Justice Taiwo Taiwo of the Abuja Division of the Federal High Court yesterday ordered their removal from office on account of their defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

Taiwo, in his judgement, held that the affected federal and state legislators could not continue to occupy office having dumped the party that brought them into office

thanks for bring this up.what was the ruling of the appeal court sir because they made an appeal against the injunction and continued as law makers.Please I will like ur reply on this.
Then secondly to even go by ur line of argument.it was a court that made such an injunction that those law makers in cross rivers should vacate their seat not any speaker or any Mr governor , why are u guys now supporting the speaker declaring a seat vacant and not allow court to do it work.U can see we are just using constitution when it favours us and doing otherwise if it does not.
Na why I no too dey blame our leaders when citizens are accusing them because they were selected from amongst us.

This section was exactly what was used in the case in Cross Rivers

In arguing its case, PDP’s lawyer, Emmanuel Ukala, a Senior Advocate of Nigeria (SAN), sought the court’s interpretation of the provisions of Section 109(1)(g) of the constitution, which prohibits a lawmaker from defecting to another political party without justifiable reasons.

This was used to sack them and fresh election was done

I can't remember the last time court declare anyone seat vacant because they cross carpet.We saw plenty legislators of the last national assembly crosscarpeting and noting happened before the 2023 election.U know this.
