THE destination was Inagbe Grand Beach Resort on one of the islands that dot the Lagos lagoon waterway heading to Badagry. The take-off point was the jetty along Queens Drive, Ikoyi where a luxury boat latched to the jetty bobbed to the rise and fall of the waves on the lagoon. Each member of the team made his or her way to the boat, collected a life jacket and gingerly stepped into the boat. The leather settee felt comfortable.The boatparaded a 1, 000 horse power twin outboard engine. The last person to come on board was a tall, young man in navy blue shirt and white chinos trousers. He had stayed back to ensure that everyone was comfortably accommodated. He boarded the vessel and glanced round to make sure everybody was comfortable and safe. Then he ordered the boat operator to launch the trip. In the course of the comfortable 15-minute cruise to the resort, some of us got to know that the person that courteously supervised the boarding was the resort’s owner, then Prince Adeyeye Ogunwusi. Today, he is the Ooni of Ife. At Inagbe Grand Beach Resort, right from the wooden walkway that extended deep onto the lagoon with the floating lounge on the water, everything about the resort was classy and special. Former Niger Delta Minister, Elder Godsday Orubebe, has denied allegations of corruption levelled against him by the Code of Conduct Tribunal, claiming that he is being framed for his unalloyed support for former President Goodluck Jonathan. Orubebe, who is being charged before the Code of Conduct Tribunal, told Vanguard in Abuja that he had not committed any offence to warrant being vilified by the present administration. The former minister also declared that he neither demanded nor collected bribe throughout his six-year tenure as a minister of the Federal Republic of Nigeria. He said he was convinced that the CCT was out to frame him given the way it had already begun his trial in the media when he had only been served with the summons to appear before the court on November 9, 2015. He said: “I was served with Code of Conduct Tribunal summons on Friday last week and the paper, which I personally signed and collected, stated that I was expected to appear before them on November 9. I was taken aback by the news that I had already been arraigned. This tells me that it is an issue of witch-hunt which is not good for this country. It is not good to take me to the public court before being tried. The issues contained in the summons are that I took N50 million bribe from one of the contractors who handled a project for the Ministry of Niger Delta and another N20 million from the same contractor as well as not declaring my plots of land in Asokoro and Kyame districts of Abuja. Chief Justice of Nigeria, Justice Mahmud Mohammed, at the weekend said the judiciary has been properly positioned to meet the challenges posed by the dynamics of digital age. The CJN spoke while playing host to some members of the Nigeria Electronic Fraud Forum, NEFF, led by Deputy Governor (Operations) of the Central Bank of Nigeria, CBN, Alhaji Suleiman Barau. The visit, according to Barau, was in anticipation of increase in electronic fraud attempts with imminent increase in electronic payments in the country following the take-off of the “Cash-less Lagos” pilot project. The CJN told the group that as a matter of principle, the judiciary gives priority to fraud or criminal cases, especially those brought on appeal to the Supreme Court and the Court of Appeal. The problem associated with adjudication of criminal cases, the CJN noted, was not mainly in the courts, but outside of it. “It is in the investigation, collection of evidence, presentation of the cases and trial. “Judiciary is like a builder, and works with materials that are brought to it. As such, the materials necessary for construction must measure up to standard in order to be applied by the courts. “Court cannot carry out investigation and our security agencies must be encouraged to carry out investigation-led arrest and not arrested-led investigation,” he said. The CJN further counselled that once suspects are charged to courts, there should not be too many counts of offences (charges) as each count charge requires a witness or more. “In some cases, up to 200 count charge are brought before the court which is a waste of court’s time and makes mockery of the constitution and the laws,” he added. The CIN said most superior courts in the country, including the Supreme Court, have enacted practice directions on serious crimes, including money laundering and fraud, which should see cases being fast tracked for trial and determination “I wish to assure the Forum that the judiciary will stand with the Banker’s Committee in providing an effective solution to electronic fraud and other ancillary issues. “Indeed, it is our hope that soon Nigeria will become a major destination for the movement of capital investment,” the CJN added On his part, the CBN deputy governor stated that; given the importance of providing secure payment systems, whilst ensuring public confidence in electronic means of payment, the role of proactive fraud management could not be overemphasised. He said it was in this context and leveraging on lessons learnt from past experience (e.g. ATM magnetic stripe card frauds) that the Nigeria e-Fraud Forum was established. Barau disclosed that Payment System industry losses have grown to over N4bn, which give credence to the fact that e-fraud has become an industry of its own. This is the view of the Rivers State chapter of the Peoples Democratic Party, PDP in reaction to the nod given to president Buhari’s choice of Amaechi as one of his Ministers despite the monumental allegations of fraud, looting of State treasury and unprecedented abuse of trust while he held sway as Governor of the State for eight wasted years, as contained in the Justice George Omereji led – Judicial Commission of inquiry and the Rivers State Government white paper which indicted Amaechi. ABUJA —The Court of Appeal sitting in Abuja, yesterday, expunged some paragraphs of the petition that led to the annulment of the April 11 governorship election that brought Governor Nyesom Wike of Rivers State to power. In a judgment it delivered, a three-man panel of Justices of the Appeal Court headed by Justice Datti Yahaya, struck out portions of the petition alleging that security agents were used to rig the election in favour of Wike and the Peoples Democratic Party, PDP. The decision of the appellate court followed an interlocutory appeal that was lodged before it by the APC and its governorship candidate in Rivers State, Dr. Dakuku Peterside. Both APC and Peterside had gone before the court to challenge the ruling of the previous chairman of the Rivers State Governorship Election Petition Tribunal panel, Justice Muazu Pindiga, which deleted paragraphs of the petition containing criminal allegations against unnamed security operatives. Justice Pindiga, who was subsequently removed from presiding over the petition by the President of the Court of Appeal, Justice Zainab Bulkachuwa, based his decision on the fact that the petitioners failed to join the said security agents and other persons it said participated in the alleged electoral fraud as parties to the suit. Among those that the APC alleged masterminded the rigging of election in Rivers State included wife of former President Goodluck Jonathan, Dame Patience. But, dissatisfied with the ruling of the lower tribunal, the petitioners took the matter before the appellate court. While upholding the decision of the tribunal yesterday, the appeal court held that paragraphs of the petition containing allegations of electoral crime against named and unnamed security agents and alleged political thugs should be expunged from the record of the tribunal. The court stressed that the petitioners ought to have joined the accused security agents and political thugs as parties to the petition. Specifically, the court directed that evidences that were led against security agents and political thugs, whether named or unnamed, in the course of hearing of the petition against Wike, where the said security agents and alleged political thugs were not joined as parties, should be struck out. The Court of Appeal further directed that all the criminal allegations contained in the petition against the said security agents and alleged political thugs be expunged as they had no opportunity to defend themselves at the tribunal. The court held that in cases where criminal allegations were made against institutions, agents and individuals, the law required that in the interest of justice, they should be joined as parties to the matter. ENUGU – Director of Radio Biafra and Leader of Indigenous People of Biafra, IPOB, Nnamdi Kanu, who was arrested at Golden Tulip Essential Hotel, Ikeja, on Saturday, has been granted bail. Although, he is yet to fulfill his bail conditions.IPOB’s lawyer, Mr. Egechukwu Obetta lamented that Nnamdi Kanu was put in the same cell with terrorists despite his life threatening health challenges.He said Kanu is selective to delicacies, adding that he (Kanu) vowed never to eat any food served by the Federal Government of Nigeria. However, midway into the chat with his lawyer, a call came in, indicating that Kanu has been granted bail in the sum of N2 million or with surety of N2 million with a civil servant of grade level 16. It’s taken nearly five months but Nigeria — Africa’s biggest economy, most populous nation and number one oil producer — may get a government this week. Final screening of 36 ministerial nominees is due to take place from Tuesday, ending a lengthy process that has earned President Muhammadu Buhari a less than flattering nickname. Buhari, dubbed “Baba Go Slow” for the time it has taken him to appoint ministers since he took office in May, will then assign the candidates portfolios once they are approved. Buhari declared before his election: “Corruption will have no place and the corrupt will not be appointed to my administration.” He has already begun a purge of the NNPC, appointing Kachikwu and ordering an audit of the group’s opaque accounting practices to identify and recover stolen funds. At the same time, former oil minister Diezani Alison-Madueke was arrested in London as part of a British investigation into international corruption. Her arrest — and the sealing of her house in Abuja by Economic and Financial Crimes Commission agents — has left few in doubt at Buhari’s seriousness in tackling graft. But his nomination of Amaechi, his presidential campaign manager, could muddy the waters as he is subject to a probe ordered by the Peoples Democratic Party in Rivers. Amaechi switched sides from the PDP to the APC in 2013 and the elections in March, which the APC lost in Rivers, were marred by violence, bad blood and claims of electoral fraud. Malte Liewerscheidt, senior Africa analyst at political consultants Verisk Maplecroft, said the claims against Amaechi could dent Buhari’s image as a “Mr Clean”. “Buhari’s open support of Amaechi, who is enveloped in corruption allegations, will furnish the opposition with opportunities to undermine Buhari’s trademark anti-graft image,” he said. Since the first names were submitted to parliament on September 30, speculation has been rife about which post goes where. But some appointments look clearer than others. Ibe Kachikwu, the new head of the Nigerian National Petroleum Corporation (NNPC), is a virtual certainty to serve as junior oil minister, after Buhari said he will personally oversee the ministry himself. Former army chief Abdulrahman Dambazau is in line for the defence portfolio, which has been dominated for the last six years by the Boko Haram insurgency in the northeast. Former Ekiti state governor Kayode Fayemi has been tipped for foreign affairs. Since he was sworn in on May 29, Buhari has been running Nigeria with permanent secretaries (senior civil servants), laying himself open to charges of autocracy. But the 72-year-old, who headed a military government in the 1980s, has blamed the late reception of handover notes from the previous administration for the time taken to make his nominations. Political commentator Chris Ngwodo suggested that as well as the “political back- and-forth” about potential nominees, he has also been looking at revamping failing government structures. “He wanted to finish all that. He wanted to be able to conduct a proper audit of the federal bureaucracy before getting ministers,” he told AFP. As for the candidates, Buhari — elected on a promise of “change” — is constitutionally bound to nominate candidates from each of Nigeria’s 36 states. “‘The List’ has much to commend and cause for thought too,” said Max Siollun, a historian and author of “Oil, politics and violence: Nigeria’s military coup culture (1966-1976)”. “It is a pragmatic list that combines technocratic talent with the need for careful ethno-regional balancing. “Buhari could not appoint an entire cabinet 100 percent composed of trailblazing reformers. “He had to take vested interests into account and include ministers who may not be his personal first choices but who are allied to the politicians that helped him to get elected.” The technocrats include Kachikwu, a former ExxonMobil executive, and Ogun state finance commissioner Kemi Adeosun, a former investment banker and accountant, who has been tipped for finance minister. Both reflect Buhari’s priorities to overhaul the notoriously-corrupt oil sector and boost the economy, which has been battered by the fall in global oil prices since last year. Figures such as the former Lagos State governor Babatunde Fashola and Rotimi Amaechi, his counterpart in oil-rich Rivers State, were his “political IOU”, said Ngwodo. “It’s generally a good balance… personally I think it’s a decent list for both considerations,” he added. “He’s covered the right bases. A lot of it has shown his own individual mindedness. ABAKALIKI-THE faction of the Movement for the Actualization of the Sovereign State of Biafra, MASSOB weekend called on the Federal government to immediately release the Radio Biafra Director, Nnamdi Kanu who was arrested by the Department of State Security, DSS in Lagos state. In a statement issued in Abakaliki, the National Director of Information, MASSOB, Comrade Uchenna Madu threatened that any refusal by the federal government to ensure the release of Kanu would lead to a world wide demonstration, protest which would endanger the already battered image of Nigeria before the international communities. The statement read in part: “MASSOB Faction condemned the cowardly arrest and detention of Radio Biafra Director but also accept the fact that it is part of non violence struggle; no agitation is complete without arrest, detention & prosecution. “It shape the minds of the activist, drawing sympathy from the internal and external observers. It also shows that Nnamdi Kanu and Radio Biafra have become a factor of reckoning in Nigeria. “The arrest & detention of Nnamdi Kanu by DSS will assist immensely in reviving the consciousness & sympathy for Biafra actualization in higher dimension which was temporary halted by Ralph Uwazuruike’s deviation & lust of wealth. “This singular arrest will cause more diplomatic harm on Nigeria’s image than good. Awka— THE National Assembly elections petitions tribunal sitting in Awka, yesterday, affirmed the declaration of Mrs. Stella Oduah by the Independent National Electoral Commission, INEC, as the duly elected senator for Anambra North senatorial zone. Oduah was dragged to the tribunal by the candidate of All Progressives Grand Alliance, APGA, Chief Dubem Obaze, who alleged that there were irregularities during the March 28, 2015 polls. According to the petitioner, there was falsification of figures during the polls. He argued further that if the actual votes were properly counted, he ought to be declared the winner of the zone. Also declared duly elected were Chief Chukwuma Onyema and Mrs. Eucharia Azodo for Ogbaru and Aguata federal constituencies. Senate President, Dr. Bukola Saraki, on Sunday, responded to a statement said to have been issued by the National Leader of his party, the ruling All Progressives Congress (APC), Asiwaju Bola Tinubu, where he (Tinubu), while reacting to a recent media report by a national daily (not Vanguard), accused Saraki of crass disloyalty to party discipline, giving the manner he captured his current seat as Senate President. But in a swift reaction, Saraki who took to his Facebook page, said he had seen the statement said to be issued by Senator Tinubu over the published story, but have decided not to join issues with him. Recall that on Saturday, the national daily had in its publication alleged that the former Lagos State governor, is reportedly angered that the ministerial candidates he sent to President Muhammadu Buhari didn’t scale through. The daily reported that Tinubu who was visibly angry is said to have conspired with Senator Bukola Saraki to thwart the President Buhari-led administration, adding that for this reason, the President had ordered the security agencies to place Tinubu under security surveillance. While reacting on Sunday, in a statement signed by his chief of staff and special media adviser, Sunday Dare, Tinubu, lambasted the daily, saying it took a sad excursion from journalism into the realm of gothic tales and political slander. Among other things, Tinubu affirmed that he “remains glued to the party decision that the manner by which Saraki captured his current seat travestied party discipline. It was a crass act of disloyalty showing that Saraki may have joined the APC on paper but has remained true to the malpractices and wrong aims of the reactionary PDP in his soul.” Read Tinubu’s full statement here SARAKI’S REACTION Reacting however, Saraki said: “I saw the statement said to be issued by Senator Bola Ahmed Tinubu over a story published by a national daily. I recognise Tinubu as one of the leaders of the APC who contributed so much to the victory of the party in the last election. Some other people also contributed and I believe the collective efforts made it possible for the first time in the history of our party for an opposition party to win the general elections. “Let me state clearly that I remain a committed member of the APC and will do all in my power to ensure the party fulfill its promises to bring positive changes into the country. Since my election as Senate President, my focus and efforts have been devoted to doing the job that I was elected to do by my constituents and my colleagues in the Senate. Twice, my colleagues have confirmed their support for me as the primus inter pares in the Senate. “As I said in my speech when we resumed from our recess late September and in Ikenne yesterday (Saturday) the screening of ministerial nominees will be handled by me and my colleagues with all sense of responsibility and in adherence to the provision of the constitution. “We will be fair to all and be guided by the interest of Nigeria. The screening will be devoid of sentiment and it is not an opportunity for anybody to settle scores. We are equally eager for us to make a positive difference in our polity and Nigerians will be able to judge us whether we acted in their best interest or not,” added the Senate President.
