by the DSS is legendary and unrivalled.

“Few days ago, the officers of the Nigerian Police Force exhibited similar traits when it also invaded the precincts of the High Court, Effurun to arrest Mr. Ademi-Akpeto, Chairman of Sapele branch of the NBA. Many Nigerians are still in unlawful custody and not charged to court. Nigerians are now under siege by security agents who have no regards for the law and the courts.

“The NBA urges all Nigerians to be alive to their responsibilities as citizens of the Federal Republic of Nigeria and is ready to partner with all Nigerians and civil society organisations to ensure that the rights of Nigerians as guaranteed by Chapter 4 of the Constitution of the Federal Republic of Nigeria, 1999 as amended are not trampled upon by by any agency of government. The NBA therefore, demands as follows:

1. That the Federal Government of Nigeria and the National Assembly immediately investigate the shameful conduct by the DSS and ensure that all persons found culpable are duly punished in accordance with the law.

2. The immediate suspension of the Director General of the Department of State Security from office. We make this demand bearing in mind the fact that the DSS under his leadership has established itself as a brutish and irresponsible agency that derives immense pleasure from violating the fundamental rights of Nigerians and disrespecting court orders.

3. That the National Assembly should review the laws setting up the DSS and indeed all security agencies in Nigeria with a view to repositioning them to be more responsible and responsive to the public.

4. That the Attorney General of the Federation, being the Chief Law officer of the Federation takes over all the political cases or cases involving politically exposed persons presently handled by the DSS.

“The above demands of the NBA is without prejuduce to the consultations presently going on amongst critical Stakeholders in the legal profession and the judiciary on how best to ensure that this sad incident does not re-occur.

“NBA thanks all Lawyers and Nigerians who have expressed displeasure over this sad incident. NBA shall keep lawyers and Nigerians alike informed of our further engagements with critical stakeholders.
