So how long will Goodluck continue to act constitutionally? What happens in the event Yar adua shows up but remains too feeble to discharge his functions? Whose responsibility is it to certify him fit to rule again?
Yeah, a nice question! I think it should now be the responsibility of the Saudi govt., to certify him healthy, a his going abroad to get a medical treatment has proved that we do not have qualified doctors and well equipped hospitals to treat illness as that. You see, this one thing about our stupid leaders. They fill our hospitals with quack doctors and sub-standard or out dated equipments only for them to go abroad to get treatment when death comes knocking on their doors, while they ought to have spent resources gotten to built such as well equipped hospital, good roads etc. They prefer to die in a foreign land and still spend our money to bring back their already-while-alive decaying carcass back home to contaminate the soils of our cemetries. |

Sick Nigeria President Yar'Adua 'to hand over power' President Umaru Yar'Adua has both heart and kidney problems Nigeria's ailing President Umaru Yar'Adua will write a letter handing power over to his vice-president, his adviser has told the BBC.
The letter, formally informing the Senate that Mr Yar'Adua is on "medical vacation", automatically means his deputy becomes acting president.
The president's allies have previously resisted calls for him to step aside.
He has been in a hospital in Saudi Arabia since November, prompting fears of a power vacuum and street protests.
The president is suffering from an inflammation of the lining around the heart and has long suffered from kidney problems.
Nigeria's powerful state governors have said they believe Vice-President Goodluck Jonathan should be acting president.
The BBC's Caroline Duffield in Lagos says Nigeria's political struggle over the president's fitness to rule may be nearing an endgame.
The president's special adviser on legislative affairs, Abba Aji, did not say when Mr Yar'Adua would write the letter but he said there would be no "undue delay".
For weeks, Nigeria has been beset with rumours and hoaxes over whether the president is alive or dead, our correspondent says.
His failure to transfer powers to his deputy before he left created a power vacuum - in which fear and false reports flourished, she says.
Newspapers said the president was brain dead - or struck dumb.
There were apparently official statements claiming the president was discharged from hospital. They later turned out not to be true.
Political tensions have been high - government business has stalled and legislation been frozen and cracks have appeared in the uneasy peace in the oil-producing Niger Delta.

Nigeria religious riot bodies found in village wells An exact death toll is not known but aid workers say it may be 300 More victims of deadly religious clashes in central Nigeria have been found, with scores of bodies stuffed in wells and sewage pits.
Up to 150 bodies have been found in Kuru Karama village, 30km (18 miles) from the city of Jos, where the violence erupted last Sunday.
Correspondents say elders hid in holes for seven hours to escape the violence.
An exact death toll is not known but overall up to 300 are thought to have died in the Muslim-Christian clashes.
Several thousand people fled their homes.
'Burned alive'
The BBC's Caroline Duffield in Jos says many of the bodies found in Kuru Karama had massive burns, other victims were hacked to death or shot.
JOS, PLATEAU STATE Deadly riots in 2001 and 2008 City divided into Christian and Muslim areas Divisions accentuated by system of classifying people as indigenes and settlers Hausa-speaking Muslims living in Jos for decades are still classified as settlers Settlers find it difficult to stand for election Divisions also exist along party lines: Christians mostly back the ruling PDP; Muslims generally supporting the opposition ANPP
She says there are still more bodies scattered in the bush beyond the village but the areas are not safe for volunteer workers to enter.
Umar Baza, head of Kuru Karama village, told Agence France-Presse news agency: "So far we have picked 150 bodies from the wells. But 60 more people are still missing."
The Human Rights Watch group said armed men had attacked the mostly Muslim Kuru Karama on 19 January.
"After surrounding the town, they hunted down and attacked Muslim residents, some of whom had sought refuge in homes and a local mosque, killing many as they tried to flee and burning many others alive," it said in a statement.
It quoted one villager as saying: "I came back on Wednesday evening escorted by the military. I saw dead bodies everywhere. The corpses were there, but now you can just see the blood on the ground. None of the houses are standing."
The group called on Vice-President Goodluck Jonathan to order an immediate criminal investigation into reports of the massacre.
Mr Jonathan deployed the military after four days of clashes.
He has been issuing orders while President Umaru Yar'Adua receives medical treatment in Saudi Arabia.
The security forces have now restored order and a curfew has been partially lifted.
But correspondents say the atmosphere is still tense.
Jos, the capital of Plateau state, lies at the point where Nigeria's Muslim north and predominantly Christian south meet.

Asked why he imposed Yar’Adua on Nigerians, well aware of his health problem, Obasanjo said he asked for Yar’Adua’s medical record in 2006. According to him, the ailing leader showed him medical records that showed that even though he was on dialysis as a kidney patient before, he Yar’Adua was no more on dialysis.
‘’I gave the report to medical experts who also confirmed that he was fit since he was no longer under dialysis’’. Obasanjo explained that he requested for Yar’Adua’s medic history because he was aware that the former Katsina Governor spent six months in Nigeria tendering to his kidney problem.

Nairaland / General / Nigeria Cabinet Told To Rule On Sick President Yar'adua by MrCartha: 6:22pm On Jan 22, 2010 |
Nigeria cabinet told to rule on sick President Yar'Adua President Umaru Yar'Adua has been absent from Nigeria for weeks The Nigerian cabinet has been ordered by the federal court to decide within 14 days if ill President Umaru Yar'Adua is fit to lead the country.
The president has been in Saudi Arabia for two months, receiving treatment for a heart condition.
The court ruling directed the cabinet to pass a resolution about whether he "is incapable of discharging the functions of his office".
The president's absence has raised concerns about a power vacuum.
The Federal High Court ruled that cabinet should hear testimony from five doctors, one of whom should be the president's personal physician.
If cabinet decides that the president is not fit to carry out his duties, the vice-president would take over, the court ruled.
"To say that I, Olusegun Obasanjo, deliberately picked somebody who is an invalid, is the height of insult " The court was responding to a law suit brought by opposition activist Farouk Adamu Aliyu.
He had asked for the judges to sack the president over his failing health and for failing to abide by the provisions of the constitution.
His lawyer Bamidele Aturu told the BBC that the judgement was a "victory for democracy".
On Thursday, Mr Yar'Adua's predecessor Olusegun Obasanjo urged the president to step down if he is not fit to continue.
"If you take up a job, elected, and then your health starts to fail you and you will not able to deliver, to satisfy yourself and satisfy the people you are supposed to serve, then there is a path of honour and path of morality," he said in his first comments on Mr Yar'Adua's health.
He denied that he had been irresponsible when choosing his successor, AFP news agency reports.
Sola Tayo, commentator on Nigerian issues: "There are lots of unsubstantiated rumours that his condition is a lot more serious" "To say that I, Olusegun Obasanjo, deliberately picked somebody who is an invalid, is the height of insult," he said.
Mr Obasanjo handpicked Mr Yar'Adua to succeed him but the pair have since fallen out.
'Offshore president'
On Thursday, more than 1,000 people gathered in Lagos to protest against Mr Yar'Adua's prolonged absence.
Some carried placards saying: "Enough of the offshore president and a people's constitution now."
YAR'ADUA ILLNESS TIMELINE 23 November 2009: Goes to hospital in Saudi Arabia 26 November 2009: Presidential doctors say he has pericarditis - inflammation of the heart lining 23 December 2009: First court case filed called him to step down 30 December 2009: Chief justice sworn in. Lawyers say this is illegal in president's absence 5 January 2010: Two more court cases filed and a human rights group wants president declared "missing" 12 January 2010: President gives first interview since going to Saudi Arabia
Yar'Adua's absence still rankles Profile: President Umaru Yar'Adua The protesters argue that when the president left the country to go to hospital he did not hand executive powers to his deputy, as required by the constitution.
In the wake of his absence, the president has faced various legal challenges by Nigerians concerned by their leader's absence.
Last week one ruling said Vice-President Goodluck Jonathan could perform all presidential duties while Mr Yar'Adua was away.
Two other court cases are waiting to be heard.
The situation has been complicated by the custom in Nigeria's ruling People's Democratic Party to alternate power between north and south.
Mr Yar'Adua is a northerner, while Mr Jonathan is from the south.
Some northern power-brokers are believed to be loath for him to take over, as this would shorten the north's "turn" in power.
In a BBC interview from his hospital bed last week, the president said he was recovering and hoped to return home, without giving a timeframe. This was his first interview since he left for Saudi Arabia in November 2009.
It is not clear if he will be able to return to perform his duties within the two-week deadline.
President Yar'Adua is being treated for inflammation of the lining around the heart and has a long-standing kidney complaint.
