The Court of Appeal, sitting in Owerri, Imo State capital, dismissed two separate but related appeals filed by the Peoples Democratic Party (PDP) in Abia State against the governorship candidate of the All Progressives Grand Alliance (APGA) in the April general elections, Dr. Alex Otti,and his patty. The appeals originated from a decision of the Abia State Governorship Election Petition Tribunal, sitting in Umuahia, to take all the preliminary objections, filed by the litigants, along with the judgment of the substantive petition. But dissatisfied with the tribunal’s decision, the party headed for the Court of Appeal, urging it to set aside the decision of the tribunal and compel it to deliver ruling on the pending motions. In one of the motions, the ruling-PDP urged the tribunal to strike out Otti’s petition on the grounds that it was not duly signed and that the necessary fees were not paid in compliance with the provisions of the Electoral Act 2010, as amended. The Court of Appeal, in a unanimous decision of the five-member panel of justices, struck out three out of the four issues raised by the PDP for lack of merit before dismissing the two appeals. In dismissing the appeals, the appellate court said that they were premature and predicated on the complaint against a ruling which the lower tribunal had not yet delivered. The court further stated that there was no infringement of the appellant’s right to fair hearing as the motions were rightly heard by the tribunal before ruling was adjourned to come within the 180 days stipulated by the Constitution. Addressing journalists at the end of the judgment, which lasted for about one hour, counsel to Otti and APGA, Mr Nwala Oracle, said that what the Court of Appeal did was ‘’giving effect to and affirming the sanctity of paragraph 12 (5) of the 1st Schedule to the Electoral Act.” Oracle further said that the Court of Appeal could not have gone any other way than to confirm that the trial tribunal has powers to take all preliminary motions along with the substantive petition. “As a matter of fact, paragraph 12 (5) is intended to reflect the sui generis nature of election matters”, the counsel said. “The spirit and intendment of that paragraph is to suppress the mischief of delaying the Election Petition proceeding by ensuring that preliminary objections, whether on jurisdiction or not, raised in the course of the proceedings, did not derail the determination of the merit of a case by undue and unwarranted delays occasioned by preliminary objections’. Oracle further insisted that ‘’as a matter of fact, the tribunal is under a duty to comply with the provisions of paragraph 12(5), when objections are raised against the hearing of a petition.” The Appeal Court, relying on the case of Aregbesola v Omisore, in its judgment, emphasized: “When paragraph 53(5) was in being, paragraph 12(5) came in on the 29th October, 2010 like a Trojan Horse. “Paragraph 53(5) itself came into effect on 20th August, 2010. Paragraph 12(5) was undoubtedly enacted for a purpose. That purpose was to enable election petition tribunals to handle election petitions without undue reliance on technicalities. “Although paragraph 53(5) was not repealed, the law is that the provisions of the later enactment amends the earlier so far as necessary to remove the inconsistency between them.” It will be recalled that the same Court of Appeal, on September 3, 2015, dismissed a similar suit brought to it by counsel for Gov. Okezie Ikpeazu, Chief Wole Olanipekun, SAN, against Otti on the same basis that it lacked merit and was a mere academic exercise. Otti is challenging the result of the election in five local government areas of Abia: Umuahia North, Isialangwa North, Ugwunagbo, Osisioma and Obingwa, where he alleged massive electoral fraud by PDP. He is urging the tribunal to nullify Okezie’s election and to declare him the winner of the poll. Meanwhile, proceedings at the trial tribunal had been adjourned to October 14, 2015 for the adoption of final written addresses of the parties. News about the judgment, which filtered into Umuahia, the state capital, and the commercial city of Aba, as well as Ohafia, sparked off wild jubilation among the residents, especially members and teeming supporters of the party and its governorship candidate. A cross-section of the people described the judgment of the Appeal Court as ‘’cheerful news and a positive development” for the state and its citizenry. Speaking in a telephone interview, the deputy governorship candidate of APGA, Dr. Uche Eme-Uche, expressed gratitude to God for the judgment, saying: “We pray that justice will prevail at the end of the judicial process”. Eme-Uche added: “We need God’s intervention for Abia to be liberated; so we shall not relent in our prayers.’’ She noted that the judgment of the Court of Appeal ‘’was in consonant with the provisions of the Electoral Act, so we expected the judgment in our favour.’’ The state chairman of APGA, Rev. Augustine Ehiemere, described the judgment as ‘’a path to the ultimate victory for the party and the suffering masses.” Reacting to the outcome of the judgment in a telephone interview from his Aba residence, Ehiemere said, ‘’We thank God for the judgment,” adding: “The judiciary has, by the judgment acquitted itself as the last hope of the common man.” Another chieftain of the party, Chief Inem Nwaka, dedicated the victory to the struggle for the emancipation of the people of Abia. NOT many critics of the education sector who believe that some things are definitely wrong with the sector can proffer solutions to the decadence bedeviling the sector. Dr. Adebayo Oyeyemi who lectured Mathematics in the tertiary institution for years and also an administrator of Good Shepherd Group of Schools, Lagos, is not one of them. He has pointed out some confusions and solution in the implementation of the new curriculum, lamenting that the university requirements through UTME is missing in the new curriculum. ”Nigeria is one of the countries that has the best educational policies but the problem is consistency and implementation as well as aligning what is happening at the grass-root. “The new national curriculum is very good because it aligns with global practices as it focuses on specialisation right from the onset. For example, if a child is going to become a medical doctor, right from the primary school, he should be having the tendencies that is directed in that way, then narrow it down when he gets to JSS and eventually to SS1, where he can focus on sciences.” According to him, the curriculum does not align with university requirements in Nigeria. “There are some schools that follow this new curriculum like our school and at the end of the day, cannot gain admission to the university.” He noted that the university requirements through UTME are different from what we have in the new curriculum. For instance, if a child is going to study engineering, the new curriculum tells us he does not need Biology and Chemistry. In the new curriculum, he said, we have five basic subjects that are compulsoryn then a student has to pick three subjects from his area of specializations making it eight. Thus, we have English, Maths, Trade, Civic and Computer. In the old curriculum, Computer was compulsory, in the new curriculum , Computer has been removed. “Due to your area of specialisation, you need three subjects or four and then take one elective across the four divisions. Others are Humanities, Business, Science, Mathematics and technology.” He maintained that both Business and Technology are having problems. In the new curriculum, it is not compulsory for them to do Biology, Chemistry, and Physics adding that there are other subjects that are related like Basic Electricity, Basic Electronics, Food and Nutrition , Technical Drawing and so on. He argued that if a child should follow that into-to, he will not get admission to the university because the universities still base their requirements on the old curriculum which says if a child wants to study Engineering, he should have Physics, Chemistry and Mathematics, now that is the problem. His words: “It is a serious problem as Physics and Chemistry are no more a Technology requirement. They are under Science and Mathematics for those studying Medical Sciences and General Science. So, if we should follow the new curriculum, it is perfect. That is why I said, by policy, they are excellent, but by implementation, no communication. There is a gap. “Till date, many schools do not know what to do as far as implementation is concerned. Though, we nearly fell victim when they gave us the curriculum and told us that we should simply follow the curriculum. However, the government needs to sit down and bring professionals together. “It is not just copying what happens in America, what happens abroad, but is also to customise our curriculum and when we customise it, we should communicate how to implement it to educators. “The Ministry of Education should go to the field and get feedback on what is happening on the field. What is happening on the field is different. In fact, it is like we are gambling with the lives of these children. “On the part of WAEC, they came up with Civic education, thereby mixing both the new and the old curriculum together. “For Lagos state government, it said Biology is compulsory. Everybody is now bringing ideas. You do not run a curriculum like that. You sit down and figure out what your goal is? What do you want to achieve with these children? Then, you set what will take them there. All ideas should be gathered together in a single document of the curriculum. “If the Federal Government says that technology students do not need Physics and Chemistry from the curriculum, why should somebody now rise up, and say they still need Chemistry, Biology? There should be a unique document. “Now we have to see how to manoeuvre ourselves, so that we will not fall victim, because some children did not gain admission. They removed Economics from Commercial, they put it under Humanities. Universities still require economics for Commercial students. “In some schools, it was when the UTME requirements came that they started doing Economics, and those students failed woefully. However, the new curriculum is perfect, to me, It is what I have been soliciting for. In fact, because of the old curriculum, there were some vocational things we put in our school, like IT. “I embrace the new curriculum because you do not need to bother students with what they do not need. Bring in general subject that will give them general knowledge then let them specialize. Civic education, English, Mathematics and Trade are general. UMUAHIA—AS part of measure to ensure that pregnant women, especially in the rural communities lead healthy lives during pregnancy, the wife of the President, Hajia Aisha Buhari, Tuesday, distrib- uted nutritional supplements to women in some hospitals in Umuahia. According to Mrs. Buhari, the supplements would help boost their health during pregnancy and the period of exclusive breast-feeding. Distributing the items at the Federal Medical Centre and State Diagonistic Centre, Hajia Buhari urged them to judiciously use the nutritional milk, Frisomum Gold, and to obey other tidbits of the medical personnel for adequate growth of their babies and safe delivery. Represented by the Abia State governor’s wife, Mrs. Nkechi Ikpeazu, Mrs. Buhari stressed the need for every pregnant woman and nursing mothers to enjoy quality health. Former President Goodluck Jonathan received a host of PDP Governors who paid him a solidarity visit in his country home at Otuoke, Bayelsa state. The governors who visited include: Chairman PDP Governors Forum, Olusegun Mimiko, Rivers State Governor, Nyesom Ezenwo Wike and the host Bayelsa Governor, Seriake Dickson. Four Deputy Governors represented their governors. Jonathan said despite the electoral loss, PDP is the only party with members in all polling units of the country. From Godwin Tsa, Abuja After 110 days of legal rigmarole, the All Progressives Congress (APC) and its governorship candidate for the April 11, 2015 election, Dr. Dakuku Peterside finally opened their case before the Rivers State Governorship Election Tribunal amidst protest by Governor Nyesom Wike and the Peoples Democratic Party (PDP) over the appointment of a new chairman of the Tribunal, Justice Adamu Guroma. Dakuku and his political platform, the APC yesterday called eight witnesses to prove that the April 11, 2015 governorship election in the state was not only fraught with manifest irregularities, but was also conducted with total disregard to relevant provisions of the Electoral Act. But this was not without stiff opposition mounted by the respondents, who questioned the appointment of a new Chairman of the tribunal, Justice Guroma, who replaced Justice Muazu Pindiga. Counsel to Wike, Mr. Emmanuel Ukala said they were worried by the development in view of fears and reports that the change was to favour a particular party. Ukala, who informed the tribunal of his intention to protest against the decision at the appropriate authorities asked the tribunal for an adjournment to enable him consult with his client on the next line of action to take. In his response, Chief Chris Uche (SAN), who appeared for the PDP while adopting the position of Ukala added that his client had been taken unawares as no notice was given to them regarding the change of the tribunal’s chairman. Uche said in view of the anxiety created by the development, it was only reasonable for the tribunal to allow them time to consult with their clients and take necessary steps. Counsel to INEC, Chief Onyekachi Ikpeazu [SAN] however, preferred to be neutral on the issue. But responding, lead counsel to the petition, Chief Akinlolu Olujunmi, SAN, said they had no prior knowledge of the appointment of a new chairman for the tribunal as they only got to know about it on Wednesday in court. He, however, said they could not question the decision of the President of the Court of Appeal in appointing a new chairman for the tribunal more so given the fact that time was already running against them. “What we have to digest is the important fact that time is against us in this petition and everything that needs to be done to fast track the hearing of the petition must be done. In realization of this fact, we urged the tribunal to allow us to call our witnesses.” In his bench ruling, Justice Adamu Goruma overruled the objections by Governor Wike and the PDP, saying he was posted by the President of the Court of Appeal, Justice Zainab Adamu Bulkachuwa, via a letter dated September 1, 2015, but which he received on September 2, to take charge of the tribunal, and would not go against that decision. Besides, he said the petition, which was filed since May would soon expire on or before October 29 and every effort must be put in place to hear it expeditiously, adding that any aggrieved party had the right to pursue his case at the appropriate quarters. “We did not consider it reasonably to delay the proceedings of this tribunal. We call on the petitioners to open his case.” After the ruling of the tribunal, the petitioners opened their case by calling eight witnesses, Jack Tamunosaki, John Lekova Koottee, Mactarlane Dunabo, Adiesigha Halliday, Tamunosa Bristol and Charles Nyome respectively who testified that the election was marred by violence, ballot boxes snatching and other allied malpractices. A Briton, Mr. Graham Meredith, says that teaching in Nigerian schools is a difficult task. Meredith, the Principal of Premiere Academy, Lugbe, Abuja, said this during the institution’s sixth graduation ceremony. He said, “To be a principal in Nigeria is not an easy job because the kids want to learn. When you have pupils that want to learn and improve themselves, it becomes a big challenge as you have to prepare because they are intelligent.” According to him, Nigerian educational system is also unique because of many factors, including the desire of the pupils to go for the best. He added, “The pupils want to learn and they see it as an opportunity to go to the United States, Canada, United Kingdom and Europe to further their careers. They work and study hard and have good manners. From what I have seen, Nigerian pupils also are very respectful. “If you do well, you can get admission and meet other best scholars across the world. And if you go to the best universities, you are going to meet the best people. But you have to get the entry ticket.” To boost the moral of teachers, he stated that motivation should be the primary factor to be taken into consideration. Meredith added, “Teachers at Premiere are qualified and are specialists in their own field. While some of them have the minimum degree qualification, others have master’s degrees. There was drama on Wednesday at the Delta State National Assembly Election Petition Tribunal, when a witness presumed to be dead showed up in court. Christopher Anirah was subpoenaed by the tribunal to give evidence an election petition matter between Hon. Gibson Ighofose Akporehe of the All Progressive Congress (APC) and Hon. Evelyn Omavowan Oboro of the People’s Democratic Party (PDP). Counsel to the APC candidate, Mr. Charles Umweni, had told the tribunal that the witness it intends to call, (Anirah) cannot come to the tribunal to testify because he was dead. He told the tribunal that Anirah died of cardiac attack and cannot be subpoenaed to give evidence in the ongoing case. But at the resumed hearing of the matter, a middle aged man who claimed to be Anirah stormed the tribunal and stepped into the witness box to give evidence when the chairman of the three-man panel, Justice Adebukole Banjoko called out the name. Anirah’s appearance caused a stir in the audience, prompting Justice Banjoko to call for calm. Akporehe of APC is challenging the election victory of Oboro in the National Assembly election held in the state. Joined in the suit are – the Independent National Electoral Commission (INEC), Resident Electoral Commission (REC), PDP and eight others. Anirah is Oboro’s star witness in the matter. Anirah , during a cross- examination, by respondents counsel , Mr. Onome Egbon, told the tribunal that he was the rightful candidate of APC for the Okpe, Sapele and Uvwie Federal Constituency in Delta State in the 2015 National Assembly election until his name was ‘fraudulently substituted” with that of Akporehe on account that he (Anirah) was dead. He told the tribunal that Akporehe allegedly forged a death certificate from a General Hospital that he (Anirah) died of cardiac failure and hypertension, with which he deceived INEC to remove his name from the list of contestants for the election. Most customers from neighbouring state have drastically reduced patronizing the market because of the flood. Shop owners in Ariaria market are calling on the state government to implement some temporary measures to help clear the flood. Former President Goodluck Jonathan on Thursday night paid a secret visit to President Muhammadu Buhari at the Presidential Villa, Abuja. At the meeting held inside the President’s official residence, no third person was admitted and no photograph of the night visit by Jonathan was allowed. The visit was Jonathan’s first time at the Presidential Villa since he left in the morning of May 29 for the Eagles Square, where Buhari took his oath of office and allegiance as his (Jonathan’s) successor. The Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, confirmed Jonathan’s visit and meeting with Buhari to our correspondent on Sunday. Adesina however said he was not privy to the subject of the discussion at the meeting. A top Presidency official also confided in our correspondent that the meeting was strictly between Buhari and Jonathan and that no photographs were taken. “Nobody was with them. I am sure they don’t want the visit to be an item in the media. That probably explains why the former President visited at night and went straight to the residence. They met for a few minutes in the President’s residence,” the official said. The following day, however, Buhari also played host to former President Olusegun Obasanjo. But unlike Jonathan’s visit, one of the photographers attached to the President was able to capture the two leaders. It was not clear as of press time whether the two visits were in any way connected. But The PUNCH learnt that Obasanjo, during his meeting with Buhari, told the President to ensure that all funds stolen under the Jonathan administration were recovered in order to strengthen the President’s anti-corruption image in the international community. A Presidency source, who confided in our correspondent, said that Obasanjo did not raise the issue of appointments with Buhari. “He (Obasanjo) argued that the anti- graft war will further raise the reputation of the Buhari administration at the international community. The former President also said stolen funds should be recovered,” the source said. The Buhari administration has been investigating some activities of Jonathan’s administration with government officials claiming that the past administration was characterised by impunity and large- scale corruption. Apart from probing the Nigerian National Petroleum Corporation, the present administration is also beaming its searchlight on the management of the Excess Crude Account under Jonathan. Some former aides of the ex- President, including the former National Security Adviser, Col. Sambo Dasuki (retd.); Jonathan’s Chief Security Officer, Mr. Gordon Obuah; and the former Director-General of Nigerian Maritime Administration and Safety Agency, Dr. Patrick Akpobolokemi, had either been arrested, detained or investigated. On the eve of his departure from office, Jonathan had on May 27 advised Buhari not to single out his administration for any probe. He said all those advising Buhari to probe his administration must also advise him to extend his probe beyond his regime, lest the probe be seen as a witch-hunt. Jonathan said, “Some people are even calling for the probe of this government. I agree that in Nigeria, there are a number of things that we will probe, very many things. “Even debts owed by states and this nation from 1960 up to this time, they are saying it is Jonathan’s administration that owes all the debts. “I believe that anybody calling for probe must ensure that these probes are extended beyond the Jonathan administration, otherwise to me, it will be a witch-hunt. “If you are very sincere, then it is not just the Jonathan’s administration that should be probed. A number of things have gone wrong and we have done our best to fix them. The Attorney-General is aware of massive judgments debts, if we aggregate all of them, it is about $1bn. “How did we come to this kind of huge judgment debts? These issues should be probed. “How do you allocate our oil wells, oil fields, marginal wells and others? Do we follow our laws? All these should be probed. I believe all these and many more areas should be looked into.” Jonathan’ ascendancy to the Presidency was believed to have been made possible by Obasanjo’s support but the two have since parted ways with Obasanjo constantly attacking Jonathan’s government as corrupt. The General Overseer of theRedeemed Christian Church of God, (RCCG), and Pastor Enoch Adeboye has appealed to his friends, children and supporters to support him in the completion of the 3.3km Arena of the church in Simawa, Ogun State. The arena which was earlier billed to be used for the just concluded convention is yet to be completed due to lack of enough funds.“The new arena is yet to be completed because there is no money. I believe that all the people who promised big money will show up one day. “For the first time in my life, I almost became a beggar. I have never asked for offering online. I don’t knowhow to do fine barer, it is just circumstances beyond my control,” Adeboye explained. He appealed for more support for the project stressing that God will keep multiplying the needs of his children and they will become his divine treasurer. The general overseer was optimistic that the new arena will be available for use by December, noting that “God provides for the work”.He urged Nigerians to keep hope in God alive and trust him to meet all their needs. The programme tagged All Sufficient God attractors worshippers from 188 countries featured bible teachings, business seminar, prophetic ministration, melody hour, prayer, and ordinations of new deacons, assistant pastors, full pastors and graduation ceremony of Bible school students. Vice President, Prof. Yemi Osinbanjo, has stated that the ongoing anti-corruption crusade championed by the President Muhammadu Buhari-led administration was not selective, but, an effort to reduce corruption and secure the future of Nigeria. Osinbajo stated this in an interview with newsmen at the funeral of Elizabeth Adesola Mamora, mother of Senator Olorunimbe Mamora, held at the First Baptist Church, Ijebu-Ife, Ogun State. He frowned at those accusing the Buhari administration of targeting only the former appointees of former President Goodluck Jonathan. He said, “It is not about a probe of a past government, that’s not what this is about. We are talking about our future, we are saying that we must put in place a clear strategy going forward.“It is not just about ensuring that people are made to pay for looting the treasury, our system of justice must be fair to ensure that anybody who does anything that is wrong is brought to account.“We can’t allow impunity to continue.
