Federal government officials are now kicking themselves over the phantom ceasefire deal with Boko Haram brokered by Idriss Déby, the president of Chad. A source in the know of the negotiations told TheCable that the federal government is still uncertain if the dummy was deliberately sold to Nigeria by Déby or if the Chadian president himself was hoodwinked into believing it was genuine. But the word in government circles is that Déby was working for Boko Haram as he has refused to communicate with Nigeria since the insurgents renewed their attacks. “Nigerian government officials no longer have access to Déby who is now said to be sick. It appears he set us up to drop our guard and allow Boko Haram to gain ground,” the official said. A man claiming to be the general secretary of Boko Haram, named Danladi Ahmadu, had told the Voice of America on October 17 that the government was negotiating with representatives of the group. Alex Badeh, an air chief marshal and chief of defence staff, later addressed the media asking Nigerians soldiers to ceasefire because of the “agreement”, which he said included releasing the 219 Chibok schoolgirls in Boko Haram captivity. TheCable also reported how Déby put the deal together, revealing how he said Boko Haram got in touch with him, how he authenticated the message and how he got the Nigerian government involved in the negotiations. But a journalist with links to the group had described the claim as “shadows and bubbles” and warned Nigerians not to believe it. Not long after that, Boko Haram became more ferocious in their attacks, taking over more Nigerian towns, including the country home of Badeh. A government official who spoke with TheCable on Saturday pointed accusing fingers at Déby, accusing him of setting a trap for Nigeria. “The period of the phantom negotiations gave the terror group time to regroup, reinforce and restrategise, which is the intent of Déby for asking the Nigerian government to negotiate a ceasefire with Boko Haram,” the source said. “As soon as Nigeria began to make a lot of gains in the war against Boko Haram, owing to the efforts of the military and President Goodluck Jonathan who has been discussing with regional leaders to halt the insurgency, and at a time the commanders of the sect were being rounded up, that was when the Chadian president approached the Nigerian government asking that it mediates between the parties in the conflict. “The discussions between the government and the Chadian president on Boko Haram started in September. However, Déby said he was already talking with Boko Haram. “The government was trying to verify the authenticity of Boko Haram’s representatives in the supposed negotiations, but Déby asked the Nigerian government to take a chance that he had done the verification already. He affirmed that Boko Haram’s representatives were truly standing in for the group in the negotiations.” It was at this stage the government nominated the principal secretary to the president, Awwal Tukur, to be part of the negotiations in N’Djamena, the capital of Chad. “Tukur was the one spearheading the dialogue with Boko Haram on behalf of the Nigerian government. He had the first contact with group. It was still in the middle of the supposed negotiations that Danladi Ahmadu announced on Voice of America that the group had ceased fire. Following the announcement of ceasefire by the group, the Nigerian government equally announced a ceasefire on October 17 for the supposed negotiations to continue. “A Nigerian delegation left for Chad on October 21 for talks with Boko Haram, but the Chadian president became evasive. The Nigerian delegation was told that Déby was sick and that the meeting be rescheduled for October 23. “However, on that date, the delegation was told that the Chadian president was still sick after waiting for six hours. The delegation made visits to Chad a number of times, but met a brickwall. “As Boko Haram’s resumed attacks grew in intensity, the Nigerian government became worried. Many attempts were made to inquire from the Chadian president who was supposed to be mediating between the Nigerian government and Boko Haram, but the attempts were all futile. “France was privy to the botched negotiations, but said nothing just like the Chadian government. “It became clear to the Nigerian government that Déby was working for Boko Haram. The government of Chad has not said a word to the Nigerian government since Boko Haram’s resumed onslaughts. It has simply refused to make any comment or communicate with the Nigerian government. “The Nigerian government has also ceased to speak with the Chadian government on the matter since it is now clear that Chad is working with Boko Haram.” The official said the Nigerian military will now resort to use of force against Boko Haram. “The only option left for the Nigerian government is to continue to use force to end the crisis. As it is now, there is no negotiation or mediation going on. The statements by some government officials that the abducted Chibok girls would return soon were based on assurances by the Chadian government, but now there is no negotiation going on anywhere,” he said. “It is important to add that the Nigerian government decided to honour Chad’s request for negotiations with Boko Haram, because it was the first time a foreign government would be mediating in the protracted insurgency in the country. Other individuals have tried, but the government has always spurned them.” Abubakar Shekau, the leader of the sect, released a video denouncing the ceasefire deal, saying he had already married off the kidnapped schoolgirls. Of the Nigerian constitution which deal with the Composition OfNational Assembly sections 47 -50 of the Constitution Of The Federal Republic Of Nigeria states as follows There shall be a National Assembly for the Federation which shall consist of a Senate and a House of Representatives. 48. The Senate shall consist of three Senators from each State and one from the Federal Capital Territory, Abuja. 49. Subject to the provisions of this Constitution, the House of Representatives shall consist of three hundred and sixty members representing constituencies of nearly equal population as far as possible, provided that no constituency shall fall within more than one State. 50. (1) There shall be:- (a) a President and a Deputy President of the Senate, who shall be elected by the members of that House from among themselves ; and (b) a Speaker and a Deputy Speaker of the House of Representatives, who shall be elected by the members of that House from among themselves. (2) The President or Deputy President of the Senate or the Speaker or Deputy Speaker of the House of Representatives shall vacate his office - (a) if he ceases to be a member of the Senate or of the House of Representatives, as the case may be, otherwise than by reason of a dissolution of the Senate or the House of Representatives; or (b) when the House of which he was a member first sits after any dissolution of that House; or (c) if he is removed from office by a resolution of the Senate or of the House of Representatives, as the case may be, by the votes of not less than two-thirds majority of the members of that House. However, that is just one side of the issue, Section 68(1)(g) of the constitution, also provides that a member of the Senate or House of Representatives shall vacate his seat in the House of which he is a member if “being a person whose election to the House was sponsored by a political party, becomes a member of another political party before the expiration of the period for which that House was elected or provided that his membership of the latter political party is not as a result of division in the political, party of which he was previously a member or of a merger of two or more political parties or factor by one of which he was previously sponsored.” You don't need an Oxford dictionary to understand these provision , Constitutionally Tambuwal and his cohorts on both divide ceased to be members of the house of representatives the day the announced their defection! I have these few questions for those insisting that Tambuwal should not loose his position 1. Where in the world does a minority party in the legislature produce the leader of parliament ? 2. Will APC as a party ever allow a PDP minority to preside over a house in which they are the majority? 3.Is it morally right to interpret a part of the constitution that suits you and pour ink over the part that does not ? 4. Can a member who is legally no longer a part of a legislature continue to parade himself as its leader? Nigerians know the truth, the constitution is explicit, members who defected, from the APC to the PDP are as guilty as Tambuwal As things stand today the PDP with a clear majority (189 to 159 of the APC) in the Nigerian House of representative should produce the speaker of the house, anything to the contrary will not only set a dangerous precedence but will also create a fertile platform for anarchy and instability. NASS transmits amended constitution to state Assemblies THE National Assembly, on Tuesday, formally transmitted the amended sessions of the 1999 Constitution to speakers of the 36 state houses of Assembly. Senate President, David Mark, who made the formal presentation at a brief ceremony held at the conference centre of the new Senate building, said the National Assembly had passed the ball to the court of the state lawmakers. The state assemblies, according to him, should do their job expeditiously and with interest of Nigeria at heart. Mark, who was joined by the Speaker, House of Representatives, Aminu Tambuwal; Deputy Senate President, Ike Ekweremadu; Deputy Speaker, Emeka Ihedioha and the Senate Leader, Victor Ndoma-Egba, as well as senators and members of the House of Representatives, asked the state assemblies to do their job, in line with what is best for Nigerian democracy. Mark stated that the National Assembly had no predetermined position on the amendments, adding that what was decided upon was the views of Nigerians. “The essence of the alteration is to get the views of all Nigerians...We are now being criticised on our move to give autonomy to local governments, yet this was an idea canvassed by Nigerians. We are more concerned about the need to bring governance closer to the people,” he said. In his welcome remarks, Ekweremadu, who is also the chairman of the Senate Committee on Constitution Review, stressed that all the amendments were reflections of the views of Nigerians. “The bill we transmit to you today is an aggregation of the will of the Nigerian people. The legislature has long recognised that to secure the future of Nigeria in political, social and economic terms, it must invariably review our constitution to meet the aspirations and needs of our diverse people and to facilitate national development in an equitable manner. “The amendments set out institutional and legal reforms, which, together with sufficient political will, may help to provide for constitutional and other legal guarantees for the practice of true federalism; provide for accountability and transparency in governance and create an independent judicial system that would ensure the proper administration of justice in Nigeria.” Honourable Tambuwal reminded the speakers of the need to ensure the financial autonomy of the assemblies, adding that in the last amendment, the state assemblies rejected the offer. Deputy Speaker of the House of Representatives, Honourable Ihedioha, also said the House held people-oriented sessions at the 360 constituencies, adding that the view of Nigerians dictated the report submitted to it. While receiving the document, chairman, Conference of Speakers of the 36 state assemblies, Honourable Samuel Ikom, speaker of Akwa Ibom State House of Assembly, said the assemblies were ready to defend their autonomy this time. “The event of today is one we consider very important for the progress of the country. We appreciate the National Assembly for involving the people by going to their constituencies to seek their input. “We assure you that we will play our role to give to Nigeria, a constitution that will reflect the will of the people. On the rejection of financial autonomy proposed to us in the Sixth National Assembly, let us put the past in the past. The Speaker of the House of Representatives, Aminu Tambuwal, has attended a meeting of the All Progressives Congress, APC, in his home state of Sokoto, sources at the meeting have told PREMIUM TIMES. Associates of the speaker said his presence at the meeting, Monday, may herald his official defection from the ruling Peoples Democratic Party, PDP. Mr. Tambuwal’s defection has long been expected. While he has remained officially a PDP speaker, Mr. Tambuwal is believed to have long fallen out with the party. He has been absent from key party functions for a while. One source at Monday’s meeting said Mr. Tambuwal told the gathering to accept him as “one of you starting from today”. The Sokoto meeting was for APC officials to choose a consensus candidate for the state’s gubernatorial election. Another source at the National Assembly also confirmed Mr. Tambuwal’s presence at the meeting. The American government has given insight into why the Nigerian military is facing difficulty procuring arms from the United States to combat the extremist Boko Haram sect wreaking havoc in Nigeria’s North East region. Nigerian government officials had on September 17 told PREMIUM TIMES that the administration opted for the controversial discreet purchase of arms in South Africa as a desperate measure after the American government allegedly blocked all legitimate arms order made by the military. Since then, the matter has been extensively reported in the Nigerian media, with some Nigerians accusing the Americans of undermining the country’s war against terrorism. But in what is the American government’s most elaborate response to the controversy so far, the American Ambassador to Nigeria, James Entwistle, said cases of human rights abuses by Nigerian troops in the North-East in the past years have stood out as a sore thumb as the United States considers the Nigerian military’s request for arms. Mr. Entwistle spoke in Yola, the Adamawa state capital, while answering questions from journalists during a working visit to the American University of Nigeria, AUN. “Before we share equipment with any country, whether it is a government to government grant or a commercial sale that requires government approval, we look at a couple of things,” the ambassador explained. “Does it make sense in terms of that country’s needs? The second thing we look at is the human rights situation in that country. And as we look at equipment transfers, we look at the situation in those countries in the past few years. And as you all know, there have been instances (I’m not saying across the board) of human rights abuses by the Nigerian military in the North-East. “So the kind of question that we have to ask is let’s say we give certain kinds of equipment to Nigerian military that is then used in a way that affects human situation. If I approve that, I’m responsible for that. We take that responsibility very seriously.” Mr. Entwistle however described as inaccurate claims that the U.S. had completely cut military aid for Nigeria, saying on the contrary, the two countries had continued to share training and equipment. “Some of the newest vessels in your navy came from the United States. So the idea that the United States does not share equipment with Nigeria across the board is untrue,” he said. The ambassador promised that the United States would continue to partner and support Nigeria in the war against the Boko Haram insurgency, saying he gave President Goodluck Jonathan that assurance on his arrival to the country a few months ago. “I had the honour of sitting down and talking to him (President Jonathan). And the first thing I said to him is ‘Mr. President, I want to be very clear, the United States stands with Nigeria on the war on terror’,” he said. Mr. Entwistle however admonished Nigeria not to think that the war against Boko Haram could be won only by buying hi-tech equipment, saying to achieve result in the campaign, the country must take the welfare of its troops even more seriously. “I would say as we support the military in the struggle against Boko Haram, obviously equipment is part of the equation but I think it’s more than that,” the ambassador said. “It bothers me when I talk to soldiers in the North-East and they say they are in the frontline with only a few bullets. “I think what’s more important is the basic needs of soldiers on the field, making sure … they are well trained and they have ammunition for their rifles. If you don’t focus on taking care of welfare of soldiers on the ground, buying hi-tech equipment does not solve anything.” Before speaking to journalists, the ambassador had addressed staff and students of the American University of Nigeria at an elaborate reception ceremony marked by flag procession and speeches. As the initial shock over Google’s removal of popular news and entertainment site, Linda Ikeji blog, begins to wane, one of those instrumental to the shutdown of the site said Ms. Ikeji ignored his repeated complaints over copyright infringement and plagiarism. Mukhtar Dan’Iyan, the Editor-in-Chief of US-based The 15 Past Eight Media Group, said he merely spoke up after the blog used his tweets about developments in the war against the Boko Haram insurgency without his permission. “I spoke up about the unauthorised use of my intellectual property that was taken from my TL (time line),” Mr. Dan’Iyan, who tweets via @MrAyeDee, told PREMIUM TIMES in an interview, Wednesday. “(I) filed a formal DMCA complaint to Google which hosted her site. “One complaint is not enough. But safe to assume when Google looked through other examples of unauthorised IP usage and other IP owners filing complaints, it all added up. “I emailed her (Linda Ikeji) repeatedly. And it was not the first time people had plagiarised my content, but usually, I reach out and they take it down,” Mr. Dan’Iyan added. A Digital Copyright Millenium Act, DMCA, is an avenue to report content that you would like removed from Google’s services under applicable laws. According to Mr. Dan’Iyan, Ms. Ikeji had used over 10,000 copyrighted pictures and stories over the past five years without the authorisation of the copyright owners. Google took down the blog on Wednesday following multiple allegations of copyright infringement. Ms. Ikeji did not respond to our enquiries Wednesday. Mr. Dan’Iyan’s accusations and subsequent threats of organising a class action against the popular blogger drew the ire of the numerous fans who accused him of envy and hate. In her response on Tuesday to the accusations, Ms. Ikeji dismissed the plagiarism allegations and accused Mr. Dan’Iyan of using another name, Emmanuel Efremov, to stalk her, as well as register almost ten of her domain names. But Mr. Dan’Iyan said Mr. Efremov is one of the directors in his company. “15Past8.com has owners like any other company. He’s one of them,” Mr. Dan’Iyan said. “Emmanuel (Efremov) has never tried to sell anything to Linda, nor has he ever demanded any sort of money from her. In fact, I doubt he’s ever had any interaction with here even in passing.” Efforts to reach Google on Wednesday were not successful.
